File No.: COS-1 101211 512025-eoffice And whereas, according to provisions of the Cosmetics Rules, 2020, as per the Condition No.03 of the RC issued under Form COS-2, the manufacturer or his authorised agent or importer or distributor or subsidiary in lndia shall inform the Licensing Authority within thirty days, in writing, in the event of change in labelling or composition or testing, or specification or in documentation of any of the cosmetic pertaining to this RC along with an undertaking that the products comply with standards laid down by the Bureau of lndian Standards as referred in the Ninth Schedule. And whereas, according to the provisions of Rule 36 of the Cosmetics Rules, 2020, no cosmetic may purport or claim to purport or convey any idea which is false or misleading to the intending user. And whereas, As per Rule 15 (3) in case of change in name or address of a registration holder or overseas manufacturer, after grant of registration under sub-rule (1)of rule 13, an application for amendment shall be made in online portal of central Government for prior approval from the central Licensing Authority for the said changes in registration certificate within a period of sixty days from the date of such change. And whereas, this office had issued a Show Cause Notice (SCN) dated 26.05.2025 to the firm M/s Kult App Private Limited in connection with non-compliance of the conditions of lmport Registration Number in Form cos{A under the cosmetic Rules, 2020. The Show cause Notice dispatched to the registered address available on the SUGAM portal could not be delivered by the postal authorities. And whereas, the firm M/s Kult E-Commerce Pvt. Ltd. applied an application in Form cos4 vide coS/coS-4120251537.|t was observed that the Market labels of all the 50 applied cosmetics products are not matching with the labels which were earlier approved by this Directorate with RC No. Rc/cos-005271 in the application no. cos/cos-1/FR12024123176 of the firm M/s. Kutt App private Limited. ln view of this, a show cause Notice dated 24 11.2025 was issued to the firm. However, the notice was returned back to this office as it could not be delivered by postal authorities due to non- existence of the firm on the registered address. And whereas, the CDSCO Zonal office, West Zone attempted to deliver the communication letter personally to the registered address of the firm.
