पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय अिधसूचना नई ᳰद᭨ ली, 15 नव᭥ बर, 2016 का.आ. 3517(अ).—भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा अिधसूचना सं. 2386(अ), तारीख 31 अग᭭त, 2015 ᳇ारा उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उᲦ राजपᮢ कᳱ ᮧितयां, िजसमᱶ उᲦ अिधसूचना अंतᳶव᳥ है, जनता को उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप या सुझाव आमंिᮢत करते ᱟए एक ᮧाᱨप अिधसूचना, भारत के राजपᮢ, असाधारण मᱶ ᮧकािशत कᳱ गई थी;

और, जनता और पणधाᳯरयᲂ से कोई आᭃेप और सुझाव ᮧा᳙ नहᱭ ᱟए हᱹ;

और, बराइला लेक सालेम अली जु᭣ बा सहानी पᭃी अभयार᭛य, िज सका कुल ᭃेᮢ 197.91 हे᭍टेयर (489.04 एकड़) है, िब हार के उ᭜ तरी मैदान मᱶ वैशाली िज ले के पाटेपुर ᭣ लॉक के झील बराइला ᮕाम मᱶ (गांव का कुल ᭃेᮢ 1278.03 हे᭍ टेयर या 3158.01 एकड़ है) ि᭭ थ त है और 25045'58'' और 25045'37'' उᱫर अᭃांश के म᭟ य तथा 85031'48'' और 85034'50'' पूवᱮ अᭃांश के म᭟ य ि᭭ थ त है;

और, बराइला लेक पᭃी अभयार᭛य और उसके सटे ᱟए ᭃेᮢ गंगा के मैदान के तटीय जोन मᱶ जल िव ᭄ान संबंधी और नमभूिम तथा जलीय पाᳯर ि᭭ थ ित क तंᮢ संबंधी ᳰᮓ याᲐ तथा ᭭ थानीय और ᮧवासी पᭃीजीव के वास ᭭ थान होने के साथ िव िभ ᭠ न ᮧकार कᳱ जलीय वन᭭ पित तथा जीवजंतु के ᮧाकृित क ᭭ थान हो, से पाᳯर ि᭭ थ ित क अपᳯर िम त और पयाᭅवरणीय मह᭜ व का है;

और, अभयार᭛य मᱶ भारतीय समुᮤी पᭃी, लाल जंतुक फा᭎ ता, एिश यन कोयल, छोटा बीकैचर, ᮩᳬी ᭭ टारलेट और इंिड यन ᮝी पाई जैसे मह᭜ वपूणᭅ आवासीय पᭃी और ᭣ लैक इ᭣ स, ᮩᳬी शैल डक, बार हेिड ड घूस, ऑᳯर यंटल मगपइ रोिब न और लेसर ᭪ हे᭭ टिल ग डक जैसे कुछ ᮧवासी पᭃी पाए जाते हᱹ; और, बराइला लेक सालेम अली जु᭣ बा सहानी पᭃी अभयार᭛ य के चारᲂ ओर के संरिᭃ त ᭃेᮢ को िज सका िव ᭭ तार और सीमाएं इस अिध सूचना के पैरा 1 मᱶ िव ᳶन ᳰद᭬ ट है, पाᳯर ि᭭ थ ित क और पयाᭅवरणीय दृि᭬ ट कोण से पᳯर ि᭭ थ ित क संवेदी जोन के ᱨप मᱶ संरिᭃ त और सुरिᭃ त करना और उ᭍ त पाᳯर ि᭭ थित क संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲄ तथा उनकᳱ संᳰᮓ याᲐ और ᮧसं᭭ करणᲂ को ᮧित िष ᳍ करना आव᭫ यक हो गया है;

अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठ त पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, िब हार रा᭔ य मᱶ बराइला लेक सालेम अली जु᭣ बा सहानी पᭃी अभयार᭛ य कᳱ सीमा से 100 मीटर से 3.5 ᳰक लोमीटर तक के पᳯरवतᱮ िव᭭ ताᳯरत ᭃेᮢ को बराइला लेक सालेम अली जु᭣ बा सहानी पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया है) के ᱨप मᱶ अिधसूिचत करती है, िजसके ᭣ यौरे िन᳜ानुसार है, अथाᭅत् :--
1.
पाᳯरि᭭थितक संवेदी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭थितक संवेदी जोन का िव ᭭ तार बराइला लेक सालेम अली जु᭣ बा सहानी पᭃी अभयार᭛ य कᳱ सीमा से 100 मीटर से 3.5 ᳰक लोमीटर मᱶ पᳯरवᳶतत है । पाᳯरि᭭थितक संवेदी जोन का ᭃेᮢ 1083.55 हे᭍ टेयर है ।
(2) पाᳯरि᭭थितक संवेदी जोन और पᭃी अभयार᭛य कᳱ सीमा का िव वरण उपाबंध I के ᱨप मᱶ सलं᭏ न है। (3) पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा के मानिच ᮢ के साथ उसके अᭃांश और देशांतर उपाबंध II के ᱨप मᱶ संल᭏ न है ।
(4) ऐसे गांव, िज नका ᭃेᮢ या उसका भाग पाᳯरि᭭थितक संवेदी जोन के भीतर आता है, झील बाराइला और लोमा है । 2. पाᳯरि᭭ थितक संवेदी जोन के िलए आंचिलक महायोजना--(1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए, राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ ᳰदए गए अनुबंधᲂ के अनुसरण मᱶ एक आंचिलक महायोजना तैयार करेगी।
(2) आंचिलक महायोजना का रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोदन ᳰक या जाएगा ।
(3) पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप मᱶ ऐसी रीित मᱶ रा᭔ य सरकार तथा सुसंगत कᱶᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य मᱶ भी तथा कᱶᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷश, यᳰद कोई हᲂ, ᳇ारा तैयार होगी । (4)
आंचिलक महायोजना सभी संबंिध त रा᭔ य िव भागᲂ कᳱ परामशᭅ से उनके उस पर एकᳱकृत पयाᭅवरणीय और पाᳯरि᭭थितक िव चारᲂ से तैयार ᳰक या जाएगा, अथाᭅत् :-- (i) पयाᭅवरण ; (ii) वन ;
(iii) शहरी िवकास ; (iv) पयᭅटन ; (v) नगरपािलका ; (vi) राज᭭ व ;
(vii) कृिष ; और (viii) िब हार रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ ।

आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᳥ न हᲂ और आचंिलक महायोजना मᱶ सभी अवसंरचना ᳰᮓयाकलापᲂ मᱶ दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी । ) 6 (

आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान देना आव᭫यक है, के िलए उपबंध हᲂगे । ) 7 (

आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कडᲂ, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी । ) 8 (

आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭ थितक अनुकूल िवकास और ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करते ᱟए िविनयिमत होगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जाने वाले उपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :-- (1) भू-उपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद सं. 23, सं. 27, सं. 32 और सं. 37 के सामने सूचीब᳍ ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-
(i) ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग; (ii) पाᳯर ि᭭ थ ित क अनुकूल पयᭅटन ᳰᮓ याकलापᲂ के िल ए, पयᭅटकᲂ के अ᭭ थायी अिध भोग के िल ए पाᳯर ि᭭ थ ित क अनुकूल कुटीर जैसे टे᭠ ट, का᳧ गृह;
(iii) वषाᭅ जल संचय; और (iv) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग भी हᱹ : परंतु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा :
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ के᭠ ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना देनी होगी ।
परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा ।
परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु᭍ त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।

(2) ᮧाकृितक जल ᮲ोतᲂ -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष᳍ करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे । (3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, जो आंचिलक महायोजना का भाग ᱨप मᱶ िन᳜िलिखत ᱨप मᱶ हᲂगे ।
(ख) पयᭅटन महायोजना पयᭅटन िवभाग, िब हार सरकार ᳇ारा राज᭭ व और वन िवभाग, िब हार सरकार के परामशᭅ से तैयार होगी ।
(ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :- (i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा जारी (समय-समय पर यथा संशोिधत) पाᳯरि᭭थितक पयᭅटन, मागᭅिनदेशᲂ के अनुसार होगा िजसमᱶ पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व ᳰदया जाएगा और पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(ii) पाᳯरि᭭ थितक संवेदी जोन के भीतर होटल और सैरगाहᲂ के नए संिनमाᭅण अनु᭄ात नहᱭ हᲂगे ; (iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा । (4) नैसᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । (5) मानव िनᳶमत िवरासत ᭭ थलᲂ - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदूषण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग, वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।
(7) वायु ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदूषण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग, वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, जल (ᮧदूषण िनवारण तथा िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा । (9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा - (i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ; (ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के

5 िलए योजनाएं तैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा ।
(10) जैव िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन. 343(अ) तारीख 28 माचᭅ, 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा । (11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होने तक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी । 4. पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧितिष᳍ और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत् :--
सारणी ᮓम सं. ᳰᮓयाकलाप टीका-ᳯट᭡पणी (1) (2) (3) क. ᮧितिष᳍ ᳰᮓयाकलाप : (1) वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइयां । (क) सभी ᮧकार के खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़ने कᳱ इकाइयां वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ के िसवाय नहᱭ हᲂगी ; (ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदेश के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।
(2) आरा िमलᲂ कᳱ ᭭थापना, िव नीर िमलᱶ या का᭬ ठ आधाᳯर त उ᳒ोग । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(3) ऐसे उ᳒ोगᲂ कᳱ ᭭थापना, िजनसे जल या वायु या मृदा या ᭟विन ᮧदूषण काᳯरत होता है ।
पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧदूषण फैलाने वाले ᳰकसी नए उ᳒ोग को लगाने या उसके िव᭭तार कᳱ अनु᭄ा नहᱭ दी जाएगी ।
(4) जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । (5) नई ᮧमुख जल िव᳒ुत पᳯरयोजनाᲐ कᳱ ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) ।

(6) ᭡ लाि᭭ टक के थैलᲂ का उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । (7) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । (8) ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) ।

ख. िविनयिमत ᳰᮓयाकलाप: (9) वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी । (10) होटलᲂ और ᳯरसोटᲄ कᳱ वािणि᭔यक ᭭थापना । पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी ᳞वसाय के िलए आवास के संबंध मᱶ संरिᭃत ᭃेᮢ कᳱ सीमा के एक ᳰकलोमीटर या पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक, जो भी िनकट हो, के भीतर ही नए वािणि᭔यक होटलᲂ और ᳯरसोटᲄ को अनु᭄ात ᳰकया जाएगा अ᭠यथा नहᱭ : पर᭠तु व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनुᱨप होगा ।
(11) पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा अभयार᭛य
ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । (12) संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन जो भी िनकट हो कᳱ सीमा से एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा: परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप-पैरा (1) मᱶ सूचीब᳍ ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करने कᳱ अनुमित दी जाएगी ।
(ख) पर᭠तु यह और ᳰक ऐसे लघु उ᳒ोगᲂ जो ᮧदूषण उ᭜ प᭠ न नहᱭ करते हᱹ, से संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखे जाएंगे । (ग) एक ᳰकलोमीटर से आगे और पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक वा᭭ तिवक ᭭ थानीय आव᭫ यकताᲐ के िलए संिनमाᭅण कᳱ अनु᭄ा दी जाएगी और अ᭠ य वािणि᭔ यक संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुᱨप हᲂगे। (13) वािणि᭔यक जल संसाधन िजसके अंतगᭅत भू-जल संचयन भी है । (क) भूिम के अिधभोगी के वा᭭तिवक कृिष और घरेलू खपत के िलए जल का िन᭬कषᭅण (सतही और भूिमगत जल) अनु᭄ात होगा ।

7 (ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत जल का िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण पूवᭅ िलिखत अनु᭄ा अपेिᭃत होगी िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी है ।
(ग) सतही या भूजल का िवᮓय अनु᭄ात नहᱭ होगा ।
(घ) ᳰकसी ᮲ोत जल, िजसके अंतगᭅत कृिष भी है, के संदूषण या ᮧदूषण को रोकने के िलए सभी उपाय ᳰकए जाएंगे ।
(14) कृिष ᮧणािलयᲂ मᱶ आमूल पᳯरवतᭅन । (15) िव᳒ुत केबलᲂ, पारेषण लाइनᲂ और दूरसंचार टावरᲂ का पᳯरिनमाᭅण । भूिमगत केबलᲂ को ᮧो᭜ साहन देना ।
(16) होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना । (17) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदृढ करना तथा नई सड़कᲂ, रेल पटरी का संिनमाᭅण । उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाय यथा लागू अनुसार हᲂगे । (18) रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे । (19) िवदेशी ᮧजाितयᲂ को लाना । (20) पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । (21) वािणि᭔ यक साइनबोडᭅ और होᳺडग । (22) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करना और अवमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा ।
(23) ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन से गैर ᮧदूषण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष, पु᭬ प कृिष, कृिष उ᳒ान या कृिष आधाᳯरत उ᳒ोग, जो देशीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन करते हᱹ और जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते हᱹ, को अनु᭄ात ᳰकया जाएगा ।
(24) वन उ᭜पादᲂ और गैर का᳧ वन उ᭜पादᲂ का संᮕहण । (25) सुरᭃा बलᲂ के कᱹप ।
(26) नए का᭬ ठ आधाᳯरत उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन के भीतर नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना अनु᭄ात नहᱭ होगी : परंतु पाᳯरि᭭ थितक संवेदी जोन मᱶ 100% आयाितत का᭬ ठ ᭭ टाक उपभोग करने वाले नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना कᳱ जा
सकेगी ।
(27) पाᳯर ि᭭ थ ित क अनुकूल पयᭅटन ᳰᮓ याकलापᲂ के िल ए, पयᭅटकᲂ के अ᭭ थायी अिध भोग के िल ए पाᳯर ि᭭ थ ित क अनुकूल कुटीर जैसे टे᭠ ट, का᳧ गृह ।

(28) नᳰद यᲂ और ᮧाकृित क जल ᭭ ᮢोतᲂ मᱶ मछली पकड़ना । (29) ठोस अपिश᳥ ᮧबंधन । (30) पाᳯरि᭭थितक-पयᭅटन । ग- संवᳶधत ᳰᮓयाकलाप : (31) ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष, जल कृिष और मछली पालन । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे । (32) वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
(33) जैिवक खेती । सᳰᮓ य ᱨप से बढावा ᳰदया जाए । (34) सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना ।
सᳰᮓ य ᱨप से बढावा ᳰदया जाए । (35) नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे । (36) वान᭭ पितक बाड़ । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे । (37) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी हᱹ । सᳰᮓ य ᱨप से बढावा ᳰदया जाए । (38) कृिष वािनकᳱ । (39) पयाᭅवरणीय जागᱧकता ।
5. पाᳯरि᭭थितक संवेदी जोन मानीटरी सिमित.—(1) कᱶᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :-
(क) िजला कले᭍टर, वैशाली िजला - अ᭟यᭃ; (ख) िब हार सरकार के राज᭭ व िव भाग का ᮧित िन िध – सद᭭ य; (ग) िब हार सरकार के जल संसाधान िव भाग का ᮧित िन िध - सद᭭य;
(घ)
िब हार सरकार के लोक िन माᭅण िव भाग का ᮧित िन िध – सद᭭य; (ङ)
िब हार सरकार के रा᭔ य ᮧदूषण िन यंᮢण बोडᭅ, पटना का ᮧित िन िध - सद᭭य; (च) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ (िजसके अंतगᭅत िवरासत संरᭃण भी है) का ᮧ᭜येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए िबहार रा᭔य सरकार ᳇ारा नामिन᳸द᳥ एक ᮧितिनिध - सद᭭य;
(छ) िबहार सरकार ᳇ारा नामिन᳸द᭬ ट पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ ᮧ᭜येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए एक िवशेष᭄ – सद᭭ य; (ज) रा᭔य जैव िविवधता बोडᭅ का ᮧितिनिध– सद᭭ य; और (झ) ᮧभागीय वन अिधकारी, वैशाली िजला – सद᭭य सिच व।

9 िनदᱷश िनबंधन :

(1) मानीटरी सिमित कᳱ अविध तीन वषᭅ कᳱ होगी ।

(2) पाᳯरि᭭थितक संवेदी जोन मानीटरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी । (3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष᳍ गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी।
(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया है, परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते हᱹ, ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब᳍ िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(5) मानीटरी सिमित का सद᭭य-सिचव या संबिधत उप संरᭃक वन/उ᳒ान और अभयार᭛य, कोई ᳞िᲦ जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता है, उसके िवᱧ᳍ पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा । (6) मानीटरी सिमित मु᳎ा दर मु᳎ा के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब᳍ पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी । (7) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मु᭎य व᭠य जीव वाडᭅन को उपाबंध III मᱶ उपबंिधत ᱨप िवधान के अनुसार उ᭍ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी । (8) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे । 6.
इस अिधसूचना के उपबंधᲂ को ᮧभाव देने के िलए कᱶᮤीय सरकार और रा᭔ य सरकार अितᳯर᭍ त उपाय, यᳰद कोई हᲂ, िविन᳸द᭬ ट कर सकᱶगे ।
7. माननीय भारत के उᲬतम ᭠यायालय या उᲬ ᭠यायालय या रा᭬ ᮝीय हᳯरत ᮧािधकरण ᳇ारा पाᳯरत कोई आदेश या पाᳯरत होने वाले ᳰकसी आदेश, यᳰद कोई हᲂ, के अधीन, इस अिधसूचना के उपबंध हᲂगे । [फा. सं. 25/31/2015-ईएसजेड/आरई] डॉ. टी. चांदनी, वै᭄ािनक ‘जी’

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 15th November, 2016 S.O. 3517(E).—WHEREAS, a draft notification was published by the Government of India in the Ministry of Environment, Forest and Climate Change in the Gazette of India, Extraordinary, vide notification number S.O. 2386(E), dated 31st August, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, no objections and suggestion received from public or stake holders; AND WHEREAS, the Baraila Lake Salim Ali Jubba Sahni Bird Sanctuary with an aggregate area of 197.91 hectare (489.04 acres), is situated in the northern plains of Bihar in the wetlands of Jheel Baraila village (total area of village being 1278.03 hectare or 3158.01 acres) of Patepur Block of Vaishali District and located between 25o45’58” and 25o45’37” North latitude and between 85o31’48” and 85o34’50” East longitude;
AND WHEREAS, the Baraila Lake Bird Sanctuary and its adjoining areas are of immense ecological, and environmental importance by way of performing hydrological and wetland and aquatic ecosystem functions of riverine zone in Gangetic plains and habitat of various aquatic flora and fauna along with home to local and migratory avifauna;
AND WHEREAS, the Indian Shag, Red collard dove, Asian Koel, Small Beecatcher, Brahmany starlet and Indian tree pie are the important residential birds, Black Ibis, Brahmany Shell Duck, Bar-headed Goose, Oriental Magpie Robin and Lesser Whistling duck are some of the migratory birds found in the Sanctuary; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of the Baraila Lake Salim Ali Jubba Sahni Bird Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 100 metre to 3.5 kilometre from the boundary of the Baraila Lake Salim Ali Jubba Sahni Bird Sanctuary in the State of Bihar as the Baraila Lake Salim Ali Jubba Sahni Eco-sensitive Zone (hereinafter referred to as the Eco- sensitive Zone), details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone.—(1)The extent of Eco-sensitive Zone varies from 100 metres to 3.5 kilometres from the boundary of the Baraila Lake Salim Ali Jubba Sahni Bird Sanctuary. The area of Eco-sensitive Zone is 1083.55 hectare. (2) The boundary description of the Eco-sensitive Zone and bird sanctuary is appended as Annexure I. (3) The map of Eco-sensitive Zone boundary together with its latitude and longitude is appended as Annexure II. (4) The villages whose area or parts thereof falling within the Eco-sensitive Zone are, Jhil Baraila and Loma. 2. Zonal Master Plan for the Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The Zonal Master Plan shall be approved by the competent authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- i. Environment; ii. Forest; iii. Urban Development;

13 iv. Tourism; v. Municipal; vi. Revenue; vii. Agriculture; and viii. Bihar State Pollution Control Board, for integrating environmental and ecological considerations into it. (5)
The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development and livelihood security of local communities. 3. Measures to be taken by State Government.—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 23, 27, 32 and 37 in column (2) of the Table in paragraph 4, namely:- (i)
Small scale industries not causing pollution; (ii)
Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for eco-friendly tourism activities; (iii) Rainwater harvesting; and (iv)
Cottage industries including village artisans: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs.—The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism.—(a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Bihar in consultation with Department of Revenue and Forests, Government of Bihar.
(c) The activity of tourism shall be regulated as under, namely.-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the eco-tourism guidelines issued by the National Tiger Conservation Authority, Ministry of Environment, Forest and Climate Change (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone; (ii)
new construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone; (iii)
till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.—The Environment Department of the State Government shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. (7) Air pollution.—The Environment Department of the State Government shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder. (9) Solid wastes.—Disposal of solid wastes shall be as under.- (i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357(E), dated the 8th April, 2016.
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco- sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone. (10) Bio-medical waste.—The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343(E), dated the 28th March, 2016. (11) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in State Government. The Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.—All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:-

Setting up of industries causing water or air or soil or noise pollution. No new or expansion of existing polluting industries shall be permitted within the Eco-sensitive Zone. 4.

Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. 5.

Establishment of new major hydroelectric projects. Prohibited (except as otherwise provided) as per applicable laws. 6. Uses of plastic carry bags.

Prohibited (except as otherwise provided) as per applicable laws. 7.

Discharge of untreated effluents and solid waste in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws. 8.

Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. B. Regulated Activities: 9.

Felling of trees. (a) There shall be no felling of trees on the forest land or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under. 10.

Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities:
Provided that, beyond one kilometer or up to the extent of the Eco-sensitive Zone, all new tourism activities or expansion of existing activities shall be in conformity with the Tourism Master Plan. 11.

Undertaking activities related to tourism like rope ways, over-flying the sanctuary area by hot- air balloons, etc. Regulated under applicable laws.

12.

Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer. Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3:
(b) Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per the applicable rules and regulations, if any. (c) Beyond one kilometre upto the extent of Eco- sensitive Zone, construction for bone fide local needs shall be allowed and other construction activities shall be regulated as per the Zonal Master Plan.
13.

Commercial water resources including ground water harvesting. (a)The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land. (b) The extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned regulatory authority. (c) No sale of surface water or ground water shall be permitted. (d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture. 14.

Drastic change of agriculture system. Regulated as per applicable laws. 15.

Erection of electrical cables, Transmission lines and telecommunication towers. Promote underground cabling. 16.

Fencing of existing premises of hotels and lodges. 17.

Widening and strengthening of existing roads and construction of new roads, rail tract. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable. 18.

Movement of vehicular traffic at night. Regulated for commercial purpose, under applicable laws. 19.

Introduction of exotic species.

Eco-sensitive Zone Monitoring Committee.—The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:- (a) District Collector, District Vaishali- Chairman; (b) A representative of the Revenue Department, Government of Bihar- Member; (c) A representative of the Water Resource Department, Government of Bihar– Member; (d) A representative of the Public Works Department, Government of Bihar – Member; (e) A representative of Bihar State Pollution Control Board, Patna-Member;
(f) A representative of Non-governmental Organizations working in the field of environment (including heritage conservation) to be nominated by the Government of Bihar for a term of three year – Member; (g) One expert in the area of ecology and environment to be nominated by the Government of Bihar - Member;
(h) Representative of State Bio Diversity Board-Member and (i) Divisional Forest Officer, District Vaishali- Member-Secretary. Terms of Reference: (1) The tenure of the Monitoring Committee is for three years. (2)
The Monitoring Committee shall monitor the compliance of the provisions of notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,

shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification. (6)
The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State per pro forma appended at Annexure III. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 7. Sanctuary, Bihar. The sanctuary is constituted of segments (aggregate area: 197.91 hectare) which are embedded within the village Jheel Baraila (area: 1278.03 hectare) except one segment in the south east where it touches the boundary of village Jheel Baraila; therefore the boundaries of Eco-sensitive Zone will be as follows: (a) The Eco-sensitive Zone will be bound by the boundary of village Jheel Baraila over all segments of the sanctuary except one specified in (b) here below; (b) For the segment in the south east which touches the boundary of village Jheel Baraila, the boundary of the Eco- sensitive Zone will extend to 100 metre in village Loma; (c) The Eco-sensitive Zone delineated as above will be bound by Chakaiya village (Thana No. 496) and Kawai Barailla village (Thana No. 580) in the north, Amthanwa village (Thana No. 579) in the north east, Mahathi Dharamchand village (Thana No. 493) in north west and Dih Buchauli village (Thana No. 616), Dulwar village (Thana No. 615) and Loma village (Thana No. 613) in the south and Mansingpur Bijhrauli village (Thana No. 612) in the south west and west which are administratively located in Patehpur and Jandaha blocks of Vaishali District; (d) The width of the Eco-sensitive zone on different sides from the sanctuary will be 100 metres or more except at one place in the north east where it will be 50 metres and more and at one place in the south where a tiny segment touches the boundary of village jheel Bariala where the width will be nil metre; (e) The area of Eco-sensitive Zone will be 1080.55 hectares in village Jheel Baraila (being the residual area of the village after accounting for the area of the sanctuary 197.91 ha) and 3.0 hectares in village Loma (being the area of the sector of Eco-sensitive Zone extending in village Loma).
