ORDER

1. An application under Section 441 of the Companies Act, 2013 filed for compounding of offence u/s 148 of theCompanies Act, 2013 vide Form GNL-1 through SRN N00361717.

2. The Presenting Officer, Mr. Krishan Kumar, Assistant Director, points out that on 20.11.2025 the applicants have preferred to place on record vide e-mail an order of the Hon’ble NCLT of appointment of IRP in the matter and matter was listed for appearance of the applicant/IRP in case desires to pursue the application.

3. Ld. PCS, Mr. Anand Kumar Singh, claiming to be an authorized representative, however, has not preferred to appear even once before this Forum on 09.09.2025, 09.10.2025, 20.11.2025, 19.12.2025 and 13.01.2026, but to submit a letter dated 06.01.2026 praying for withdrawal of[the] compounding application or keeping the matter in abeyance on account of appointment of IRP.

• 4, The Presenting Officer, Mr. Krishan Kumar, Assistant Director, submits that identity of the applicant vis-‘a-vis Ld. PCS is disputed till date as none has preferred to appear even once, therefore, the matter may be disposed of/rejected on account ofnon-prosecution alternatively prayer ofthe applicant through Ld. PCS may be considered for withdrawal.

5. In view of the above, the prayer of the applicants is considered and allowed and the application for compounding is permitted to be withdrawn. The application is dismissed as withdrawn, hence disposed of accordingly.
