ऩययावरण, वन और जऱवययु ऩररवतान मंत्रयऱय अधधसूचनय नई ददल्री, 8 अप्रैर, 2021 कय.आ. 1718(अ).—प्रारुऩ अधधसूचना बायत के याजऩत्र, असाधायण भें बायत सयकाय के ऩमाावयण, वन औय जरवामु ऩरयवतान, भंत्रारम की अधधसूचना सं. का.आ. 1877 (अ), तायीख 9 जून, 2020, द्वाया प्रकाशित की गई थी जजसभें ऐसे सबी व्मजततमों से, जजनकी उससे प्रबाववत होने की संबावना थी, उस तायीख से, जजसको उतत अधधसूचना को अन्तववाष्ट कयने वारे याजऩत्र की प्रततमां जनता को उऩरब्ध कया दी गई थीं, साठ ददन की अवधध के बीतय आऺेऩ औय सुझाव आभंत्रत्रत ककए गए थे; औय, उतत प्रारूऩ अधधसूचना को अन्तववाष्ट कयने वारे याजऩत्र की प्रततमां जनता को तायीख 9 जून, 2020, को उऩरब्ध कया दी गई थी; औय, प्रारुऩ अधधसूचना के उत्तय भें व्मजततमों औय ऩणधारयमों से कोई बी आऺेऩ औय सुझाव प्राप्त नहीं हुए; औय, केन वन्मजीव अबमायण्म अरूणाचर प्रदेि याज्म भें 1991 भें फनामा गमा था, जजसका ऺेत्रपर 31.0 वगा ककरोभीटय है, जजसे अरूणाचर प्रदेि सयकाय की अधधसूचना संख्मा सीडब्ल्मूएर/डी/43/92/1133-68, ददनांक

3 औय, केन वन्मजीव अबमायण्म के चायों ओय के ऺेत्र को, जजसका ववथताय औय सीभाएं ऩारयजथथततकी ऩमाावयणीम से ऩारयजथथततकी संवेदी जोन के रूऩ भें ऩैया 1 भें ववतनददाष्ट हैं, जैव ववववधधता की दृजष्ट सुयक्षऺत औय संयक्षऺत कयना औय उतत ऩारयजथथततकी संवेदी जोन भें उद्मोगों मा उद्मोगों के वगों के प्रचारन औय प्रसंथकयण कयने को प्रततवषद्ध कयना आवचमक है; अत्, अफ, केन्र्द्ीम सयकाय, ऩमाावयण (संयऺण) तनमभ, 1986 के तनमभ 5 के उऩतनमभ (3) के साथ ऩदठत ऩमाावयण (संयऺण) अधधतनमभ, 1986 (1986 का 29) (जजसे इस अधधसूचना भें इसके ऩचचात ऩमाावयण अधधतनमभ कहा गमा है) की धाया 3 की उऩधाया (1) औय उऩधाया (2) के खंड (v) औय खंड (xiv) तथा उऩधाया (3) द्वाया प्रदत्त िजततमों का प्रमोग कयते हुए, अरूणाचर प्रदेि के ऩजचचभ शसमांग जजरा के केन वन्मजीव अबमायण्म की सीभा के चायों ओय 0.05 ककरोभीटय से 0.50 ककरोभीटय ववथतारयत ऺेत्र को केन वन्मजीव अबमायण्म के ऩारयजथथततकी संवेदी जोन (जजसे इसभें इसके ऩच चात् ऩारयजथथततकी संवेदी जोन कहा गमा है) के रूऩ भें अधधसूधचत कयती है, जजसका वववयण तनमनानुसाय है, अथाात् :-

1. ऩारयजथथततकी संवेदी जोन का ववथताय औय सीभाएं.-(1) ऩारयजथथततकी संवेदी जोन का ववथताय केन वन्मजीव अबमायण्म की सीभा के चायों ओय 0.05 ककरोभीटय से 0.50 ककरोभीटय तक है औय ऩारयजथथततकी संवेदी जोन का ऺेत्रपर 6.8302 वगा ककरोभीटय है।
   (2) ऩारयजथथततकी संवेदी जोन औय केन वन्मजीव अबमायण्म की सीभा का वववयण उऩाफंध-I के रूऩ भें संरग्न है। (3) सीभा वववयण औय अऺांि औय देिांतय के साथ ऩारयजथथततकी संवेदी जोन के सीभांकन केन वन्मजीव अबमायण्म के भानधचत्र उऩाफंध -IIक, उऩाफंध -IIख औय उऩाफंध -IIग के रूऩ भें संरग्न है।
   (4) ऩारयजथथततकी संवेदी जोन औय केन वन्मजीव अबमायण्म की सीभा के बू-तनदेिांकों की सूची उऩाफंध-III की सायणी क औय सायणी ख भें दी गई है। (5) केन वन्मजीव अबमायण्म के प्रथताववत ऩारयजथथततकी संवेदी जोन के अंतगात कोई ग्राभ नहीं आता है।
2. ऩारयजथथततकी संवेदी जोन के शरए आंचशरक भहामोजना– (1) याज्म सयकाय, ऩारयजथथततकी संवेदी जोन के प्रमोजनों के शरए याजऩत्र भें इस अधधसूचना के प्रकािन की तायीख से दो वषा की अवधध के बीतय, थथानीम व्मजततमों के ऩयाभिा से औय याज्म के सऺभ प्राधधकायी के अनुभोदन के शरए इस अधधसूचना भें ददए गए अनुफंधों का ऩारन कयते हुए आंचशरक भहामोजना तैमाय कयेगी। (2) याज्म सयकाय द्वाया ऩारयजथथततकी संवेदी जोन के शरए आचंशरक भहामोजना ऐसी यीतत से जो इस अधधसूचना भें ववतनददाष् ट ककए गए हैं, के अनुसाय तथा सुसंगत केंर्द्ीम औय याज् म ववधधमों के अनुरुऩ औय केंर्द्ीम सयकाय द्वाया जायी भागातनदेिों, मदद कोई हों, द्वाया तैमाय होगी । (3) आंचशरक भहामोजना, उतत मोजना भें ऩारयजथथततकी औय ऩमाावयणीम फातों को सभाकशरत कयने के शरए याज् म सयकाय के तनमनशरखखत ववबागों के ऩयाभिा से तैमाय होगी.- (i) ऩमाावयण; (ii) वन औय वन्मजीव;
   (iii) कृवष; (iv) याजथव; (v) िहयी ववकास; (vi) ऩमाटन; (vii) ग्राभीण ववकास; (viii) शसंचाई औय फाढ़ तनमंत्रण;

(ix) नगयऩाशरका; (x) ऩंचामती याज; औय (xi) रोक तन भााण वव बाग। (4) आंचशरक भहामोजना अनुभोददत ववद्मभान बू-उऩमोग, अवसंयचना औय कक्रमाकराऩों ऩय कोई तनफंधन अधधयोवऩत नहीं कयेगी जफ तक कक इस अधधसूचना भें इस प्रकाय ववतनददाष् ट न हो औय आचंशरक भहामोजना सबी अवसंयचना औय कक्रमाकराऩों भें, जो अधधक दऺता औय ऩारयजथथततकी अनुकूर हों, का संवधान कयेगी ।
(5) आंचशरक भहामोजना भें अनाच्छाददत ऺेत्रों के जीणोद्धाय, ववद्मभान जर तनकामों के संयऺण, आवाह ऺेत्रों के प्रफंधन, जर-संबयों के प्रफंधन, बूतर जर के प्रफंधन, भृदा औय नभी संयऺण, थथानीम सभुदामों की आवचमकताओं तथा ऩारयजथथततकी औय ऩमाावयण से संफंधधत ऐसे अन्म ऩहरुओं, जजन ऩय ध्मान देना आवचमक है, के शरए उऩफंध होंगे । (6) आंचशरक भहामोजना ववद्मभान औय प्रथताववत बूशभ उऩमोग वविेषताओं के ब्मौयों से अनुसभधथात भानधचत्र के साथ सबी ववद्मभान ऩूजा थ थरों, ग्राभों औय नगयीम फजथतमों, वनों के प्रकाय औय ककथ भों, कृवष ऺेत्रों, ऊऩजाऊ बूशभ, हरयत ऺेत्र जैसे उद्मान औय उसी प्रकाय के थ थान, उद्मान कृवष ऺेत्र, परोउद्मान, झीरों औय अन्म जर तनकामों का अभ्मंकन कयेगी।
(7) आंचशरक भहामोजना ऩारयजथथततकी संवेदी जोन भें ववकास को ववतनमशभत कयेगी औय सायणी भें सूचीफद्ध ऩैया-4 भें प्रततवषद्ध औय ववतनमशभत कक्रमाकराऩों का अनुऩारन कयेगी औय थ थानीम सभुदामों की जीववका को सुयक्षऺत कयने के शरए ऩारयजथथततकी अनुकूर ववकास को सुतनजचचत औय उसकी अशबवृद्धध बी कयेगी।
(8) आंचशरक भहामोजना प्रादेशिक ववकास मोजना की सह ववथतायी होगी । (9) इस प्रकाय अनुभोददत आंचशरक भहामोजना इस अधधसूचना के उऩफंधों के अनुसाय भानीटयी के अऩने कामों को कयने के शरए भानीटयी सशभतत के शरए एक संदबा दथतावेज तैमाय कयेगी । 3. याज्म सयकाय द्वाया ककए जाने वारे उऩाम.- याज्म सयकाय इस अधधसूचना के उऩफंधों को प्रबावी कयने के शरए तनमनशरखखत उऩाम कयेगी, अथाात्:- (1) भू-उऩयोग.– (क) ऩारयजथथततकी संवेदी जोन भें वनों, उद्मान कृवष ऺेत्रों, कृवष ऺेत्रों, भनोयंजन के प्रमोजनों के शरए धचजन्हत ककए गए ऩाकों औय खुरे थथानों का वाखणजज्मक मा आवासीम मा औद्मोधगक संफद्ध ववकास कक्रमाकराऩों के शरए उऩमोग मा संऩरयवतान नहीं होगा: ऩयंतु मह कक ऩारयजथथततकी संवेदी जोन के बीतय बाग (क) भें ववतनददाष्ट प्रमोजनों से शबन्न प्रमोजनों के शरए कृवष औय अन्म बूशभ का संऩरयवतान भानीटयी सशभतत की शसपारयि ऩय औय मथा रागू औय ऺेत्रीम नगय मोजना अधधतनमभ औय केन्र्द्ीम सयकाय मा याज्म सयकाय के अन्म तनमभों तथा ववतनमभों के अधीन सऺभ प्राधधकायी के ऩूवा अनुभोदन से, औय इस अधधसूचना के उऩफंधों द्वाया थथानीम तनवाशसमों की तनमनशरखखत आवासीम आवचमकताओं को ऩूया कयने के शरए अनुऻात ककमा जाएगा, जैसे:- (i) ववद्मभान सड़कों को चौड़ा कयना औय उन्हें सुदृढ़ कयना तथा नई सड़कों का संतनभााण; (ii) फुतनमादी ढांचों औय नागरयक सुववधाओं का संतनभााण औय नवीकयण; (iii) प्रदूषण उत्ऩन्न न कयने वारे रघु उद्मोग; (iv) कुटीय उद्मोगों जजनके अंतगात ग्राभीण उद्मोग बी हैं; सुववधाजनक बण्डाय औय थथानीम सुववधाएं सहामक ऩारयजथथततकी ऩमाटन जजसके अन्तगात गृह वास सजमभशरत है; औय (v) ऩैया 4 के अधीन ददए गए संवधधात कक्रमाकराऩ: ऩयंतु मह औय कक प्रादेशिक नगय मोजना अधधतनमभ औय याज्म सयकाय के अन्म तनमभों औय ववतनमभों के अधीन सऺभ प्राधधकायी के ऩूवा अनुभोदन औय संववधान के अनुच्छेद 244 के उऩफंधों मा तत्सभम प्रवृत्त ववधध के उऩफंधों के अनुऩारन के त्रफना, जजसके अधीन अनुसूधचत जनजातत औय अन्म ऩयंऩयागत वन तनवासी (वन अधधकायों

5 की भान्मता) अधधतनमभ, 2006 (2007 का 2) बी है, वाखणजज्मक मा औद्मोधगक ववकास कक्रमाकराऩों के शरए जनजातीम बूशभ का उऩमोग अनुऻात नहीं होगा:
ऩयंतु मह औय बी कक ऩारयजथथततकी संवेदी जोन के बीतय बू-अशबरेखों भें उऩसंजात कोई गरती, भानीटयी सशभतत के ववचाय प्राप्त कयने के ऩचचात् याज्म सयकाय द्वाया प्रत्मेक भाभरे भें एक फाय ठीक होगी औय उतत गरती के सुधाय की सूचना केंर्द्ीम सयकाय के ऩमाावयण, वन औय जरवामु ऩरयवतान भंत्रारम को दी जाएगी:
ऩयंतु मह औय बी कक गरती के सुधाय भें इस उऩ ऩैया के अधीन मथा उऩफंधधत के शसवाम ककसी बी दिा भें बू-उऩमोग का ऩरयवतान सजमभशरत नहीं होगा;
(ख) वनीकयण तथा वास जीणोद्धाय कक्रमाकराऩों सदहत अनप्रमुत त मा अनुत् ऩादक कृवष ऺेत्रों भें ऩुन: वनीकयण कयने के प्रमास ककए जाएंगे। (2) प्रयकृततक जऱ स्रोतों.- आचंशरक भहामोजना भें सबी प्राकृततक झयनों के आवाह ऺेत्रों की ऩहचान की जाएगी औय उनके संयऺण औय नवीकयण के शरए मोजना सजम भशरत होगी औय याज् म सयकाय द्वाया ऐसे ऺेत्रों ऩय मा उनके तनकट ववकास कक्रमाकराऩ प्रततवषद्ध कयने के फाये भें जो ऐसे ऺेत्रों के शरए अदहतकय हो ऐसी यीतत से भागादिाक शसद्धांत तैमाय ककए जाएंगे। (3) ऩयाटन यय ऩयररस्थथततकी ऩयाटन.- (क) ऩारयजथथततकी संवेदी जोन के बीतय सबी नए ऩारयजथथततकी ऩमाटन कक्रमाकराऩ मा ववद्मभान ऩमाटन कक्रमाकराऩों का ववथताय ऩमाटन भहामोजना के अनुसाय ऩारयजथथततकी संवेदी जोन के शरए होगा।
(ख) ऩारयजथथततकी ऩमाटन भहामोजना याज्म ऩमाटन ववबाग द्वाया याज्म ऩमाावयण औय वन ववबाग के ऩयाभिा से तैमाय होगी। (ग) ऩमाटन भहामोजना आंचशरक भहामोजना के एक घटक के रूऩ भें होगी। (घ) ऩमाटन भहामोजना ऩारयजथथततकी संवेदी जोन की वहन ऺभता के आधाय ऩय तैमाय की जाएगी। (ङ) ऩारयजथथततकी ऩमाटन संफंधी कक्रमाकराऩ तनमनानुसाय ववतनमशभत होंगे, अथाात्:- (i) संयक्षऺत ऺेत्र की सीभा से एक ककरोभीटय के बीतय मा ऩारयजथथततकी संवेदी जोन के ववथताय तक, इनभें जो बी तनकट है, नमे वाखणजज्मक होटर औय रयजॉटा के सजन्नभााण अनुऻात नहीं होंगे: ऩयंतु, मह कक संयक्षऺत ऺेत्र की सीभा से एक ककरोभीटय की दूयी से ऩये ऩारयजथथततकी संवेदी जोन के ववथताय तक होटरों औय रयजॉटा का थथाऩना केवर ऩूवा ऩरयबावषत औय नाभतनददाष्ट ऺेत्रों भें ऩमाटन भहामोजना के अनुसाय ऩारयजथथततकी ऩमाटन सुववधाओं के शरए ही अनुऻात होगा; (ii) ऩारयजथथततकी संवेदी जोन के बीतय सबी नए ऩमाटन कक्रमाकराऩों मा ववद्मभान ऩमाटन कक्रमाकराऩों का ववथताय केंर्द्ीम सयकाय के ऩमाावयण, वन औय जरवामु ऩरयवतान भंत्रारम के भागादिाक शसद्धांतों के द्वाया तथा याष् ट्रीम व् माघ्र संयऺण प्राधधकयण, द्वाया जायी ऩारयजथथततकी–ऩमाटन, ऩारयजथथततकी-शिऺा औय ऩारयजथथततकी-ववकास ऩय फर देते हुए (सभम-सभम ऩय मथा संिोधधत) जायी भागादिाक शसद्धांतों के अनुसाय होगा; (iii) आंचशरक भहामोजना का अनुभोदन ककए जाने तक, ऩमाटन के शरए ववकास औय ववद्मभान ऩमाटन कक्रमाकराऩों के ववथताय को वाथतववक थथर ववतनददाष्ट संवीऺा औय भानीटयी सशभतत की शसपारयि ऩय आधारयत संफंधधत ववतनमाभक प्राधधकयणों द्वाया अनुऻात ककमा जाएगा औय ऩारयजथथततकी संवेदी जोन के बीतय ककसी नमे होटर मा रयसोटा मा वाखणजज्मक थथाऩना का संतनभााण अनुऻात नहीं ककमा जामेगा । (4) नैसधगाक ववरयसत.- ऩारयजथथततकी संवेदी जोन भें भहत्वऩूणा नैसधगाक ववयासत के सबी थथरों जैसे जीन कोि आयक्षऺत ऺेत्र, िैर ववयचनाएं, जर प्रऩातों, झयनों, घाटी भागों, उऩवनों, गुपाएं, थथरों, भ्रभण, अचवयोहण, प्रऩातों आदद की ऩहचान की जाएगी औय ववयासत संयऺण मोजना आंचशरक भहामोजना के बाग के रुऩ भें ऩरययऺण औय संयऺण के शरए तैमाय की जाएगी ।

(5) मयनव तनर्मात ववरयसत थ थऱ.- ऩारयजथथततकी संवेदी जोन भें बवनों, संयचनाओं, शिल्ऩ-तथ्म, ऐततहाशसक, थथाऩत्म, सौंदमाऩूयक औय सांथकृततक भहत्व के ऺेत्रों की औय उऩऺेत्रों ऩहचान औय उनके संयऺण के शरए ववयासत मोजना आंचशरक भहामोजना के बाग के रुऩ भें तैमाय की जाएगी।
(6) ध् वतन प्रदूषण.- ऩमाावयण अधधतनमभ के अधीन ध्वतन प्रदूषण (ववतनमभन औय तनमंत्रण) तनमभ, 2000 भें तनमत उऩफंधों के अनुसाय ऩारयजथथततकी संवेदी जोन भें ध्वतन प्रदूषण के तनमंत्रण औय तनवायण का अनुऩारन ककमा जाएगा।
(7) वययु प्रदूषण.- ऩारयजथथततकी संवेदी जोन भें, वामु प्रदूषण के तनवायण औय तनमंत्रण का वामु (प्रदूषण तनवायण औय तनमंत्रण) अधधतनमभ, 1981 (1981 का 14) औय उसके अधीन फनाए गए तनमभों के उऩफंधों के अनुसाय अनुऩारन ककमा जाएगा।
(8) बहहस्रयव कय तनथसयरण.- ऩारयजथथततकी संवेदी जोन भें उऩचारयत फदहस्राव का तनथसयण, साधायण भानकों के उऩफंधों के अनुसाय ऩमाावयण अधधतनमभ औय उसके अधीन फनाए गए तनमभों के अधीन आने वारे ऩमाावयणीम प्रदूषण के तनथसयण के शरए साधायण भानकों मा याज्म सयकाय द्वाया तनमत भानकों, जो बी अधधक कठोय हो, के उऩफंधों के अनुसाय होगा। (9) ठोस अऩर्िष्ट.- ठोस अऩशिष्ट का तनऩटान औय प्रफंधन तनमनानुसाय ककमा जाएगा:- (क) ऩारयजथथततकी संवेदी जोन भें ठोस अऩशिष्ट का तनऩटान औय प्रफंधन बायत सयकाय के ऩमाावयण, वन औय जरवामु ऩरयवतान भंत्रारम की अधधसूचना सं. का.आ. 1357(अ), तायीख 8 अप्रैर, 2016 के द्वाया प्रकाशित ठोस अऩशिष्ट प्रफंधन तनमभ, 2016 के उऩफंधों के अनुसाय ककमा जाएगा; अकाफातनक ऩदाथो का तनऩटान ऩारयजथथततकी संवेदी जोन से फाहय धचजन्हत ककए गए थथानों ऩय ऩमाावयण-अनुकूर यीतत से ककमा जाएगा; (ख) ऩारयजथथततकी संवेदी जोन भें भान्म प्रौद्मोधगककमों का उऩमोग कयते हुए ववद्मभान तनमभों औय ववतनमभों के अनुरूऩ ठोस अऩशिष्ट का सुयक्षऺत औय ऩमाावयण-अनुकूर प्रफंधन अनुऻात ककमा जा सकेगा। (10) जैव धचककत्सय अऩर्िष् ट.- जैव धचककत्सा अऩशिष् ट का प्रफंधन तनमनानुसाय ककमा जाएगा.- (क) ऩारयजथथततकी संवेदी जोन भें जैव धचककत्सा अऩशिष्ट का तनऩटान बायत सयकाय के ऩमाावयण, वन औय जरवामु ऩरयवतान भंत्रारम की अधधसूचना सं.सा.का.तन 343 (अ), तायीख 28 भाचा, 2016 के द्वाया प्रकाशित जैव धचककत्सा अऩशिष्ट प्रफंधन तनमभ, 2016 के उऩफंधों के अनुसाय ककमा जाएगा।
(ख) ऩारयजथथततकी संवेदी जोन भें भान्म प्रौद्मोधगककमों का उऩमोग कयते हुए ववद्मभान तनमभों औय ववतनमभों के अनुरूऩ जैव-धचककत्सा अऩशिष्ट का सुयक्षऺत औय ऩमाावयण-अनुकूर प्रफंधन अनुऻात ककमा जा सकेगा। (11) प्ऱयस्थटक अऩर्िष्ट प्रबंधन.- ऩारयजथथततकी संवेदी जोन भें प्राजथटक अऩशिष्ट प्रफंधन का तनऩटान बायत सयकाय के ऩमाावयण, वन औय जरवामु ऩरयवतान भंत्रारम की सभम-सभम ऩय मथासंिोधधत अधधसूचना सं.सा.का.तन 340(अ), तायीख 18 भाचा, 2016 द्वाया प्रकाशित प्राजथटक अऩशिष्ट प्रफंध तनमभ, 2016 के उऩफंधों के अनुसाय ककमा जाएगा। (12) तनमयाण और ववध्वंस अऩर्िष्ट प्रबंधन.- ऩारयजथथततकी संवेदी जोन भें संतनभााण औय ववध्वंस अऩशिष्ट प्रफंधन का तनऩटान बायत सयकाय के ऩमाावयण, वन औय जरवामु ऩरयवतान भंत्रारम की सभम-सभम ऩय मथासंिोधधत अधधसूचना सं.सां.का.तन 317(अ), तायीख 29 भाचा, 2016 द्वाया प्रकाशित संतनभााण औय ववध्वंस प्रफंध तनमभ, 2016 के उऩफंधों के अनुसाय ककमा जाएगा । (13) ई–अऩर्िष्ट.- ऩारयजथथततकी संवेदी जोन भें ई–अऩशिष्ट प्रफंधन का तनऩटान बायत सयकाय के ऩमाावयण, वन औय जरवामु ऩरयवतान भंत्रारम की सभम-सभम ऩय मथासंिोधधत द्वाया प्रकाशित ई–अऩशिष्ट प्रफंध तनमभ, 2016 के उऩफंधों के अनुसाय ककमा जाएगा। (14) ययनीय ययतयययत.- मातामात की मानीम गततववधधमां आवास के अनुकूर ववतनमशभत होंगी औय इस संफंध भें आंचशरक भहामोजना भें वविेष उऩफंध सजमभशरत ककए जाएंगे औय आंचशरक भहामोजना के तैमाय होने औय

7 याज्म सयकाय के सऺभ प्राधधकायी द्वाया अनुभोददत होने तक, भानीटयी सशभतत सुसंगत अधधतनमभों औय उसके अधीन फनाए गए तनमभों औय ववतनमभों के अनुसाय मानीम कक्रमाकराऩों के अनुऩारन को भानीटयी कयेगी। (15) ययनीय प्रदूषण.- रागू ववधधमों के अनुऩारन भें वाहन प्रदूषण का तनवायण औय तनमंत्रण ककमा जाएगा औय थवच्छक ईंधन के उऩमोग के शरए प्रमास ककए जाएंगे। (16) औद्योधगक ईकयइययं.- (क) याजऩत्र भें इस अधधसूचना के प्रकािन ऩय मा उसके ऩचचात ऩारयजथथततकी संवेदी जोन के बीतय कोई नए प्रदूवषत उद्मोगों की थथाऩना की अनुऻा नहीं दी जाएगी।
(ख) केन्र्द्ीम प्रदूषण तनमंत्रण फोडा द्वाया पयवयी, 2016 भें जायी सभम-सभम ऩय मथा संिोधधत भागादिाक शसद्धान्तों भें उद्मोगों के वगीकयण के अनुसाय, जफ तक कक अधधसूचना भें इस प्रकाय ववतनददाष्ट न हो, ऩारयजथथततकी संवेदी जोन के बीतय केवर गैय-प्रदूषणकायी उद्मोगों को अनुऻात ककमा जाएगा औय इसके अततरयतत, गैय प्रदूषणकायी उद्मोगों को फढ़ावा ददमा जाएगा। (17) ऩहयडी ढऱयनों को संरऺण.- ऩहाड़ी ढरानों का संयऺण तनमनानुसाय होगा:- (क) आंचशरक भहामोजना ऩहाड़ी ढरानों ऩय ऺेत्रों का संकेत होगा जहां ककसी बी संतनभााण की अनुऻा नहीं दी जाएगी; (ख) कटाव के एक उच्च डडग्री के साथ ववद्मभान खड़ी ऩहाड़ी ढरानों मा ढरानों ऩय ककसी बी संतनभााण की अनुऻा नहीं दी जाएगी । 4. ऩारयजथथततकी संवेदी जोन भें प्रततवषद्ध औय ववतनमशभत ककए जाने वारे कक्रमाकराऩों की सूची.- ऩारयजथथततकी संवेदी जोन भें सबी कक्रमाकराऩ ऩमाावयण अधधतनमभ के उऩफंधों औय उसके अधीन फनाए गए तनमभों जजसके अन्तगात तटीम ववतनमभन जोन, 2011 औय ऩमाावयणीम सभाघात तनधाायण अधधसूचना, 2006 औय अन्म रागू ववधधमों के जजसभें वन (संयऺण) अधधतनमभ, 1980 (1980 का 69), बायतीम वन अधधतनमभ, 1927 (1927 का 16), वन्मजीव (संयऺण) अधधतनमभ, 1972 (1972 का 53) सजमभशरत हैं औय ककमे गमे संिोधनों द्वाया िाशसत होंगे औय नीचे दी गई सायणी भें ववतनददाष्ट यीतत भें ववतनमशभत होंगे, अथाात् :- सयरणी क्रम सं. 4. ककसी ऩरयसंकटभम ऩदाथा का उऩमोग मा उत्ऩादन मा प्रसंथकयण। प्रततवषद्ध।
5. प्राकृततक जर तनकामों मा ऺेत्र बूशभ भें अनुऩचारयत फदहस्रााव का तनथसायण । प्रततवषद्ध।
6. नई आया शभरों की थथाऩना। ऩारयजथथततकी संवेदी जोन के बीतय नई औय ववद्मभान आया शभरों का ववस् ताय अनुऻात नहीं होगा।
7. ईंट बट्टों की थथाऩना कयना। प्रततवषद्ध।
8. जरावन रकड़ी का वाखणजज्मक उऩमोग। प्रततवषद्ध। 9. ऩोशरथीन फैगों का प्रमोग । प्रततवषद्ध। 10. शिकाय कयना। प्रततवषद्ध। 11. नदी का ववषैराऩन। प्रततवषद्ध। 12. ववथपोटक का उऩमोग। प्रततवषद्ध। 13. अबमायण्म की सीभा से एक ककरोभीटय के बीतय ककसी नए रकड़ी आधारयत उद्मोग की थथाऩना। प्रततवषद्ध। आ. ववतनयर्मत कक्रययकऱयऩ 14. वाखणजज्मक होटरों औय रयसोटों की थथाऩना । ऩारयजथथततकी ऩमाटन कक्रमाकराऩों रघु अथथामी संयचनाओं के शसवाम संयक्षऺत ऺेत्र की सीभा से एक ककरोभीटय के बीतय मा ऩारयजथथततकी संवेदी जोन के ववथताय तक, इनभें जो बी तनकट है, नए वाखणजज्मक होटर औय रयसोटों को अनुऻात नहीं ककमा जाएगा:

ऩयंतु मह कक संयक्षऺत ऺेत्र की सीभा से एक ककरोभीटय के ऩये मा ऩारयजथथततकी संवेदी जोन के ववथताय तक इनभें से, जो बी तनकट हो सबी नए ऩमाटन कक्रमाकराऩ मा ववद्मभान कक्रमाकराऩ का ववथताय ऩमाटन भहामोजना औय मथा रागू भागादिी शसद्धांतों के अनुरुऩ होगा। 15. संतनभााण कक्रमाकराऩ । (क) संयक्षऺत ऺेत्र की सीभा से एक ककरोभीटय के बीतय मा ऩारयजथथततकी संवेदी जोन के ववथताय तक, इनभें जो बी तनकट

9 हो, ककसी बी प्रकाय के नमे वाखणजज्मक संतनभााण की अनुऻा नहीं होगी: ऩयंतु मह कक थथानीम रोगों को अऩनी आवास समफन्धी तनमनशरखखत आवचमकताओं को ऩूया कयने के शरए, ऩैया 3 के उऩ ऩैया (1) भें सूचीफद्ध कक्रमाकराऩों सदहत अऩने उऩमोग के शरए, अऩनी बूशभ भें बवन उऩ-ववधधमों के अनुसाय, संतनभााण कयने की अनुऻा होगी: ऩयंतु मह कक गैय–प्रदूषणकायी रघु उद्मोगों से संफंधधत संतनभााण कक्रमाकराऩ रागू तनमभों औय ववतनमभों, मदद कोई हों, के अनुसाय सऺभ प्राधधकायी की ऩूवा अनुभतत से ववतनमशभत ककए जाएंगे औय वे न्मूनतभ होंगे ।
(ख) एक ककरोभीटय ऺेत्र से ऩये मे आंचशरक भहामोजना के अनुसाय ववतनमशभत होंगे । 16. प्रदूषण उत्ऩन्न न कयने वारे रघु उद्मोग। पयवयी, 2016 भें केन्र्द्ीम प्रदूषण तनमंत्रण फोडा द्वाया जायी उद्मोगों भें वगीकयण के अनुसाय सभम-सभम ऩय मथा संिोधधत गैय-प्रदूषणकायी उद्मोग औय अऩरयसंकटभम भें, रघु औय सेवा उद्मोग, कृवष, ऩुष्ऩ कृवष, उद्मान कृवष मा ऩारयजथथततकी संवेदी जोन से देिी साभग्री से उत्ऩादों को उत्ऩन्न कयने वारे कृवष आधारयत उद्मोग सऺभ प्राधधकायी द्वाया अनुऻात होंगे। 17. वृऺों की कटाई। (क) याज्म सयकाय भें सऺभ प्राधधकायी की ऩूवा अनुऻा के त्रफना वन, सयकायी मा याजथव मा तनजी बूशभ ऩय मा वनों भें वृऺों की कटाई नहीं होगी । (ख) वृऺों की कटाई संफंधधत केंर्द्ीम मा याज्म अधधतनमभ मा उसके अधीन फनाए गए तनमभों के उऩफंध के अनुसाय ववतनमशभत होगे । 18. वन उत्ऩादों मा गैय काष् ठ वन उत्ऩादों का संग्रहण । रागू ववधधमों के अनुसाय ववतनमशभत होंगे । 19. ववद्मुत औय संचाय टावयों का ऩरयतनभााण औय केफरों के त्रफछाए जाने औय अन्म फुतनमादी ढांचे । रागू ववधधमों के अधीन ववतनमशभत होंगे (बूशभगत केफर के त्रफछाए जाने को फढ़ावा ददमा जा सकेगा)। 20. नागरयक सुख सुववधाओं सदहत अवसंयचनाएं । न्मूनीकयण उऩामों को रागू ववधधमों, तनमभों औय ववतनमभनों औय उऩरब्ध भागादिाक शसद्धांतों के अनुसाय ककमा जाना । 21. ववद्मभान सड़कों को चौड़ा कयना औय उन्हें सुदृढ़ कयना तथा नवीन सड़कों का संतनभााण । न्मूनीकयण उऩामों को रागू ववधधमों, तनमभों औय ववतनमभनों तथा उऩरब्ध भागादिाक शसद्धांतों के अनुसाय ककमा
जाएगा । 22. ऩमाटन से संफंधधत अन्म कक्रमाकराऩ जैसे गभा वामु गुब्फायें, हेरीकाप्टय, िोन,
भाइक्रोराइटस, आदद द्वाया ऩारयजथथततकी संवेदी जोन ऺेत्र के ऊऩय से उड़ना जैसे कक्रमाकराऩ कयना।

23. ऩहाड़ी ढारों औय नदी तटों का संयऺण । 24. यात्रत्र भें मातनक मातामात का संचरन । रागू ववधधमों के अधीन वाखणजज्मक प्रमोजन के शरए ववतनमशभत होंगे । 25. थथानीम सभुदामों द्वाया चर यही कृवष औय फागवानी प्रथाओं के साथ दुग्धिारा, दुग्घ उद्मोग, कृवष औय भछरी ऩारन । थथानीम रोगों के उऩमोग के शरए रागू ववधधमों के अधीन अनुऻात । 26. पभों, तनगभ औय कंऩतनमों द्वाया फड़े ऩैभाने ऩय वाखणजज्मक ऩिुओं औय कुतकुट पाभों की थथाऩना । थथानीम आवचमकताओं को ऩूया कयने के शरए रागू ववधधमों के अधीन ववतनमशभत (अन्मथा उऩफंधधत के शसवाम) होंगे । 27. प्राकृततक जर तनकामों मा सतही ऺेत्र भें उऩचारयत फदहस्रााव का तनथतायण । जर तनकामों भें उऩचारयत अऩशिष्ट जर मा फदहस्रााव के तनथसायण से फचा जाएगा औय उऩचारयत अऩशिष्ट जर के ऩुन:चक्रण औय ऩुन:उऩमोग के शरए प्रमास ककए जाएंगे। अन्मथा रागू ववधधमों के अनुसाय उऩचारयत फदहस्रााव के ऩुनचाक्रण मा प्रवाह के तनवाहन को ववतनमशभत ककमा जाएगा। 28. सतही औय बूजर का वाखणजज्मक तनष्कषाण । 29. ठोस अऩशिष्ट का प्रफन्धन। 30. ववदेिी प्रजाततमों को राना । 31. ऩारयजथथततकी ऩमाटन। 32. वाखणज् तमक सूचनाऩट्ट औय होडडंग। 33. झूभ की कृवष। रागू ववधधमों के अनुसाय ववतनमशभत होगा । 34. चाम कॉपी संऩदा की थथाऩना। रागू ववधधमों के अनुसाय ववतनमशभत होगा । इ. संवधधात कक्रययकऱयऩ

(2) भानीटयी सशभतत का कामाकार अगरे आदेि होने तक ककमा जाएगा, ऩयंतु मह कक सशभतत के गैय-सयकायी सदथमों को सभम-सभम ऩय याज्म सयकाय द्वाया नाभतनददाष्ट ककमा जाएगा। (3) उन कक्रमाकराऩों की, जो बायत सयकाय के तत्कारीन ऩमाावयण औय वन भंत्रारम की अधधसूचना संख्मांक का.आ. 1533 (अ), तायीख 14 शसतमफय, 2006 की अनुसूची भें सजमभशरत हैं, औय जो ऩारयजथथततकी संवेदी जोन भें आते हैं, शसवाम इसके जो ऩैया 4 के अधीन सायणी भें मथा ववतनददाष्ट प्रततवषद्ध कक्रमाकराऩों के, भानीटयी सशभतत द्वाया वाथतववक ववतनददाष्ट थथरीम दिाओं के आधाय ऩय संवीऺा की जाएगी औय उतत अधधसूचना के उऩफंधों के अधीन ऩूवा ऩमाावयण अनाऩवत्त के शरए केर्द्ींम सयकाय के ऩमाावयण, वन औय जरवामु ऩरयवतान भंत्रारम को तनददाष्ट ककमा जाएगा। (4) उन कक्रमाकराऩों की, जो बायत सयकाय के तत्कारीन ऩमाावयण औय वन भंत्रारम की अधधसूचना संख्मांक का.आ. 1533 (अ) तायीख 14 शसतंफय, 2006 की अनुसूची भें सजमभशरत नहीं है, औय जो ऩारयजथथततकी संवेदी जोन भें आते हैं, शसवाम इसके ऩैया 4 के अधीन सायणी भें मथाववतनाष्ट प्रततवषद्ध कक्रराकराऩों के भानीटयी सशभतत द्वाया वाथतववक ववतनददाष्ट थथरीम दिाओं के आधाय ऩय संवीऺा की जाएगी औय उसे संफंद्ध ववतनमाभक प्राधधकयणों को तनददाष्ट ककमा जाएगा।
(5) भानीटयी सशभतत का सदथम-सधचव मा संफद्ध उऩामुतत ऐसे व्मजतत के ववरूद्ध, जो इस अधधसूचना के ककसी उऩफंध का उल्रंघन कयता है, ऩमाावयण (संयऺण) अधधतनमभ की धाया 19 के अधीन ऩरयवाद पाइर कयने के शरए

S.O. 1877(E), dated the 9th June, 2020, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 9th June, 2020; AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification; AND WHEREAS, the Kane Wildlife Sanctuary in the State of Arunachal Pradesh was created in 1991 covering an area of 31.0 square kilometres notified vide notification of the Government of Arunachal Pradesh number CWL/D/43/92/1133-68, dated the 11th April, 2007, is gift of rich biodiversity with scenic beauty;
AND WHEREAS, the Kane Wildlife Sanctuary is situated in the foothill of semi evergreen forest of West Siang District consisting of tropical semi evergreen forests to subtropical moist forests, the area in the Sanctuary is represented by rugged, mountainous with few gentle slopes with tributary of Siri (Jiadhol) river and many rivulets and streams;

AND WHEREAS, the Kane Wildlife Sanctuary conserves the biota and its biodiversity and supports various floral, faunal, herpetofaunal and avifaunal species, the major floral species found in the Sanctuary are Albizia procera (Koroi), Bombax ceiba (Simul), Kydia kalycina (Pichola), Urea Koata (Sokamara), Moras lavigeta (Bola), Ficus dumosa (Dimaru), Amoora wallichi (Amari), Dysoxylum gobera (Banderdima), Sterculia villosa (Udal), Abroma augusta (Bon kopahi), Pterspermum acerifolium (Hati polia), Dillenia indica (Outenga), Alstonia scholars (Satiana), Vatica lancefolia (Morhal), Bischofia javonica (Urium), Sterospermum personatum (Paroli), Oroxylum indicum (Bhatgila), Erythrina stricta (Madar), Duabhanga grandiflora (Khokan), Cinnamum tamalum (Tejpat), Litsea salicifolia (Digloti), Gemilia arborea (Gameri), Calicarpa arborea (Gunmala), Laportia cranulata (Chorat), Pogosteman bengalensis (Shukhati), Solanum nigrum, Musa parasideca (Wild banana), Pandanus foetidus (Kevra), Alpinia allugus (Taragunch), Imperata cylindrical (Thatch), Vitiveria zizanoise (Briga), Teminalia myriocarpa, Ailanthus excelsa, Artocarpus chaplasa, Canarium strictium, Quercus lalisa, Castonosis indica, Phoebe goalparents, Quercus sp. and Syzigium macarocarpum, etc.; AND WHEREAS, the Kane Wildlife Sanctuary is home to many species of wild animals like Manis petnadactyla (Chinese pangolin), Talpa leucura (white tailed mole), Crocidura allenuate (grey shrew), Tupaia belangeri (tree shrew), Marcoglossus sobrinus (long tongued hill fruit bat), Nycticebus coucang (slow loris), Macaca assamensis (Assamese macaque), Trachypithecus pileatus (capped langur), Cuon alpines (wild dog), Ursus thibetanus (Asiatic black bear), Martes flavigula (yellow throated martin), Lutra lutra (common otter), Felis chaus (jungle cat), Viverra zibetha (large Indian civet), Paradoxurus hermaphrodities (common palm civet), Herpestes edwardsii (grey mongoose), Prionailurus bengalensi (leopard cat), Pardofelis marmorata (marbled cat), Panthera pardus (leopard), Panthera tigris (tiger), Elephas maximus (elephant), Sus scrofa (wild pig), Muntiacus muntjak (barking deer), Naemorhedus sumatraensis (Himalayan serow), Ratufa bicolor (Malayan giant squirrel), Callosciurus pygerythrus (hoary-bellied squirrel), Dremomys lokriah (orange-bellied Himalayan squirrel), Petaurista petaurista (common flying squirrel), Bandicota indica (large bandicoot rat) and Hystrix brachyuran (Chinese porcupine), etc.; AND WHEREAS, the Kane Wildlife Sanctuary has many species of resident and migratory birds including Lophura leucomelanos (Kalij pheasant), Picus flavinucha (greater yellow nape woodpecker), Megalaima lineate (Lineated barbet), Halcyon coromanda (ruddy kingfisher), Centropus bengalensis (lesser coucal), Otus spilocephalus (Mountain scopes owl) and Ducula badia (Mountain imperial pigeon), etc.; AND WHEREAS, the Kane Wildlife Sanctuary conserves and supports the herpetofauna broadly comprising of amphibians including Duttaphrynus melanostictus (Common toad), Hyla annectans (Indian hylid frog), Microhyla ornate (Ornamental pigmy frog), Amolops assamensis (Assamese cascade frog) and Rhacophorus maximus (Large tree frog). The Sanctuary supports the survival of reptiles including Calotes sp., Japalura sp., Varanus sp., Eutrophis sp., Lygosoma sp., Python sp., Ahaetulla sp., Amphiesma sp., Bungarus sp., Naja sp., Ophiophagus sp., Cuora sp., Pangshura sp., the Sanctuary also supports the aquatic species like Danio sp., Barilius sp., Semiplotus sp., Puntius sp., Tor sp., Chagunius sp. and Garra sp. etc.; AND WHEREAS, the Kane Wildlife Sanctuary also conserves, protect and provides shelter to many threatened species like elephants, tigers, rhesus macaque, deer, etc.; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of the Kane Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0.05 kilometres to 0.50
kilometres around the boundary of the Kane Wildlife Sanctuary, in West Siang district in the State of Arunachal Pradesh as the Kane Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco- sensitive Zone) details of which are as under, namely: -

1. Extent and boundaries of Eco-sensitive Zone.–(1) The Eco-sensitive Zone shall be to an extent of 0.05 kilometres to 0.50 kilometres around the boundary of the Kane Wildlife Sanctuary and the area of the Eco-sensitive Zone is 6.8302 square kilometres.
   (2) The boundary description of the Kane Wildlife Sanctuary and its Eco-sensitive Zone is appended as

19 Annexure-I. (3) The maps of the Kane Wildlife Sanctuary demarcating the Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB and Annexure-IIC. (4) Lists of geo-coordinates of the boundary of the Kane Wildlife Sanctuary and the Eco-sensitive Zone are given in Table A and Table B of Annexure-III. (5) There are no villages inside the proposed Eco-sensitive Zone of the Kane Wildlife Sanctuary. 2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco- sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj; and (xi) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the Regional Town Planning Act and other rules and regulations of the Central Government or the State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as :- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including homestay; and (v) promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.-(a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended

21 from time to time) with emphasis on eco-tourism, eco-education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within the Eco-sensitive Zone area.
(4) Natural heritage.-All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.-Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution.-Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.-Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.-Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by the State Government, whichever is more stringent. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (10) Bio-Medical Waste.–Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.-The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.-The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.–The vehicular movement of traffic shall be regulated in a habitat friendly manner and

specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.-Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.–(a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (b) Only non-polluting industries shall be allowed within the Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.-The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.-All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment Act and the rules made thereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act, 1972 (53 of 1972) and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl. (a) All new and existing mining (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within the Eco- sensitive Zone; (b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012. 2.
Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted: Provided that non-polluting industries shall be allowed within the Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition the non- polluting cottage industries shall be promoted.

River poisoning. Prohibited. 12.
Use of explosives. Prohibited. 13.
Establishment of new wood based industries within one kilometer from the boundary of the Sanctuary. Prohibited. B. Regulated Activities 14.
Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of the Eco- sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities: Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 15.
Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub- paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents. Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
16.
Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro- based industry producing products from indigenous materials from the Eco-sensitive Zone shall be

permitted by the competent Authority. 17.
Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 18.
Collection of Forest produce or Non-Timber Forest produce. Regulated as per the applicable laws. 19.
Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws (underground cabling may be promoted).

Infrastructure including civic amenities. Taking measures of mitigation as per the applicable laws, rules, regulations and available guidelines. 21.
Widening and strengthening of existing roads and construction of new roads. Taking measures of mitigation as per the applicable laws, rules, regulations and available guidelines.
22.
Undertaking other activities related to tourism like flying over the Eco-sensitive Zone area by
hot air balloon, helicopter, drones, microlites, etc. 23.
Protection of hill slopes and river banks. 24.
Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
25.
Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted as per the applicable laws for use of locals. 26.
Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies. Regulated (except otherwise provided) as per the applicable laws except for meeting local needs. 27.
Discharge of treated waste water or effluents in natural water bodies or land area. The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water or effluent shall be regulated as per the applicable laws.

Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- Sl. 6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The tenure of the Monitoring Committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure-IV. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
