का.आ. 3101(अ).—न नलखत ाप अ धसूचना, िजसे के&'य सरकार, पया)वरण (संर-ण) अ धनयम, 1986 (1986 का 29) क2 धारा 3 क2 उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पठत उपधारा (1) 9वारा द:त शि<तय= का योग करते हुए, जार करने का Cताव करती है, पया)वरण (संर-ण) नयम, 1986 के नयम 5 के उपनयम (3) क2 अपे-ानुसार, जनसाधारण क2 जानकार के लए काशत क2 जाती है; िजनके उससे भाGवत होने क2 संभावना है,; और यह सूचना द जाती है Iक उ<त ाप अ धसूचना पर, उस तारख से, िजसको इस अ धसूचना वाले भारत के राजपK क2 तयां जनसाधारण को उपलLध करा द जाती हM, साठ दन क2 अव ध क2 समािNत पर या उसके पOचात् Gवचार Iकया जाएगा; 2. ऐसा कोई Sयि<त, जो ाप अ धसूचना मT अंतGव)Uट Cताव= के संबंध मT कोई आ-ेप या सुझाव देने मT हतबY है, इस कार Gवनद)Uट अव ध के भीतर, के&'य सरकार 9वारा Gवचार Iकए जाने के लए, आ-ेप या सुझाव स चव, पया)वरण, वन और जलवायु पZरवत)न मंKालय, इं'ा पया)वरण भवन, जोर बाग रोड, अलगंज, नई दल-110003 या ई-मेल पते: esz-mef@nic.in पर लखत प मT भेज सकेगा।

डेइंग एZरंग व&यजीव अभयार]य (नकटतम नगर पासीघाट औरह अ_णाचल देश के िजला पूव सयांग के िजला मुaयालय के लगभग 5 Iकलोमीटर) 190 वग) Iकलोमीटर -ेK मT फैला हुआ अ धसूचना संaया 248/78/2, तारख 23.08.1978 और संaया सी डLयी एल/37/83/डी/पी/4524-54, तारख 27/10/86 9वारा अ धसू चत सयांग नद के दो मुaय जलमागf के मgय अhछj तरह फैला है तथा पूव हमालय जैव GवGवधता हॉट Cपॉअ का एक भाग है;

अ धकतर -ेK तटवत` वन और घास के मैदान से घरा है, जहां पौध= क2 91 से अ धक जातयां जैसे कोराई, मोज, सुबाबुल, समुल, Gपचोला, ब&दरदमा, उदुल, बौन कोपाह, हतGपला इ:याद इस अभयार]य मT सू चबY क2 गई है और इसक2 मुaय वनCपतयां उपोUणीय वन, आ') शीतोUणीय वन और बांस वन है।

अभयार]य मT पाई जाने वाल मुaय पशु जातयां गंजेटक डॉिफन, तTदुआ, जलय भMस, सांबर, काकड़, पाढ़ा इ:याद है और बंगाल oलोZरकन- एक संकटाप&न जात के अतZर<त, मुaय प-ी जैसे मैना, Cपैटो हॉक, लफ बड), Sहाइट Gवंग बुड डक इ:याद अभयार]य मT पाए जाते हM।

और, डेइंग एZरंग व&यजीव अभयार]य के चार= ओर के -ेK को, िजसका GवCतार और सीमाएं इस अ धसूचना के पैरा 1 मT Gवनद)Uट हM, पया)वरण क2 xिUट से पारि&थ(तक संवेद+ जोन के प मT सुरp-त और संरp-त करना तथा उ<त पारि&थ(तक संवेद+ जोन मT उ9योग= या उ9योग= के वगy के चालन तथा संCकरण करने को तGषY करना आवOयक है;
अतः, अब, के&'य सरकार, पया)वरण (संर-ण) नयम, 1986 के नयम 5 के उपनयम (3) और पया)वरण (संर-ण) अ धनयम, 1986 (1986 का 29) क2 धारा 3 क2 उपधारा (2) के खंड (v) और खंड (xiv) के साथ पठत और उपधारा (1) 9वारा द:त शि<तय= का योग करते हुए, अ_णाचल देश मT डेइंग एZरंग व&यजीव अभयार]य क2 सीमा से शू&य से 100 मीटर तक के GवC ताZरत -ेK को डेइंग एZरंग व&यजीव अभयार]य पाZरिC थतक2य संवेद जोन (िजसे इसमT इसके पO चात् पाZरिC थतक संवेद जोन कहा गया है) के प मT अ धसू चत करती है, िजसका Gववरण न नानुसार है, अथा)त् :--
1.
पारि&थ(तक संवेद+ जोन का -व&तार और उसक/ सीमाएं--(1) पाZरिC थतक संवेद जोन डेइंग एZरंग व&यजीव अभयार]य क2 सीमा से शू&य से 100 मीटर तक GवCताZरत होगा। पाZरिC थतक संवेद जोन का GवC तार व& यजीव अभयार]य से दp-ण और पिOचम-दp-ण शू&य Iकलोमीटर है, िजसक2 सीमा असम रा|य से लगती है। पाZरिC थतक संवेद जोन का -ेKफल 500.72 हे< टेयर है।
(2) डेइंग एZरंग व&यजीव अभयार]य क2 सीमा, डेइंग एZरंग व& यजीव अभयार]य क2 पिO चमी सीमा के }ब&दु िजओ-को ऑर•डनेट पर 95023'16.418'' पूव) और 27056' 54.546'' उ:तर से ारंभ होती है,

(3) अ-ांश और देशा&तर के साथ पाZरिCथतक संवेद जोन क2 सीमा का मान चK उपाबंध I के प मT दया गया है। 2. पारि&थ(तक संवेद+ जोन के 4लए आंच4लक महायोजना –(1) रा|य सरकार, पाZरिC थतक संवेद जोन के योजन= के लए राजपK मT इस अ धसूचना के अंतम काशन क2 तारख से दो वष) क2 अव ध के भीतर, Cथानीय Sयि<तय= के परामश) से, इस अ धसूचना मT संलv न अनुबंध= के सामंजC य से आंचलक महायोजना तैयार करेगी। (2) आचंलक महायोजना रा| य सरकार मT स-म ा धकार 9वारा अनुमोदत होगी।
(3) पाZरिC थतक संवेद जोन के लए आंचलक महायोजना इस अ धसूचना मT Gवनद)U ट प मT ऐसी रत मT रा| य सरकार तथा सुसंगत कT 'य और रा| य Gव धय= के सामंजC य मT भी तथा कT 'य सरकार 9वारा जार माग)नद€श, यद कोई ह=, 9वारा तैयार होगी। (4) आंचलक महायोजना, इसमT पया)वरणीय और पाZरिC थतक2 Gवचार= को समाकलत करने के लए न नलखत सभी संबY रा| य सरकार के Gवभाग= के परामश) से तैयार होगी, अथा)त्:-- (i) पया)वरण; (ii) वन;
(iii) नगर Gवकास; (iv) पय)टन; (v) नगरपालक; (vi) राजC व;
(vii) कृGष; और (viii) अ_णाचल देश रा| य दूषण नयंKण बोड)। (5) आंचलक महायोजना अनुमोदत Gव9यमान भू-उपयोग, अवसंरचना और I‚याकलाप= पर कोई नबƒधन अ धरोGपत नहं करेगी जब तक Iक इस अ धसूचना मT और आचंलक महायोजना मT सभी अवसंरचना और अ धक भावी और पाZरिC थतक2य अनुकूल I‚याकलाप कारक इस कार Gवनद)U ट न हो। (6) आंचलक महायोजना मT अनाhछादत -ेK= के जीणyYार, Gव9यमान जल नकाय= के संर-ण, आवाह -ेK= के बंधन, जल-संभर= के बंधन, भूतल जल के बंधन, मृदा और नमी संर-ण, Cथानीय समुदाय= क2

आवOयकताओं तथा पाZरिCथतक2 और पया)वरण से संबं धत ऐसे अ&य पहलूओं, िजन पर gयान देना आवOयक है, के लए उपबंध ह=गे। (7) आंचलक महायोजना सभी Gव9यमान पूजा C थल=, „ाम= और नगरय बंदोबCत=, वन= के कार और IकC म=, कृGष -ेK=, ऊपजाऊ भूम, हZरत -ेK जैसे उ9यान और उसी कार के C थान, उ9यान कृGष -ेK, आIक) ड=, झील= और अ&य जल नकाय= का अ†यकंन करेगी। (8)
आंचलक महायोजना पाZरिC थतक संवेद जोन मT Gवकास को पाZरिC थतक अनुकूल Gवकास और C थानीय समुदाय= क2 आजीGवका को सुनिO चत करते हुए Gवनयमत होगी।
3. रा7य सरकार 8वारा 9कए जाने वाले उपाय-- रा|य सरकार इस अ धसूचना के उपबंध= को भावी करने के लए न नलखत उपाय करेगी, अथा)त् :-- (1) भू-उपयोग - पाZरिC थतक संवेद जोन मT उ9यान-कृGष -ेK=, कृGष -ेK=, आमोद-मोद के योजन के लए

चि&हत Iकए गए वन=, पाकf और खुले Cथान= का वाणि|यक और औ9यो गक संबY Gवकास I‚याकलाप= के लए उपयोग या संपZरवत)न नहं होगा:
परंतु पाZरिCथतक संवेद जोन के भीतर कृGष भूम का संपZरवत)न, मानीटर समत क2 सफाZरश पर और रा|य सरकार के पूव) अनुमोदन से, Cथानीय नवासय= क2 आवासीय जरत= को पूरा करने के लए और पैरा 4 क2 सारणी के Cतंभ (2) के अधीन मद. सं. 29, 32, 37, और 42 के सामने सूचीबY I‚याकलाप= को पूरा करने के लए अनु‡ात ह=गे, अथा)त् :-
(i) दूषण उ:प&न न करने वाले लघु उ9योग; (ii) पाZरिC थतक2य अनुकूल पय)टन I‚याकलाप= के लए पय)टक= के अC थायी आवासन के लए पाZरिC थतक2य अनुकूल आरामगाह जैसे टTट, लकड़ी के मकान आद; (iii) वषा) जल संचयन; और (iv) कुटर उ9योग, िजसके अंतग)त „ामीण शपी भी हM : परंतु यह और Iक रा|य सरकार के पूव) अनुमोदन और संGवधान के अनुh छेद 244 या त:समय वृ:त Gव ध के उपबंध= के अनुपालन के }बना, िजसके अंतग)त अनुसू चत जनजात और अ&य परंपरागत वन नवासी (वन अ धकार= क2 मा&यता) अ धनयम, 2006 (2007 का 2) भी है, वाणि|यक या उ9योग Gवकास I‚याकलाप= के लए जनजातीय भूम का उपयोग अनु‡ात नहं होगा :
परंतु यह और भी Iक पाZरिC थतक संवेद जोन के भीतर भू-अभलेख= मT पाई जाने वाल कोई Kुट मानीटर समत के Gवचार ाNत करने के पOचात् रा|य सरकार 9वारा :येक मामले मT एक बार संशो धत होगी और उ<त Kुट के संशोधन क2 भारत सरकार के पया)वरण, वन और जलवायु पZरवत)न मंKालय को सूचना देनी होगी :
परंतु यह और भी Iक उपयु)<त Kुट के संशोधन मT इस उप पैरा के अधीन यथा उपबं धत के सवाय Iकसी भी दशा मT भू-उपयोग का पZरवत)न सि मलत नहं होगा :
परंतु यह और भी Iक हZरत -ेK जैसे वन -ेK, कृGष -ेK आद मT कोई पाZरणामक कटौती नहं होगी और अयु< त या अनु: पादक कृGष -ेK= मT पुन: वनीकरण करने के यास Iकए जाएंगे।

(2) #ाकृ(तक जल->ोत -- आचंलक महायोजना मT सभी ाकृतक ˆोत= क2 पहचान क2 जाएगी और उनके संर-ण और पुनन)वीकरण के लए योजना सि मलत होगी और रा| य सरकार 9वारा ऐसे -ेK= पर या उनके नकट Gवकास I‚याकलाप तGषY करने के लए ऐसी रत से माग)नद€श तैयार Iकए जाएंगे। (3) पयटन – (क) पाZरिCथतक संवेद जोन के भीतर पय)टन संबंधी I‚याकलाप, जो आंचलक महायोजना का भाग प मT न नलखत प मT ह=गे।
(ख) पय)टन महायोजना पय)टन Gवभाग, हZरयाणा सरकार 9वारा राजC व और वन Gवभाग, हZरयाणा सरकार के परामश) से तैयार होगी।
(ग) पय)टन संबंधी I‚याकलाप न नलखत के अधीन Gवनयमत ह=गे, अथा)त् :- (i) पाZरिCथतक संवेद जोन के भीतर सभी नए पय)टन I‚याकलाप= या Gव9यमान पय)टन I‚याकलाप= का GवCतार भारत सरकार के पया)वरण, वन और जलवायु पZरवत)न मंKालय के माग)दश)क सYांत= के 9वारा तथा पाZरिCथतक पय)टन राU qय S या‰ संर-ण ा धकरण, 9वारा जार (समय- समय पर यथा संशो धत) माग)दश)क सYांत= के अनुसार, पाZरिCथतक पय)टन, पाZरिCथतक श-ा और पाZरिCथतक Gवकास को मह:व देते हुए पाZरिCथतक संवेद जोन क2 वहन -मता के अgययन पर आधाZरत होगा;
(ii) पाZरिC थतक संवेद जोन के भीतर होटल और Zरसाट) के नए संनमा)ण अनु‡ात नहं ह=गे। (iii) आंचलक महायोजना का अनुमोदन Iकए जाने तक, पय)टन के लए Gवकास और Gव9यमान पय)टन I‚याकलाप= के GवCतार को वाCतGवक Cथल Gवनद)Uट संवी-ा तथा मानीटर समत क2 सफाZरश पर आधाZरत संबं धत Gवनयामक ा धकाZरय= 9वारा अनु‡ात Iकया होगा। (4) नैसगक -वरासत -- पाZरिCथतक संवेद जोन मT मह:वपूण) नैस ग)क Gवरासत के सभी Cथल= जैसे सभी जीन कोश आरp-त -ेK, शैल Gवरचनाएं, जल पात=, झरन=, घाट मागf, उपवन=, गुफाओं, Cथल=, Šमण, अOवरोहण, पातो आद क2 पहचान क2 जाएगी और उ&हT पZररp-त Iकया जाएगा तथा उनक2 सुर-ा और संर-ा के लए इस अ धसूचना के काशन क2 तारख से छह मास के भीतर, उपयु<त योजना बनाई जाएगी और ऐसी योजना आंचलक महायोजना का भाग होगी। (5) मानव (न4मत -वरासत & थल - पाZरिC थतक संवेद जोन मT भवन=, संरचनाओं, शप-त‹य, ऐतहासक, कला:मक और सांCकृतक मह:व के -ेK= और अहात= क2 पहचान क2 जाएगी और इस अ धसूचना के काशन क2 तारख से छह मास के भीतर उनके संर-ण क2 योजनाएं तैयार क2 जाएंगी तथा आंचलक महायोजना मT सि मलत क2 जाएंगी।
(6) A व(न #दूषण -- पाZरिCथतक संवेद जोन मT g वन दूषण के नयंKण के लए रा| य सरकार का पया)वरण Gवभाग वायु (दूषण नवारण और नयंKण) अ धनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए नयम= के उपबंध= के अनुसरण मT माग)दश)क सYांत और Gवनयम तैयार करेगा।

(7) वायु #दूषण -- पाZरिCथतक संवेद जोन मT, वायु दूषण के नयंKण के लए रा|य सरकार का पया)वरण Gवभाग वायु (दूषण नवारण और नयंKण) अ धनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए नयम= के उपबंध= के अनुसरण मT माग)दश)क सYांत और Gवनयम तैयार करेगा।
(8) बCह>ाव का (न&सारण -- पाZरिCथतक संवेद जोन मT उपचाZरत बहˆाव का नCसारण जल (दूषण नवारण तथा नयंKण) अ धनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए नयम= के उपबंध= के अनुसार होगा। (9) ठोस अप4शFट -- ठोस अपशUट= का नपटान न नलखत प मT होगा - (i) पाZरिCथतक संवेद जोन मT ठोस अपशUट= का नपटान भारत सरकार के त:कालन पया)वरण, और वन मंKालय क2 समय-समय पर यथा संशो धत अ धसूचना सं. का.आ. 908(अ), तारख 25 सतंबर, 2000 को काशत नगरपालक ठोस अपशUट (बंध और हथालन) नयम, 2000 के उपबंध= के अनुसार Iकया जाएगा; (ii) Cथानीय ा धकरण जैव न नीकरणीय और अजैव न नीकरणीय संघटक= मT ठोस अपशUट= के संपृथ<कन के लए योजनाएं तैयार करTगे;
(iii) जैव न नीकरणीय साम„ी को अ धमानतः खाद बनाकर या कृम खेती के माgयम से पुनःचI‚त Iकया जाएगा;
(iv) अकाब)नक साम„ी का नपटान पाZरिCथतक संवेद जोन के बाहर पहचान Iकए गए C थल पर Iकसी पया)वरणीय Cवीकृत रत मT होगा और पाZरिCथतक संवेद जोन मT ठोस अपशU ट= को जलाना या भC मीकरण अनु‡ात नहं होगा।
(10) जैव च9कG सीय अप4शF ट- पाZरिCथतक संवेद जोन मT जैव चIक:सीय अपशUट= का नपटान भारत सरकार के त:कालन पया)वरण, और वन मंKालय क2 समय-समय पर यथासंशो धत अ धसूचना सं.का.आ.630 (अ) तारख 20 जुलाई, 1998 9वारा काशत जैव चIक:सीय अपशUट (बंध और हथालन) नयम, 1998 के उपबंध= के अनुसार Iकया जाएगा। (11) यानीय परवहन - पZरवहन क2 यानीय गतGव धयां आवास के अनुकूल Gवनयमत ह=गी और इस संबंध मT आंचलक महायोजना मT Gवशेष उपबंध अ धक थत Iकए जाएंगे और आंचलक महायोजना के तैयार होने और पया)वरण, वन और जलवायु पZरवत)न मंKालय के अनुमोदत होने तक, मानीटर समत वृ:त नयम= और Gवनयम= के अनुसार यानीय गतGव धय= के अनुपालन को मानीटर करेगी। 4. पारि&थ(तक संवेद+ जोन मI #(त-षJ और -व(नय4मत 9कए जाने वाले 9KयाकलापL क/ सूची - पाZरिCथतक संवेद जोन मT सभी I‚याकलाप पया)वरण (संर-ण) अ धनयम, 1986 (1986 का 29) के उपबंध= 9वारा शासत ह=गे और नीचे द गई तालका मT Gवनद)Uट रत मT Gवनयमत ह=गे, अथा)त् :--

(क) सभी कार के खनन (लघु और वृहत खनज), प:थर क2 खानT और उनको तोड़ने क2 इकाइयां वाCतGवक Cथानीय नवासय= क2 घरेलू आवOयकताओं के सवाय नहं ह=गी; (ख) खनन संI‚याएं, माननीय उhचतम &यायालय क2 Zरट या चका (सGवल) सं. 1995 का 202 ट.एन. गौडाबम)न थ_मूलपाद बनाम भारत सरकार के मामले मT आदेश तारख 4.8.2006 और Zरट या चका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मT तारख 21.04.2014 के अंतZरम आदेश के अनुसरण मT सव)दा चालन होगा।
2. आरा मशीन= क2 Cथापना। पाZरिCथतक संवेद जोन के भीतर नई और Gव9यमान आरा मल= का GवC तार अनु‡ात नहं होगा।
3. जल या वायु या मृदा या g वन दूषण काZरत करने वाले उ9योग= क2 C थापना।
पाZरिCथतक संवेद जोन के भीतर Iकसी नए और दूषण काZरत करने वाले Gव9यमान उ9योग= का GवC तार अनु‡ात नहं होगा। 4. Iकसी पZरसंकटमय पदाथf का उपयोग या उ:पादन। लागू Gव धय= के अनुसार तGषY (अ& यथा उपबं धत के सवाय)। 5. होटल और Zरसोट) का वाणि|यक Cथापन। नए वाणि| यक C थापन जैसे होटल और Zरसोट) पाZरिCथतक संवेद जोन के भीतर त:काल भाव से तGषY ह=गे।
6. जलावन लकड़ी का वाणि|यक उपयोग। लागू Gव धत के सवाय)। 7. नई बृहत जल Gव9युत पZरयोजनाओं क2 Cथापना। लागू Gव धत के सवाय)। 8. पय)टन से संबं धत I‚याकलाप जैसे गम) वायु गुबार= आद 9वारा अभयार]य -ेK के ऊपर से उड़ना जैसे I‚याकलाप करना। लागू Gव धत के सवाय)। 9. N लािC टक के थैल= का उपयोग।

Draft Notification
Whereas, the DayingEring Wildlife Sanctuary (about 5 kilometers from Pasighat nearest town and District headquarter of East Siang District of Arunachal Pradesh) covering an area of 190 square kilometer notified vide notification No. 248/78/2 dated 23.08.1978 &No.CWL/37/83/D/P/4524-54 dated 27/10/86 is well spread between the two main channels of Siang river and is part of Eastern Himalaya Biodiversity Hotspot.
And whereas, majority of the area is occupied by riverine forest and grassland where over 91 species of plants like Korai, Moj, Subabul, Simul, Pichola, Banderdima, Udul, Bon kopahiHatipila etc. have been listed in this sanctuary and its major vegetation’s are subtropical forest, wet temperate forests, and bamboo forests. And whereas,the main animal species found in the sanctuary are Gangetic Dolphin, Leopard, Water Buffalo, Sambar, Barking deer, Hog deer, etc. and the main birds like Myna, Sparrow hawk, Leaf bird, White wing wood duck etc. found in the sanctuary besides the Bengal florican- an endangered species.
And whereas, the sanctuary is home to many migratory birds like- Pelican, ducks, Strokes, teals etc., and the herpetofauna broadly comprise of frogs as- Bufo sp., Duttaphrynussp., Hyla sp., Megophyrussp., etc. and reptiles as Lizards- Calotes sp., Japalura sp., Hemidactylus sp., Varanus sp. Skinks as- Eutrophis sp., Lygosoma sp., Snakes as – Ramphotyphlops sp., Python sp., Ahaetullasp., Amphiesmasp., Bungarus sp., Naja sp., Ophiophagus sp., Tortoises as- Cuorasp., Pangshura sp., are also found in the sanctuary and the aquatic bodies harbors various fishes as Daniosp., Barilius sp., Semiplotussp., Puntius sp., Tor spp., Chagunius sp., Garra sp., Noemacheilus sp., Glyptothorax sp. And whereas, it is necessary to conserve and protect the area,the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of the Daying Ering Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; Now, therefore, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from zero to 100 metres from the boundary of the Daying Ering Wildlife Sanctuary in the State of Arunachal Pradesh as the Daying Ering Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone.-(1) The extent of Eco-sensitive Zone varies from zero to100 meters from the boundary of the Daying Ering Wildlife Sanctuary. The extent of Eco-sensitive Zone is zero kilometres from South and West-south of the Wildlife Sanctuary, which shares boundary with State of Assam. The area of Eco- sensitive Zone is 500.72 hectares.
(2) The boundary of Daying Ering Wildlife Sanctuary starts from a point at Western boundary of Daying Ering Wildlife Sanctuary at geo-coordinate 95023’16.418”E and 27056’54.546”N, the boundary of Eco-Sensitive Zone goes Westwards for 100 meters upto the point at geo-coordinates 95023’12.325”E and 27056’53.312”N and the boundary passes through geo-coordinates 95023’21.47”E and 27059’34.247”N, 95023’4.543”E and 2803’25.071”N, 95023’4.543”E and 2804’35.006”N, 95025’46.007”E and 2804’47.602”N, 95027’40.16”E and 2803’0.513”N, 95028’45.262”E and 2800’8.361”N, 95028’1.94”E and 27055’43.411”N, 95029’7.299”E and 27052’12.215”N, then westwards for 100 meter upto southeast point of D’Ering Wildlife Sanctuary at geo-coordinates 95029’3.868”E and 27052’10.232”N then along the sanctuary boundary southwards and east wards upto the starting point. (3) The map of Eco-sensitive Zone boundary together with its latitude and longitude is appended as Annexure I.
(4) No village falling within the proposed Eco-sensitive Zone of Daying Ering Wildlife Sanctuary. 2. Zonal Master Plan for the Eco-sensitive Zone.-(1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism;

(v) Municipal; (vi) Revenue; (vii) Agriculture; and (viii) Arunachal Pradesh State Pollution Control Board, for integrating environmental and ecological considerations into it. (5)
The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development and livelihood security of local communities. 3. Measures to be taken by State Government.-The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Landuse. - Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 29, 32, 37 and 42 in column (2) of the Table in paragraph 4, namely:- (i)
Small scale industries not causing pollution; (ii) Eco-friendly cottages for temporary occupation of tourists such as
tents, wooden houses, for Eco-friendly tourism activities; (iii)
Rainwater harvesting; and
(iv)
Cottage industries including village artisans: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural Springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism.-(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Arunachal Pradesh in consultation with Department of Revenue and Forests, Government of Arunachal Pradesh.
(c) The activity of tourism shall be regulated as under, namely.-

(i)
all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the eco-tourism guidelines issued by the National Tiger Conservation Authority, Ministry of Environment, Forest and Climate Change (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone; (ii)
new construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone;

(iii)
till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981)and the rules made thereunder. (7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981)and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974)and the rules made thereunder. (9) Solid wastes. - Disposal of solid wastes shall be as under.- (i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment, Forest and Climate Change vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material shall be disposed of in an environmentally acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.-The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment, Forests and Climate Change vide Notification number S.O. 630(E), dated the 20th July, 1998as amended from time to time. (11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government. The Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.-All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:-

2. Setting up of saw mills. No new and expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. 3. Setting up of industries causing water or air or soil or noise pollution. No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted. 4. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. 5. Commercial establishment of hotels and resorts. No new or expansion of existing commercial establishments such as hotels and resorts shall be permitted within the Eco-sensitive Zone. 6. Commercial use of firewood. 7. Establishment of new major hydroelectric projects. 8. Undertaking activities related to tourism like over-flying the sanctuary area by hot-air balloons, etc. 9. Uses of plastic carry bags. 10. Discharge of untreated effluents and solid waste in natural water bodies or land area. 11. Construction activities. No new construction of any kind shall be permitted within the Eco- sensitive Zone, except for the domestic needs of local residents including the activities listed in sub-paragraph (1) of paragraph 3. In case of the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum. 12. Hunting. 13. River poisoning. 14. Use of Explosive. 15. Establishment of new wood based industry within one kilometer from the boundary of the Sanctuary. 16. Contamination or pollution of water including from agriculture. 17. Laying of new high tension transmission Line/wire.

Regulated Activities: 18. Felling of trees. (a) There shall be no felling of trees on the forest land or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under. 19. Drastic change of agriculture system. Regulated under applicable laws. 20. Commercial water resources including ground water harvesting. (a)The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land. (b) The extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned Regulatory Authority. (c) No sale of surface water or ground water shall be permitted. (d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture. 21. Erection of electrical cables and telecommunication towers. Promote underground cabling. 22. Widening and strengthening of existing roads and construction of new roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable 23. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws. 24. Introduction of exotic species.
25. Protection of hill slopes and river banks. 26. Commercial Sign boards and hoardings. 27. Air (including noise) and vehicular pollution. 28. Discharge of treated effluents in natural water bodies or land area. Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed. 29. Small scale industries not causing pollution. Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Eco-sensitive Zone which do not cause any adverse impact on environment shall be permitted. 30. Collection of Forest produce or Non- Timber Forest Produce (NTFP). 31. Security Forces Camp. 32. Eco-friendly cottages for temporary occupation of tourists such as tents, wooden houses, etc. for Eco-friendly tourism activities. 33. Harvesting of timber. 34. Jhum cultivation. 35. Setting up of Tea / Coffee estate.

Permitted Activities:

Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming and fisheries. Permitted under applicable laws. 37. Rain water harvesting. Shall be actively promoted. 38. Organic farming. Shall be actively promoted. 39. Adoption of green technology for all activities. Shall be actively promoted. 40. Use of renewable energy sources. Permitted under applicable laws.

Vegetative fencing. Permitted under applicable laws. 42. Cottage industries including village artisans, etc. Shall be actively promoted. 43. Rearing of Mithun (Bosfrontalis). Permitted under applicable laws.

Eco-sensitive Zone Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:- (a) Deputy Commissioner, East Siang District, Pasighat, Government of

– Chairman;
Arunachal Pradesh (b) Executive Engineer, Water Resources Development Department,

• Member; East Siang District
  (c) Member Secretary, Arunachal PradeshState Pollution Control Board, Itanagar

-Member; (d) District Fishery Development Officer, East Siang District

-Member; (e) District Tourism Officer, East Siang District;

• Member; (f) District Agriculture Officer, East Siang District;

• Member; (g) One expert in the area of ecology and environment to be nominated by the
  Government of Arunachal Pradesh for a term of one year

-Member; (h) Land Record and Settlement Officer, East Siang District;

-Member; (i) One representative of Non-governmental Organizations’ working in the field of
environment to be nominated by the Government of Arunachal Pradesh

–Member; and (j) Divisional Forest Officer, Daying EringWildlife Sanctuary, Pasighat
– Member Secretary. 6. Terms of Reference: (1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (4) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification. (5)
The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State per Proforma appended at Annexure II. (7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F.
