ORDER

1. An application under Section 441 of the Companies Act, 2013 filed for compounding of offence u/s 96(1) of the Companies Act, 2013 vide Form GNL-1 through SRN N28077261.

2. Ld. PCS for the Applicant(s) confirms that an investigation u/s 212(1)(c) of the Companies Act, 2013 is pending against the applicant company and this fact was inadvertently omitted from the compounding application, and it is a bar under 3" proviso of Section 441(1) of the Companies Act, 2013.

3. Further, Ld. PCS prayed that withdrawal of the compounding application may be permitted with an opportunity to file afresh, in case permitted by law after completion of the investigation.

4. The Presenting Officer, Ms. Aruna M, Assistant Director, confirms that the application is not maintainable in terms of 3" Proviso to Section 441(1) of the Companies Act, 2013 and endorses the prayer of applicants for withdrawal, besides liberty sought.

5. In view of the above, the prayer of Ld. PCS is considered and allowed and the compounding application for compounding default u/s 96 of the Companies Act, 2013 is permitted to be withdrawn. The application is dismissed as withdrawn, hence disposed of accordingly with an opportunity to file afresh in case permissible by law.
