और केQ Rीय सरकार 9ारा उA %ा&प िनयमB पर जनता से %ाM आ ेपB या सुझावB पर स4यक &प से िवचार कर िलया गया है;

अतः, अब, केQ Rीय सरकार, िव फोटक अिधिनयम, 1884 (1884 का 4) क धारा 5 और धारा 7 9ारा %दT शिAयB का %योग करते Uए िव फोटक िनयम, 2008 का संशोधन करने के िलए िनVिलिखत िनयम बनाती है, अथा.त्:-

अतः, अब, केQ Rीय सरकार, िव फोटक अिधिनयम, 1884 (1884 का 4) क धारा 5 और धारा 7 9ारा %दT शिAयB का %योग करते Uए िव फोटक िनयम, 2008 का संशोधन करने के िलए िनVिलिखत िनयम बनाती है, अथा.त्:-

. (1) इन िनयमB का संि Y त नाम िव फोटक (संशोधन) िनयम, 2019 है। (2) ये राजप, म> %काशन क तारीख को %वृT हBगे। 2. िव फोटक िनयम, 2008 म> (िजसे इसम> इसके प\ात मूल िनयम कहा गया है), िनयम 2, म>- (क) ख< ड (4) म>, "या साइट िम^ण िव फोट", शJ दB का लोप कया जाएगा।

(ख) ख< ड (24) म>, "राकेट, गोले, आाघात टोिपयां", शJ दB के थान पर " िF व क मैच तथा माइ_ो कोड." शJ द रख> जाएंगे। (ग) ख< ड (24) के प` चात िन4 निलिखत उप-खंड अंतः थािपत कया जाएगा, अथा.त्:-

चलते है और िजसम> गोले और रॉकेट भी सि4मिलत है अिभ%ेत है; (घ) ख< ड (25) के प चात् िन4 निलिखत ख< ड अंतः थािपत कया जाएगा, अथा.त्:– ‘25(क) "आितशबाजी अनुसंधान और िवकास केQ R" से वह पेjोिलयम तथा िव फोटक सुर ा संगठन का आितशबाजी अनुसंधान और िवकास केQ R’ अिभ%ेत है; (ङ) ख< ड (35), म>- (i) उप- ख< ड (घ) के प चात् िन4 निलिखत उप- ख< ड अंतः (ङ) "उस संगठन या उप_म 9ारा िलिखत &प म> सरकारी संगठन या केQ Rीय या रा( य सरकार/ लोक उप_म 9ारा नािमत कोई अिधकारी;"; (ii) के खंड (घ) म> आखरी पंिA के शJ द ‘समझा जाएगा’ के थान पर ‘होगा’ शJ द को रखा जाएगा;

उस संगठन या उप_म 9ारा िलिखत &प म> सरकारी संगठन या केQ Rीय या रा( य सरकार/ लोक उप_म 9ारा नािमत कोई अिधकारी;"; (ii) के खंड (घ) म> आखरी पंिA के शJ द ‘समझा जाएगा’ के थान पर ‘होगा’ शJ द को रखा जाएगा; (च) खंड (39) म>, oहंदी पाठ क आवयकता नहK है। (छ) ख< ड (53) म>, "या 5000 मीटर से अिधक के सुर ा pयूज" शJदB का लोप कया जाएगा; 3. मूल िनयम म> oहंदी पाठ क आवयकता नहK है।
4. मूल िनयम म> िनयम 4 म> उप-िनयम (1) के थान पर िन4 निलिखत उप-िनयम रखा जाएगा, अथा.त्:– "(1) इन िनयमB के %योजनB के िलए िव फोटकB को इन िनयमB से उपाबq अनुसूची 1 म> िविनrद.s ट रीित म> वगtकृत कया जाएगा।"
5. मूल िनयम म>, िनयम 6, म> –
(क) उप-िनयम (1) म> – (i) उप िनयम (1) म>, " क> Rीय सरकार 9ारा राजप,:" शJदB के थान पर "पेjोिलयम और िव फोटक सुर ा संगठन क आिधकाuरक वेबसाइट" शJद रख> जाएंगे; (ii) परंतुक म>, “परंतु इस िनयम क कोई बात”, शJ दB के प\ात "संघ के सशv बलB और आयुध कारखानB या र ा मं,ालय के अQय थापनB के िलए िव फोटकB के िविनमा.ण" शJ दB को अंतः थािपत कया जाएगा; (ख) उप-िनयम (4) म>, “िवभागीय परी ण केQ R” शJदB के प चात् "या आितशबाजी अनुसंधान एवं िवकास केQR" अंतः थािपत कया जाएगा ; (ग) उप-िनयम (12) म>, “िवभागीय पuर ण केQ R”, शJदB के प चात" या आितशबाजी अनुसंधान एवं िवकास केQR"
शJदB को अंतः थािपत कया जाएगा ; (घ) उप-िनयम 15 के खंड (i) के उप-ख< ड (घ) का लोप कया जाएगा;
(ङ) उप-िनयम (17), म>- (i) खंड (vii) म> "केQRीय खनन अनुसंधान सं थान" शJदB के थान पर "केQRीय खनन और Pधन अनुसंधान सं थान" शJदB को अंतः थािपत कया जाएगा;

खंड (i) के उप-ख< ड (घ) का लोप कया जाएगा;
(ङ) उप-िनयम (17), म>- (i) खंड (vii) म> "केQRीय खनन अनुसंधान सं थान" शJदB के थान पर "केQRीय खनन और Pधन अनुसंधान सं थान" शJदB को अंतः थािपत कया जाएगा; (ii) खंड (viii), के प` चात िनVिलिखत खंड अंतः थािपत कया जाएगा , अथा.त्:–
"(ix) मु2य िनयं,क संघ के सशv बलB और आयुध कारखानB या र ा मं,ालय के अQय थापनB हेतु िविनGम.त िव फोटकB के िलए, र ा संगठनB से सहमित और अनुमित के अधीन, े, परी ण म> छूट दे सकते हL"। 6. मूल िनयम म>, िनयम 10, म>- (क) उप-िनयम (1) म>, खंड (ख) के प\ात, िनVिलिखत खंड अंतः थािपत कया जाएगा, अथा.त्:–
“(ग) िव फोटको के िविनमा.ण के िलए %योग कए जाने वाले भवनB को इन िनयमB से उपाबq अनुसूची 7 म> दए गए िविनदxशB के अनुसार कया जाएगा।

परंतु, संघ के सशv बलB और आयुध कारखानB या र ा मं,ालय के अQय थापनB के िलए िव फोटकB के िविनमा.ण के िलए भवनB का िनमा.ण िव फोटक भ< डारण और पuरवहन सिमित पुि तका 3 के अनुसार कया जाएगा।"; (ख) उप-िनयम (2) म>, खंड (ग) म>, उप-खंड (V) म> “एई-27” शJ द और अंक के थान पर “एई-8” शJ द और अंक रखा जाएगा;
(ग) उप-िनयम (5) म>, (i) "सूया. त और सूयyदय " शJदB के प` चात "जब तक अQयथा अनुzापन %ािधकारी 9ारा िवशेष &प से अनुम| य’’ अंतः थािपत कया जाएगा; (ii) परंतुक का लोप कया जाएगा; (घ) उप-िनयम (6) के प\ात, िनVिलिखत उप-िनयम अंतः थािपत कया जाएगा:
‘(6क) इन िनयमB के अधीन %| येक अनुzY त पuरसर म> िवशेष &प से “धू}पान िनषेध” के िच, के साथ थानीय और अंeेजी भाषा म> “धू}पान िनषेध” का बोड.

नयम (6) के प\ात, िनVिलिखत उप-िनयम अंतः थािपत कया जाएगा:
‘(6क) इन िनयमB के अधीन %| येक अनुzY त पuरसर म> िवशेष &प से “धू}पान िनषेध” के िच, के साथ थानीय और अंeेजी भाषा म> “धू}पान िनषेध” का बोड. %दGश.त कया जाएगा;’; (ङ) उप-िनयम (7) म>, (i) oहंदी पाठ म> संशोधन क आवयकता नहK है (ii) खंड (ग) म>, "िव_य", शJ द के प चात ”उपयोग” शJ द अंतः थािपत कया जाएगा; (च) उप-िनयम (8) के प चात िनVिलिखत परंतुक अंतः "परंतु, िव फोटकB के िविनमा.ण के िलए %युA संघटकB के िलए यह उप-िनयम लागू नही होगा।" 7. मूल िनयम के िनयम 11 म> – उप-िनयम (4) के प चात िन4 निलिखत उप-िनयम को अंतः "(5) ऐसे कसी यिA क फोरमैन के &प म> िनयुिA नहK क जाएगी िजसने दसवK क ा उTीण. नहK क हो और िजसे आितशबाजी या सुर ा pयूज िविनमा.ण के े, म> पॉच वष से कम का काय. का अनुभव हो”
8. मूल िनयम म> िनयम 12 म>, उप-िनयम (1) म>, “िविनदxश”, शJद, के थान पर "समय-समय पर यथा संशोिधत िविनदxश आइएस: 2309" शJद और अंकB को अंतः थािपत कया जाएगा। 9. मूल िनयम म>, िनयम 14 म>,-उप-िनयम (1) के खंड (घ) म>, "%ािधकरण" शJ द के थान पर "संगम" शJ द को रखा जाएगा। 10.

मय-समय पर यथा संशोिधत िविनदxश आइएस: 2309" शJद और अंकB को अंतः थािपत कया जाएगा। 9. मूल िनयम म>, िनयम 14 म>,-उप-िनयम (1) के खंड (घ) म>, "%ािधकरण" शJ द के थान पर "संगम" शJ द को रखा जाएगा। 10. मूल िनयम म>, िनयम 15 म>, उप-िनयम (1) के खंड (i) म>,– (क) उप-खंड (च) के थान पर िनVिलिखत उपखंड रखा जाएगा, अथा.त्:– "(च) पैकेज क िविशH पहचान सं2या (मु2य िनयं,क 9ारा दए गए %ा&प म>) पैकेज के दोनो तरफ िचिनत, बारकोड और मानव पठनीय अ रB के &प म> "; (ख) उप-खंड (ठ) के प चात िनVिलिखत उप-खंड को अंतः " (ड) -10 िडeी सेिसयस से कम तथा 60 िडeी सेिसयस से अिधक तापमान म> िव फोटकB का भ< डारण नहK कया जाएं"। (ग) परंतुक के थान पर िन4 निलिखत परंतुक रखा जाएगा, अथा.त्:– ‘परंतु आितशबाजी या सुर ा pयूज के मामले म>, उप खंड (क) और (ठ) लागू नहK हBगे और आितशबाजी या सुर ा pयूज शJद, यथा ि थित, बाहरी पैकेज पर िचिनत कया जाएगाः परंतु यह और क आगे "उप-खंड (च) आितशबाजी के िलए लागू नहK होगा।’। (घ) उप-िनयम (2) म>, उप-खंड (च) के प चात िन4 निलिखत उप-ख< ड अंतः थािपत कया जाएगा, अथा.त्; –

"(छ) मु2य िनयं,क 9ारा यथा िविनrद.s ट तारीख से लागू, बाहरी पैकेज पर िचिनत बारकोड और मानव पठनीय अ रB के %&प म> पैकेज क िविशH पहचान सं2या (मु2य िनयं,क 9ारा दए गए %ा&प म>)।"; (ङ) उप-िनयम (3) के थान पर िनVिलिखत उप-िनयम रखा जाएगा, अथा.त्:–

गू, बाहरी पैकेज पर िचिनत बारकोड और मानव पठनीय अ रB के %&प म> पैकेज क िविशH पहचान सं2या (मु2य िनयं,क 9ारा दए गए %ा&प म>)।"; (ङ) उप-िनयम (3) के थान पर िनVिलिखत उप-िनयम रखा जाएगा, अथा.त्:–

"(3) िव फोटकB के वग. 6 ^ेणी पर oचंहांकन - िव फोटकB के वग. 6 ^ेणी 1, 2 और 3 के मामलB म> oचंहांकन मु2य िनयं,क 9ारा यथा िविनrद.s ट तारीख से िनVानुसार होगा: - (क) वग. 6 ^ेणी 1 (सेpटी pयूज के िलए): बारकोड और मानव पठनीय अ रB के &प म> िचिनत िविशH पहचान सं2या (मु2य िनयं,क 9ारा दए गए %ा&प म>) %|येक कॉइल के बाहरी पैकेज पर पर िचिनत होगी।
(ख) वग. 6 ^ेणी 2 (डेटोनेटंग कॉड. के िलए): %|येक पूल के दोनो ओर बारकोड और मानव पठनीय अ रB के &प म> िचिनत िविशH पहचान सं2या (मु2य िनयं,क 9ारा दए गए %ा&प म>) और डेटोनेटंग कॉड. के हर मीटर पर िविशH पहचान सं2या िचिनत क जाएगी; (ग) वग. 6 ^ेणी 2 (डेटोनेटर के िलए): (i) %|येक डेटोनेटर के टुकड़े पर सु पHता से िविनमा.ता का पूण. या संि M &प म> नाम मुRत या उभरा Uआ जाएगा और यद, संि M &प का उपयोग कया जाता है तो मु2य िनयं,क से पंजीकृत कया जाएगा;
(ii) %|येक आंतuरक पैकेज िजसम> 100 Y लेन डेटोनेटर है या इलेिFjक डेटोनेटर के %|येक गुछे पर बारकोड और मानव पठनीय अ रB के &प म> िचिनत िविशH पहचान सं2या (मु2य िनयं,क 9ारा दए गए %ा&प म>) िचिनत होगी; (iii) गैर िव*ुत डेटोनेटर या िडले डेटोनेटर के मामले म>, %|येक डेटोनेटर के टुकड़े पर oचंहांकन बॉFस पर अंकन क तरह िचनांकत रहेगा।”। (च) उप-िनयम (4) म>, “िविनमा.ता का नाम”, शJ दB के प` चात, "(वलनशील, िव फोटक, oचंगाuरयB क बौछार तथा आग के गोलो का उ|सज.न करता है," शJदB को अंतः थािपत कया जाएगा;

पर अंकन क तरह िचनांकत रहेगा।”। (च) उप-िनयम (4) म>, “िविनमा.ता का नाम”, शJ दB के प चात, "(वलनशील, िव फोटक, oचंगाuरयB क बौछार तथा आग के गोलो का उ|सज.न करता है," शJदB को अंतः थािपत कया जाएगा; (छ) उप-िनयम (4) के प चात, िनVिलिखत उप-िनयम अंतः थािपत कया जाएगा, अथा.त्:–

"4(क) आितशबाजी के आंतuरक पैकेज पर आितशबाजी िविनमा.ण क ितिथ, बैच नंबर िलखा जाएगा ।" 11. मूल िनयम म>, िनयम 20 म>, उप-िनयम (1) म>, “अनुzY त कारखाने म>”, शJ द के प\ात, "आितशबाजी िविनमा.ण करने वाले कारखाने सिहत" शJदB को अंतः थािपत कया जाएगा; 12. मूल िनयम म>, िनयम 21 म>, उप-िनयम (3) म>, िनVिलिखत परंतुक अंतः " परQतु यह क संघ के सश, बलB और आयुध कारखानB या र ा मं,ालय के अQय थापनB के िलए िव फोटकB के िविनमा.ण कारखानB को, र ा मं,ालय के र ा उ|पादन िवभाग के र ा सुर ा पुि तका म> यथा उिल िखत सुर ा से संबंिधत उपबंधो का पालन करना होगा" 13. मूल िनयम म>, िनयम 22 म>, उप-िनयम (2) म>, "िव*ुत उप कर", शJदB के प` चात, "आई.ई.सी., आई.एस./ आय.ई.सी. 60079 या आई.एस./ आई.ई.सी. 61241 और आई.एस./ आई.ई.सी. 60529 कोड के अनु&प या" शJद और अंकB को अंतः थािपत कया जाएगा; 14.

, उप-िनयम (2) म>, "िव*ुत उप कर", शJदB के प चात, "आई.ई.सी., आई.एस./ आय.ई.सी. 60079 या आई.एस./ आई.ई.सी. 61241 और आई.एस./ आई.ई.सी. 60529 कोड के अनु&प या" शJद और अंकB को अंतः थािपत कया जाएगा; 14. मूल िनयम म>, िनयम 24 म>,- (क) उपिनयम(1) के प चात, िन4 निलिखत उपिनयम अंतः

“(1क) िव फोटक िविनमा.ता, %ितदन ऑनलाइन %णाली म> िविनGम.त िव फोटकB के %कार और मा,ा के J यौरा क %िविH अनुzापन %ाअिधकारी 9ारा उपलJ ध कराये गए ऑनलाइन %णाली म> करेगा।” (ख) उप-िनयम (3) के थान पर िनVिलिखत उप-िनयम रखा जाएगा, अथा.त्:– "(3) अनुzिMधारी िविनGम.त, %ाY त, िव_य कए गए या अQ तuरत या उपयोग कए Uए या नs ट कए Uए िव फोटकB (आितशबाजी के अितuरF त) क मािसक िववरणी िनयं,क के साथ-साथ िजला मिज jेट को अनुसूची 5 के भाग 5 म> िनधा.uरत %&प म> % तुत करेगा, िजससे क वह उपयु.F त %ािधकाuरयB को %| येक आगामी माह के दस दनB के भीतर पUंच सक> तथा अनुzापन %ािधकारी 9ारा उपलJ ध कराई गई ऑनलाइन %णाली म> भी अनुzिMधारी %| येक आगामी माह के दसव> दन के भीतर मािसक िववरणी % तुत करेगा ।”;
(ग) उप-िनयम (4) म>, “,ैमािसक” शJद के थान पर "मािसक" शJद अंतः थािपत कया जाएगा; (घ) उप-िनयम (4) के प` चात्, िनVिलिखत उप-िनयम अंतः थािपत कया जाएगा, अथा.त्:–

"(5) िव फोटकB के िविनमा.ण या िव_य या उपयोग के िलए उनके रखने के िलए अनुzिM %ाY त कोई @िA या फम. या कंपनी 9ारा िव फोटकB के काट.uरजB और पैकेजB पर बारकोड जनरेट करने, मुRण और बारकोड को

, अथा.त्:–

¹Hkkx IIµ[k.M 3(i)º 5 पढ़ने के िलए उपयुA कैनर के िलए आवयक @व था क जाएगी और अनुzापन %ािधकारी 9ारा यथा िनदxिशत आवयक सूचना %ौ*ोक ढाँचा भी िवकिसत कया जाएगा।

(6) िव फोटकB के िव_य या उपयोग हेतु रखने के िलए अनुzिMधारी 9ारा बारकोड को पढ़ने के िलए उपयुA कैनर के िलए आवयक @व था क जाएगी और मु2 य िनयं,क 9ारा यथा िनrद.s ट समय म> आवयक सूचना %ौ*ोक ढाँचा भी िवकिसत कया जाएगा।” 15. मूल िनयम म>, िनयम 26 म>,- (क) उप-िनयम (2) के खंड (छ) म>, "िव फोटन उपसाधनB", शJ दB के प\ात "या आितशबाजी" शJदB को अंतः थािपत कया जाएगा; (ख) उप-िनयम (3) के खंड (ङ) म>, “क परी ा”, शJ दB के प\ात " थल पर" शJद को अंतः थािपत कया जाएगा; (ग) उप-िनयम (6) के प\ात, िनVिलिखत उप-िनयम अंतः थािपत कया जाएगा, अथा.त्:– "(7) िव फोटकB या आितशबािजयB के िविनमा.ण हेतु अनुz Y त पuरसर या िविनमा.ण सुिवधाएं कसी भी अQय @िA या कंपनी या सं था को पे पर नहK दी जाएगी"। 16. मूल िनयम म>, िनयम 28 म>, परQतुक म> “अ थायी अनुजा” शJद के प\ात, "छह महीने क अविध से अिधक के िलए नहK," शJद को अंतः थािपत कया जाएगा; मूल िनयम म>, िनयम 29 म> ‘’हाल ही म>’’ शJदB के थान पर ‘’वत.मान’’ शJद रखा जाएगा;
17. मूल िनयम म>, िनयम 43 के थान पर, िन4 निलिखत िनयम रखा जाएगा, अथा.त्:– “43. भूिम माग. से आयात या िनया.त.- (1) ऐसे %| येक मामले म>, जहां केQ Rीय सरकार मु2 य िनयं,क के परामश. से शत एवं %ितबंध लागू करती है, केQ Rीय सरकार क पूव. मंजूरी के िबना, भूिम माग.

जाएगा, अथा.त्:– “43. भूिम माग. से आयात या िनया.त.- (1) ऐसे %| येक मामले म>, जहां केQ Rीय सरकार मु2 य िनयं,क के परामश. से शत एवं %ितबंध लागू करती है, केQ Rीय सरकार क पूव. मंजूरी के िबना, भूिम माग. से िव फोटकB के आयात या िनया.त के िलए कोई अनुzिM अनुद| त नहK क जाएगी। (2) भारतीय िमशन और आयात करने वाले देश क सरकार 9ारा जारी कए गए अनापिT %माण-प, के िबना भूिम माग. से िव फोटकB के िनया.त के िलए कोई अनुzिM अनुद| त नहK क जाएगी। 18. मूल िनयम म>, िनयम 45 म>,-

(क) उप-िनयम (3) म>.- “(i) खंड (क) म> "जो प| तन पर उतारे जाने आशियत हL तथा इन िनयमB के अ धीन जांच, िव लेिषत या परीि त कए जाने के िलए अपेि त है " शJदB के थान पर, "इन िनयमB के अधीन, िव फोटकB के आवयक परी ण, िवेषण या जांच जैसा वह आवयक समझे" शJद रख> जाएंगे।”; (ii) ख< ड (ख) के थान पर िन4 निलिखत ख< ड रखा जाएगा, अथा.त्:– “(ख) मा टर या एज>ट, यथाि थित, खंड (क) म> िनrद.H अिधकारी को िव फोटकB के उन सभी नमूनो को सपेगा जो आव यक हो। नमूना अिधकारी यद चाहे तो नमूने, उनके 9ारा बताए गए कसी िविशs ट पैकेज से उठाए जाएंगे।”; (ख) उप िनयम (5), म>,- (i) खंड (क) म> "%&प सी.ई-1 परी ण %माणप, म>", शJदB के थान पर, यथाि थित, "नाइjो- यौिगक या Fलोरेट िम^ण के मामले म> %&प सीई-1 परी ण %माणप, म> िवेषण या जांच uरपोट.

"(क) सीमा शुक आयुA 9ारा कोई भी आयाित त िव फोटक उतारने के िलए अनुमित तब तक नहK दी जाएगी जब तक इन िनयमB के अधीन ऐसे िव फोटकB के आयात के िलए अनुzिM %ाY त हो और ऐसी अQ य जांच
जैसी वह आवयक समझे, कर ली गई हो; "; (घ) उप िनयम (7) के खंड (ङ) के प चात िनVिलिखत उप- खंड अंतः थािपत कया जाएगा, अथा.त्: -

[PART II—SEC. 3(i)] "(च) कसी भी @िA को िव फोटकB का आयात करने हेतु तब तक अनुzिM जारी नही क जाएगी जब तक व ह आयात करने हेतु आशियत िव फोटकB के वग. और मा,ा को रखने के िलए वैध अनुzM पuरसर का धारक नहK है ।" 19. मूल िनयम म>, िनयम 46 म>, उप-िनयम (2) म>,- (क) खंड (क) म> "%ािधकरण" शJद के थान पर "संघ" शJद रखा जाएगा; (ख) उप-िनयम (2) के प` चात िनVिलिखत उप-िनयम अंतः थािपत कया जाएगा, अथा.त्:–

"(3) कसी भी @िA को िव फोटकB का िनया.त करने हेतु तब तक अनुzिM जारी नहK क जाएगी जब तक व ह िनया.त करने हेतु आशियत िव फोटकB के वग. और मा,ा को रखने के िलए वैध अनुzM पuरसर का धारक नहK है ।" 20. मूल िनयम म>, िनयम 48 म>,-

(क) उप-िनयम (1) म>, “परी ण अिधकारी”, शJदB के प\ात "या िव फोटक िनयं,क" शJद अंतः थािपत कए जाएंगे; (ख) उप-िनयम (2) म>, परी ण अिधकारी, शJदB के प\ात् "या िव फोटक िनयं,क" शJद अंतः थािपत कये जाएंगे; 21.

) उप-िनयम (1) म>, “परी ण अिधकारी”, शJदB के प\ात "या िव फोटक िनयं,क" शJद अंतः थािपत कए जाएंगे; (ख) उप-िनयम (2) म>, परी ण अिधकारी, शJदB के प\ात् "या िव फोटक िनयं,क" शJद अंतः थािपत कये जाएंगे; 21. मूल िनयम म>, िनयम 51 म>, उप-िनयम (5) म> "%ािधकरण" शJद के थान पर "संघ" शJ द रखा जाएगा। 22. मूल िनयम म>, िनयम 61 म>,-

(क) मूल िनयम के पा` व. शीष.क म> “jैFटर”, शJद के प\ात, "मोटर jक पर आ&ढ फF ड चेिसस मालवाहक िडJ बा या गूस नेक टाइप सेमी jेलर वाहन" शJदB को अंतः थािपत कया जाएगा।
(ख) उप-िनयम (1) म>, “सड़क यान म> कसी िव फोटक”, शJदB के प\ात्, "या मोटर jक पर आ&ढ फF ड चेिसस मालवाहक िडJ बा या गूस नेक टाइप सेमी jेलर वाहन या" शJदB को अंतः थािपत कया जाएगा। (ग) उप-िनयम (2) म>, “सड़क वैन”, शJदB के प\ात्, " या मोटर jक पर आ&ढ फF ड चेिसस यथाि थित, मालवाहक िडJ बा या गूस नेक टाइप सेमी jेलर वाहन" शJदB को अंतः थािपत कया जाएगा। (घ) उप-िनयम (3) के प\ात्, िनVिलिखत उप-िनयम अंतः थािपत कया जाएगा:

"(4) मोटर jक पर आ&ढ फF ड चेिसस मालवाहक िडJ बा या गूस नेक टाइप सेमी jेलर वाहन 9ारा िव फोटकB के सड़क पuरवहन हेतु अनुzिM तब दी जाएगी जब -

(क) िवदेश से मालवाहक िडJ बे म> िव फोटक %ाM हो रहे हL;

(ख) िव फोटको को मालवाहक िडJ बे म> अQय देशB को िनया.त कया जा रहा हL, या

(ग) आपात ि थित म> मु2य िनयं,क क पूव. अनुzा से। (5) मालवाहक िडJ बे अंतरराs jीय समुRी खतरनाक माल संकेितक के अनु&प हBगे;
(6) मोटर jक पर आ&ढ फF ड चेिसस मालवाहक िडJ बा या गूस नेक टाइप सेमी jेलर वाहन म> ले जा रहे िव फोटकB का अिधकतम वजन 20 मीujक टन या सड़क पuरवहन %ािधकरण 9ारा अनुम|य वाहन क अिधकतम वहन मता, जो भी कम हो, से अिधक नहK होगा।” 23.

ड चेिसस मालवाहक िडJ बा या गूस नेक टाइप सेमी jेलर वाहन म> ले जा रहे िव फोटकB का अिधकतम वजन 20 मीujक टन या सड़क पuरवहन %ािधकरण 9ारा अनुम|य वाहन क अिधकतम वहन मता, जो भी कम हो, से अिधक नहK होगा।” 23. मूल िनयम म>, िनयम 67 म>, उप-िनयम (11) के प चात् िनVिलिखत उप-िनयम अंतः "(12) मु2 य िनयं,क 9ारा घोिषत क तारीख से, िजसको; िविनrद.s ट कर> िव फोटकB के पuरवहन म> उपयुF त सड़क वैन को jैकंग %योजन हेतु आवयक लोबल पोिजशoनंग %णाली उपकरणB से उपसित कया जाएगा।" 24. मूल िनयम म> िनयम 72 म>, उप-िनयम(1) के थान पर िन4 निलिखत उप-िनयम रखे जाएंगे, अथा.त्:–
"(1) मूल पैकेजेस म> िव फोटकB का िव_य.- िव फोटकB का िव_य मूल पैकेजेस म> या िविशH पहचान िचन युF त सबसे छोटे पैकेज म> कया जाएगा। कसी भी पuरि थित म> िव फोटकB का िव_य सबसे छोटे पैकेज से कम मा,ा म> नही कया जाएगा।
(1क) िनयम 15 के अनुसार %|येक पैकेज पर िचनांकन भी कया जाएगा।" 25. मूल िनयम म> िनयम 77 म>, उप-िनयम (2) के खंड (ङ) के प` चात् िनVिलिखत ख< ड अंतः थािपत कए जाएंगे, अथा.त्:–
(च) मु2य िव फोटक िनयं,क या िव फोटक िनयं,क 9ारा जारी िविधमाQ य अनुzिM धारक परेिषती अनुसूची 5 के भाग 5 के अंतग.त %&प आरई-11 म> परेषक को ऑनलाइन मांगप, % तुत करेगा;

अंतः थािपत कए जाएंगे, अथा.त्:–
(च) मु2य िव फोटक िनयं,क या िव फोटक िनयं,क 9ारा जारी िविधमाQ य अनुzिM धारक परेिषती अनुसूची 5 के भाग 5 के अंतग.त %&प आरई-11 म> परेषक को ऑनलाइन मांगप, % तुत करेगा;

¹Hkkx IIµ[k.M 3(i)º 7 (छ) %&प आरई-11 म> ऑनलाइन मांगप, %ाM होने पर तथा स4 यक स|यापन के बाद, परेषक अनुसूची V के भाग 5 के अंतग.त %&प आरई -12 म> ऑनलाइन पास जारी करने के प` चात मांगप, से अनिधक %कार और मा,ा म> िव फोटक परेषक को आपूGत. करेगा;

(ज) परेषण क %ािM पर, परेषक, अनुसूची 5 के भाग 5 के अंतग.त %&प आरई -3 म> ऑनलाइन %णाली के माbयम से तुरंत ही, %ाY त कए गए िव फोटकB के %कार और मा,ा क %िविH करेगा;

(झ) मु2य िव फोटक िनयं,क या िव फोटक िनयं,क 9ारा जारी िव फोटकB को रखने तथा उपयोग हेतु अनुzिMधारक यिA, िव फोटकB के अंितम उपयोग हेतु ऑनलाइन पास जारी करने के प` चात ही शॉट-फायरर/ J ला टस. को अनुसूची 5 के भाग 5 के अंतग.त %&प आरई -13 म> िव फोटक िवतuरत करेगा।"। 26. मूल िनयम म> िनयम 81 म>, िनVिलिखत परंतुक अंतः थािपत कया जाएगा, अथा.त्:– "परंतु, संघ और आयुध कारखानB के सशv बलB या र ा मं,ालय के अQय थापनB के िलए िव फोटकB के िविनमा.ण के िलए भवनB का िनमा.ण िव फोटक भ< डारण और पuरवहन सिमित पुि तका 3 के अनुसार कया जाएगा।" 27. मूल िनयम म>, िनयम 82 म>- (क) उपिनयम (1) म>, "या पाँच हजार मीटर से अनिधक के सुरि त pयूज", शJदB का लोप कया जाएगा; (ख) उपिनयम (2) म>, "या सुरि त pयूज", शJदB का लोप कया जाएगा; 28.

(ख) उपिनयम (4) म> खंड (ग) म> शJ द "तल" के थान पर "तलB" शJ द रखा जाएगा; 29. मूल िनयम म>, िनयम 84 म>, उपिनयम (6) के प चात् िनVिलिखत उपिनयम अंतः थािपत कए जाएंगे, अथा.त्:– "(7) आितशबाजी क दुकानB के ऐसे समूह के िलए %ाथिमक िचक|सा, ए4JयुलेQस और कम से कम दो अि शमन वाहन उपलJध होग>।; (8) %मुख थानB पर थानीय भाषा म> एक चेतावनी बोड. 'िव फोटक या खतरनाक पदाथ. ' %दGश.त कया जाएगा।" 30. मूल िनयम म> िनयम 86 म>, उपिनयम (2) म>, "या सुर ा pयूज", शJदB का लोप कया जाएगा; 31. मूल िनयम म>, िनयम 87 म>,- (क) मूल िनयम म>, "या सुरि त pयूज", शJदB का लोप कया जाएगा; (ख) िनयम 87 के परंतुक म> "या सुरि त pयूज", शJदB का लोप कया जाएगा; 32. मूल िनयम म> िनयम 90 म>, उप-िनयम (4) म>, “ िलया गया था”, शJदB के प चात्, "और लौटाएं गए िव फोटकB के %कार और मा,ा क %िविHयां, अनुzापन %ािधकारी 9ारा %द| त ऑनलाइन %णाली म> क जाएगी" शJदB को अंतः थािपत कया जाएगा; 33. मूल िनयम म>, िनयम 101 म>, उप-िनयम (4) के प` चात िनVिलिखत उपिनयम अंतः "(5) िव फोटकB को रखने तथा उपयोग हेतु कसी ऐसे @िA या फम.

रा %द| त ऑनलाइन %णाली म> क जाएगी" शJदB को अंतः थािपत कया जाएगा; 33. मूल िनयम म>, िनयम 101 म>, उप-िनयम (4) के प` चात िनVिलिखत उपिनयम अंतः "(5) िव फोटकB को रखने तथा उपयोग हेतु कसी ऐसे @िA या फम. या कंपनी को अनुzिM के िलए अनुमोदन नहK दया जाएगा िजसके पास िव फोटकB को रखने तथा िब_ के िलए अनुzिM हL तथा यह िवलोमतः भी लागू होगा। "(6) उप-िनयम (5) म> कोई बात िव फोटक िविनमा.ण कारखानB म> अवि थत तथा उससे संबq, उपयोग हेतु रखने के मैगजीन तथा िब_ हेतु रखने के मैगजीन पर उपयु.F त उप-िनयम लागू नही होगा।"
34. मूल िनयम म>, िनयम 107 म>, उप-िनयम (6) म>, "िव फोटकB के संभलाई और िव फोटन से संबंिधत े, म> पया.Y त zान और अनुभव हL" शJ दB के थान पर, "आितशबाजी तथा या सुर ा pयूज के िविनमा.ण के े, म> पाँच वष का अनुभव और दसवK क ा उ| तीण. है", शJ द रख> जाएंगे;

मूल िनयम म>, िनयम 112 म>, उप-िनयम (10) म>,- (क) "तीन" शJ द के थान पर दोनB थानो पर जहां वे आ रहे हL "छह" शJ द रखा जाएगा। (ख) "पुन.िविधमाQ यकरण " शJ द के थान पर "नवीकरण" शJ द रखा जाएगा।

तक अधमता से जुड़े दांिडक अपराध के िलए िसqदोष ठहराया गया है तथा उसे दंड क समािM के प` चात पाँच साल क अविध के दौरान कसी एक समय पर, छह महीने क अविध से अनिधक के िलए" शJदB को अंतः थािपत कया जाएगा;

[PART II—SEC. 3(i)] 39. मूल िनयम म>, िनयम 118 म>, उप-िनयम (1) के खंड (I) म>,- (क) उप-खंड (ख) म>, "दांिडक अपराधB", शJदB के प चात "कसी भी oहंसा या नैितक अधमता से जुड़े दांिडक अपराध के िलए िसqदोष ठहराया गया है तथा उसे दंड क समािM के प चात पाँच साल क अविध के दौरान कसी एक समय पर, छह महीने क अविध से अनिधक के िलए" शJदB को अंतः थािपत कया जाएगा; (ख) उप-खंड (ख) के प` चात िन4 निलिखत उप-खंड अंतः थािपत कया जाएगा, अथा.त् :–
"(ग) अनुz Y त पuरसर या िविनमा.ण सुिवधा को कसी अQय @िA, कंपनी, सोसाईटी आद को पे पर दया गया हL "। 40. मूल िनयम म>, िनयम 124 म> अनुदT उसक कोई अिध%मािणत %ित खो जाती है या संयोगवश नs ट हो जाती है तो अनुसूची 4 के भाग 2 म> िविनrद.s ट फस के संद| त कर दए जाने पर उसक दूसरी %ित जारी क जा सकती है।" शJदB के प\ात ‘’खो जाती है या दुघ.टना पूण. िवनH हो जाती है अनुिलिप %ित जारी क जा सकेगी’’ शJद रखे जाएगे
41. मूल िनयम म>, िनयम 131 म>, उप-िनयम (1) म>, "दुघ.टना होने के चौबीस घंटे के भीतर, टेलीफ़ोन, टेलीeाम" शJ दB के

ाती है या दुघ.टना पूण. िवनH हो जाती है अनुिलिप %ित जारी क जा सकेगी’’ शJद रखे जाएगे

ालन कया जाएगा। (83) बॉल िमल, को¢न£ग मशीन, कुटाई मशीन, छंटाई मशीन, आद िव*ुत संचािलत उपकरणB का %भावी ढंग से अ¢थ£ग कया जाएगा और संबंिधत इमारतB के दरवाजो म> िलिमट ि वच का %बंध कर, ऐसी %_याओ को दूर थ कया जाएगा। (84)

(86) ऐसे भवनB के कंपाट.म>ट के आंतuरक भाग क जहां बा&द का िविनमा.ण या हथलाई क जाती हL और

वहां रखी मशीनरी या फटंस क दन के काय. क समािM पर सफाई क जाएगी ।

(13) ऑनलाइन %णाली के माbयम से िविनमा.ण uरकॉड. का % तुतीकरण अनुzापन %ािधकारी 9ारा िनrद.H तारीख से %वृT होगा";

(30) अनुzापन %ािधकारी 9ारा उपलJ ध कराए गए ऑनलाइन %णाली के माbयम से िव फोटकB के िब_/उपयोग के िलए अनुzिMधारी 9ारा, आरई-11 म> मांगप, जारी कया जाएगा, िव फोटकB के िब_ हेतु
आरई-12 म> और िव फोटकB के उपयोग हेतु आरई-13 म> पास जारी कया जाएगा।";
(झ) सेट-IX म> -

(i) %ारंिभक पैरा म>, "या 50000 मीटर से अनिधक सुर ा pयूज" शJदB का लोप कया जाएगा; (ii) शत. _मांक (2) के थान पर, िन4 निलिखत शत. को रखा जाएगा, अथा.त् :-

(19) (19) (19) (19) (1) इन िनयमB के %काशन के प चात, सभी नये साइट िमF सड िव फोटक संयं,/ वीकृत साइलो, चारB ओर 45 मीटर बाहरी सुर ा दूरी का अनुपालन कर>गे। (2) वाहनB के िलए वीकृत अिधकतम दूरी िन4 नानुसार होगी: (क) मैujFस के अंतरण हेतु, मूल संयं, से साइलो संयं, तक 1500 कमी (एकतरफा माग.)। (ख) बीएमडी वाहनB हेतु, मूल संयं,/साइलो संयं, से खान तक, 250 कमी (एकतरफा माग.) (3) नए साइलो थानB पर िनVिलिख त आवयकता का अनुपालन क या जाएगा: (क) एक साइलो क मता 40 लाख टन से अिधक नहK होगी। (ख) एक साइट पर साइलB क अिधकतम सं2या तीन से अिधक नहK होगी। (ग) आस साइलो के बीच Qयूनतम दूरी, 1.5 मीटर या 0.5 गुना यलो के @ास जो भी अिधक हो, से कम नहK होगी । (47) मूल िनयम क अनुसूची VII म>, (क) िविनदxश 1 म>, _म सं2 या 1 म>,-

G.S.R.17(E).—Whereas the draft rules were published to amend the Explosives Rules, 2008, as required by sub-section (1) of section 18 of Explosives Act, 1884 (4 of 1884) vide notification of the Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion) number G.S.R. 1440(E), dated the 20th day of November, 2017 in the Gazette of India, Part II, Section 3, Sub-Section (i) inviting objections and suggestions from all the persons likely to be affected thereby, before the expiry of a period of forty-five days from the date on which the copies of the Gazette containing the said notification were made available to the public;

Now, therefore, in exercise of powers conferred by sections 5 and 7 of the Explosives act, 1884 (4 of 1884), the Central Government hereby makes the following rules further to amend the Explosives Rules, 2008, namely:-
1. (1) These rules may be called the Explosives (Amendment) Rules, 2019. (2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Explosives Rules, 2008 (hereinafter referred to as the principal rules), in rule 2,- (a) in clause (4), the words “or site mixed explosive (SME) ”, shall be omitted; (b) in clause (24), for the words “rockets, shells, percussion caps”, the words “ such as quick match and micro cord” shall be substituted ; (c) after clause (24), the following clause shall be inserted, namely:- '(24A) “aerial fireworks” means low hazard explosives, which moves by its own propulsion or shots into the sky through a mortar consisting of paper tube or casing filled with combustible material to deliver sound and pyrotechnic effect and includes shells and rockets;';
(d) after clause (25), the following clause shall be inserted, namely:-
'(25A) "Fireworks Research and Development Centre” means the Fireworks Research and Development Centre of the Petroleum and Explosives Safety Organisation;';

“(ix) The Chief Controller may exempt the field trials for the explosives manufactured for armed forces of the Union and Ordnance factories or other establishments of Ministry of Defence subject to the concurrence and clearance from the Defence Organisations.”. 6. In the principal rules, in rule 10,- (a) in sub-rule (1), after clause (b), the following clause shall be inserted, namely:- “(c) The buildings to be used for manufacture of explosives shall comply with the specifications laid down in Schedule VII annexed to these rules: Provided that the buildings for manufacture of explosives for armed forces of the Union and Ordnance factories or other establishments of Ministry of Defence shall be constructed as per Storage and Transport of Explosives Committee Pamphlet 3.”; (b) in sub-rule (2), in clause (c), in sub-clause (v), for the letters and figures “AE-7”, the
letters and figures “AE-8” shall be substituted;

    (ii) in the long line, for the words “sale, loading”, the words “sale, use, loading,” shall  be inserted;

(f) after sub-rule (8), the following proviso shall be inserted, namely:- “Provided that nothing in this sub-rule shall be applicable to ingredients used for manufacture of explosives.”. 7. In the principal rules, in rule 11, after sub-rule (4), the following sub-rule shall be inserted, namely:- “(5) No person shall be appointed as a Foreman if he has not passed tenth class and has less than five years experience in the field of manufacture of fireworks or safety fuse.”. 8.

(a) Class 6 Division 1(for Safety Fuse): Each coil shall bear unique identification number (in the format advised by the Chief Controller) on the outer package in the form of barcode and human readable characters marked; (b) Class 6 Division 2 (for Detonating Cord): Each Spool shall bear unique identification number (in the format as advised by the Chief Controller) in the form of barcode and human readable characters marked on both sides of spool and on every meter of the detonating cord; (c) Class 6 Division 3 (for Detonators): (i) the name of manufacturer in full or abbreviated form shall be printed or embossed legibly on each piece of detonator and if abbreviated form is used, it shall be registered with the Chief Controller;

(iii) in case of Non Electric Detonators or delay detonators, each piece of such detonator shall bear the same markings as on the box."; (f) in sub-rule (4), after the words “manufacturer's name,", the words" flammable, explodes, emits shower of sparks or shoots flaming balls,” shall be inserted;
(g) after sub-rule (4), the following sub-rule shall be inserted, namely:- “4(A). The batch number and date of manufacturing of fireworks shall be printed on each package of fireworks.”. 11. In the principal rules, in rule 20, in sub-rule (1), after the words “licensed factory”, the words “including fireworks manufacturing factory” shall be inserted; 12. In the principal rules, in rule 21, in sub rule (3), the following proviso shall be inserted, namely:- “Provided that factory for manufacture of explosives for armed forces of the Union and Ordnance factories or other establishments of the Ministry of Defence shall adhere to the provisions relating to security as mentioned in Defence Security Manual of Department of Defence Production, Ministry of Defence.”.

[PART II—SEC. 3(i)] 13. In the principal rules, in rule 22, in sub-rule (2), after the words "equipment shall be", the words, letters and figures “conforming to IEC, IS/IEC 60079 or IS/IEC 61241 and IS/IEC 60529 codes or” shall be inserted;

(b) for sub-rule (3) the following sub-rule shall be substituted, namely:- “(3) The licensee shall submit monthly returns of explosives (other than fireworks) received, sold or transferred or used or destroyed to the Controller as well as District Magistrate in Form prescribed in Part 5 of Schedule V annexed to the rules so as to reach the above authorities within tenth day of every succeeding month and licensee shall also submit monthly return in the online system made available by the licensing authority within tenth day of the succeeding month.";

(d) after sub-rule (4), the following sub-rules shall be inserted, namely:- “(5) A person or a firm or a company holding a licence to manufacture or possession for sale or use of explosives shall make necessary arrangement for generating, printing barcodes on packages and cartridges of explosives and suitable scanners to read barcodes and shall also develop necessary information technology set up as advised by the licensing authority.

In the principal rules, in rule 26,- (a) in sub-rule (2), in clause (g), after the words " blasting accessories", the words “or fireworks” shall be inserted; (b) in sub-rule (3), in clause (e), after the words “testing of”, the words "on-site" shall be inserted; (c) after sub-rule (6), the following sub-rule shall be inserted, namely:- “(7) The licensed premises or manufacturing facilities shall not be leased to any other person, or company or firm or society for possession or manufacture of explosives or fireworks.”. 16.

The samples, if the sampling officer so desires, shall be taken from particular package indicated by him.";

(i) in clause (a), for the words “ a test certificate in CE-1”, the words “or an analysis or examination report or test certificate in CE-1 in the case of a Nitro-compound or a Chlorate mixture, as the case may be” shall be substituted; (ii) in clause (b), the words “each of the certificate in CE-1” shall be omitted; (c) in sub-rule (6), for clauses (a) and (b), the following sub-clause shall be substituted,
namely:- “(a) No imported explosives shall be permitted to be landed by the Commissioner of Customs except with the licence for import of such explosive under these rules and after making such other enquiries as considered necessary.”;

In the principal rules, in rule 67, after sub-rule (11), the following sub-rule shall be inserted, namely:-

“(12) Road Vans used for transportation of explosives shall be equipped with necessary devices of Global Positioning System for tracking purpose with effect from such date as the Chief Controller may specify.”.

In the principal rules, in rule 72, for sub-rule (1), the following sub-rule shall be substituted, namely:- “(1) Sale of explosives in original packages.—The explosive shall be sold in original packages or in smallest package bearing unique identification markings and under no circumstances, explosives shall be sold in quantity less than smallest package.

(i) A person holding a licence for possession and use of explosives granted by the Chief Controller or Controller of Explosives shall issue explosives to the shot firers or blasters only after issuing on line pass for end-use of explosives in Form RE-13 under Part 5 of Schedule V annexed to these rules.”. 27.

(86) The interior of the compartments of the building in which gunpowder is manufactured or handled and the machinery or fittings therein shall be thoroughly cleaned at the end of day’s work.
