ORDER

1. An application under Section 441 of the Companies Act, 2013 filed for compounding of default committed u/s 96 of the Companies Act, 2013 was filed by the aforesaid Applicant vide e Form GNL-I through SRN F63327936.

2. The Registrar of Companies (ROC), NCT of Delhi and Haryana vide its report dated 09.11.2023 inter-alia recommending compounding, however, after addition of Mr. Ashok Joshi, Mr. Rajinder Pal Singh Bindra and Ms. Preeti Jaiswal as applicants besides Mr. Sudeep Ellath.

3. The then Presiding Officer vide order dated 03.01.2024 has directed Ld. PCS to submit a response to the queries of the ROC and in compliance thereof, the Ld. PCS have filed a compilation of documents on 18.01.2024 in support of the contention that a solitary person can apply for compounding in case he is authorized under section 2(60) of theCompanies Act, 2013.

4. Further, during the course of hearing, Ld. PCS has preferred not to divulge or point out that similar/same offence has been compounded by this Forum on 07.03.2023 against the Company of whom the present applicant is claiming to be a representative/director and praying for compounding in his individual capacity u/s 2(60) r/w 441 r/w 96 of the Companies Act, 2013.

5. The Presenting Officer Ms. Aruna M, Assistant Director, submits that this is undisputed that this application is barred and ought not to have been even filed as the similar offence has compounded in last three years, being hit by the restrictions u/s 441 of theCompanies Act, 2013.

6. Consequent to the aforesaid proceedings, Ld. PCS prays for withdrawal of compounding application on account ‘the restrictions u/s 441 of the Companies Act, 2013 with an assurance to ensure every factual correctness. PPE, ap

7. The Presenting Officer, Ms. Aruna M, Assistant Director, confirms that the application can be withdraw by the applicant, at any stage, before it is logically concluded and endorses the prayer of the applicants.

8. In view of the above, the applicants through Ld. PCS are permitted to withdraw the compounding application and the application is dismissed as withdrawn and disposed of accordingly.
