  1. An application under Section 441 of the Companies Act, 2013 filed for compounding of default committed u/s 155 of the Companies Act, 2013 was filed by the aforesaid Applicant vide e Form GNL-1 through SRN N31029408.

  2. Ld. CA for the applicant confirm that the default under section 155 of the Companies Act, 2013 is not compoundable in nature and falls under adjudication proceedings under section 454 of the Companies Act, 2013 and the same has been recommended by the ROC NCT of Delhi and Haryana vide its report dated 01.09.2025. Further, Ld. CA submit a letter dated 11.12.2025 inter alia praying for withdrawal of the compounding application.

  3. The Presenting Officer. Mr. Purnava Ganguly, Deputy Director, confirms that the application can be withdrawn by the applicant, at any stage, before it is logically concluded and endorses the prayer of the applicants.

  4. In view of the above, the applicant is permitted to withdraw the compounding application with a liberty to file afresh, in case permissible by law. The prayer of Ld. CA is considered and allowed, and the application is dismissed as withdrawn, and disposed of accordingly.
