1. (1) इन िनयम का संि(@ नाम माल के भौगोिलक उपदशन (रिज#$ीकरण और संर(ण) (संशोधन) िनयम, 2019 है।
2. माल के भौगोिलक उपदशन (रिज#$ीकरण और संर(ण) िनयम, 2002 (िज4ह3 इसम3 इसके पNात मूल िनयम कहा गया है), के िनयम 56 के उप-िनयम (1) के #थान पर िनिलिखत उप िनयम रखा जाएगा: “(1) उOपादक -ारा रिज#$ीकृत भौगोिलक उपदशन के ािधकृत उपयोगकता के प म3 धारा 17 के अधीन रिज#$ीकरण के िलए रिज#$ार को आवेदन #तािवत ािधकृत उपयोगकता -ारा प भौ उ.-3 म3 कया जाएगा

THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] और साथ म3 मामले का एक कथन होगा क वह रिज#$ीकृत भौगोिलक उपदशन का उOपादक होने का दावा कैसे कर रहा है। आवेदक आवेदन क, ित रिज#$ीकृत #वOवधारी को अRेिषत करेगा, और रिज#$ार को तामीला से अवगत करेगा।”
3. मूल िनयम के िनयम 56 के उप-िनयम (2) का लोप कया जाएगा।
4. मूल िनयम के िनयम 59 के उप-िनयम (1) के #थान पर, िनिलिखत उप-िनयम रखा जाएगा:
(1) जहाँ जनल म3 िवTािपत या पुनः िवTािपत आवेदन के िवरोध क, कोई सूचना धारा 17 क, उप-धारा (3 ) के
उप-खंड (ङ) के अधीन िविनIदJ अविध के भीतर फ़ाइल नहY क, जाती या जहाँ िवरोध फ़ाइल कया जाता है और वह खाGरज कर दया जाता है, वहां रिज#$ार ािधकृत उपयोगकता को रिज#टर के भाग ख म3 िवJ करेगा और भौगोिलक उपदशन रिज#$ी क, मुहर के साथ रिज#$ीकरण माणप= जारी करेगा। 5.

या जहाँ िवरोध फ़ाइल कया जाता है और वह खाGरज कर दया जाता है, वहां रिज#$ार ािधकृत उपयोगकता को रिज#टर के भाग ख म3 िवJ करेगा और भौगोिलक उपदशन रिज#$ी क, मुहर के साथ रिज#$ीकरण माणप= जारी करेगा। 5. मूल िनयम के िनयम 59 के उप-िनयम (2) के खंड (च) और (छ) का लोप कया जाएगा।
6. मूल िनयम के िनयम 59 के उप-िनयम (3) म3, िनिलिखत का लोप कया जाएगा: “भौगोिलक उपदशन क, मढ़ी 0ई समाकृित जो उसके रिज#$ीकरण के िलए आवेदन के प म3 रिज#$ीकरण के समय दी गई है, ऐसे अनुरोध के साथ दी जाएगी।” 7. मूल िनयम क, पहली अनुसूची म3,
क) िविJ 3क के #थान पर िनिलिखत रखा जाएगा: 3क धारा 17, िनयम 56 (1) के अधीन रिज#$ीकृत भौगोिलक उपदशन के ािधकृत उपयोगकता के रिज#$ीकरण के िलए आवेदन पर शू4य

MINISTRY OF COMMERCE AND INDUSTRY (Department for Promotion of Industry and Internal Trade) NOTIFICATION New Delhi, the 12th September, 2019 G.S.R. 645(E).—The following draft of certain Rules to amend the Geographical Indications of Goods (Registration and Protection) Rules, 2002 which the Central Government proposes to make in exercise of the powers conferred by Section 87 of the Geographical Indications of Goods (Registration and Protection) Act, 1999 (48 of 1999), is hereby published, as required by sub-section (3) of the said section, for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft shall be taken into consideration on or after the expiry of a period of thirty days from the date on which the Official Gazette, containing the notification, are made available to the public; Objections or suggestions, if any, may be addressed to Ms.

DRAFT RULES 1. (1) These rules may be called the Geographical Indications of Goods (Registration and Protection) (Amendment) Rules, 2019. 2. For sub-rule (1) of Rule 56 of the Geographical Indications of Goods (Registration and Protection) Rules, 2002 (hereinafter referred as the principal rules), the following sub rule shall be substituted: “(1) An application to the Registrar for the registration under Section 17 by a producer as an authorized user of the registered geographical indication shall be made by the proposed authorized user in Form GI-3 and shall be accompanied by a Statement of Case of how he claims to be the producer of the registered geographical indication. The applicant shall also forward a copy of the application to the registered proprietor, and intimate the Registrar of due service of the same. ” 3. Sub-rule (2) of rule 56 of the principal rules shall be deleted. 4.

Clauses (f) and (g) of sub rule (2) of rule 59 of the principal rules shall be deleted. 6. In sub-rule (3) of Rule 59 of the principal rules, the following shall be deleted : “An unmounted representation of the geographical indication exactly as shown in the form of application for registration thereof at the time of registration shall accompany such request.” 7. In the FIRST SCHEDULE of the principal rules,
