/2018.—भारतीय मानक यूरो अिधिनयम, 2016 (2016 का 11) क धारा 13 और धारा
14 के साथ प!ठत धारा 39 म$ %द& शि)य* का %योग करते -ए भारतीय मानक यूरो क काय/का!रणी सिमित, के1 2ीय
सरकार के पूवा/नुमोदन से िन5 निलिखत िविनयम बनाती है, अथा/त् :
1.
संि:; त नाम और %ारंभ
(1) इन िविनयम* का संि:= नाम भारतीय मानक यूरो (हॉलमा@कग) िविनयम, 2018 है।
(2) ये राजपB म$ इनके %काशन क तारीख को %वृ& ह*गे ।

से िन5 निलिखत िविनयम बनाती है, अथा/त् :
1.
संि:; त नाम और %ारंभ
(1) इन िविनयम* का संि:= नाम भारतीय मानक यूरो (हॉलमा@कग) िविनयम, 2018 है।
(2) ये राजपB म$ इनके %काशन क तारीख को %वृ& हगे ।

प!रभाषा – इन िविनयम म$ जब तक क संदभ/ से अ1 यथा अपेि:त न हो –
(क) ‘’अिधिनयम’’ से मानक यूरो अिधिनयम 2016 अिभ%ेत है।
(ख) ‘’कैरेट’’ से %ित चौबीस भाग* म$ K यL त सोने के अंश क माBा और कुल माBा के बीच के अनुपात अिभ%ेत है ।
(ग) "प!रशुMता" से %ित हज़ार भाग म$ K यL त ब-मूय धातु अंश क माBा और कुल माBा के बीच के अनुपात
अिभ%ेत है ।
(घ) "िनयम " से भारतीय मानक यूरो िनयम, 2017 अिभ%ेत है।
(ङ) ‘’अनुसूची’’ से इन िविनयम* से संलP न अनुसूची अिभ%ेत है ।

त बमूय धातु क व तु क िब के िलए रिज "ीकरण माण माण माण माण- प प प प क मंजूरी के िलए आवेदन करेगा। (2) उप-िविनयम (1) के अधीन आवेदन, इन िविनयम& से संल' न, ()प 1 म, अनुसूची- I म, िविन-द. फस के साथ 1यूरो को 3कया जाएगा। (3) आवेदन ()प, आवेदक या इस संबंध म, (ािधकृत 3कसी अ6य 7ि8 9ारा ह ता ;<रत 3कया जाएगा। (4) आवेदन के साथ िन>िलिखत द तावेज& क व-(मािणत (ितिलिप भी संल@ होगी, अथात— (क) फम या कंपनी क थापना का (माण; (ख) प<रसर के पते का (माण; (ग) ह ता;रकता क पहचान का (माण; (घ) िनकटतम भूिम िचBन से प<रसर का थान दशाने वाला मानिचD; और (ड.) वाEषक आवत के संबंध म, (माण। (5) य3द आवेदन अपेि;त फस के साथ नहF 3कया जाता है तो आवेदन अ वीकार कर 3दया जाएगा। (6) आवेदन (ािH पर वीकार 3कया जाएगा। (7) य3द उप-िविनयम (4) के अधीन ( तुत द तावेज म म, नहF हJ, तो 1यूरो आवKयक द तावेज या कोई अनुपूरक जानकारी मांग सकता है, जैसा भी मामला हो, य3द प.ीकरण के (योजन के िलए यह आवKयक हो। (8) य3द आवेदक 9ारा ( तुत द तावेज़ प.ीकरण म म, पाया जाता है, तो आवेदन रिज "ीकरण का (माण-पD (दान करने के िलए आगे क (3 या क जाएगी। (9) य3द द तावेज म म, नहF पाये जाते हJ, उप-िविनयम (2) के अंतगत आवेदन को 1यूरो 9ारा अ वीकार 3कया जा सकेगा। (10) आवेदक आवKयक द तावेज& के साथ अपना जवाब ( तुत कर सकता है और नो<टस (ाH होने क तारीख से लेकर चौदह 3दन& के भीतर वयं या उसके 9ारा (ािधकृत 3कसी (ितिनिध के माRयम से सुनवाई के िलए अनुरोध कर सकता है। (11) अ वीकृित के आधार के साथ 1यूरो का िनणय आवेदक को िलिखत )प म, सूिचत 3कया जाएगा। (12) उप-िविनयम (9) के अधीन आवेदन क अ वीकृित के मामले म, आवेदन फस वापस नहF होगी। 4.
ाई के िलए अनुरोध कर सकता है। (11) अ वीकृित के आधार के साथ 1यूरो का िनणय आवेदक को िलिखत )प म, सूिचत 3कया जाएगा। (12) उप-िविनयम (9) के अधीन आवेदन क अ वीकृित के मामले म, आवेदन फस वापस नहF होगी। 4. रिज ीकरण माण प रिज ीकरण माण प रिज ीकरण माण प रिज ीकरण माण प दान करना दान करना दान करना दान करना - (1) 1यूरो रिज "ीकरण (माण पD (दान कर सकता है— (क) य3द आवेदन म म, पाया जाता है; और (ख) अनुसूची- I म, िन-द. रिज "ीकरण फस के भुगतान पर (2) रिज "ीकरण का (माण-पD इन िविनयम& के साथ संल@ ()प -2 म, (दान 3कया जाएगा और पांच साल क अविध के िलए वैध होगा। (3) रिज "ीकरण के (माण-पD का 1यौरा 1यूरो क वेबसाइट पर हो ट 3कया जाएगा । (4) रिज "ीकरण का (माण-पD रिज "ीकरण (माण-पD म, बताए गए प<रसर के िलए वैध होगा। (5) रिज "ीकरण का (माण-पD िविनयम 5 म, िन-द. िनयम& और शतS के अनुसार होगा। 5. रिज ीकरण माण प के रिज ीकरण माण प के रिज ीकरण माण प के रिज ीकरण माण प के िनयम व िनयम व िनयम व िनयम व शत

- (1) रिज "ीकृत आभूषण िव ेता उसके 9ारा बेची गई हॉलमाक यु8 बमू य धातु क व तु क शुUता और प<रशुUता के िलए उVरदायी होगा। (2) रिज "ीकृत आभूषण िव ेता 3कसी अ6 य आभूषण िव ेता के पहचान िच6ह के साथ मुहरां3कत हॉलमाक -यु8 बमूय धातु क व तु
को बेच सकता है, बशतW 3क खरीद या अ6य )प म, (ािधकार का (माण उसके पास उपल1ध हो। (3) रिज "ीकृत आभूषण िव ेता, जो व तु को हॉलमाक करवा रहा है, ऐसी व तु क शुUता और प<रशुUता के िलए उVरदायी होगा। (4) रिज "ीकृत आभूषण िव ेता, जो िब करता है, िनयम& के अनुसार शुUता या प<रशुUता म, 3कसी भी (कार क कमी होने पर मुआवजे का भुगतान करने के िलए उVरदायी होगा। (5) रिज

"ीकृत आभूषण िव ेता (_येक परेषण के िलए िलिखत म, हॉलमा[कग के अनुरोध के साथ असेZयग और हॉलमा[कग क,\ म,

तुएं जमा करवाएगा और (_येक अनुरोध क एक (ित अपने पास रखेगा।
(8) असेZयग और हॉलमा[कग के िलए बमूय धातु क व

"ीकृत आभूषण िव ेता अपने (ितिनिधय& के नाम और ह
ता;र घोिषत करेगा जो असेZयग और हॉलमा[कग क,\ को हॉलमा[कग
के िलए अनुरोध (
तुत करने के िलए (ािधकृत होगा।
(10) रिज
"ीकृत आभूषण िव ेता अनुसूची – IV म, यथािविन-द.
आभूषण िव ेता अपने (ितिनिधय& के नाम और ह ता;र घोिषत करेगा जो असेZयग और हॉलमा[कग क,\ को हॉलमा[कग के िलए अनुरोध ( तुत करने के िलए (ािधकृत होगा। (10) रिज "ीकृत आभूषण िव ेता अनुसूची – IV म, यथािविन-द. असेZयग और हॉलमा[कग क,\ को हॉलमा[कग फस का भुगतान करेगा। (11) हॉलमाक यु8 बमूय धातु क व तु क िब के िबल या बीजक म, (_येक व तु का िववरण, बमूय धातु का शुU भार, केरेट और प<रशुUता म, शुUता और हॉलमा[कग (भार& का अलग-अलग िववरण 3दया जायेगा। (12) मानक के 3कसी भी संशोधन या पुनरी;ण के मामले म, 1यूरो उसके काया6वयन से तीस 3दन पहले रिज "ीकृत आभूषण िव ेता को नो<टस देगा। (13) रिज "ीकृत आभूषण िव ेता हॉलमा[कग के िलए 3कये गए अनुरोध, असेZयग एवं हॉलमा[कग क,\ 9ारा जारी 3कये गये बीजक या िबल, हॉलमाक यु8 व तु क िब के बीजक या िबल और आभूषण िव ेता से ख़रीदी गई हॉलमाक यु8 व तु के बीजक या िबल क (ितय& का <रकॉड पांच वष क अविध या हॉलमाक यु8 व तु के बेचे जाने तक, जो भी अिधक हो, रखेगा। (14) रिज "ीकृत आभूषण िव ेता, 1यूरो के (ािधकृत (ितिनिध के साथ अपने आऊट-लेट के िनरी;ण, िनगरानी के दौरान या िशकायत क जांच के दौरान के सjबU <रकॉड या नमूने लेने के िलए सहयोग करेगा। (15) रिज "ीकृत आभूषण िव ेता िब क,\ म, 1यूरो 9ारा हॉलमाक -यु8 व तु क िब के िलए जारी 3कए गए रिज "ीकरण के मूल (माण-पD और 1यूरो 9ारा िनधा<रत अ6य (दशन अपे;ा को (मुखता से (दEशत करेगा। (16) 1यूरो रिज "ीकरण (माण-पD क वैधता के दौरान रिज "ीकृत आभूषण िव ेता को तीस 3दन का नो<टस देकर, रिज "ीकरण के (माण पD के 3कसी भी िनयम और शत म, बदलाव कर सकता है। (17) िनयम& और शतS का उलंघन 3कए जाने पर, रिज "ीकरण (माण’-पD रl 3कया जा सकता है। 6.
िज "ीकृत आभूषण िव ेता को तीस 3दन का नो<टस देकर, रिज "ीकरण के (माण पD के 3कसी भी िनयम और शत म, बदलाव कर सकता है। (17) िनयम& और शतS का उलंघन 3कए जाने पर, रिज "ीकरण (माण’-पD रl 3कया जा सकता है। 6. रिज ीकरण रिज ीकरण रिज ीकरण रिज ीकरण (माण-पD का नवीकरण का नवीकरण का नवीकरण का नवीकरण - (1) रिज "ीकृत आभूषण िव ेता रिज "ीकरण के (माण-पD क वैधता क समािH के तीस 3दन पूव अनुसूची- I म, िविन-द. फस के साथ, इन िविनयम& से जुड़े ()प-III म, नवीकरण आवेदन 1यूरो को देगा। (2) वैधता क समािH से पहले नवीकरण आवेदन (ाH होने पर, — (क) रिज "ीकरण का (माण-पD पांच साल क अविध के िलए नवीनीकृत 3कया जा सकता है; या (ख) य3द रिज "ीकरण का (माण-पD रl 3कए जाने या गैर-नवीकरण के िलए िवचारणीय है तो रिज "ीकरण (माण-पD के नवीकरण पर िनणय तीन महीने तक आ थिगत रखा जा सकता है, और आ थिगत करने के िनणय क सूचना रिज "ीकृत आभूषण िव ेता को दी जाएगी। साथ ही उसे हॉलमाक-यु8 कमती धातु/व तु क िब रोकने और कमती धातु/व तु को हॉलमाक न करवाने के िनदWश 3दए जाय,गे। 7. रिज ीकरण या गैर नवी रिज ीकरण या गैर नवी रिज ीकरण या गैर नवी रिज ीकरण या गैर नवीकरण करण करण करण (माण-पD को र करना र करना र करना र करना - (1) 1यूरो रिज "ीकरण (माण-पD को रl कर सकेगा या नवीकरण नहF कर सकेगा य3द, — (क) आभूषण िव ेता 9ारा घोिषत 3कसी भी घोषणा को झूठ या गलत पाया जाता है; (ख) रिज "ीकृत आभूषण िव ेता ने रिज "ीकरण (माण पD के 3कसी भी िनयम और शतS का उलंघन 3कया है; (ग) रिज "ीकृत आभूषण िव ेता ने व तु क दावा क गई या उस पर अं3कत शुUता या प<रशुUता से कम शुUता वाली व तु को बेचा है या बेचने का ( ताव 3कया है;
"ीकरण (माण पD के 3कसी भी िनयम और शतS का उलंघन 3कया है; (ग) रिज "ीकृत आभूषण िव ेता ने व तु क दावा क गई या उस पर अं3कत शुUता या प<रशुUता से कम शुUता वाली व तु को बेचा है या बेचने का ( ताव 3कया है; (घ) रिज "ीकृत आभूषण िव ेता, िनगरानी दौरे या िशकायत क जाँच के दौरान 1यूरो के (ािधकृत (ितिनिध 9ारा कV7& का िनवहन करने म, सहयोग देने म, िवफल रहा हो। ( ड.) रिज "ीकृत आभूषण िव ेता को हॉलमाक के दुrपयोग के 3कसी भी अनुिचत 7वहार म, िलs त पाया जाए । (2) रिज "ीकरण के (माण-पD को रl करने या उसके गैर-नवीकरण से पहले, 1यूरो रिज "ीकृत आभूषण िव ेता को रिज "ीकरण के (माण-पD को रl करने या इसके नवीकरण न करने के आशय के कारण& का हवाला देकर नो<टस देगा।

(3) य3द उप-िविनयम (1) के खंड (ड.) म, 3दए गए कारण& से रिज "ीकरण (माण-पD को रl करने या गैर-नवीकरण के िलए नो<टस जारी 3कया जाता है, तो रिज "ीकृत आभूषण िव ेता को हॉलमाक वाले कमती धातु क व तु क िब रोकने और बमू य धातु क व तु
पर हॉलमाक न लगवाने के िनदWश 3दए जाय,गे।
(4) उप-िविनयम (2) के अंतगत नो<टस (ाH होने पर, रिज
"ीकृत आभूषण िव ेता नो<टस (ाH होने क तारीख से चौदह 3दन& के भीतर
1यूरो को
प.ीकरण (
तुत कर सकता है।
(5) जब
प.ीकरण (
तुत 3कया जाए तो 1यूरो उस
प.ीकरण पर िवचार कर सकता है और रिज
"ीकृत आभूषण िव ेता या उसके
अिधकृत (ितिनिध क 7ि8गत सुनवाई कर सकता है, जैसा भी मामला हो।
(6) अपराध के शमन के मामले म, (माण-पD को रl करने के िलए (3 या नहF क जाएगी।
(7) य3द कोई िववरण नहF 3दया गया है, तो 1यूरो नो<टस क अविध क समािH पर रिज
"ीकरण (माण-पD रl कर सकता है।
(8) जहां रिज
"ीकरण का (माण-पD रl कर 3दया गया है या नवीनीकृत नहF 3कया गया है, वहां आभूषण िव ेता हॉलमाक यु8 कमती
धातु क व
तु
, तो 1यूरो नो<टस क अविध क समािH पर रिज
"ीकरण (माण-पD रl कर सकता है।
(8) जहां रिज
"ीकरण का (माण-पD रl कर 3दया गया है या नवीनीकृत नहF 3कया गया है, वहां आभूषण िव ेता हॉलमाक यु8 कमती
धातु क व
तु
क िब को रोक देगा और अिधिनयम क धारा 34 के अंतगत अपील के लंिबत होने के बावजूद 3कसी भी असेZयग और
हॉलमा[कग क,\ से बमू य धातु क व
तु
पर हॉलमाक लगवाना बंद कर देगा।
(9) उप-िविनयम (1) के खंड (ड.) म, 3दए गए कारण& से रlकरण या गैर-नवीकरण के मामल& म, 1यूरो ऐसे आदेश पा<रत होने क तारीख
से एक वष क िवराम अविध से पहले रिज
"ीकरण (माण-पD (दान करने के िलए आवेदन
वीकार नहF करेगा।
(10) रl 3कये गए या नवीनीकृत न 3कये गए रिज
"ीकरण के (माण-पD के िववरण 1 यूरो अपनी वेबसाइट पर डालेगा।
(11) अtयपण, रlकरण और गैर नवीकरण क ि

"ीकरण के (माण-पD के िलए आवेदन करने का पाD नहF होगा।

थािपत 3कया गया कोई भी असेZयग क,, असेZयग और
हॉलमा[कग क,\ के )प म, संचािलत करने के िलए मा6यता (दान करने हेतु आवेदन कर सकेगा।
(2) 1 यूरो को आवेदन इन िविनयम& से संल' न ()प –IV म, अनुसूची –II म, िन-द. फस और िनj निलिखत द
तावेज़& क
व-(मािणत
(ितिलिप के साथ 3कया जाएगा अथात्:—
(क) फम या कंपनी क
थापना का (माण;
(ख) प<रसर के पते का (माण;
(ग) ह

(4) य3द आवेदन के साथ अपेि;त फस नहF दी गई है तो आवेदन को अ
वीकार कर 3दया जाएगा।
(5) आवेदन (ाH होने के पuात् उसक
वीकृित दी जाएगी और ज{च के बाद सही पाए जाने पर उसे <रकॉड 3कया जाएगा।
(6) य3द उप-िविनयम (2) के अधीन 3दया गया द
तावेज़ सही नहF हJ, तो 1यूरो आवKयक द
तावेज़ या कोई पूरक जानकारी मांग सकता
है, जैसा भी मामला हो, य3द
प.ीकरण के (योजन के िलए यह अपेि;त हो।
(7) परी;ण 3कए जाने पर , 1यूरो 3कसी आवेदन को अ
वीकार कर सकता है, य3द,—

(4) उप-िविनयम (3) के अंतगत, 1यूरो अनुरोध क जांच कर सकता है, मूयांकन कर सकता है, जो 3क काय;ेD म, प<रवतन पर िवचार
करने के िलए आवKयक है।
(5) इस िविनयम के अंतगत दी गई मा6यता तीन साल क अविध के िलए मा6य होगी।
(6) 1यूरो 9ारा (मािणत असेZयग और हॉलमा[कग के 1यौरे को वेबसाइट पर डाला जायेगा।

(3) असेZयग और हॉलमा[कग क, , मशीनरी, उपकरण, असेZयग काEमक (मािणत संदभ सामvी क अनुपल1धता अथवा 3कसी बड़े
उपकरण& के टूटने क सूचना भी 1यूरो को देगा, जो नमूना लेने क, असेZयग और हॉलमा[कग गितिविधय& को (भािवत कर सकती है।
(4) िविनयम 5 के उप-िविनयम (7) म, बताये गए अनुसार असेZयग और हॉलमा[कग क,\ संबंU मानक के अनुसार केवल (मािणत आभूषण
िव ेता से ही हॉलमा[कग के िलए आभूषण
वीकार करेगा एवं आभूषण िव ेता हॉलमा[कग के िलए िलिखत )प म, 1यौरे सिहत अनुरोध
करेगा ।
(5) मानक के 3कसी भी संशोधन या पुनरी;ण के मामले म, 1यूरो इसके काया6वयन से पहले असेZयग और हॉलमा[कग क,\ को एक महीने
का नो<टस देगा।
(6) परी;ण और मुहरांकन अंशशोधन उप
कर& और (मािणत संदभ सामvी का उपयोग करके सुसंगत भारतीय मानक के अनुसार 3कया
जाएगा।
(7) हॉलमाक का िडज़ाइन और इसके साथ िचिBनत होने वाले 1यौरे अनुसूची -III म, यथािविन-द. ह&गे।
(8) असेZयग और हॉलमा[कग क,\ 1 यूरो 9ारा बताए गए अनुसार <रकॉड रखेगा िजसम, आभूषण िव ेता से (ाs त हॉलमा[कग हेतु अनुरोध
का <रकॉड भी शािमल है।

(8) असेZयग और हॉलमा[कग क,\ 1 यूरो 9ारा बताए गए अनुसार <रकॉड रखेगा िजसम, आभूषण िव ेता से (ाs त हॉलमा[कग हेतु अनुरोध

(10) असेZयग और हॉलमा[कग क, \ अनुसूची – IV म, बताए गए अनुसार 1 यूरो को हॉलमा[कग फस देगा।
(11) असेZयग और हॉलमा[कग क, \ मािसक और वाEषक आधार पर हॉलमाक क गई बमू य धातु क व तु के साथ-साथ अ वीकृत क गई व तु का भी 1यौरा, संa या और वज़न म, देगा।
(12) असेZयग और हॉलमा[कग क, \ 1यूरो के (ािधकृत (ितिनिय& के साथ मूयांकन करने के िलए, के6 \ के पास उपल1 ध बमू य धातु व तु के िनरी;ण एवं परी;ण के िलए सुसंगत <रकॉडS के उ_पादन म, सहयोग करेगा।
(13) 1यूरो मा6यता क वैधता क अविध के दौरान असेZयग और हॉलमा[कग क,\ को तीस 3दन& का नो<टस देकर पहचान के वैध Zनबंधन& और िनयम& को संशोिधत कर सकता है।
(14) िनबंधन और शतS का उलंघन 3कए जाने पर, मा6 यता रl हो सकती है।

मा&यता का नवीकरण मा&यता का नवीकरण मा&यता का नवीकरण मा&यता का नवीकरण - (1) असेZयग और हॉलमा[कग के6\ इन िविनयम& से संल' न ()प–VII म, मा6यता के नवीकरण के िलए आवेदन जमा कर, िजसके साथ अनुसूची II म, िन-द. फस हो और िन>िलिखत द तावेज& क व-(मािणत (ितिलिप हो, अथात्:— (क) फम या कंपनी क थापना का (माण; (ख) प<रसर के पते का (माण; (ग) ह ता;रकता क पहचान का (माण; (घ) िनकटतम लJडमाक से प<रसर का थान दशाने वाला मानिचD; (ड) गुणता पुि तका; तथा (च) इन िविनयम& से जुड़े ()प-V म, शपथ पD और वचनबUता (2) नवीकरण के िलए आवेदन मा6यता क वैधता क समािH क तारीख से न1बे 3दन पहले ( तुत 3कया जाएगा । (3) उप-िविनयम (1) के अंतगत नवीकरण के िलए आवेदन (ाH होने पर, 1यूरो, आवेदक के िपछले <रकॉड पर िवचार करके और इस बात का संतोष करके 3क क, \ के पास बमू य धातु क व तु क असेZयग और हॉलमा[कग के िलए सुसंगत मानक के अनुसार आवKयक बुिनयादी ढांचा और ;मता है, उसे तीन वष क अविध के िलए नवीकृत कर सकता है । (4) य3द असेZयग और हॉलमा[कग क,\ वैधता क समािH से पहले अपेि;त फस के साथ नवीकरण के िलए आवेदन नहF करता है, तो उसे मा6यता क वैधता ख_म हो जाने के बाद हॉलमाक के (योग करने का अिधकार नहF होगा और ऐसे मामले म, 1यूरो 9ारा वैधता क तारीख से न1बे 3दन& क अविध के िलए मा6यता का नवीकरण आ थिगत 3कया जा सकता है । (5) य3द, मा6यता के थगन क अविध के दौरान, अनुसूची- II म, िन-द.
रने का अिधकार नहF होगा और ऐसे मामले म, 1यूरो 9ारा वैधता क तारीख
से न1बे 3दन& क अविध के िलए मा6यता का नवीकरण आ
थिगत 3कया जा सकता है ।
(5) य3द, मा6यता के
थगन क अविध के दौरान, अनुसूची- II म, िन-द. पांच हजार rपए के िवलjब फस और आवKयक द
तावेजो़ं के
साथ आवेदन 3कया जाता है, तो 1यूरो 9ारा मा6यता को नवीकृत 3कया जा सकता है।
परंतु, 1यूरो 9ारा मा6यता का नवीकरण 3कये जाने तक असेZयग और हॉलमा[कग क, \ को हॉलमाक के (योग का अिधकार नहF होगा।
(6) य3द नवीकरण आवेदन िनधा<रत फस और द
तावेज& के साथ
थगन क अविध के भीतर (ाH नहF होता है, तो मा6यता समाH हो
जाएगी।
(7) य3द मा6यता िनलंबन के अधीन है या उस पर िनलंबन, रlकरण या गैर-नवीकरण के िलए िवचार 3कया जा रहा है तो मा6यता के
नवीकरण के िनणय को वैधता क ितिथ से 6 महीने तक आ
थिगत 3कया जा सकता है ।

वैधािनक (ािधकारी का िनदWश ह&, तो असेZयग एवं हॉलमा[कग के6 \ इस िवषय म, शी ही 1 यूरो को सूिचत करेगा।
(2) उन कारण& के समाs त होते ही (चालन के रlकरण को वािपस िलए जाने क सूचना 1यूरो को तुरंत भेजी जाएगी, िजनके कारण
(चालन रl 3कया गया था।
(3) य3द, 3कसी भी समय, 1यूरो के पास पयाH साय ह& 3क असेZयग और हॉलमा[कग भारतीय मानक के अनु)प नहF हो रही हJ, तो
ो वािपस िलए जाने क सूचना 1यूरो को तुरंत भेजी जाएगी, िजनके कारण
(चालन रl 3कया गया था।
(3) य3द, 3कसी भी समय, 1यूरो के पास पयाH साय ह& 3क असेZयग और हॉलमा[कग भारतीय मानक के अनु)प नहF हो रही हJ, तो
असेZयग और हॉलमा[कग क,\ को अपने (चालन को िनलंिबत करने के िनदWश 3दए जाएं और ऐसे साय िनj निलिखत तक सीिमत नहF हJ,
ले3कन िन>िलिखत म, से एक या अिधक ह& सकते हJ, अथात्:—
(i) इन-हाउस या

(4) ऐसे हॉलमा[कग एवं असेZयग के6 , िजनक मा6 यता है, 1यूरो को इसके आदेश के अनुपालन के बारे म, सूिचत कर,गे।
(5) सुधारा_मक कावयाही क (ािH पर, य3द आवKयक हो, तो सुधारा_मक कायवाही क (भावशीलता को स_यािपत करने के िलए एक
िवशेष मूयांकन 3कया जा सकता है।

समान िवसंगितयां 3फर से होने पर;
क अविध के िलए असेZयग और हॉलमा[कग क,\ िनलंिबत हो;
(ज) असेZयग और हॉलमा[कग क,\ ने िनधा<रत समय के भीतर सुधारा_मक कायवाही न क हो या सुधारा_मक कारवाई करने के बावजूद
समान िवसंगितयां 3फर से होने पर;
(2) मा6यता को रl करने या गैर नवीकरण से पहले, 1यूरो को कारण देते ए मा6 यता रl करने या मा6 यता का नवीकरण न करने के इरादे
का असेZयग और हॉलमा[कग क, \ को नो<टस देना होगा।
(3) य3द उप-िविनयम (1) के खंड (घ), (ड.) या (च) म, 3दए गए कारण& म, रl करने के िलए नो<टस जारी 3कया जाता है तो क,\ को

(4) उप-िविनयम (2) के अंतगत नो<टस (ाH होने पर, असेZयग और हॉलमा[कग क, \ नो<टस (ाH होने क तारीख से चौदह 3दन& के भीतर

(5) 1यूरो,

(6) अपराध के शमन के मामले म, मा6 यता को रl करने के िलए कारवाई नहF क जाएगी।

(5) य3द आवेदन के साथ अपेि;त फस नहF है तो आवेदन अ
वीकार कर 3दया जाएगा।
(6) आवेदन (ाH होने के बाद उसक
वीकृित दी जाएगी और ज{च के बाद सही पाए जाने पर उसे <रकॉड 3कया जाएगा।
(7) 1यूरो आवेदक के 3कसी भी व87 के समथन म, या उसे पुa ता करने के िलए कोई पूरक जानकारी या द
तावेज़ी साय मांग सकता है।
(8) 1यूरो 3कसी आवेदन को अ
वीकार कर सकता है, य3द,—
(क) आवेदन अधूरा हो या िन-द. द
तावेज& के िबना पाया जाता है या िन-द. आवKयकता
को पूरा नहF करता है।
(ख) आवेदन क (3 या के दौरान 3कसी भी समय यह पाया जाता है 3क आवेदक हॉलमाक का दुrपयोग करने के िलए 3कसी (कार के
|w टाचार, िजसके िलए अिधिनयम के अ6 तगत मुकlमा चलाया जा सकता है, म, शािमल है।
(ग) आवेदक के पास परी;ण और िनरी;ण क योजना के (ावधान& के अनुपालन के िलए और सुसंगत भारतीय मानक के अनुसार
आवKयक बुिनयादी ढांचा और ;मता नहF है;

(ड.) मा6 यता रl होने या अनुिH के गैर-नवीकरण होने पर िविनयम 19 के उप-िविनयम (9) म, बताए गए अनुसार रोक अविध क
समािH से पहले आवेदन जमा 3कया गया है अथवा उपिविनयम (12) म, िन-दw ट अिधिनयम के (ावधान& के अ6 तगत दोष िसU हो ।
(9) 3कसी भी आवेदन को अ
वीकार करने से पहले, 1यूरो आवेदक को उसम, किमय& को उधृत कर नो<टस देगा।
(10) आवेदक आवKयक द
तावेज& के साथ अपना जवाब दे सकता है और नो<टस (ाH होने क तारीख से लेकर चौदह 3दन& के भीतर

या उसके 9ारा अिधकृत 3कसी (ितिनिध के माRयम से सुनवाई के िलए अनुरोध कर सकता है।

वीकृित के आधार के साथ 1यूरो का िनणय आवेदक को िलिखत )प म, सूिचत 3कया जाएगा।
(12) कोई आवेदक या अिधिनयम के उपबंध& के अधीन िसUदोष पाया गया ~ यि8 इस तरह क सजा क तारीख से एक वष क िवराम
अविध म, आवेदन करने के िलए पाD नहF होगा।
(13) उप-िविनयम (8) के अ6 तगत आवेदन क अ
वीकृित के मामले म, आवेदन फस वापस नहF होगी।
15. अनुिH क मंजूरी - (1) 1यूरो अनुिH (दान करेगा—
(क) यह संतुि. हो जाने पर 3क आवेदक के पास सुसंगत मानक के अनुसार प<रw कृत बमू य धातु
के िनमाण और परी;ण के िलए
आवKयक बुिनयादी ढांचा और ;मता होने पर ;
(ख) <रफाइंड प<रw करण बमू य धातु सुसंगत भारतीय मानक के अनु)प होने पर ;
(ग) अनुसूची- V म, िविन-द.
नुसार प<रw कृत बमू य धातु

(2) उप-िविनयम (1) के अ6 तगत स_यापन के (योजन के िलए आवेदक को कायालय, िनमाण, परी;ण, भ डार से संबंिधत प<रसर का
िनरी;ण करने के िलए तथा नमूने लेने और परी;ण म, 1यूरो के अिधकृत (
तािवत (ितिनिध के साथ सहयोग करना होगा।
(3) अनुिH इन िनयम& के साथ संल' न ()प-XI म, (दान 3कया जाएगा।
(4) अनुिHधारी अनुसूची- V के अनुसार फस के साथ अनुिH के िवषय-;ेD म, प<रवतन के िलए अनुरोध कर सकता है।
(5) िवषय-;ेD म, प<रवतन पर िवचार करने के िलए 1यूरो अनुरोध पर िवचार कर सकता है एवं जांच कर सकता है, और संशोिधत िवषय-
;ेD इन िनयम& के िलए ()प-XII म, जारी 3कया जाएगा।
(6) इस िविनयम के अ6 तगत जारी 3कया गया अनुिH एक वष क अविध के िलए मा6य होगा।
(7) जारी 3कए गए सभी अनुिHय& का 1यौरा 1यूरो 9ारा अपनी वेबसाइट पर डाला जाएगा।
(8) अनुिH िविनयम 16 म, 3दए गए िनबंधन और शतS के अधीन होगा ।

(6) हॉलमाक का िडज़ाइन और इसके साथ िचिBनत होने वाले 1यौरे अनुसूची -III म, बताए गए अनुसार ह&गे।
(7) मानक या परी;ण और िनरी;ण क योजना के 3कसी भी संशोधन या पुनरी;ण के मामले म, 1यूरो इसके काया6वयन से पहले
अनुिHधारी को एक महीने का नो<टस देगा।
(8) अनुिHधारी 1 यूरो 9ारा समय-समय पर बताए गए अनुसार <रकॉड रखेगा।
(9) अनुिHधारी बनाए गए, िचिBनत 3कए गए, बेचे गए एवं
टॉक म, उपल1ध माDा के बारे म, जानकारी देने के साथ (े िषितय& का
िववरण भी 1 यूरो को उपल1ध कराएगा।
(10) अनुिHधारी 1 यूरो के (ािधकृत (ितिनिध को सुसंगत <रकॉड उपल1 ध करवाने और नमूने लेने म, सहयोग करेगा ।
(11) अनुिHधारी िनयम& के अनुसार प<रशुUता म, 3कसी भी कमी के िलए ;ितपूEत का भुगतान करेगा।

अनु9ि: का नवीकरण— (1) अनुिHधारी इन िविनयम& से जुड़े ()प- XIII म, नवीकरण आवेदन 1यूरो को अनुसूची- V म, िविन-द.
फस के साथ, देगा। (2) नवीकरण के िलए आवेदन अनुिH क वैधता क समािH क तारीख से साठ 3दन पहले (
तुत 3कया जाएगा ।
(3) अनुिHधारी से आवेदन (ाH होने पर 1यूरो, अनुिH को इन िनयम& के साथ संल' न ()प-XIV म, अिधकतम दो वष क अविध के
िलए नवीनीकृत कर सकता है ।
(4) अनुिH का नवीकरण तभी 3कया जाएगा जब 1 यूरो को इस बात क संतुि. हो जाए 3क अनुिHधारी के पास सुसंगत मानक के
अनुसार प<रw कृत बमू य धातु
का िविनमाण करने और परी;ण करने के िलए आवKयक बुिनयादी ढांचा और ;मता है।
(5) य3द अनुिHधारी, अनुिH क वैधता क समािH से पहले नवीकरण के िलए आवेदन नहF करता है, या अपेि;त फस जमा नहF
करवाता या अपेि;त िववरण उपल1 ध नहF करता तो उसे अनुिH क वैधता समाs त हो जाने के बाद हॉलमाक के (योग करने का
अिधकार नहF होगा और ऐसे मामले म, 1यूरो 9ारा वैधता क तारीख से न1बे 3दन& क अविध के िलए अनुिH का नवीकरण आ
थिगत
3कया जा सकता है ।
(6) य3द, अनुिH के
थगन क अविध के दौरान, अनुसूची- V म, िविन-द.
े का अिधकार नहF होगा और ऐसे मामले म, 1यूरो 9ारा वैधता क तारीख से न1बे 3दन& क अविध के िलए अनुिH का नवीकरण आ थिगत 3कया जा सकता है । (6) य3द, अनुिH के थगन क अविध के दौरान, अनुसूची- V म, िविन-द. पांच हजार rपए के िवलjब फस और आवKयक द तावेजो़ं के साथ आवेदन 3कया जाता है, तो 1यूरो 9ारा अनुिH को नवीकृत 3कया जा सकता है। बशतW 3क 1यूरो 9ारा अनुिH का नवीकरण 3कये जाने तक अनुिHधारी को हॉलमाक के (योग का अिधकार नहF होगा। (7) य3द नवीकरण आवेदन िनधा<रत फस और द तावेज& के साथ थगन क अविध के अंदर (ाH नहF होता है, तो अनुिH समाH हो जाएगी। (8) य3द अनुिH िनलंबन के अधीन है या िनलंबन, रlकरण या गैर नवीकरण के िलए िवचाराधीन है तो अनुिH के नवीकरण के िनणय को 6 महीने तक आ थिगत 3कया जा सकता है । (9) थिगत करने के िनणय क सूचना अनुिHधारी को िलिखत )प म, मुहरांकन रोकने एवं हॉलमाक युx त प<रw कृत बमूय धातु क िब रोकने के िनदWश& के साथ दी जाएगी। (10) अनुिHधारी 1 यूरो के आदेश के अनुपालन के बारे म, 1यूरो को इसक पुि. करेगा। 18. . . . मा मा मा मा&यता का िनलंबन &यता का िनलंबन &यता का िनलंबन &यता का िनलंबन— (1) य3द, 3कसी भी समय प<रw कृत बमू य धातु क अनु)पता मानक के साथ बनाए रखने म, क<ठनाई हो रही हो या परी;ण उप कर खराब हो जाएं या (ाकृितक आपदा अथवा (बंधन 9ारा तालाबंदी घोिषत हो जाए या स;म 6यायालय या वैधािनक (ािधकारी 9ारा (चालन को बंद करने के िनदWश ह& तो अनुिHधारी 1 यूरो को सूिचत करके प<रw कृत बमू य धातु का मुहरांकन रोक देगा । (2) जैसे ही दोष हटा 3दए जाएं, मुहरांकन को पुन: चालू 3कया जा सकता है और इस मुहरांकन को पुन: चालू करने क जानकारी तुरंत 1 यूरो को भेज दी जाएगी ।

बमू य धातु क िब को रोकने के िनदWश दे सकता है और ऐसे (माण िनj निलिखत तक सीिमत नहF हJ, ले3कन िन>िलिखत म, से एक या
अिधक ह& सकते हJ, अथात्: —
(i) इन-हाउस या
वतंD परी;ण के बाद प<रw कृत बमू य धातु क गैर-अनु)पता
(ii) परी;ण और िनरी;ण क योजना के (ावधान& का काया6वयन नहF 3कया जाना;
(iii) परी;ण कEमय& क अनुपल1धता और वैकिपक 7व
था का न होना;
(iv) 1 यूरो के पूव मू यांकन और अनुमोदन के िबना (3 या म, मह_ वपूण संशोधन
(v) िविनमाण इकाई का
थानांतरण;
(vi) तीन महीने से अिधक लj बे समय तक िविनमाण इकाई बंद रखना

(ख) अनुिHधारी 9ारा मा6यता क 3कसी भी Zनबधन और शतS का उलंघन करने पर;
(ग) हॉलमाक क गई बमूय व
तुएं मानक के अनु)प न होने पर;
(घ) िशकायत क जांच के िलए या 1यूरो के (ािधकृत (ितिनिध के साथ िनरी;ण के िलए दौरे के दौरान अनुिHधारी 9ारा सहयोग करने
म, िवफल रहने पर;
(ड.) अनुिHधारी िनलंबन क अविध के दौरान हॉलमाक का (योग करते ए पाया जाता है;
(च) अनुिHधारी अनुिH के अंतगत न आने वाली प<रwकृत बमूय 3क
म क धातु पर हॉलमाक िचिBनत करता आ पाया जाता है;
(छ) एक वष क अविध के िलए अनुिH िनलंिबत हो;
(ज) अनुिHधारी ने िनयत समय के भीतर अपे;त सुधारा_मक कायवाही नही क है या सुधारा_मक कारवाई करने के बावजूद भी वैसी ही
िवसंगितय& क पुनरावृिV होती है;
ै;
(छ) एक वष क अविध के िलए अनुिH िनलंिबत हो;
(ज) अनुिHधारी ने िनयत समय के भीतर अपे;त सुधारा_मक कायवाही नही क है या सुधारा_मक कारवाई करने के बावजूद भी वैसी ही
िवसंगितय& क पुनरावृिV होती है;
(2) अनुिH को रl करने या नवीकृत न करने से पहले, 1यूरो कारण& का उलेख करते ए, अनुिH को रl करने या नवीकृत न करने के
अपने आशय क सूचना अनुिHधारी को देगी।
(3) य3द सूचना उप-िविनयम (1) के खंड (ड.) या (च) म, 3दए गए कारण& के कारण& से रlकरण या गैर-नवीकरण के िलए जारी क जाती
है तो अनुिHधारी को िनदWश 3दया जाएगा 3क वह हॉलमाक वाली प<रwकृत बमूय धातु क िचBनांकन करना बंद कर दे और हॉलमाक
क गई प<रwकृत बमूय धातु का िव य बंद कर दे।
(4) उप-िविनयम (2) के अधीन सूचना के (ाH हो जाने पर अनुिHधारी सूचना क (ािH क तारीख से 14 3दन के भीतर 1यूरो को
प.ीकरण (
तुत कर सकेगा और अनुिHधारी अिधिनयम क धारा 33 के उपबंध& के अनुसार शमन करने के िलए अपने मामले पर
िवचार करने हेतु और अनुरोध कर सकेगा।
(5) 1यूरो (
तुत 3कए गए
प.ीकरण पर िवचार करेगा और य3द अनुरोध 3कया जाए अनुिHधारी या उसके (ािधकृत (ितिनिध को
7ि8गत सुनवाई का अवसर (दान करेगा;
े िलए अपने मामले पर
िवचार करने हेतु और अनुरोध कर सकेगा।
(5) 1यूरो (
तुत 3कए गए
प.ीकरण पर िवचार करेगा और य3द अनुरोध 3कया जाए अनुिHधारी या उसके (ािधकृत (ितिनिध को
7ि8गत सुनवाई का अवसर (दान करेगा; और 1यूरो, शमन करने के िलए, अनुरोध पर, य3द अिधिनयम के उपबंध& के अनुसार,
अनुिHधारी 9ारा 3कया गया पर, िवचार कर सकेगी।
(6) अपराध के शमन के मामले म, अनुिH रl करने के िलए कारवाई नहF क जाएगी।
(7) य3द कोई
प.ीकरण नहF 3दया है, तो 1यूरो नो<टस क अविध क समािH पर मा6 यता रl कर सकता है।
(8) जब अनुिH रl कर दी जाती है या नवीकृत नहF क जाती है तब अनुिHधारी अिधिनयम क धारा 34 के अधीन 3कसी अपील के
लंिबत होते ए भी हॉलमाक वाले प<रwकृत बमूय धातु के िचBनांकन और िव य को बंद करेगा।
(9) उप-िविनयम (1) के खंड (ड.) या (च) म, 3दए गए कारण& से रlकरण या गैर-नवीकरण के मामल& म, 1यूरो ऐसे आदेश पा<रत 3कए
जाने क तारीख से एक वष क िवराम अविध से पहले अनुिH अनुदV करने के आवेदन को
वीकार नहF करेगा।
(10) जब अनुिH िनलंबनाधीन रखी जाती है या रl कर दी जाती है या नवीकृत नहF क जाती या समाH हो जाती है तब 1यूरो अपने
वेबसाइट पर ऐसी अनुिH क िविशि.यां डालेगी।
(11) अनुिHधारी 1यूरो को मूल अनुिH द

NOTIFICATION
New Delhi, the 14th June, 2018
F. No. BS/11/05/2018.—In exercise of the powers conferred by section 39 read with sections 13 and 14 of the
Bureau of Indian Standards Act, 2016 (11 of 2016), the Executive Committee of the Bureau of Indian Standards, with the
previous approval of the Central Government, hereby makes the following regulations, namely:-
1.
Short title and commencement. - (1) These regulations may be called the Bureau of Indian Standards
(Hallmarking) Regulations, 2018.
(2) They shall come into force on the date of their publication in the Official Gazette.
2.
Definitions. - (1) In these regulations, unless the context otherwise requires,–
(a) “Act” means the Bureau of Indian Standards Act, 2016;
(b) “carat” means the ratio between the mass of gold content and the total mass expressed in parts per twenty-
four;

(c) “fineness” means the ratio between the mass of precious metal content and the total mass expressed in parts
per thousand;
(d) “rules” means the Bureau of Indian Standards Rules, 2017;
(e) “Schedule” means the Schedule annexed to these regulations.
(2) The words and expressions used herein and not defined, but defined in the Act, shall have the same meaning as
assigned to them in the Act.
Chapter I
Grant, Operation, Renewal and Cancellation of Certificate of Registration
3.
Application for certificate of registration. - (1) A jeweller shall apply for grant of certificate of registration to
sell precious metal articles notified under sub-section (1) of section 14 of the Act.
(2)
The application under sub-regulation (1) shall be made to the Bureau in Form-I, annexed to these regulations,
along with the fee specified in the Schedule-I.
(3)
The application form shall be signed by the applicant or by any other person authorised in this regard.
(4)
The application shall be accompanied by self-certified copy of the following documents, namely:-
(a)
proof of establishment of the firm or company;
(b)
proof of the address of the premises;
(c)
proof of identity of the signatory;
(d) map indicating location of the premises from the nearest landmark; and
(e) proof in regard to annual turnover.

(5)
The application shall be rejected if it is not accompanied by requisite fee.
(6)
The application shall be acknowledged on its receipt.
(7)
If the documents submitted under sub regulation (4) are not in order, the Bureau may call for required document
or any supplementary information, as the case may be, if required for the purpose of clarification.
(8)
If the document or clarification furnished by the applicant is found in order, the application shall be further
processed for grant of a certificate of registration.
(9)
The application under sub-regulation (2) may be rejected by the Bureau if the documents are not found in order.
(10)
The applicant may furnish his reply with necessary documents and may request for hearing either in person or
through a representative authorised by him within fourteen days from the date of receipt of the notice.
(11)
The decision of the Bureau with the grounds of rejection shall be communicated in writing to the applicant.
(12)
The application fee shall not be refundable in case of rejection of the application under sub-regulation (9).
4.
Grant of certificate of registration. - (1) The Bureau may grant certificate of registration,-
(a) if the application is found in order; and
(b) on payment of registration fee specified in Schedule-I.

(2)
The certificate of registration shall be granted in Form-II annexed to these regulations and shall be valid for a
period of five years.
(3)
The details of the certificate of registration shall be hosted on the website of the Bureau.
(4)
The certificate of registration shall be valid for the premises mentioned in the certificate of registration.
(5)
The certificate of registration shall be subject to terms and conditions specified in regulation 5.
5.
Terms and conditions of certificate of registration. - (1)
The registered jeweller shall be responsible for
purity and fineness of the hallmarked precious metal articles sold by it.
(2)
The registered jeweller may sell hallmarked precious metal articles, which are marked with the identification
mark of any other jeweller, provided evidence of purchase or authorisation in any other form is available with him.
(3)
The registered jeweller getting the article hallmarked shall be responsible for purity and fineness of such article.
(4)
The registered jeweler, who makes the sale shall be liable to pay compensation for any shortage in purity or
fineness as per rules.
(5)
The registered jeweller shall inform the Bureau of any change in premises and management of the firm.

The registered jeweller shall submit the precious metal articles to the assaying and hallmarking centre with a
request for hallmarking, in writing for each consignment and a copy of the each of the request shall be maintained by
him.
(8)
While submitting the precious metal articles for assaying and hallmarking, the registered jeweller shall mention
his name and address, certificate of registration number, identification mark, type of article, number of article, declared
purity of each article or group of articles and overall weight of consignment in each request, which shall be signed by an
authorised representative of the jeweller with date.
(9)
The registered jeweller shall declare the name and signature of his representative who shall be authorised to
submit request for hallmarking, to the assaying and hallmarking centre.

Schedule III.

(11)
The bill or invoice of sale of hallmarked precious metal articles shall indicate separately description of each
article, net weight of precious metal, purity in carat and fineness, and hallmarking charges.
(12)
In case of any amendment or revision of the standard, the Bureau shall give notice of thirty days to the
registered jeweller before its implementation.
(13)
The registered jeweller shall maintain record of copies of request for hallmarking, invoice or bill issued by
assaying and hallmarking centre, invoice or bill of sale of hallmarked articles and invoice or bill of purchase of
hallmarked articles from jewellers, if any, for a period of five years or till the hallmarked articles are sold, whichever is
longer.
(14)
The registered jeweller shall co-operate with the authorised representative of the Bureau in inspection of its
outlet, in production of relevant records and drawal of sample during surveillance or for investigation of a complaint.
(15)
The registered jeweller shall display prominently in the sales outlet the original certificate of registration issued
by the Bureau for sale of hallmarked articles and other display requirements as stipulated by the Bureau.

(16)
The Bureau may alter, during the validity of the certificate of registration, any terms and conditions of the
certificate of registration by giving thirty days’ notice to the registered jeweller.
(17)
The violation of terms and conditions, may lead to the cancellation of the certificate of registration.
6.
Renewal of certificate of registration. - (1) The registered jeweller shall submit renewal application in Form-III
annexed to these regulations to the Bureau along with fee as specified in Schedule-I before thirty days of the
expiry of the validity of certificate of registration.
(2)
In case renewal application is received before the expiry of validity,-
(a) the certificate of registration may be renewed for a period of five years; or
(b) the decision on renewal of the certificate of registration may be kept under deferment up to three months,
if certificate of registration is being considered for cancellation or non-renewal and the decision of
deferment shall be informed to the registered jeweller with instructions to stop the sale of hallmarked
precious metal articles and stop getting precious metal articles hallmarked.
7.
Cancellation or non-renewal of certificate of registration.

Cancellation or non-renewal of certificate of registration. - (1) The Bureau may cancel or not renew a certificate
of registration, if,-
(a) any declaration made by the jeweller is found to be false or incorrect;
(b) registered jeweller has violated any of the terms and conditions of the certificate of registration;
(c) registered jeweller has sold or offered for sale of hallmarked precious metal article of purity or fineness less than
that claimed or marked on the article;
(d) registered jeweller has failed to co-operate with the authorised representative of the Bureau to enable him to
discharge his duties during the visit for surveillance or investigation of a complaint;
(e) registered jeweller is found indulging in any unfair practices amounting to misuse of hallmark.
(2)
Before cancellation or non-renewal of certificate of registration, the Bureau shall give notice to the registered
jeweller of its intention to cancel or not renew the certificate of registration citing reasons for the same.
(3)
In case the notice is issued for cancellation or non-renewal of certificate of registration due to reasons given at
clause (e) of sub-regulation (1), the registered jeweller shall be instructed to stop the sale of hallmarked precious metal
articles and stop getting precious metal articles hallmarked forthwith.

(4)
On receipt of notice under sub-regulation (2), the registered jeweller may submit an explanation to the Bureau
within fourteen days from the date of receipt of the notice.

(5)
When an explanation is submitted, the Bureau may consider the explanation and give a personal hearing to the
registered jeweller or his authorised representative, as the case may be.
(6)
In the case of compounding of the offence, the certficate shall not be processed for cancellation.
(7)
If no explanation is submitted, the Bureau may cancel the certificate of registration on the expiry of period of
the notice.
(8)
Where a certificate of registration has been cancelled or not renewed, the jeweller shall stop the sale of
hallmarked precious metal articles and stop getting precious metal articles hallmarked from any assaying and
hallmarking centre notwithstanding the pendency of appeal under section 34 of the Act.
(9)
In cases of cancellation or non-renewal due to reasons given in clause (e) of sub- regulation (1), the Bureau shall
not accept an application for grant of certificate of registration before a cooling period of one year from the date of
passing of such order.

its website.

The jeweller shall return the original certificate of registration document to the Bureau in the event of its
surrender, cancellation or non-renewal and shall ensure defacing of the hallmark from the precious metal articles
available in stock.
(12)
In the event of cancellation, non-renewal or the jeweller opting to surrender the certificate of registration, the
jeweller shall forthwith destroy all publicity material such as handbills, pamphlets and letterheads, through which the
jeweller claims to be the registered jeweller for selling hallmarked precious metal articles.
(13)
A registered jeweller, who has been convicted under the provisions of the Act, shall not be eligible to apply for
certificate of registration for a cooling period of one year from the date of such conviction.
Chapter II Grant, Operation, Renewal, Suspension and Cancellation of Recognition of Assaying and Hallmarking Centre 8. Application for recognition. - (1) Any assaying centre set up in accordance with a relevant Indian Standard may apply for grant of recognition to operate as assaying and hallmarking centre.

The application shall be made in the Form-IV annexed to these regulations to the Bureau along with the fee

On examination, the Bureau may reject an application, if, -
(a) the application is found to be incomplete or without relevant documents;
(b) at any time during processing of application it is found that the assaying and hallmarking centre is indulging in
any malpractice amounting to misuse of hallmark for which it is liable to be prosecuted under the Act;
(c) the centre does not have the necessary infrastructure and competence as per the relevant Indian Standard for
carrying out assaying and hallmarking of the precious metal articles;
(d) the application is submitted before expiry of cooling period in case of cancellation or non-renewal of
recognition as specified in sub-regulation (9) of regulation 13 or conviction under provisions of the Act as
specified in sub-regulation (11).

(8)
Before rejecting any application under sub-regulation (7), the Bureau shall give a notice to the applicant citing
the deficiencies therein.

An applicant or a person convicted under the provisions of the Act shall not be eligible to apply for a cooling
period of one year from the date of such conviction.

9.
Grant of recognition. - (1) The Bureau shall grant recognition,-
(a) on satisfaction that the Centre has the necessary infrastructure and competence as per the relevant standard for
carrying out assaying and hallmarking of the precious metal articles; and
(b) on payment of recognition fee and assessment fee as specified in Schedule-II.
(2)
The certificate of recognition shall be issued in Form-VI annexed to these regulation, giving scope of
recognition.
(3)
The assaying and hallmarking centre may request for change in scope of recognition.

On receipt of an application under sub-regulation (3), the Bureau may examine the request, carry out
assessment, as required for considering the change of scope.

The recognition granted under this regulation shall be valid for a period of three years.

The details of assaying and hallmarking centres recognised by the Bureau shall be hosted on its website.
(7)
The recognition of assaying and hallmarking centre shall be subject to the terms and conditions as provided in
regulation 10.
10.
Terms and conditions of recognized of assaying and hallmarking centre. - (1) The assaying and hallmarking
centre shall be responsible for determination of purity and fineness of the precious metal articles hallmarked by it.
(2)
The assaying and hallmarking centre shall inform the Bureau whenever there is any change in the management,
premises or name and address of the Centre.
(3)
The assaying and hallmarking centre shall inform the Bureau of any changes in machinery, equipment, assaying
personnel, non-availability of certified reference materials or breakdown of any major equipment affecting sampling,
assaying and hallmarking activities.

(4)
The assaying and hallmarking centre shall accept the jewellery for hallmarking as per the relevant Standard only
from a certified jeweller with request for hallmarking in writing giving details as specified in sub-regulation (7) of
regulation 5.
(5)
In case of any amendment or revision of the standard, the Bureau shall give notice of one month to the assaying
and hallmarking centre before its implementation.
(6)
The testing and marking shall be carried out as per relevant Indian Standard using calibrated equipment and
certified reference material.
(7)
The design of hallmark and particulars to be marked with it shall be as specified in the Schedule-III.
(8)
The assaying and hallmarking centre shall maintain records as specified by the Bureau including the records of
request for hallmarking received from jewellers.
(9)
The assaying and hallmarking centre shall take hallmarking fee from jewellers as specified in Schedule-IV and
issue bill or invoice for each consignment as per request for hallmarking received, to the jeweller.
(10)
The assaying and hallmarking centre shall deposit the hallmarking fee to the Bureau as specified in Schedule-
IV.
(11)
The assaying and hallmarking centre shall furnish the details regarding the precious metal articles hallmarked as
well as rejected, in number and weight on monthly and annual basis.

of the following documents, namely:-
(a)

proof of identity of the signatory;
(d)
map indicating location of the premises from some nearest prominent landmark;
(e)
quality manual; and
(f)
affidavit cum undertaking in Form-V annexed to these regulations.

(2)
The application for renewal shall be submitted ninety days before the date of expiry of the validity of
recognition

The Bureau, on receipt of an application for renewal under sub-regulation (1), may renew the recognition for a
period of three years after satisfying that the centre continues to have the necessary infrastructure and competence as per
the relevant Standard for carrying out assaying and hallmarking of the precious metal articles and also considering the
past records of the applicant.
(4)
In case the assaying and hallmarking centre does not apply for renewal before the expiry of validity along with
requisite fee, it shall cease to have right to use hallmark after the validity of recognition is over and in such case, the
renewal of recognition may be deferred for a period of ninety days from the date of validity by the Bureau.
(5)
If, during the period of deferment of recognition, an application is made along with late fee of rupees five
thousand, the requisite fee, specified in Schedule-II and required documents, the recognition may be renewed by the
Bureau:

renewed by the Bureau.

(6)
In case renewal application along with requisite fee and documents is not received within such period of
deferment, the recognition shall stand expired.
(7)
The decision on renewal of the recognition may be kept under deferment up to six months from the date of its
validity, if recognition is under suspension, or being considered for suspension, cancellation or non-renewal.
(8)
The decision of deferment shall be informed to the centre in writing with instructions to stop hallmarking of
precious metal articles.
12. Suspension of recognition. - (1) If, at any time, there is difficulty in assaying and hallmarking of the precious metal
articles or in the event of test equipment getting out of order or due to natural calamities or a lock out declared by the
management; or directed by a competent court or statutory authority, the assaying and hallmarking centre shall inform it
to the Bureau immediately.
(2)
As soon as the events which caused the suspension have been removed, the intimation of revocation of the
suspension of operations shall be sent to the Bureau immediately.

If, at any time, the Bureau has sufficient evidence that the assaying and hallmarking may not be conforming to
the Indian Standard, the assaying and hallmarking centre shall be directed to suspend its operation and such evidence
may not be limited to, but may include one or more of the following, namely:-
(i) non-conformity of hallmarked precious metal articles established after in-house or independent testing;
(ii) non-implementation of the provisionof the relevant Standard;
(iii) non-availability of testing personnel and absence of alternate arrangements;
(iv) relocation of assaying and hallmarking centre;
(v) prolonged closure of assaying and hallmarking centre for more than three months;
(vi) assaying and hallmarking on precious metal articles not included in the scope of the recognition;
(vii) non-submission of monthly or yearly statement regarding hallmarking charges collected from certified
jewellers;
(viii)
non-payment of marking fee to the Bureau within stipulated period.
(4)
The assaying and hallmarking centre whose recognition has been placed under suspension shall inform the
Bureau about the compliance of its order.
(5)
On receipt of corrective actions, a special assessment, if required, may be carried out to verify the effectiveness
of the corrective actions.

(6) The Bureau shall revoke the suspension after satisfying itself that the assaying and hallmarking centre -
(a)
has taken necessary actions;
(b)
deposited assessment fee as specified in Schedule -II; and
(c)
has provided sufficient evidence to establish competence of the centre as per the relevant standard for
assaying and hallmarking of precious metal articles.
13. Cancellation or non-renewal of recognition.- (1)
The Bureau may cancel or not renew the recognition of an
assaying and hallmarking centre for any of the following reason, namely:-
(a) any declaration made by the assaying and hallmarking centre is found to be false or incorrect;
(b) assaying and hallmarking centre has violated any of the terms and conditions of the recognition;
(c) articles marked with hallmark do not comply with the relevant Indian Standard;
(d) assaying and hallmarking centre has failed to co-operate with the authorised representative of the Bureau during
his visit for assessment or for investigating a complaint;

articles for non-certified jewellers, marking of articles with incomplete hallmark or hallmarking articles without
carrying out testing or hallmarked precious metal article is found to have shortage of purity of more than forty
parts per thousand;
(f) assaying and hallmarking centre is found to be marking precious metal articles with hallmark during period of
suspension;
(g) assaying and hallmarking centre is under suspension for a period of one year;
(h) assaying and hallmarking centre has not taken required corrective actions within stipulated time or in spite of
taking corrective actions there is recurrence of similar discrepancies.
(2)
Before cancelling or non-renewal of the recognition, the Bureau shall give notice to the assaying and
hallmarking centre of its intention to cancel or not to renew the recognition citing the reasons.
(3)
In case the notice is issued for cancellation due to reasons provided in clauses (d),(e) or (f) of sub-regulation (1)

The application shall be accompanied by self-certified copy of the following documents, namely:-
(a)
proof of the establishment of the firm or company;
(b)
proof of the address of the premises;
(c)
proof of identity of the signatory;
(d) map indicating location of the premises from some nearest prominent landmark;
(e) micro or small scale industry certificate, if applicable;
(f) process flow chart of refining or minting, as applicable
(g) design and weight of the bullion or coin, as applicable
(h) list of manufacturing machinery in Form-IX annexed to these regulations;
(i) list of test equipment with valid calibration in Form-X annexed to these regulations;
(j) accreditation of the laboratory of refinery or mint by National Accreditation Board for Testing and
Calibration Laboratories (NABL) or London Bullion Market Association (LBMA);
(k) plant layout;
(l) list of technical personnel;
(m) list of certified reference material; and
(n) test report of in-house testing.
(4)
The application form shall be signed by the applicant or by any other person authorised in this regard.
(5)
The application shall be rejected, if it is not accompanied by requisite fee.
(6)
The application shall be acknowledged after its receipt and recorded after scrutiny, if found in order.

The Bureau may call for any supplementary information or documentary evidence from the applicant in support
of or to substantiate any statement made by him in his application.

The Bureau may reject an application, if,-
(a)
the application is found to be incomplete or without specified documents or does not fulfill the specified
requirements.
(b)
at any time during processing of application it is found that the applicant is indulging in any malpractice
amounting to misuse of hallmark for which it is liable to be prosecuted under the Act;
(c)
the applicant does not have the necessary infrastructure and competence as per the relevant Standard and
for compliance to the provisions of scheme of testing and inspection;
(d)
the refined precious metal does not conform to relevant Standard;
(e)
the application is submitted before expiry of cooling period in case of cancellation or non-renewal of
licence as specified in sub-regulation (9) of regulation 19 or conviction under provisions of the Act as
specified in sub-regulation (12).

Before rejecting an application, the Bureau shall give notice to the applicant citing the deficiencies therein.

The applicant may furnish his reply with necessary documents and may request for hearing, either in person or
through a representative authorised by him on his behalf within fourteen days from the receipt of the notice.

An applicant or a person convicted under the provisions of the Act shall not be eligible to apply for a cooling

15.
Grant of licence.- (1) The Bureau shall grant licence,-
(a) on satisfaction of the Bureau that the applicant has the necessary infrastructure and competence for
manufacturing and testing of refined precious metal as per the relevant Indian Standard;
(b) if the refined precious metal conform to the relevant Indian standard;
(c) on payment of marking fee as specified in Schedule-V.

(2)
The applicant shall co-operate with the authorised representative of the Bureau to inspect the premises relating
to office, manufacturing, testing, storage and to draw and test sample(s) for the purpose of verification under sub-
regulation (1).
(3) The licence shall be granted in Form-XI annexed to these regulations.

The licensee may request for change in scope of licence with fee as per Schedule -V.

Terms and conditions of licence.- (1) The licensee shall be responsible for fineness of the hallmarked refined
precious metal manufactured by it.

availability of certified reference materials or breakdown of any major equipment affecting sampling, assaying and
hallmarking activities.
(4)
The licensee shall test the refined precious metal as per the scheme of testing and inspection as specified by the
Bureau and accepted by the licensee.
(5)
The licensee shall hallmark refined precious metal that conforms to the relevant Standard.
(6)
The design of hallmark and particulars to be marked with it shall be as specified in the Schedule-III.
(7)
In case of any amendment or revision of the standard or the scheme of testing and inspection, the Bureau shall
give notice of one month to the licensee before its implementation.
(8)
The licensee shall maintain records as specified by the Bureau from time to time.
(9)
The licensee shall furnish information regarding quantity manufactured, marked, sold, available in stock along
with details of the consignees to the Bureau.
(10)
The licensee shall co-operate with the authorised representative of the Bureau for inspection and testing, in
production of relevant records and drawl of samples.

The Bureau may alter any terms and conditions of the licence during the period of the validity of the licence by
giving thirty days’ notice to the licensee.

The violation of the above terms and conditions may lead to the cancellation of the licence.
17.
Renewal of licence. - (1) The licensee shall submit application for renewal of licence in Form-XIII annexed to
these regulations accompanied by fee as specified in Schedule-V.
(2)
The application for renewal shall be made before sixty days from the date of expiry of the licence.
(3)
The Bureau may, on receipt of application from a licensee, renew the licence for a maximum period of two
years in Form-XIV annexed to these regulations.
(4)
The licence shall be renewed only after satisfaction of the Bureau that the licensee continues to have the
necessary infrastructure and competence for manufacturing and testing of the refined precious metal as per the relevant
standard and the scheme of testing and inspection and also considering the past records.

(5)
In the case the licensee does not apply for renewal before the expiry of validity of licence or deposit requisite
fee or provide required details, it shall cease to have right to use hallmark after the validity of licence is over and in such
case, the renewal of licence may be deferred for a period of ninety days from the date of validity by the Bureau.
(6)
If, during the period of deferment of licence, an application is made along with late fee of rupees five thousand,
requisite fee specified in Schedule-V and required documents, the licence may be renewed by the Bureau:

(9)
The decision of deferment shall be informed to the licensee in writing with instructions to stop marking and sale

18.
Suspension of licence. - (1) If, at any time, there is difficulty in maintaining the conformity of the refined
precious metal to the Standard or the testing equipment goes out of order or due to natural calamities or a lock out
declared by the management; or, closure of operations directed by a competent court or statutory authority, the marking
of the refined precious metal shall be stopped by the licensee under intimation to the Bureau.

If, at any time, there is sufficient evidence that the refined precious metal carrying the hallmark may not be

to, but may include one or more of the following, namely:-
(i)
non-conformity of the refined precious metal established after in-house or independent testing;

non-implementation of the provision(s) of the scheme of testing and inspection;
(iii)
non-availability of testing personnel and absence of alternate arrangements;
(iv)
significant modification(s) in the process without prior evaluation and approval of the Bureau;
(v)
relocation of manufacturing unit;
(vi)
prolonged closure of manufacturing unit for more than three months;
(vii) marking non-conforming refined precious metal;
(viii) marking on refined precious metal of variety not included in the licence;
(ix)
non-compliance of any instruction issued by the Bureau.
(4) The licensee whose licence has been placed under suspension shall confirm to the Bureau about compliance of its
order.

(5) The licensee shall inform the corrective actions taken to the Bureau and on receipt of corrective actions, a special

(a) has taken necessary actions;

(c) has provided sufficient evidence to establish competence for manufacturing and testing of refined precious
metal as per relevant standard;

19.
Cancellation or non-renewal of licence. – (1) The Bureau may cancel or not renew a licence for any of the
following reason, namely:-
(a) any declaration made by the licensee is found to be false or incorrect;
(b) the licensee has violated any of the terms and conditions of the licence;
(c) the refined precious metal marked with hallmark does not comply with the standard;
(d) the licensee has failed to cooperate with the authorised representative of the Bureau during his visit for
inspection or for investigating a complaint;
(e) the licensee is found to be using hallmark during period of suspension;
(f) the licensee is found marking hallmark on refined precious metal of variety not covered in the licence;
complaint;
(e) the licensee is found to be using hallmark during period of suspension;

(g) the licence is under suspension for a period of one year;
(h) the licensee has not taken required corrective actions within stipulated time or in spite of taking corrective

(2)
Before cancelling or not renewing a licence, the Bureau shall give notice to the licensee of its intention to cancel
or not renew the licence citing the reasons.
(3)
In case the notice is issued for cancellation or non-renewal due to reasons provided in clauses (e) or (f) of sub-
regulation (1) the licensee shall be instructed to stop marking refined precious metal with the hallmark and stop sale of
hallmarked refined precious metal.

(4)
On the receipt of notice under sub-regulation (2), the licensee may submit an explanation to the Bureau within
fourteen days from the date of receipt of the notice and the licensee may further request for considering his case for
compounding as per provisions of section 33 of the Act.

The Bureau shall consider the explanation submitted and give a personal hearing to the licensee or its authorised
representative, if sought and the Bureau may consider the request for compounding, if made by the licensee as per the
provisions of the Act.
(6) In the case of compounding of offence, the licence shall not be processed for cancellation.

If no explanation is submitted, the Bureau may cancel the licence on the expiry of period of the notice.

metal with hallmark notwithstanding the pendency of any appeal under section 34 of the Act.
(9)
In case of cancellation or non-renewal due to reasons provided in clauses (e) or (f) of sub-regulation (1) the
Bureau shall not accept application for grant of licence before a cooling period of one year from the date of passing of
such order.
(10)
When a licence is kept under suspension or cancelled or not renewed or expired, the Bureau shall host the
particulars of such licence on its website.
(11)
The licensee shall return the original licence document to the Bureau in the event of its surrender, non-renewal
or cancellation.
(12)
In the event of cancellation, non-renewal or the licensee opting to surrender the licence, the licensee shall
forthwith destroy all publicity material such as handbills, pamphlets, and letter- heads through which he claims to be a
licensee of the Bureau.

If a jeweller has five or more outlets anywhere in India, he can opt for the certificate of registration at corporate
level covering various retail outlets in one certificate and claim a discount of 10% in registration fee for each

artefacts provided to it by only BIS certified jeweler, on chargeable basis is the responsibility of the assaying
and hallmarking centre.

I/We agree to indemnify BIS for all claims/damages arising out of hallmarking of any gold or silver article due
to shortage of purity that may be made against BIS by any person/consumer/association/ jeweller etc.
I/We shall use the BIS logo only with the words “BIS recognised A and H Centre” on documents such as
letterhead, receipt, invoice, delivery challan, assay sheet, test - report of assay, certificate of hallmarking, if
issued, and for publicity through print and/or electronic media.

I/We shall neither use its recognition in any manner so as to bring disrepute to BIS nor shall make any statement
relevant to its recognition which may be considered misleading by BIS.

I/We shall not subcontract any of our activities including receiving, sampling, assaying and hallmarking to any
other agency as specified in IS 15820.

The identification mark or logo as given below is owned by us. We have given this mark or logo for its
application as a component of Hallmark on the jewellery or artefacts assayed and Hallmarked by us for only BIS
certified jewelers. We shall not use any other Identification Mark or logo for Hallmarking. Prior permission of
the Bureau shall be taken in case we wish to change the Mark registered with the Bureau. We shall be
responsible for display of our mark or

I/We understand that the validity of recognition of an A and H Centre is for a period of three years subject to
satisfactory performance based on assessment of its capability and competence by BIS. This affidavit shall
remain in force until the recognition is cancelled by BIS. Any violation of the affidavit cum undertaking may
lead to the cancellation of the Recognition.
