भारतीय मानक ब्यूरो (ईपभोक्ता मामले जिभाग) ऄजधसूचना नइ ददल्ली, 27 ऄक्तूबर 2021

फा. सं. बीएस/11/05/2018.—ब्यूरो, भारतीय मानक ब्यूरो ऄजधजनयम, 2016 (2016 का 11) की धारा 13 और 14 के साथ पठित धारा 39 द्वारा प्रदत्त िजक्तयों का प्रयोग करते हुए, केंद्रीय सरकार के पूिव ऄनुमोदन से, भारतीय मानक ब्यूरो (हॉलमार्ककग) जिजनयम, 2018 का और संिोधन के जलए एतद् द्वारा जनम्नजलजखत जिजनयम बनाता है, ऄथावत्:-

1. (1) आन जिजनयमों का संजिप्त नाम भारतीय मानक ब्यूरो (हॉलमार्ककग) संिोधन जिजनयम, 2021 है।
   (2) ये राजपत्र में ईनके प्रकािन की तारीख को प्रिृत्त होंगे।

भारतीय मानक ब्यूरो (हॉलमार्ककग) जिजनयम, 2018 (जजसे आसमें आसके पश्चात् ईक्त जिजनयम कहा गया है), में ऄध्याय 1 के ऄध्याय िीर्वक में 'निीकरण' िब्द का लोप दकया जाएगा।

ईक्त जिजनयमों में, जिजनयम 3 के स्ट्थान पर, जनम्नजलजखत जिजनयम रखा जाएगा ऄथावत्:-
"3. रजजस्ट्रीकरण प्रमाण-पत्र हेतु अिेदन: - (1) कोइ अभूर्ण जिक्रेता ऄजधजनयम की धारा 14 की ईप-धारा (1) के ऄधीन ऄजधसूजचत बहुमूल्य धातु की िस्ट्तुओं की जबक्री करने के जलए रजजस्ट्रीकरण प्रमाण-पत्र प्रदान करने के जलए अिेदन करेगा।
(2) ईप-जिजनयम (1) के ऄधीन अिेदन, आन जिजनयमों से ईपाबंद्ध प्ररूप 1 में ब्यूरो को दकया जाएगा।

(3) ब्यूरो का जिजनश्चय ऄस्ट्िीकृजत के अधारों के साथ अिेदक को जलजखत रूप में संसूजचत दकया जाएगा।
(4) यदद दकसी अभूर्ण जिक्रेता के भारत में कहीं भी पांच या ऄजधक खुदरा अईटलेट हैं, तो िह एक प्रमाणपत्र में जिजभन्न खुदरा दुकानों को अजिष्ट करते हुए कॉपोरेट स्ट्तर पर रजजस्ट्रीकरण प्रमाणपत्र का जिकल्प चुन सकता है।"
4. ईक्त जिजनयमों में, जिजनयम 4 में, -
(क) ईप-जिजनयम (1) का लोप दकया जाएगा;
(ख) ईप-जिजनयम (2) में, "पांच साल की ऄिजध के जलए" िब्दों के स्ट्थान पर "जीिन-पयवन्त" िब्द रखे जाएंगे। 5. ईक्त जिजनयमों में, जिजनयम 5 में, ईप-जिजनयम (3) के पश्चात, जनम्नजलजखत ईप-जिजनयम, ऄंतः स्ट्थाजपत दकया जाएगा, ऄथावत्: -
“(3क) हॉलमावक िाले अभूर्णों में पठरितवन अभूर्णों के भार के पचास प्रजतित या दो ग्राम तक, जो भी कम हो, अभूर्ण जिक्रेता पर िुद्धता की जजम्मेदारी के ऄध्यधीन ऄनुज्ञात होगा।
6. ईक्त जिजनयमों में, जिजनयम 6 का लोप दकया जाएगा ।

े भार के पचास प्रजतित या दो ग्राम तक, जो भी कम हो, अभूर्ण जिक्रेता पर िुद्धता की जजम्मेदारी के ऄध्यधीन ऄनुज्ञात होगा।
6. ईक्त जिजनयमों में, जिजनयम 6 का लोप दकया जाएगा ।
7. ईक्त जिजनयमों में, जिजनयम 7 में, -
(i)
“या गैर-निीकरण” िब्दों, जहां कहीं िे अते हैं, का लोप दकया जाएगा।
(ii) ईप-जिजनयम (1) में "या निीकरण नहीं कर सकेगा " और ईप-जिजनयम (2) में िब्दों "या आसके निीकरण न करने" का लोप दकया जाएगा;
(iii) ईप-जिजनयम (8) में "या निीनीकृत नहीं दकया है," और ईप-जिजनयम (10) में िब्दों "या निीनीकृत न दकये गए" का लोप दकया जाएगा;
(iv) ईप-जिजनयम (12) में, ",गैर-निीकरण" िब्दों का लोप दकया जाएगा।
8. ईक्त जिजनयमों में, जिजनयम 8 में, ईप-जिजनयम (12) के पश्चात, जनम्नजलजखत ईप-जिजनयम ऄंतःस्ट्थाजपत दकया जाएगा, ऄथावत्:-
"(13) कोइ भी मान्यताप्राप्त परख और हॉलमार्ककग केंद्र, ब्यूरो द्वारा जारी ददिा-जनदेिों के ऄनुसार एक ऑफसाआट परख और हॉलमार्ककग केंद्र स्ट्थाजपत कर सकेगा।"
9. ईक्त जिजनयमों में, जिजनयम 10 में, ईप-जिजनयम (10) के पश्चात, जनम्नजलजखत ईप-जिजनयम ऄंतःस्ट्थाजपत दकया जाएगा, ऄथावत्: -
"(10क) जब कभी ऄपेजित हो, ब्यूरो ईप-जिजनयम (10) के ऄधीन जिजनर्ददष्ट हॉलमार्ककग फीस में छूट दे सकेगा।"
10. ईक्त जिजनयमों में, ऄनुसूची I का लोप दकया जाएगा।
11. ईक्त जिजनयमों में, प्ररूप 1 में, -
(i) मद 7 में, ईप-मद (ख) में, "िैधता" िब्द का लोप दकया जाएगा।
(ii) मद 8 में, "(प्रमाण संलग्न करें)" कोष्ठक और िब्दों का लोप दकया जाएगा।
(iii) मद 11 का लोप दकया जाएगा ।
12.

ईप-मद (ख) में, "िैधता" िब्द का लोप दकया जाएगा।
(ii) मद 8 में, "(प्रमाण संलग्न करें)" कोष्ठक और िब्दों का लोप दकया जाएगा।
(iii) मद 11 का लोप दकया जाएगा ।
12. ईक्त जिजनयमों में, प्ररूप 2 में, -

(क)
पैरा 1 में, "/प्रमाणपत्र का निीकरण (यथा-ऄनुप्रयोज्य काट दें)” िब्दों और कोष्ठक का लोप दकया जाएगा।
(ख) पैरा 3 में, "….. तक िैध होगा और संबंजधत जिजनयमों के ऄनुसार आसका निीकरण दकया जायेगा" िब्दों के स्ट्थान पर "िैध होगा" िब्द रखे जाएंगे।
13. ईक्त जिजनयमों में, प्ररूप 3 का लोप दकया जाएगा।

BUREAU OF INDIAN STANDARDS (Department of Consumer Affairs) NOTIFICATION New Delhi, the 27th October, 2021

F. No. BS/11/05/2018. —In exercise of the powers conferred by section 39 read with sections 13 and 14 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Bureau, with the previous approval of the Central Government, hereby makes the following regulations to further amend the Bureau of Indian Standards (Hallmarking) Regulations, 2018, namely:- 1. (1) These regulations may be called the Bureau of Indian Standards (Hallmarking) Amendment Regulations, 2021.

They shall come into force on the date of their publication in the Official Gazette. 2. In the Bureau of Indian Standards (Hallmarking) Regulations, 2018 (hereinafter referred to as the said regulations), in Chapter heading of Chapter I, the word „Renewal‟ shall be omitted. 3. In the said regulations, for regulation 3, the following regulation shall be substituted, namely:- “3. Application for certificate of registration. - (1) A jeweller shall apply for grant of certificate of registration to sell precious metal articles notified under sub-section (1) of section 14 of the Act. (2) The application under sub-regulation (1) shall be made to the Bureau in Form-I, annexed to these regulations. (3) The decision of the Bureau with the grounds of rejection shall be communicated in writing to the applicant.
(4) If a jeweller has five or more outlets anywhere in India, he can opt for the certificate of registration at corporate level covering various retail outlets in one certificate.” 4. In the said regulations, in regulation 4, - (i) sub-regulation (1) shall be omitted; (ii) in sub-regulation (2), for the words “a period of five years”, the word “lifetime” shall be substituted. 5.

In the said regulations, in regulation 5, after sub-regulation (3), the following sub-regulation shall be inserted, namely:- “(3A) Alteration in the hallmarked jewellery upto fifty per cent. of the weight of jewellery or upto two grams, whichever is lower, shall be permitted subject to the responsibility of purity on the jeweller.” 6. In the said regulations, regulation 6 shall be omitted. 7. In the said regulations, in regulation 7, -

(i) the words “or non-renewal”, wherever they occur, shall be omitted; (ii) in sub-regulations (1) and (2), the words “or not renew” shall be omitted; (iii) in sub-regulations (8) and (10), the words “or not renewed” shall be omitted; (iv) in sub-regulation (12), the words “, non-renewal” shall be omitted. 8. In the said regulations, in regulation 8, after sub-regulation (12), the following sub-regulation shall be inserted, namely:-
“(13) Any recognised Assaying and Hallmarking centre may setup an offsite Assaying and Hallmarking centre in accordance with the guidelines issued by the Bureau.” 9. In the said regulations, in regulation 10, after sub-regulation (10), the following sub-regulation shall be inserted, namely:- “(10A) The Bureau may relax the hallmarking fee specified under sub-regulation (10) as and when required.” 10.

In the said regulations, Schedule I shall be omitted. 11. In the said regulations, in Form I, - (i) in item 7, in sub-item (b), the words “Validity:” shall be omitted. (ii) in item 8, the brackets and words “(attach proof)” shall be omitted. (iii) item 11 shall be omitted. 12. In the said regulations, in Form II, - (i) in paragraph 1, the words and brackets “/renews the certificate granted to (strike out as applicable)” shall be omitted. (ii) in paragraph 3, the words “to -------and may be renewed in accordance with the said Regulations” shall be omitted. 13. In the said regulations, Form III shall be omitted.
