Date of Hearing: 14.10.2025 ORDER

  1. Anapplication under Section 441 ofthe Companies Act, 2013 filed for compounding of offence committed u/s 177 of the Companies Act, 2013 through SRN N29416377.

  2. The Registrar ofCompanies, NCT of Delhi & Haryana has submitted its report vide letter dated 16.06.2025 wherein it has been reported that the default u/s 177 of the Companies Act, 2013 is punishable with penalty u/s 178(8) of the Act which is subjected to adjudication u/s 454 of the Act, therefore, the instant Compounding application is not maintainable.

  3. Ld. PCS for the applicant(s) through a letter dated 14.10.2025 confirms that the default under section 177 of the Companies Act, 2013 is subjected to adjudication under section 454 of the Companies Act, 2013 and therefore, prays for liberty to withdraw the compounding application.

  4. The Presenting Officer, Ms. Aruna M, Assistant Director, submits that withdrawal is permissible at any stage before the application is disposed of and therefore may be considered for approval.

  5. In view of the above, the prayer of Ld. PCS for withdrawal of Compounding Application is considered and allowed. The Compounding Application is dismissed as withdrawn, and disposed of accordingly.
