और, BीलंकामालेCर व यजीव अभयारDय म8 मु[यतः दिणी उ]णकटबंधीय शु]क पणपाती िविवध कार 5 ए / सी 3 जैसा पीटरोकरपस संटालीनस, अनोगेइसस 'पा., कारी'सा कारानदस जीजयफस ए^सलोफाइसेस, डोडोनाइया बीसकोसा, मैटनस इमरगीनाटा, िडयोफाइरोस कालोरोए^सलोन, हाडिवकया बीनाटा, टारेना एिशयाटका और िडयोफाइरोस फेररया इस तरह क च2िपयन और सेठ वगFकरण म8 जाितयां पाई जाती है।

वािहत होकर पेQार नदी से जोड़ती है और अभयारDय म8 ऐितहािसक समय के दौरान बने अनेक सदानीर जल bोत और मानव िन9मत ट2क भी है । और, BीलंकामालेCर व यजीव अभयारDय के चार" ओर के े. को, िजसका िव'तार और सीमाएं इस अिधसूचना के पैरा 1 म8 िविन>द: ह2, पयावरण क दृि: से पारिथितक पारिथितक पारिथितक पारिथितक संवेदी संवेदी संवेदी संवेदी जोन जोन जोन जोन के प म8 सुरित और संरित करना तथा उ! पार पार पार पारिथितक िथितक िथितक िथितक संवेदी संवेदी संवेदी संवेदी जोन जोन जोन जोन म8 उdोग" या उdोग" के वगT के चालन तथा सं'करण करने को ितिष= करना आव5यक है; अतः, अब, के ीय सरकार, पयावरण (संरण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पठत पयावरण (संरण) अिधिनयम, 1986 (1986 का 29) क धारा 3 क उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उप धारा (3) ारा द शि!य" का योग करते %ए, आंM देश राNय म8 BीलंकामालेCर व यजीव अभयारDय क सीमा से 1 +कलोमीटर तक के िव' तारत े. को BीलंकामालेCर व यजीव अभयारDय पारि' थितकय संवेदी जोन (िजसे इसम8 इसके प5 चात् पारि' थितक संवेदी जोन कहा गया है) के प म8 अिधसूिचत करती है, िजसका िववरण िनानुसार है, अथात् :--

2. पारिथितक पारिथितक पारिथितक पारिथितक संवेदी संवेदी संवेदी संवेदी जोन जोन जोन जोन केकेकेके िलए िलए िलए िलए आंचिलक आंचिलक आंचिलक आंचिलक महायोजना महायोजना महायोजना महायोजना – (1) राNय सरकार, पारि' थितक संवेदी जोन के योजन" के िलए राजप. म8 इस अिधसूचना के अंितम काशन क तारीख से दो वष क अविध के भीतर, 'थानीय 7ि!य" के परामश से, और इस अिधसूचना म8 +दए गए अनुबंध" का पालन करते %ए आंचिलक महायोजना तैयार करेगी । (2) आचंिलक महायोजना का अनुमोदन राNय सरकार म8 सम ािधकारी ारा +कया जाएगा | (3) पारि'थितकय संवेदी जोन के िलए आंचिलक महायोजना राNय सरकार ारा ऐसी रीित जैसा इस अिधसूचना म8 िविन>द: है और सुसंगत के ीय और राNय िविधय" तथा के ीय सरकार ारा जारी मागदशक िस=ांत", य+द कोई हो, के अनु प भी तैयार क जाएगी | (4) आंचिलक महायोजना सभी संब= राNय िव भाग" के साथ परामश से पयावरणीय और पारि'थितकय िवचारण" को उसम8 एककृत करने के िलए तैयार क जाएगी, अथात्:--
   (i) पयावरण ; (ii) वन ;
   (iii) नगर िवकास ; (iv) पयटन ;

(v) नगरपािलक ; (vi) राज' व ;
(vii) कृिष ;
(viii) राN य दूषण िनयं.ण बोड, (ix) hसचाई; और (x) लोक िनमाण िवभाग

(5) आंचिलक महायोजना अनुमो+दत िवdमान भू-उपयोग, अवसंरचनाY मक और +iयाकलाप" पर कोई िनबjधन अिधरोिपत नहW करेगी जब तक +क इस अिधसूचना म8 इस कार िविन>द: न हो और आंचिलक महायोजना सभी अवसंरचना और कायकलाप" म8 दता और पार ि' थ ितकय अनुकूलता का संव=न करेगी
(6) आंचिलक महायोजना म8 अनाkछा+दत े." के जीणT=ार, िवdमान जल िनकाय" के संरण, आवाह े." के बंधन, जल-संभर" के बंधन, भूतल जल के बंधन, मृदा और नमी संरण, 'थानीय समुदाय" क आव5यकताL तथा पारि'थितक और पयावरण से संबंिधत ऐसे अ य पहलूL, िजन पर mयान देना आव5यक है, के िलए उपबंध ह"गे । (7) आंचिलक महायोजना सभी िवdमान पूजा ' थल", _ाम" और नगरीय बंदोब'त", वन" के कार और +क' म", कृिष े.", ऊपजाऊ भूिम, हरत े. जैसे उdान और उसी कार के ' थान, उdान कृिष े., आ>कड", झील" और अ य जल िनकाय" का अoयकंन करेगी । (8) आंचिलक महायोजना पारि'थितक संवेदी जोन म8 िवकास को िविनयिमत करेगी िजससे +क 'थानीय समुदाय" के पारि'थितकज य िवकास और जीिवका को सुिनिpत +कया जा सके । 3. राय राय राय राय सरकार सरकार सरकार सरकार ारा ारा ारा ारा कए कए कए कए जाने जाने जाने जाने वाले वाले वाले वाले उपाय उपाय उपाय उपाय-------- राNय सरकार इस अिधसूचना के उपबंध" को भावी करने के िलए िनिलिखत उपाय करेगी, अथात् :- (1) भूभूभूभू-उपयोग उपयोग उपयोग उपयोग - पारि' थितक संवेदी जोन म8 वन", उdान-कृिष े.", कृिष े.", आमोद-मोद के योजन के िलए िचि हत +कए गए पाकq और खुले 'थान" का वािणिNयक और औdोिगक संब= िवकास +iयाकलाप" के िलए उपयोग या संपरवतन नहW होगा :
परंतु पारि'थितक संवेदी जोन के भीतर कृिष भूिम का संपरवतन मानीटरी सिमित क िसफारश पर और राNय सरकार के पूव अनुमोदन से, 'थानीय िनवािसय" क आवासीय ज रत" को पूरा करने के िलए और पैरा 4 क सारणी के 'तंभ (2) के अधीन मद सं. 21, 26, 31, और 34 के सामने सूचीब= +iयाकलाप" को पूरा करने के िलए अनुUात ह"गे, अथात् :-
(i) िवdमान सड़क" को चौड़ा और सुदृढ़ करना और नई सड़क" का सिQमाण; (ii) दूषण उYपQ न करने वाले लघु उdोग; (iii) वषा जल संचय; और (iv) कुटीर उdोग, िजसके अंतगत _ामीण द'तकार ह2 |

परंतु यह और +क राNय सरकार के पूव अनुमोदन और संिव धान के अनुk छेद 244 तथा तYसमय वृ िविध के उपबंध" के अनुपालन के िबना, िजसके अंतगत अनुसूिचत जनजाित और अ य परंपरागत वन िनवासी (वन अिधकार" क मा यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणिNयक या उdोग िवकास +iयाकलाप" के िलए जनजातीय भूिम का उपयोग अनुUात नहW होगा :

परंतु यह और भी +क पारि' थितक संवेदी जोन के भीतर भू-अिभलेख" म8 उपसंजात कोई .ुट मानीटरी सिमित के िवचार ा4 करने के पpात् राNय सरकार ारा Yयेक मामले म8 एक बार संशोिधत होगी और उ! .ुट के संशोधन क भारत सरकार के पयावरण, वन और जलवायु परवतन मं.ालय को सूचना देनी होगी ।
परंतु यह और भी +क उपयु! .ुट का संशोधन म8 इस उप पैरा के अधीन यथा उपबंिधत के िसवाय +कसी भी दशा म8 भू- उपयोग का परवतन सिfमिलत नहW होगा ।
परंतु यह और भी +क िजससे हरत े. म8 जैसे वन े., कृिष े. आ+द म8 कोई पारणािमक कटौती नहW होगी और अनयु^ त या अनुYपादक कृिष े." म8 पुन: वनीकरण करने के यास +कए जाएंगे ।

(ख) पयटन महायोजना, पयटन िवभाग ारा वन और पयावरण िवभाग, आMं देश सरकार के परामश से तैयार होगी।
(ग) पयटन संबंधी +iयाकलाप िनf निलिखत के अधीन िविनयिमत ह"गे, अथात् :- (i) पारि'थितक संवेदी जोन के भीतर सभी नए पयटन +iयाकलाप" या िवdमान पयटन +iयाकलाप" का िव'तार रा] tीय u याv संरण ािधकरण, पयावरण, वन और जलवायु परवतन मं.ालय ारा जारी (समय-समय पर यथा संशोिधत) मागिनदेश" के अनुसार होगा िजसम8 पारि'थितक पयटन, पारि'थितक िशा और पारि'थितक िवकास को महYव +दया जाएगा ; (ii) आंचिलक महायोजना का अनुमोदन +कए जाने तक, पयटन के िलए िवकास और िवdमान पयटन +iयाकलाप" के िव'तार को वा'तिवक 'थल िविन>द: संवीा तथा मानीटरी सिमित क िसफारश पर आधारत संबंिधत िविनयामक ािधकारय" ारा अनुUात +कया होगा । (4) नैस गक नैस गक नैस गक नैस गक िवरासत िवरासत िवरासत िवरासत -------- पारि'थितक संवेदी जोन म8 महYवपूण नैस9गक िवरासत के सभी 'थल" जैसे सभी जीन कोश आरित े., शैल िवरचनाएं, जल पात", झरन", घाटी मागq, उपवन", गुफाएं, 'थल", wमण, अCरोहण, पातो आ+द क पहचान क जाएगी और उ ह8 संरित +कया जाएगा तथा उनक सुरा और संरा के िलए इस अिधसूचना के काशन क तारीख से छह मास के भीतर, उपयु! योजना बनाएगी और ऐसी योजना जोनल मा'टर xलान का भाग होगा । (5) मानव िन मत िवरासत  थ मानव िन मत िवरासत  थ मानव िन मत िवरासत  थ मानव िन मत िवरासत  थल ल ल ल - पारि' थितक संवेदी जोन म8 भवन", संरचनाL, िशAप-तyय, ऐितहािसक, कलाYमक और सां'कृितक महYव के े." क पहचान करनी होगी और इस अिधसूचना के काशन क तारीख से छह माह के भीतर उनके संरण क योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना म8 सिfमिलत क जाएगी ।

(9) ठोस ठोस ठोस ठोस अपिश) अपिश) अपिश) अपिश) -------- ठोस अपिश:" का िनपटान िनिलिखत प म8 होगा - (i) पारि'थितक संवेदी जोन म8 ठोस अपिश:" का िनपटान भारत सरकार के तYकालीन पयावरण और वन मं.ालय क समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 908(अ), तारीख 25 िसतंबर, 2000 नगरपािलक ठोस अपिश: (बंध और हथालन) िनयम, 2000 के उपबंध" के अनुसार +कया जाएगा ; (ii) 'थानीय ािधकरण जैव िनf नकरणीय और अजैव िनf नकरणीय संघटक" म8 ठोस अपिश:" के संपृथ{न के िलए योजनाएं तैयार कर8गे ;
(iii) जैव िनीकरणीय साम_ी को अिधमानतः खाद बनाकर या कृिम खेती के माmयम से पुनःच+iत +कया जाएगा ;
(iv) अकाबिनक साम_ी का िनपटान पारि'थितक संवेदी जोन के बाहर पहचान +कए गए ' थल पर +कसी पयावरणीय 'वीकृत रीित म8 होगा और पारि'थितक संवेदी जोन म8 ठोस अपिश] ट" को जलाना या भ] मीकरण अनुUात नहW होगा ।

Draft Notification

WHEREAS, Sri Lankamalleswara Wildlife Sanctuary is located in the Kadapa District (Kadapa and Proddatur Forest Divisions) of Andhra Pradesh State being the hill ranges of Lankamallai in the Deccan Plateau of Kadapa District, situated in between 14°

43' 12” North and 14°

28' 12" North Latitudes, 78°48' 00" East and 79° 01' 48" East Longitudes and the Lankamalla Reserve Forest constitute the wildlife Sanctuary and the total area of the Sanctuary is 464.42 square kilometer;
AND WHEREAS, the Sri Lankamalleswara Wildlife Sanctuary is the only home for one of the most endangered and least known birds in the World, the Jerdon’s Double Banded Courser, which is endemic to the State of Andhra Pradesh and the Sanctuary is also inhabited by Leopard, Sambar, Cheetal, Dhole, Chousingha and many reptilian and bird species;

AND WHEREAS, the area has very rich Faunal and Floral diversity and has the largest population of Red sanders (Pterocarpus santallinus which is endemic to the region;

AND WHEREAS, the Sri Lankamalleswara Wildlife Sanctuary has mostly Southern Tropical dry deciduous Miscellaneous Type 5A/C3 as per Champion and Seth classification having species such as Pterocarpus santallinus,
Anogeissus sp., Carrissa carrandas, Zizyphus xylophyros, Dodonaea viscosa, Maytenus emerginata, Diospyros chloroxylon, Hardwickia binata, Tarenna asiatica, and Diospyros ferrea;

AND WHEREAS, numerous streams flowing over the entire reserve join river Pennar which forms the main drainage for the catchments in the Sanctuary and that the Sanctuary has many perennial springs and manmade tanks constructed during historical times;.

AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Lankamalleswara Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processed in the said Eco-sensitive Zone;

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub – section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of one kilometers from the boundary of Lankamalleswara Wildlife Sanctuary in the State of Andhra Pradesh, as the Lankamalleswara Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1.
Extent and Boundary of Eco-sensitive Zone.-(1) The extent of Eco-sensitive Zone is one kilometer from the boundary of Lankamalleswara Wildlife Sanctuary and includes 16 villages in Kadapa District. (2)
The list of villages along with their coordinates is given at Annexure-I. (3)
The map of Eco-sensitive Zone boundary together with latitudes –longitudes is appended with this notification as Annexure II. 2. Zonal Master Plan for the Eco-sensitive Zone.-(1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2)
The said Plan shall be approved by the Competent Authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-

(i) Environment;

(ii) Forest; (iii) Urban Development;
(iv) Tourism;

(v) Municipal; (vi) Revenue; (vii) Agriculture; (ix) State Pollution Control Board;

(x) Irrigation; and (xi) Public Works Department; for integrating environmental and ecological considerations into it.

The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood security of local communities.

Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 21, 26, 31 and 34 in column (2) of the Table in paragraph 4, namely:-

(i) Widening and strengthening of existing roads and construction of new roads;

(ii) Small scale industries not causing pollution; (iii) Rainwater harvesting; and
(iv) Cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of Article 244 of the Constitution of India or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural Springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment, Government of Andhra Pradesh .
(c) The activity of tourism shall be regulated as under, namely:-

(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;

(ii) Till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (7) Air pollution.- The Environment Department of the State Government or State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974) and the rules made thereunder. (9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco- sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone (10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial Units No new establishment of any industrial unit shall be permitted in the Eco- sensitive zone.
(13) Use of plastics: The use of plastics laminates and tetra-packs within the Eco-sensitive zone shall be regulated as per the activities mentioned in this notification.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:-

4. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. 5. Establishment of new major hydroelectric projects and irrigation projects. laws. 6. Use or production of any hazardous substances. laws.

Discharge of untreated effluents and solid waste in natural water bodies or land area. laws. 8. Undertaking activities related to tourism like over-flying the National Park Area by aircraft, hot-air balloons. laws. 9 New wood based industry. However, expansion of the existing Commercial tourism establishments is to be regulated strictly in accordance with ''The guidelines for taking non forestry activities in Wild life habitats" issued vide F.No.610/2011 WL dated 15-03-2011 by the Ministry of Environment and Forest (WL Division), New Delhi and National Tiger Conservation Authority guidelines.
15 Commercial use of natural water resources including ground water harvesting for commercial mineral water plants, aerated drinks bottling plants, etc. laws. 16 Introduction of Exotic Species. laws. Regulated Activities 17 Construction activities (a) No new commercial construction of any kind shall be permitted within One Kilometer from the boundary of the Protected Area: Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3. (b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the Competent Authority as per applicable rules and regulations, if any. (c) Construction activity in the ESZ shall be as per Zonal Master Plan. 18 Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder. (c) In case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed.

Monitoring Committee:- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:-

(a) District Collector, Kadappa – Chairman. 19 Erection of electrical cables and telecommunication towers. (a) Erection of High Tension Power Transmission Lines up to 11 KV subject to environmental impact assessment.
(b) Promote underground cabling. 20 Fencing of existing premises of hotels and lodges. Regulated under applicable laws. 21 Widening and strengthening of existing roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable. 22 Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws. 23 Protection of hill slopes and river banks. Regulated under applicable laws. 24 Discharge of treated effluents in natural water bodies or land area. Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
25 Commercial Sign boards and hoardings. Regulated under applicable laws. 26 Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro- based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment. 27 Collection of Forest produce or Non- Timber Forest Produce (NTFP). Regulated under applicable laws. 28 Air and vehicular pollution. Regulated under applicable laws. 29 Drastic Change of Agriculture systems. Regulated under applicable laws. Promoted Activities 30 Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. However, excessive expansion of some of these activities should be regulated as per the master plan. 31 Rain water harvesting. Shall be actively promoted. 32 Organic farming. Shall be actively promoted. 33 Adoption of green technology for all activities. (b) One representative of Non Governmental Organization working in the field of environment to be nominated by the Government of Andhra Pradesh for a term of one year in each case

(c) One expert in the area of ecology and environment to be nominated by the Government of Andhra Pradesh for a term of one year in each case

(d) Regional Officer, State Pollution Control Board
– Member.

(e) Municipal Commissioner or his representative of Kadappa Town
– Member.

(f) The Divisional Forest Officer, Proddator Wildlife Division
– Member.

(g) Representative of the Department of Environment, Government of Andhra Pradesh
– Member.

(h) Representative of the Department of Urban Development,
Government of Andhra Pradesh
– Member.

(i) Deputy Conservator of Forests/ Divisional Forest Officer, Kadappa Division
– Member Secretary.

6. Terms of Reference:

(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.

(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.

(4) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.

(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at
Annexure III.

(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8.
The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
