निš भारत के राजपत्र, असाधारण में प्रकाशिSत किœया गया थां, जिसमें उन सभी व्यक्ति यों से, जिनके उससे प्रभावि¢त होते की संभावना थी, उस तारीख से, जिसको भारत के राजपत्र में प्रकाशिSत रूप में उक्त अधिPसूचना की प्रतियां जनता को उपलब्ध करा दी गई थीं, साठ दिvन की समाप्ति© के पूर्वf आक्षेप और सुझाव मांगे गए थे ; और, उक्त अधिPसूचना से उपाबद्ध राजपत्र की प्रतियां तारीख 3 जनवरी, 2014 को जनता को उपलब्ध करा दी गई थी ; और, उक्त प्रारुप अधिPसूचना के प्रत्युत्तर में सभी व्यक्ति यों और पणधारिnयों से प्राप्त सभी आक्षेपों और सुझावों पर केंद्रीय सरकार द्वारा सम्यक्‌ रूप से वि¢चार कर लिµया गया है; f- और, केंद्रीय सरकार ने वि¢चार किœया है किœ पुलीकट झील आंध्र प्रदेश और तमि¸लनाडु में फैली हुई भारत में दूसरी सबसे बड़ी at पानी की समुद्रताल/तट मग्न भूमि¸ है जिसमें शीतकऋतु के प्रवासी पक्षी आते हैं और यह वि¢श्निÁज्न जलचर और स्थलचर पक्षिÄयों जैसे age और लघु हंसावरों, जांघिÇलों, बड़े और करछिÉया बगुलों, भूरे हवासिËलों, भूरे बगुलों और जल पक्षिÄयों जैसे उत्तरी सीखपर, श्यामपंखी बड़ा पनेवा, उत्तरी तिदारिnयों, सामान्य चैती, सामुद्रिÏक, कुरकी, टिÑटिÑहरी, बटान, टिÑकरी, गुलिµंदा आदिv के लिµए एक महत्वपूर्णf भोजन स्थल है, और शीत के दौरान आने वाले प्रवासी पक्षिÄयों की बड़ी संख्या के लिµए प्रसिËद्ध है क्योंकिœ झील भोजन और परभक्षिÄयों से सुरक्षा प्रदान करती है। और, अभयारण्य जिला नैल्लोर के पांच मंडलों ताडा, सुल्लुस्पेट, डोरावेरीसतरम, चिÚत्तामूर, और वाकाडु को आच्छादिvत करते हुए लगभग 460 वर्गf किœलोमीटर में वि¢स्तारिnत है ; और, अभयारण्य क्षेत्र में श्रीहरिnकोटा द्वीप पर कच्छ वनस्पति, तटीय वनस्पति और बैंतझाड़ी से वि¢कीर्णिßàत दक्षिÄणी 2845 GI/2015 (1)

2 THE GAZETTE OF INDIA: EXTRAORDINARY SC GAZETTE OF INDIA: EXTRAORDINARY [PART II—SEC. 360] II—SEc. 3(ii)] उष्णकटिÑबन्धी शुष्क सदाबहार वनों के अवशेषों के अतिमहत्वपूर्णf खंड हैं जो अत्यंत वानस्पतिक महत्व का है; और, इस अभयारण्य में प्राणी जात के मुख्य प्रवर्गf हैं जिसमें अन्य के साथ-साथ जिसके अंतर्गfत अकशेरुकिœयों में झींगा, समुद्री झींगा, केकड़ा, प्राणीप्लवक, सीलन्टरेट, एनेलिµड, मोलस्क और शूलचर्मीê, मत्स्य की 168 प्रजातियां, afer छिÉपकली, fra, नाग, रसल घोषारु, FUT, वनशूकर, जंगली बिíल्ली और सिËयार तथा वि¢भिïन्‍न पक्षी वर्गf हैं; और, मुख्य पक्षी प्रजातियों, जो पुलीकट झील में बृहद हंसावर (प्रत्येक वर्षf लगभग 30,000 हंसावर पुलीकट में आते हैं) और ऐसे अन्य भरण प्रवासी पक्षी जैसे पैलीकन, जांघिÇल, वि¢वृत चंचु वलॉक, धूसर बगुले, जलकॉक, श्वेत बुज्जा, दाबिíल, बगुला, जलशैल बगुले, चकत्ता चंचु बतख, उत्तरी तिदारी, उत्तरी सीखपर, बलुई पाईपर्सf, सामुद्रिÏक और नदी कुरकी भी हैं ; और, बृहद हंसावर (फोनिšकोप्टैरस रोजस) प्रजनन स्थल कच्छ के रण से आते हुए अक्तूबर के दौरान पुलीकट में आता है और अप्रैल के दौरान वापस लौटता है और इसे एक संकटापन्न प्रजाति के संरक्षण की आवश्यकता हैः और, पारस्थि‹तिक और पर्याefवरणीय दृष्टिûकोण से पुलीकट पक्षी अभयारण्य के संरक्षिÄत क्षेत्र के आसपास के क्षेत्र जिसकी सीमा और वि¢स्तार इस अधिPसूचना के पैराग्राफ में वि¢निšर्दिvàष्ट है, को पारस्थि‹तिक संवेदनशील क्षेत्र के रूप में संरक्षिÄत और सुरक्षिÄत करना और उक्त पारिnस्थि‹तिक संवेदी जोन उद्योग या उद्योगों के वर्गf और उनके प्रचालन और प्रसंस्करण को प्रतिषेध करना आवश्यक है; अतः, अब केंद्रीय सरकार पर्याefवरण (संरक्षण) निšयम, 1986 के निšयम 5 के उपनिšयम (3) के साथ पठिāत, पर्याefवरण (संरक्षण) 4 अधिPनिšयम, 1986 (1986 का 29) की धारा 3 की उपधारा (1 ), उपधारा (2) के खंड (५) और खंड (xiv) और उपधारा (3) द्वारा प्रदत्त शक्ति यों का प्रयोग करते हुए, आंध्र प्रदेश राज्य में पुलीकट पक्षी अभयारण्यके उत्तर से दक्षिÄण दो किœलोमीटर के क्षेत्र को THR स्थतिक संवेदनशील क्षेत्र के रूप में अधिPसूचिÚत करती है, जिसके ब्यौरे निšम्नलिµखिĆत हैं, अर्थाefत्‌ :--

1. पारिnस्थि‹तिक संवेदी जोन का वि¢स्तार और सीमाएं - (1) आंध्रप्रदेश राज्य में पुलीकट पक्षी अभयारण्य का पश्चिĉमी सीमा के साथ उत्तर से दक्षिÄण तक दो किœलोमीटर तक पारिnस्थि‹तिकी संवेदी जोन क। वि¢स्तार है। (2) पारिnस्थि‹तिक संवेदी जोन की सीमाओं का वि¢स्तृत वर्णfन. इस अधिPसूचना से उपाबंध | के रूप में उपाबद्ध है । (3) पारिnस्थि‹तिक संवेदी जोन की सीमा का मानचिÚत्र इस अधिPसूचना से अक्षांश और देशांतर के साथ उपाबंध 1 में भी उपाबद्ध है; (4) पुलीकट पक्षी अभयारण्य की सीमा से बाहर और पुलीकट पक्षी अभयारण्य wah जोन के भीतर आने वाले तेईस ग्रामों की सूची उनके अक्षांश और देशांतर के साथ प्रमुख बिíंदुओं पर इस अधिPसूचना में उपाबंध 111 के रूप में उपाबद्ध है: परंतु उपाबंध 1 में दी गई ग्रामों की सूची आंचलिµक महायोजना तैयार करते समय राज्य सरकार द्वारा और पुनरीक्षिÄत तथा पुष्टिû होगी
2. पारिnस्थि‹तिक संवेदी जोन के लिµए आंचलिµक महायोजना.- (1) राज्य सरकार, पारिnस्थि‹तिक संवेदी जोन के प्रभावी प्रबंध के प्रयोजन के लिµए, राजपत्र में इस अधिPसूचना के प्रकाशन की तारीख से दो वर्षf की अवधिP के भीतर, स्थानीय व्यक्ति यों के परामर्शf से और इस अधिPसूचना में दिvए गए अनुबंधों का पालन करते हुए, आंचलिµक महायोजना तैयार करेगी | (2) पारिnस्थि‹तिक संवेदी जोन के लिµए आंचलिµक महायोजना पुलीकट झील के संरक्षण के लिµए पारिnस्थि‹तिक सिËद्धांतों पर आधारिnत होगी। (3) आचंलिµक महायोजना राज्य सरकार में सक्षम प्राधिPकारी द्वारा अनुमोदिvत होगी। (4) पारिnस्थि‹तिक संवेदी जोन के लिµए आचंलिµक महायोजना इस अधिPसूचना में वि¢निšर्दिvàष्ट रूप में ऐसी रीति में राज्य सरकार तथा सुसंगत केंद्रीय और राज्य वि¢धिPयों के सामंजस्य में भी तथा केंद्रीय सरकार द्वारा जारी मार्गfनिšर्देĒश, यदिv कोई हों, द्वारा तैयार होगी । (5) आंचलिµक महायोजना, इसमें पर्याefवरणीय और पारिnस्थि‹तिक की वि¢चारों को समाकलिµत करने के लिµए निšम्नलिµखिĆत सभी संबद्ध राज्य सरकार के वि¢भागों के परामर्शf से तैयार होगी, अर्थाefत्‌:- (0) पर्याefवरण ; (ii) वन और वन्यजीवन ; (ii) . कृषिĔ; (iv) सड़क और भवन ; (vy) राजस्व ; (i) शहरी वि¢कास ; (vil) पर्यfटन ;

Camere 3] भारत ता चाजबन £ असम र कमकवकनऊ-+५+ंĚवायबय<ननाधयपपपपस+मतमय+री राजपत्र : असाधारण 3 (viii) ग्रामीण वि¢कास ; (ix) नगरपालिµक ; (x) पंचायत राज ; (xi) सिËंचाई; और 001) लोक निšर्माefण वि¢भाग | (6) आंचलिµक महायोजना अनुमोदिvत वि¢द्यमान भू-उपयोग, अवसंरचनात्मक और क्रिğयाकलापों पर कोई निšर्बfधन अधिPरोपिĢत नहीं करेगी जब तक किœ इस अधिPसूचना में और आचंलिµक महायोजना में सभी अवसंरचना और अधिPक प्रभावी और पारिnस्थि‹तिक अनुकूल क्रिğयाकलाप कारक इस प्रकार वि¢निšर्दिvàष्ट न हो | (7) आंचलिµक महायोजना में अनाच्छादिvत क्षेत्रों के जीर्णोĥद्धार, वि¢द्यमान जल निšकायों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, जल- संभरों के प्रबंधन, भूतल जल के प्रबंधन, मृदा और नमी संरक्षण, स्थानीय समुदायों की आवश्यकताओं तथा पारिnस्थि‹तिकी और पर्याefवरण से | संबंधिPत ऐसे अन्य पहलूओं, जिन पर ध्यान देना आवश्यक है, के लिµए उपबंध होंगे | ; (8) आंचलिµक महायोजना सभी वि¢द्यमान पूजा स्थलों, ग्रामों और नगरीय बंदोबस्तों, बनों के प्रकार और किœस्मों, कृषिĔ क्षेत्रों, ऊपजाऊ भूमि¸, हरिnत क्षेत्र, जैसे, उद्यात और उसी प्रकार के स्थान, उद्यान कृषिĔ क्षेत्र, फलोघान, झीलों और अन्य जल निšकायों का अभ्यकंन करेगी | (9) आंचलिµक महायोजना पारिnस्थि‹तिक संवेदी जोन में वि¢कास को पारिnस्थि‹तिक अनुकूल वि¢कास और स्थानीय समुदायों की जीवकोपार्जfन को सुनिšश्चिĉत करते हुए वि¢निšयमि¸त होगी | 3. राज्य सरकार द्वारा किœए जाने वाले उपाय-- राज्य सरकार, उस अधिPसूचना के उपबंधों को प्रभावी करने के लिµए निšम्नलिµखिĆत उपाय करेगी, अर्थाefत्‌ :- (1) भू-उपयोग - पारिnस्थि‹तिक संवेदी जोन में वनों, उद्यान-कृषिĔ क्षेत्रों, कृषिĔ क्षेत्रों, आमोद-प्रमोद के प्रयोजन के लिµए चिÚन्हिĪīत किœए गए पार्कोंĭ और खुले स्थानों का वाणिßज्यिİıक और औद्योगिijक संबद्ध वि¢कास क्रिğयाकलापों के लिµए उपयोग या संपरिnवर्तfन नहीं होगा : परंतु पारिnस्थि‹तिक संवेदी जोन के भीतर कृषिĔ भूमि¸ का संपरिnवर्तfन, मानीटरी समि¸ति की सिËफारिnश पर और राज्य सरकार के पूर्वf अनुमोदन से, स्थानीय निšवासिËयों की आवासीय जरूरतों को पूरा करने के लिµए और पैरा 4 की सारणी के स्तंभ (2) के अधीन मंद सं. 17, सं. 19, सं. 25, और सं. 27 के सामने सूचीबद्ध क्रिğयाकलापों को पूरा करने के लिµए अनुज्ञात होंगे, अर्थाefत्‌ :- 6) पर्याefवरण हिīतेशी पर्यfटन क्रिğयाकलापों के लिµए, पर्यfटकों के अस्थायी अभिïभोग के लिµए पर्याefवरण हिīतेशी कुटीर जैसे तम्बू काश्ठ के घर; (४) वि¢द्यमान सड़कों को चौड़ा करना और मजबूत बनाना; (ii) वर्षाef जल संचय; और (iv) Fer उद्योग, जिसके अंतर्गfत ग्रामीण उद्योग, भंडारण सुवि¢धाएं और स्थानीय सुवि¢धाएं भी हैं: परंतु यह और किœ राज्य सरकार के पूर्वf अनुमोदन के बिíना और संवि¢धान के अनुच्छेद 244 या तत्समय प्रवृत्त वि¢धिP के उपबंधों के अनुपालन के बिíना, जिसके अंतर्गfत अनुसूचिÚत जनजाति और अन्य परंपरागत वन निšवासी (वन अधिPकारों की मान्यता) अधिPनिšयम, 2006 (2007 का 2) भी है, वाणिßज्यिİıक या उद्योग वि¢कास क्रिğयाकलापों के लिµए जनजातीय भूमि¸ का उपयोग अनुज्ञात नहीं होगा : परंतु यह और भी किœ पारिnस्थि‹तिक संवेदी जोन के भीतर भू-अभिïलेखों में उपसंजात कोई त्रुटिÑ, मानीटरी समि¸ति के वि¢चार प्राप्त करने के पश्चात्‌ राज्य सरकार द्वारा प्रत्येक मामले में एक बार संशोधिPत होगी और उक्त त्रुटिÑ के संशोधन की भारत सरकार के पर्याefवरण, वन और जलवायु परिnवर्तfन मंत्रालय को सूचना देनी होगी : परंतु यह और भी किœ उपर्युĹfक्त त्रुटिÑ का संशोधन में इस उप पैरा के अधीन यथा उपबंधिPत के सिËवाय किœसी भी दशा में भू-उपयोग का परिnवर्तfन सम्मिĻ¸लिµत नहीं होगा | परंतु यह और भी किœ जिससे हरिnत क्षेत्र में जैसे वन क्षेत्र, कृषिĔ क्षेत्र आदिv में कोई पारिnणामि¸क कटौती नहीं होगी और अनप्रयुक्त या अनउत्पादक कृषिĔ क्षेत्रों में पुन: वनीकरण करने के प्रयास किœए जाएंगे | (2) प्राकृतिक स्लोतों - आचंलिµक महायोजना में सभी प्राकृतिक स्रोतों की पहचान की जाएगी और उनके संरक्षण और पुनरुद्भूतकरण के लिµए योजना सम्मिĻ¸लिµत होगी और राज्य सरकार द्वारा ऐसे क्षेत्रों पर या उनके निšकट के क्षेत्र, जिन्हें ऐसे क्षेत्र को अभ्यकंन है, में वि¢कास क्रिğयाकलाप प्रतिषिĔद्ध करने के लिµए ऐसी रीति से मार्गfनिšर्देĒश तैयार किœए जाएंगे ।

4 THE GAZETTE OF INDIA: EXTRAORDINARY [PART II—SEC. 3(ii)] (3) पर्यfटन — (क) पारिnस्थि‹तिक संवेदी जोन के भीतर पर्यfटन संबंधी क्रिğयाकलाप, पर्यfटन महायोजना के अनुसार होंगे, जो आंचलिµक महायोजना का भाग रूप में निšम्नलिµखिĆत रूप में होंगे । (ख) पर्यfटन महायोजना आंध्र प्रदे 1पर्यfटन वि¢भाग, द्वारा वन और पर्याefवरण वि¢भाग आंध्र प्रदे 1सरकार के परामर्शf से तैयार होगी। (ग) पर्यfटन संबंधी क्रिğयाकलाप निšम्नलिµखिĆत के अधीन वि¢निšयमि¸त होंगे, अर्थाefत्‌ :- () पारिnस्थि‹तिक संवेदी जोन के भीतर सभी नए पर्यfटन क्रिğयाकलापों या वि¢द्यमान पर्यfटन क्रिğयाकलापों का वि¢स्तार केंद्रीय सरकार के पर्याefवरण, वन और जलवायु परिnवर्तfन मंत्रालय, तथा राष्ट्रीय व्याप्र संरक्षण प्राधिPकरण, द्वारा जारी मार्गfनिšदेशों के अनुसार होगा जिसमें पारिnस्थि‹तिक पर्यfटन, पारिnस्थि‹तिक शिSक्षा और पारिnस्थि‹तिक वि¢कास को महत्व दिvया जाएगा और पारिnस्थि‹तिक संवेदी जोन की वहन क्षमता के अध्ययन पर आधारिnत होगा ; (1) पुलीकट पक्षी अभयारण्य की सीमा से एक किœलोमीटर के भीतर पारिnस्थि‹तिक अनुकूल पर्यfटन क्रिğयाकलाप से संबंधिPत पर्यfटन के अस्थायी अधिPभोग के लिµए आवासन के सिËवाय होटल और सैरगाहों के नए संनिšर्माefण अनुज्ञात नहीं होंगे : परंतु पारिnस्थि‹तिक संवेदी जोन का वि¢स्तार अभयारण्यकी सीमा से एक किœलोमीटर की दूरी से परे, नए होटलों और सैरगाहों की स्थापना पर्यfटन महायोजना के अनुसार पारिnस्थि‹तिक पर्यfटन सुवि¢धाओं के लिµए अभिïहिīत क्षेत्रों में अनुज्ञात होंगे । (iii) आंचलिµक महायोजना का अनुमोदन किœए जाने तक, पर्यfटन के लिµए वि¢कास और वि¢द्यमान पर्यfटन क्रिğयाकलापों के वि¢स्तार को वास्तवि¢क स्थल वि¢निšर्दिvàष्ट संवीक्षा तथा मानीटरी समि¸ति की सिËफारिnश पर आधारिnत संबंधिPत वि¢निšयामक प्राधिPकरणों द्वारा अनुज्ञात किœया होगा | (4) नैसर्गिijàक वि¢रासत .- पारिnस्थि‹तिक संवेदी जोन में महत्वपूर्णf नैसर्गिijàक वि¢रासत के सभी स्थलों जैसे सभी जीत कोश आरक्षिÄत क्षेत्र, शैल वि¢रचनाएं, जल प्रपातों, झरनों, घाटी मार्गोंĭ, उपवनों, गुफाएं, स्थलों, भ्रमण, अश्वरोहण, प्रपातों आदिv की पहचान की जाएगी और उन्हें संरक्षिÄत किœया जाएगा तथा उनकी सुरक्षा और संरक्षा के लिµए इस अधिPसूचना के प्रकाशन की तारीख से छह मास के भीतर, उपयुक्त योजना बनाएगी और ऐसी योजना आंचलिµक महायोजना का भाग होगा । (5) मानव निšर्मि¸àत वि¢रासत स्थलों .- पारिnस्थि‹तिक संवेदी जोन में भवनों, संरचनाओं, शिSल्प-तथ्य, ऐतिहासिËक, कलात्मक और सांस्कृतिक महत्व के क्षेत्रों की पहचान करती होगी और इस अधिPसूचना के प्रकाशन की तारीख से छह माह के भीतर उनके संरक्षण की योजनाएं तैयार करनी होगी तथा आंचलिµक महायोजना में सम्मिĻ¸लिµत की जाएगी | (6) ध्वनिš प्रदूषण .- पारिnस्थि‹तिक संवेदी जोन में ध्वनिš प्रदूषण के निšयंत्रण के लिµए राज्य सरकार का पर्याefवरण वि¢भाग, वायु (प्रदूषण निšवारण और निšयंत्रण) अधिPनिšयम, 1981 (1981 का 14) और उसके अधीन बनाए गए निšयमों के उपबंधों के अनुसरण में मार्गfदर्शfक सिËद्धांत और वि¢निšयम तैयार करेगा | (7) वायु प्रदूषण .- पारिnस्थि‹तिक संवेदी जोन में, वायु प्रदूषण के निšयंत्रण के लिµए राज्य सरकार का पर्याefवरण वि¢भाग, वायु (प्रदूषण निšवारण और निšयंत्रण) अधिPनिšयम, 1981 (1981 का 14) और उसके अधीन बनाए गए निšयमों के उपबंधों के अनुसरण में मार्गfदर्शfक सिËद्धांत और वि¢निšयम तैयार करेगा | (8) बहिīल्लाव का निšस्सारण .- पारिnस्थि‹तिक संवेदी जोन में उपचारिnत बहिīस्राव का निšस्सारण, जल (प्रदूषण निšवारण तथा निšयंत्रण) अधिPनिšयम, 1974 (1974 का 6) और उसके अधीन बनाए गए निšयमों के उपबंधों के अनुसार होगा । (9) ठोस अपशिSष्ट .- ठोस अपशिSष्टों का निšपटान निšम्नलिµखिĆत रूप में होगा :- (i) पारिnस्थि‹तिक संवेदी जोन में ठोस अपशिSष्टों का निšपटान भारत सरकार के तत्कालीन पर्याefवरण और वन मंत्रालय की समय-समय पर यथा संशोधिPत अधिPसूचना सं. का.आ. 908(अ), तारीख 25 सिËतंबर, 2000 नगरपालिµक ठोस अपशिSष्ट (प्रबंध और हथालन) निšयम, 2000 के उपबंधों के अनुसार किœया जाएगा ; (ii) स्थानीय प्राधिPकरण जैव निšम्नीकरणीय और अजैव निšम्नीकरणीय संघटकों में ठोस अपशिSष्टों के संपृथक्लन के लिµए योजनाएं तैयार करेंगे ; (1) जैव निšम्नीकरणीय सामग्री को अधिPमानतः खाद बनाकर या कृमि¸ खेती के माध्यम से पुनःचक्रिğत किœया जाएगा ; (iv) अकार्बfनिšक सामग्री का निšपटान पारिnस्थि‹तिक संवेदी जोन के बाहर पहचान किœए गए स्थल पर किœसी पर्याefवरणीय स्वीकृत रीति में होगा और पारिnस्थि‹तिक संवेदी जोन में ठोस अपशिSष्टों को जलाना या भष्मीकरण अनुज्ञात नहीं होगा |

(भागा-खण्ड iy) अभासतकाराजपत्र :असाधारण ऊ ाe+ 7 5. पारिnस्थि‹तिक संवेदी जोन मानीटरी समि¸ति- (1) केंद्रीय सरकार, पारिnस्थि‹तिक संवेदी जोन के प्रभावी मानीटरी के लिµए एक मानीटरी समि¸ति का गठन करेगी जो निšम्नलिµखिĆत से मि¸लकर बनेगी, अर्थाefत्‌ :- (i) जिला कलक्टर, नेल्लोर - अध्यक्ष ; (ii) पर्याefवरण के क्षेत्र में कार्यf करने वाले गैर-सरकारी संगठनों (जिसके अंतर्गfत वि¢रासत संरक्षण भी है) का प्रत्येक मामले में एक वर्षf की अवधिP के लिµए आंध्र प्रदेश राज्य सरकार द्वारा नामनिšर्दिvàष्ट एक प्रतिनिšधिP - सदस्य ; (iii) आंध्र प्रदेश राज्य के ख्याती प्राप्त संस्थान या वि¢श्ववि¢द्यालय से पारिnस्थि‹तिक और पर्याefवरण क्षेत्र में प्रत्येक मामले में एक वर्षf की अवधिP के लिµए आंध्र प्रदेश सरकार द्वारा नामनिšर्दिvàष्ट एक वि¢शेषज्ञ

• सदस्य ; (५) भारत वन्यजीव संस्थान का प्रतिनिšधिP, देहरादूत - सदस्य ; (५) प्रादेशिSक अधिPकारी, राज्य प्रंदूषण निšयंत्रण बोर्डf - सदस्य ; (vi) संबंधिPत ज्येष्ठ नगर निšयोजक - सदस्य ; (vii) उप वन संरक्षक/प्रखंड वन अधिPकारी, भारसाधक पुलीकट पक्षी अभ्यारण्य - सदस्य-सचिÚव | निšर्देĒश का निšबंधन (2) राज्य स्तरीय पारिnस्थि‹तिक संवेदी जोन समि¸ति इस अधिPसूचना के उपबंधों के अनुपालन को मानीटर करेगी । (3) पारिnस्थि‹तिक संवेदी जोन में भारत सरकार के तत्कालीन पर्याefवरण और बन मंत्रालय की अधिPसूचना से. का.आ. 15334) तारीख 14 सिËतंबर, 2006 की अनुसूची में के अधीन सम्मिĻ¸लिµत क्रिğयाकलापों और इस अधिPसूचना के पैरा 4 के अधीन प्रतिषिĔद्ध गतिवि¢धिPयों के सिËवाय आने वाले ऐसे क्रिğयाकलापों की दशा में वास्तवि¢क Ree स्थलीय दशाओं पर आधारिnत मानीटरी समि¸ति द्वारा संवीक्षा की जाएगी और उक्त अधिPसूचना के उपबंधों के अधीन पूर्वf पर्याefवरण निšकासी के लिµए केन्द्रीय सरकार के पर्याefवरण, वन और जलवायु परिnवर्तfन मंत्रालय को निšर्दिvàष्ट की जाएगी। (4) इस अधिPसूचना के पैरा 4 के अधीन यथा वि¢निšर्दिvàष्ट प्रतिषिĔद्ध क्रिğयाकलापों के सिËवाय, भारत सरकार के पयवि¢रण, वन और जलवायु परिnवर्तfन मंत्रालय की अधिPसूचना संख्यांक का.आ. 1533(अ) तारीख 14 सिËतंबर, 2006 की अधिPसूचना के अनुसूची के अधीन ऐसे क्रिğयाकलापों, जिन्हें सम्मिĻ¸लिµत नहीं किœया गया है, परंतु पारिnस्थि‹तिक संवेदी जोन में आते हैं, ऐसे क्रिğयाकलापों की वास्तवि¢क वि¢निšर्दिvàष्ट स्थलीय दशाओं पर आधारिnत मानीटरी समि¸ति द्वारा संवीक्षा की जाएगी और उसे संबद्ध वि¢निšयामक प्राधिPकरणों को निšर्दिvàष्ट किœया जाएगा। (5) मानीटरी समि¸ति का सदस्य-सचिÚव या संबद्ध उपायुक्त, ऐसे व्यक्ति  के वि¢रूद्ध, जो इस अधिPसूचना के किœसी उपबंध का उल्लंघन करता है, पर्याefवरण (संरक्षण) अधिPनिšयम, 1986 की धारा 19 के अधीन परिnवाद फाइल करने के लिµए सक्षम होगा | (6) मानीटरी समि¸ति मुद्दा दर मुद्दा के आधार पर अपेक्षाओं पर निšर्भfर रहते हुए संबद्ध वि¢भागों के प्रतिनिšधिPयों या वि¢शेषज्ञों, औद्योगिijक संगमों या संबद्ध पणधारिnयों के प्रतिनिšधिPयों को अपने वि¢चार-वि¢मर्शf में सहायता के लिµए आमंत्रिŔत कर सकेगी | (7) मानीटरी समि¸ति प्रत्येक वर्षf की 31 मार्चf तक की अपनी वार्षिĔàक कार्रfवाई रिnपोर्टf उपाबंध ।४ में उपबंधिPत रूप वि¢धान के अनुसार उक्त वर्षf के 30 जून तक राज्य के मुख्य वन्यजीव ada को प्रस्तुत करेगी | (8) केन्द्रीय सरकार का पर्याefवरण, वन और जलवायु परिnवर्तfन मंत्रालय मानीटरी समि¸ति को अपने कृत्यों के प्रभावी निšर्वfहन के लिµए समय-समय पर ऐसे निšदेश दे सकेगा, जो वह ठीक समझे |

8 THE GAZETTE OF INDIA: EXTRAORDINARY a OACETTE OF INDIA: EXTRAORDINARY ____[PART 158८. 3(ii)] EE DE NDIA EXTRAORDINARY _[PART IISc. 3(ii)] 3(ii)] उपाबंध-। पारिnस्थि‹तिक संवेदी जोन की सीमाओं का वि¢स्तृत वर्णfन उत्तर : पुलीकट पक्षी अभ्यारण्य की पारिnस्थि‹तिक संवेदनशील क्षेत्र की सीमा वालामेदु ग्राम के उत्तर से 1 किœ.मी. दूरी से प्रारंभ होती है और 2 किœ.मी. पूर्वीê दिvशा में आगे बढ़ती है तथा बंगाल की खाड़ी में मि¸लती है। पूर्वf : पुलीकट पक्षी अभ्यारण्य की सीमा बंगाल की खाड़ी की समुद्री रेखा के सभी ओर पूर्वीê दिvशा की तरफ पुलिµंजरिnकृप्पम ग्राम की उत्तरी दिvशा में 750 मी. पर तमि¸लनाडु और आंध्र प्रदेश की अंतरराज्यिİıक सीमा तक पारिnस्थि‹तिक संवेदनशील क्षेत्र की सीमा है। दक्षिÄण : पारिnस्थि‹तिक संवेदनशील क्षेत्र रेखा पुलिµंजरिnकुप्पम ग्राम के उत्तरी ओर 750 मी. पर आंध्रप्रदेश और तमि¸लनाडु की अंतरराज्यिİıक सीमा पर प्रारभ होती है तथा दक्षिÄण की ओर तमि¸लनाडु राज्य की सीम। के ara आगे बढ़ती है और तत्पश्चात्‌ पश्चिĉम ओर आगे बढ़ती है तथा उसके पश्चात्‌ उत्तरी ओर आगे बढ़ती है और अरमबक्कम ग्राम के पश्चिĉमी ओर 200 मीटर पर समाप्ति© होती है ! पश्चिĉम : पारिnस्थि‹तिक संवेदनशील क्षेत्र रेखा करुरु ग्राम के निšकट रा.रा.5 के पश्चिĉम ओर 200 मीटर की दूरी पर तमि¸लनाडु और आंध्रप्रदेश राज्य की सीमा से प्रारंभ होती है जो स्टेशन सं. 1 है और रेखा 200 मीटर की दूरी पर रा.रा. 5 के पश्चिĉम ओर के साथ आगे बढ़ती है तथा टाडा, — मार्गf जंक्शन पर काटती है तथा स्टेशन सं. 2 पर मि¸लती है जो चेनीगुंटा ग्राम की रेलवे क्रासिËंग है तथा स्टेशन सं. 3 पर बटेम्बेडु ग्राम को छूती हुई उत्तरी दिvशा की ओर आगे बढ़ती है और तत्पश्चात्‌ tat उत्तरी दिvशा की ओर आगे बढ़ती है तथा करीजशथा ग्राम के स्टेशन सं. 4 पर छूती है, तत्पश्चात्‌ रेखा पश्चिĉमी ओर आगे बढ़ती है तथा उलासपाडवा सिËंचाई तालाब के स्टेशन सं. 5 को छूती है, तत्पश्चात्‌ रेखा उत्तरी दिvशा की ओर आगे बढ़ती है और कोनपलली ग्राम में स्टेशन सं. 6 पर छूती है, तत्पश्चात्‌ रेखा उत्तरी दिvशा की ओर आगे बढ़ती है, तदुपरिn रेखा उत्तरी दिvशा की ओर आगे बढ़ती है और आनेग्रोट्टम ग्राम के निšकट स्टेशन सं. 8 को छूती है और उसके पश्चात्‌ रेखा उत्तरी दिvशा में आगे बढ़ती हुई पुलाथोटा ग्राम में स्टेशन सं. 9 को छूती है, तत्पश्चात्‌ रेखा उत्तरी दिvशा में आगे बढ़ती हुई स्टेशन सं. 10 को डिşगुवा वरट्टूर के निšकट छूती है और तदुपरिn रेखा आगे बढ़ती हुई अरूर ग्राम के निšकट स्टेशन सं. 11 को छूती है, तत्पश्चात्‌ रेखा उत्तरी पूर्वीê दिvशा की ओर आगे बढ़ती है और कोगिijली ग्राम में स्टेशन सं. 12 को छूती है और तदुपरिn रेखा कोक्कुपलेम ग्राम के निšकट स्टेशन सं. 13 को छूती है, तदुपरिn रेखा उत्तरी दिvशा की ओर आगे बढ़ती है और स्टेशन सं. 14 पर छूती है, तत्पश्चात्‌ रेखा उत्तरी दिvशा की ओर आगे बढ़ती है तथा अंदलमाला ग्राम के निšकट स्टेशन सं. 15 पर छूती है, तदुपरिn रेखा उत्तर-पूर्वीê दिvशा की ओर बढ़ती है तथा वालामेंदु ग्राम के निšकट स्टेशन सं, 16 पर बंगाल की खाड़ी की समुद्र रेखा पर मि¸लती है, जो एक बंद स्टेशन है।

12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Cormorants, White Ibises, Spoonbills, Egrets, Reef Herons, Spot billed Ducks, Northern Shovellers, Northern Pintails, Sand Pipers, Gulls and River terns; And Whereas, the greater Flamingo (Phoenicopterus roseus) - endangered species requiring protection - visits Pulicat during October coming from Great Rann of Kutch, the breeding place and returns back during April; And Whereas, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph | of this notification around the protected area of Pulicat Bird Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processed in the said Eco-sensitive Zone; Now therefore, in exercise of the powers conferred by sub-section (1), clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area of two kilometers from north to south all along the western boundary of the Pulicat Bird Sanctuary in the State of Andhra Pradesh as an Eco- sensitive Zone, details of which are as under, namely:- 1. Extent and Boundaries of Eco-sensitive Zone.- (1) The extent of Eco-sensitive Zone is two kilometers from north to south all along the western boundary of the Pulicat Bird Sanctuary in the State of Andhra Pradesh. (2) The detailed description of boundaries of the Eco-sensitive Zone is appended to this notification as Annexure I. (3) The map of Eco-sensitive Zone boundary together with its latitudes and longitudes is appended as Annexure II. (4) The list of twenty three villages falling outside the boundary of the Pulicat Bird Sanctuary and falling within the Pulicat Bird Sanctuary Eco-sensitive Zone along with their iongitudes and jatitudes at promineni poinis are appended as Annexur

iidl Provided that the list of villages as given in Annexure III shall be further revisited and confirmed by the State Government while preparing the Zonal Master Plan. 2. Zonal Master Plan for the Eco-sensitive Zone.-(1) The State Government shall, for the purpose of the effective Management of Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be based upon ecological principles for conservation of Pulicat lake. (3) The Zonal Master Plan shall be approved by the Competent Authority in the State Government. (4) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (5) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Roads and Building; (v) Revenue; (vi) Urban Development; (vii) Tourism; (viii) | Rural Development; (ix) Municipal; (x) Panchayat raj ; (xi) Irrigation; and (xii) Public Works department; for integrating environmental and ecological considerations into the said plan. (6) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. Xu (7) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(amuses 3) पेय वि¢न्‍ननन्ननननतततततततत तन ततततततततततततततत गर-खण्ड 3 (1) ] भारत का राजपत्र : असाधारण 13 (8) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development for livelihood security of local communities. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 17, 19, 25 and 27 in column (2) of the Table in paragraph 4, namely:-. (i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities, (ii) Widening and strengthening of existing roads; (iii) Rainwater harvesting; and (iv) Cottage industries including village industries, conven nd local amenities: i be permitted for commercial and industrial development Provided further that no use of tribal activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee. once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Ciimate Change: Provided also that the above correction of error shall not include change of Jand use in any case except as provided under this sub-paragraph: हु Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. + (2) Natural Springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. . (b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment, Government of Andhra Pradesh. (c) The activity of tourism shall be regulated as under, namely:- (i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone; (ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Pulicat Bird Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities: Provided that beyond the distance of one kilometer from the boundary of the Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in designated areas for Eco- tourism facilities as per Tourism Master Plan; (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. 26५5 CULT -५

14 THE GAZETTE OF INDIA: EXTRAORDINARY OA TTE OF INDIA EXTRAORDINARY [PART 11570. 3(ii)] II—SEc. 3(ii)] (4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zona! Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan. (6) Noise pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder, (7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder. (9) Solid wastes. - Disposal of solid wastes shal! be as under:- (i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number 5.0. 908 (8), dated the 25" September, 2000 as amended from time to time; (ii) the local authoriti¢s shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture: (iy) the inorganic material may be disposed in an environmentally acceptable manner at a site identified outside the Eco- sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone. (10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide Notification number 5.0. 630(E), dated the 20" July, 1998 as amended from time to time. (11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder (12) Industrial Units No new establishment of any industrial unit shall be permitted in the Eco- sensitive zone. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:-

Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:- (i) District Collector, Nellore — Chairman; (ii) a representative of Non-Governmental Organizations working in the field of environment (including heritage conservation) to be nominated by the Government of Andhra Pradesh for a term of one year in each case - Member; (iii) one expert in the area of ecology and environment from reputed Institution or University of the State of Andhra Pradesh to be nominated by the Government of Andhra Pradesh for a term of one year in each case- Member; (iv) Representative of Wildlife Institute of India, Dehradun - Member (vi) Deputy Conservator of Forests/Divisional Forest Officer incharge of Pulicat Bird Sanctuary —Member Secretary. Terms of Reference: (2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number 5.0. 1533 (E), dated the 14" September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 147 September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited.activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned Deputy Conservator of Forests/Divisional Forest Officer incharge of Protected Area shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31° March of every year by 30°" June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure IV. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. East: The boundary of the Pulicat Bird Sanctuary is the boundary of the Eco-sensitive Zone towards eastern side all along the shore line of Bay of Bengal upto inter-state boundary of Tamil Nadu and Andhra Pradesh at 750m northern side of Pulinjerikuppam village. South: The Eco-sensitive zone line starts at inter-state boundary of Andhra Pradesh and Tamil Nadu at 750m Northern side of Pulinjerikuppam village and runs all along the Tamil Nadu State boundary towards South and then runs towards west side and then runs Northern side and ends at 200meters western side of Arambakkam village.
