त =कए गए थे; और उ2 राजप क ितयाँ 13 अ2ूबर, 2017 को जनता को उपलEध करा दी गL थG; और केM Nीय सरकार 7ारा उ2 ा!प िनयम@ पर जनता से ाJ आेप@ और सुझाव@ पर सPयक !प से िवचार कर िलया गया है; अतः, अब, केM Nीय सरकार, िव फोटक अिधिनयम, 1884 (1884 का 4) क धारा 5 और धारा 7 7ारा दR शि2य@ का योग करते Sए अमोिनयम नाइ ेट िनयम, 2012 का और संशोधन करने के िलए िनTिलिखत िनयम बनाती है, अथा,त्:-

(1) इन िनयम@ का संिV त नाम अमोिनयम नाइ ेट (संशोधन) िनयम, 2018 है।
(2) ये राजप* म; इनके काशन क तारीख को वृX त ह@गे।
अमोिनयम नाइ ेट िनयम, 2012 म; (िजसे इसम; इसके पZात मूल िनयम कहा गया है) िनयम 2 म;,-

(अ) ख9 ड (ध) के थान पर िनTिलिखत ख9 ड रखा जाएगा, अथा,त्:-
‘(ध) "नौभा]रक” के अंतग,त कोई ^ यि2 या अिभकरण या फम, भी होगा जो पोत से अमोिनयम नाइ ेट क चढ़ाई और उतराई, अनु_V त भ9 डार गृ ह तक उसके प]रवहन का काय, करता है;”; (आ) ख9 ड (न) म; “नौभरण, प]रवहन, भंडारण और उपयोग” शE द@ के थान पर "प]रवत,क और नौभा]रक" शE द रखे जाएंगे।
3. मूल िनयम के िनयम 5 म;, परंतुक का लोप =कया जाएगा। 4. मूल िनयम के, िनयम 6 म;,- (अ) उप-िनयम 2 के ख9 ड (क) का लोप =कया जाएगा;
(आ) उप-िनयम 5 के ख9 ड (ख) के थान पर िनTिलिखत ख9 ड रखा जाएगा, अथा,त्:-

"अमोिनयम नाइ ेट का प]रवहन याि*य@ के िलए चलाए गए या उनक ढुलाई कर रहे =कसी वाहक पोत या वाहन म; नहG =कया जाएगा।" 5.

(आ) उप-िनयम 5 के ख9 ड (ख) के थान पर िनTिलिखत ख9 ड रखा जाएगा, अथा,त्:-

"अमोिनयम नाइ ेट का प]रवहन याि*य@ के िलए चलाए गए या उनक ढुलाई कर रहे =कसी वाहक पोत या वाहन म; नहG =कया जाएगा।" 5. मूल िनयम के, िनयम 8 म;,- (अ) ख9 ड (क) के थान पर िनTिलिखत ख9 ड रखा जाएगा, अथा,त्:-
“(क) वह एक उिचत जलसह थैले म; पैक =कया गया हो”;
(आ) ख9 ड (ख) के थान पर िनTिलिखत ख9 ड रखा जाएगा, अथा,त्:-
“(ख) थैले पर िनयम 9 के उपबंध@ अनुसार िचिMहत =कया गया हो”;”
(इ) ख9 ड (ग) म; “पैकेज” शE द के थान पर “थैले” शE द रखा जाएगा; (ई) ख9 ड (घ) म; “पैकेज” शE द के थान पर “थैले” शE द रखा जाएगा। 6. मूल िनयम के िनयम 9 म;,- (अ) उप-िनयम (1) म;,- (i) “या आधान” शE द@ का लोप =कया जाएगा;
(ii) ख9 ड (च) म;, “पैकेज” शE द के थान पर “थैले” शE द रखा जाएगा; (iii) ख9 ड (ज) म; “नौभरण अिभकता,” शE द@ के थान पर “नौभरक” शE द रखा जाएगा; (आ) उप-िनयम (2) मे “आरएफआईडी” शEद@ के थान पर “रेिडयो de;सी आइड;]ट=फकेशन िडवाइस” शE द रखे जाएंगे।
7. मूल िनयम के, िनयम 12 म;,- (अ) उप-िनयम (4) के थान पर िनP निलिखत उप-िनयम रखा जाएगा, अथा,त्:-
“(4) अमोिनयम नाइ ेट भ9 डारगृह से िनP निलिखत सुरा दू]रयां रखी जाएगी अथा,त्:-

 (क) 30 मै]

क टन से अनिधक अमोिनयम नाइ ेट के भ9 डारण के िलए,-

(i) 30 मै] क टन से अनिधक मता के भ9 डारगृह से 4.5 मीटर;

(ii) अमोिनयम नाइ ेट मेf ट टHक से 4.5 मीटर;

एगी अथा,त्:-

 (क) 30 मै]

क टन से अनिधक अमोिनयम नाइ ेट के भ9 डारण के िलए,-

(i) 30 मै] क टन से अनिधक मता के भ9 डारगृह से 4.5 मीटर;

(ii) अमोिनयम नाइ ेट मेf ट टHक से 4.5 मीटर;

(iii) चारदीवारी से 4.5 मीटर; और (iv) =कसी भी संरित काय, से 45 मीटर।

(ख) 30 मै]

क टन से अिधक अमोिनयम नाइ ेट के भ9 डारण के िलए,-

(i) अM य भ9 डारगृह से 9 मीटर;

(ii) अमोिनयम नाइ ेट मेf ट टHक से 9 मीटर;

(iii) चारदीवारी से 9 मीटर और (iv) =कसी भी संरित काय, से 90 मीटर; (4अ) भ9 डारगृह या अमोिनयम नाइ ेट मेf ट टHक, अमोिनयम नाइ ेट के िविनमा,ण या संप]रवत,न के पेटीबंदकरण एकक या िव फोटक िविनमा,ण संयं* या नाइ स ऑC साइड िविनमा,ण संयं* के िनकटवतi हो सकता है, =कMतु उप- िनयम (4) के सभी उपबंध@ का पालन =कया जाएगा; (4आ) सुरा दूरी क नाप यथािथित अमोिनयम नाइ ेट मेf ट टHक या भ9 डारगृह के =कनारे से ली जाएगी।”; (आ) उप-िनयम (6) म;,- (क) "वग, मीटर ित", शEद@ के पj चात अंक "1.5" को अंतःथािपत =कया जाएगा;

(ख) परंतुक अंक "200", के थान पर अंक "300" रखे जाएंगे। (इ) उप-िनयम (8) के, ख9 ड (iii) म;, “दूरी रखी जाएगी” शE द@ के पj चात “और दो ऐसे अमोिनयम नाइ ेट मेf ट टHक के बीच M यूनतम एक मीटर क दूरी बनाई रखी जाएगी” शEद अंतःथािपत =कए जाएंगे। 8.

“(1) अमोिनयम नाइ ेट के िविनमा,ण, संप]रवत,न, नौभरण, िवlय या उपयोग हेतु कEजा, प]रवहन, आयात या िनया,त हेतु, इन िनयम@ के अंतग,त जारी अनु_िJ के X येक धारक 7ारा अनुसूची 2 के भाग 3 म; िविनnदo ट !प@ म; अिभलेख रखा जाएगा ता=क अमोिनयम नाइ ेट क जवाबदेही, पहचान और पता लगाना सुिनिZत =कया जा सक; और िनयम 50 म; िविनnदo ट ािधकारी 7ारा मांगे जाने पर ऐसे अिभलेख तुत =कए जाए; (1क) अनु_िJ धारक अमोिनयम नाइ ेट के िविनमा,ण, संप]रवत,न, नौभरण, पेटीबंदकरण, िवlय या उपयोग हेतु कEजा, भंडारण, प]रवहन, आयात या िनया,त के संबंध म; िविशिqयाँ, पे ोिलयम तथा िवफोटक सुरा संगठन क आिधका]रक वेबसाइट म; उपलEध ऑनलाइन णाली म;, ित=दन के आधार पर िविq करेगा।”; 9. मूल िनयम म;, “अs याय 3” के शीष,क के थान पर, िनP निलिखत शीष,क को रखा जाएगा, अथा,त्:-

(क) “सुरा और संरा बंधन योजना के िलए उपबंध”। 10. मूल िनयम म;, िनयम 15 के, उप-िनयम (1) के थान पर िनP निलिखत उप-िनयम को रखा जाएगा, अथा,तः--

“(1) अमोिनयम नाइ ेट के िविनमा,ण, संप]रवत,न या नौभरण के िलए इu छुक ^ यि2 अनु_ापन ािधकारी और िजला ािधकारी को सुरा और संरा बंधन योजना तुत करेगा।”। 11. मूल िनयम के िनयम 18 म;,- (अ) उप-िनयम (1) के थान पर िनTिलिखत उप-िनयम को रखा जाएगा, अथा,त्:-

िलए इu छुक ^ यि2 अनु_ापन ािधकारी और िजला ािधकारी को सुरा और संरा बंधन योजना तुत करेगा।”। 11. मूल िनयम के िनयम 18 म;,- (अ) उप-िनयम (1) के थान पर िनTिलिखत उप-िनयम को रखा जाएगा, अथा,त्:-

"(1)अमोिनयम नाइ ेट को आयातक 7ारा केवल थेले म; आयाितत =कया जाएगा। य=द आवjयक हो, तो आयातक उपयु2 पेwकग के िलए इन िनयम@ के अधीन िविधमाMय अनु_िJ वाले नौभा]रक को ािधकृत करेगा; (आ) उप-िनयम (2) म;, “नौभरण अिभकता,” शE द@ के थान पर “नौभा]रक” शE द रखा जाएगा;
(इ) उप-िनयम (3) म;, “नौभा]रक अिभकता,” शE द@ के थान पर “नौभा]रक” शE द रखा जाएगा; (ई) उप-िनयम (4) म;, “अनु_ापन ािधकारी और” शE द@ का लोप =कया जाएगा; (उ) उप-िनयम (5) के खंड (ख) म; “ !प गड-1” शE द, अर और अंक के थान पर “ !प ग-1” शE द, अर और अंक रखे जाएंगे। 12. मूल िनयम म;, िनयम 19 के उप-िनयम (3) के पj चात, िनP निलिखत उप-िनयम अंतःथािपत =कया जाएगा, अथा,त्:-
“(4) िनया,तक, Xयेक पारेषण के िनया,त पर, जैसे ही भारतीय समूNी पX तन या सीमा से उसके ेषण करते ही, मु/य िनयं*क को लदान के िबल क ित और !प द-12 म; िववरणी तुत करेगा।”। 13. मूल िनयम म;, िनयम 21 के, उप-िनयम (6) म; “भ9 डार गृह” शE द के पj चात “या अमोिनयम नाइ ेट मेf ट टHक” शE द रखे जाएंगे। 14. मूल िनयम म;, िनयम 22 के, उप-िनयम (8) के पj चात, िनP निलिखत उप-िनयम अंतःथािपत =कया जाएगा, अथा,त्:-

“(9) अमोिनयम नाइ ेट के प]रवहन म; लगे यान@ म; xलोबल पोिजyzग िसटम क सुिवधा उपलEध कराई जाएगी और !प त-4 म; प]रवहन अनु_िJ धारक 7ारा िनगरानी क जाएगी।”। 15. मूल िनयम के, िनयम 26 म;, “=कसी भ9 डार गृह म; और उससे” शE द@ के थान पर “=कसी भ9 डार गृह या अमोिनयम नाइ ेट मेf ट टHक से“ शE द रखे जाएंगे। 16.

त-4 म; प]रवहन अनु_िJ धारक 7ारा िनगरानी क जाएगी।”। 15. मूल िनयम के, िनयम 26 म;, “=कसी भ9 डार गृह म; और उससे” शE द@ के थान पर “=कसी भ9 डार गृह या अमोिनयम नाइ ेट मेf ट टHक से“ शE द रखे जाएंगे। 16. मूल िनयम म;, िनयम 27 के, उप-िनयम (2) के ख9 ड (ग), के पj चात िनP निलिखत ख9 ड अंतःथािपत =कया जाएगा, अथा,त्:-
“(घ) अमोिनयम नाइ ेट का कE जा और उपयोग के िलए अनु_िJ धारक 7ारा अनुसूची 2 के भाग 3 के !प द -13 म; पास जारी क जाएगी।”। 17. मूल िनयम म;, अs याय 7 के शीष,क म;, “अंतरण” शE द का लोप =कया जाएगा।
18. मूल िनयम म;, िनयम 29 के उप-िनयम (1) म;, - (अ) ख9 ड (ख) म;, “भ9 डार गृह से” शE द@ के थान पर “अमोिनयम नाइ ेट के” शEद रखे जाएंगे;
(आ) ख9 ड (ग) म;, “भ9 डार गृह” शE द@ के पZात, “या टHक म; िपघला अमोिनयम नाइ ेट” शEद अंतःथािपत =कए जाएंगे; (इ) ख9 ड (घ) म; “भ9 डार गृह” शE द@ के पj चात “या टHक म; िपघला अमोिनयम नाइ ेट” शEद अंतःथािपत =कए जाएंगे। 19. मूल िनयम के, िनयम 30 म;,- (अ) उप-िनयम (1) के थान पर, िनP निलिखत उप-िनयम रखा जाएगा, अथा,त्:-
“(1) अमोिनयम नाइ ेट के िविनमा,ण, संप]रवत,न, नौभरण, िबl हेतु भ9 डारण के िलए कEजा या अमोिनयम नाइ ेट के उपयोग हेतु कE जा, इन िनयम@ के अधीन अनु_िJ ाV त करने हेतु =कसी ^ यि2 7ारा िनयम 33 म; उिfलिखत द तावेज तुत कर, ऐसी अनु_िJ जारी करने के िलए सश2 सम ािधकारी से पूवा,नुमोदन ाV त करना होगा।”; (आ) उप-िनयम (2) म;, “मिज ेट” शE द के थान पर “ ािधकारी” शE द रखा जाएगा;

रा िनयम 33 म; उिfलिखत द तावेज तुत कर, ऐसी अनु_िJ जारी करने के िलए सश2 सम ािधकारी से पूवा,नुमोदन ाV त करना होगा।”; (आ) उप-िनयम (2) म;, “मिज ेट” शE द के थान पर “ ािधकारी” शE द रखा जाएगा;

5 (इ) उप-िनयम (3) म;, शE द और अंक “िनयम 33” के थान पर शE द और अंक “िनयम 34” रखा जाएगा।
20. मूल िनयम के िनयम 31 म;, शE द और अंक, “िनयम 32” के थान पर शE द और अंक, “िनयम 33” रखा जाएगा।
21. मूल िनयम म;, िनयम 33 के, उप-िनयम (2) के खंड (घ) म;, “चाट,]रत अिभयंता” शE द@ के थान पर “आवेदक” शEद रखा जाएगा।
22. मूल िनयम के िनयम 34 म;,- (अ) उप-िनयम (2) के ख9 ड (ख) मे “खान सुरा महािनदेशक” शE द@ के पj चात “या खान सुरा उप महािनदेशक या खान सुरा िनदेशक” शE द अंतःथािपत =कए जाएंगे; (आ) उप-िनयम (3) के थान पर िनP निलिखत उप-िनयम रखा जाएगा, अथा,त्:-
“(3) िजला ािधकारी या खानसुरा महािनदेशक या खानसुरा उप-महािनदेशक या खानसुरा िनदेशक 7ारा िविनमा,ण या संप]रवत,न या भ9 डारगृह या टHक म; िपघले अमोिनयम नाइ ेट के योजन, के िलए जारी =कए गए अनापिR माण प* या िव फोटक िनयम, 2008 के अधीन जारी अना पिR माण-प* के दायरे म; य=द वह थान शािमल है जह| ये काय, पहले से िव'यमान है तो उसके िलए नए िसरे से अनापि} ा माण-प* अपेित नही होगा।”। 23. मूल िनयम म;, िनयम 35 के, उप-िनयम (3) म;, “अनु_ापन ािधकारी” शE द@ के थान पर “िनयं*क या िजला ािधकारी” शE द रखे जाएंगे।

यमान है तो उसके िलए नए िसरे से अनापि} ा माण-प* अपेित नही होगा।”। 23. मूल िनयम म;, िनयम 35 के, उप-िनयम (3) म;, “अनु_ापन ािधकारी” शE द@ के थान पर “िनयं*क या िजला ािधकारी” शE द रखे जाएंगे।
24. मूल िनयम के, िनयम 36 म;,- (अ) उप-िनयम (4) के थान पर िनP निलिखत उप-िनयम रखा जाएगा, अथा,त्:-
“(4) अनु_िJ के नवीकरण के िलए X येक आवेदन, अनु_िJ फस के साथ ऐसे तुत =कया जाएगा =क वह अनु_ापन ािधकारी या अनु_िJ के नवीकरण के िलए अिधकृत ािधकारी के पास उस तारीख को या उससे पहले पहॅुंच जाए, िजस तारीख को अनु_िJ क िविधमाM यता समाV त होती हैः

परM तु य=द पूरे द तावेज@ के साथ नवीकरण आवेदन अनु_ापन ािधकारी 7ारा अनु_िJ क िविधमाM यता समाV त होने के पj चात wकतु उसक िविधमाM यता समाV त होने के छह माह के भीतर ाV त होता है; और य=द अनु_ापन ािधकारी को यह समाधान हो जाता है =क िवलंब का कारण अनु_िJधारी के िनयं*ण से बाहर था, तो इस िनिमR =कए गए =कसी भी अMय कार,वाई के ितकूल भाव के िबना, एक वष, के अनु_िJ फस के तुfय िवलंब फस के भुगतान करने पर नवीकरण =कया जा सकता है।”; (आ) उप-िनयम (5) म;, “और य=द अनु_िJ क िविधमाMयता क तारीख तक उसके नवीनीकरण के िलए कोई आवेदन ाJ नहG होता तो अनु_िJ क िविधमाMयता समाJ हो जाएगी” शE द@ का लोप =कया जाएगा;

पर नवीकरण =कया जा सकता है।”; (आ) उप-िनयम (5) म;, “और य=द अनु_िJ क िविधमाMयता क तारीख तक उसके नवीनीकरण के िलए कोई आवेदन ाJ नहG होता तो अनु_िJ क िविधमाMयता समाJ हो जाएगी” शE द@ का लोप =कया जाएगा; (इ) उप-िनयम (8) के पj चात िनP निलिखत उप-िनयम अंतःथािपत =कए जाएंगे, अथा,त्:-

“(9) ऐसी कोई भी अनु_िJ का नवीकरण नहG =कया जाएगा य=द अनु_ापन या नवीकरण ािधकारी 7ारा नवीकरण का आवेदन, अनु_िJ के िविधमाM यता समाV त होने के छह माह के पj चात ाV त =कया जाता है।

(10) अनु_िJ के िविधमाM यता समाV त होने के छह माह के पj चात य=द अनु_िJ नवीकरण हेतु आवेदन ाV त होता है तो उसे नई अनु_िJ जारी करने हेतु आवेदन समझा जाएगा और ऐसे मामले म;, नई अनु_िJ जारी करने हेतु िजला ािधकारी 7ारा जारी अनापिR माण-प* सिहत सभी आवj यक द तावेज, अनु_ापन ािधकारी को तुत =कए जाएंगे।”। 25. मूल िनयम म;, िनयम 51 के उप-िनयम (3) म; “इस िनयम” शE द@ के थान पर शE द, अंक और ~े केट “उप-िनयम (2)” रखे जाएंगे।

मूल िनयम के, िनयम 52 म;, “जहॉ हािन अमोिनयम नाइ ेट के रोजमरा, के उX पादन, भ9 डारण, प]रवहन, या उपयोग के दौरान तीकाX मक !प से होने वाली हािन क मा*ा से अिधक हािन होती है,” शE द@ का लोप =कया जाएगा।

ूल िनयम के, िनयम 52 म;, “जहॉ हािन अमोिनयम नाइ ेट के रोजमरा, के उX पादन, भ9 डारण, प]रवहन, या उपयोग के दौरान तीकाX मक !प से होने वाली हािन क मा*ा से अिधक हािन होती है,” शE द@ का लोप =कया जाएगा। 27. मूल िनयम क अनुसूची 1 के सारणी म; lम सं/ या 3 के सामने, तंभ 2 म;,- (अ) मद (क) म; “या योग” शE द@ का लोप =कया जाएगा; (आ) मद (ख) के थान पर िनP निलिखत मद रखी जाएगी, अथा,तः-

“(ख) =कसी भ9 डार गृह या टHक म; िपघले अमोिनयम नाइ ेट से 30 मै] क टन से अिधक अमोिनयम नाइ ेट के िवlय हेतु कE जे म; रखने के िलए अनु_िJ; या”;
(इ) मद (ग) के थान पर िनTिलिखत मद रखा जाएगा, अथा,त्:-

“(ग) =कसी िव फोटक िविनमा,ता या नाइ स ऑC साइड िविनमा,ता इकाई या औ'ोिगक इकाई से संब भ9 डार गृह या टHक म; िपघले अमोिनयम नाइ ेट से उपयोग हेतु आमोिनयम नाइ ेट कE जे म; रखने के िलए अनु_िJ; या”; (ई) मद (घ) म; “भ9 डार गृह” शE द@ के पj चात “3 मै] क टन से अनिधक” अंक और शE द अंतःथािपत =कए जाएंगे।
28. मूल िनयम के अनुसूची 2 म;, (अ) भाग-1 क, सारणी म;, तंभ 2 म;, !प क-3 के सामने,-

(क) मद (क) म; “या योग” शE द@ का लोप =कया जाएगा;

G.S.R. 1271(E), dated the 13th day of October, 2017 in the Gazette of India, Part II, Section 3, Sub-Section (i) inviting objections and suggestions from all the persons likely to be affected thereby, before the expiry of a period of forty five days from the date on which the copies of the Gazette containing the said notification were made available to the public; And, whereas, copies of the said Gazette were made available to the public on 13th day of October, 2017; And, whereas, objections and suggestions were received from the public on the said draft rules, have been duly considered by the Central Government; Now, therefore, in exercise of powers conferred by sections 5 and 7 of the Explosives Act, 1884 (4 of 1884), the Central Government hereby makes the following rules further to amend the Ammonium Nitrate Rules, 2012, namely:-

(1) These rules may be called the Ammonium Nitrate (Amendment) Rules, 2018. (2) They shall come into force on the date of their final publication in the Official Gazette.

In the Ammonium Nitrate Rules, 2012 (hereinafter referred to as the principal rules), in rule 2,-

(i) for clause (s), the following clause shall be substituted, namely:- '(s) "stevedore" includes any person or agency or firm which undertakes loading and unloading of Ammonium Nitrate from the ship, its transport to the licensed store house; (ii) in clause (t), for the words “stevedoring, transport, storage and usage”, the words “converter and stevedore” shall be substituted. 3. In the principal rules, in rule 5, the proviso shall be omitted. 4. In the principal rules, in rule 6,- (A) in sub-rule (2), clause (a) shall be omitted;
(B) in sub-rule (5), for clause (b), the following clause shall be substituted, namely:- "No Ammonium Nitrate shall be transported in any carriage vessel or vehicle plying for or carrying passengers.".

(4A) The store house or Ammonium Nitrate melt tank may be adjacent to the bagging unit of the manufacturing or conversion of Ammonium Nitrate or explosives manufacturing plant or nitrous oxide manufacturing plant, but shall observe all the provisions of sub-rule (4). (4B) The safety distance shall be measured from the edge of the store house or Ammonium Nitrate melt tank as the case may be. "; (B) in sub-rule (6),- (i) after the words "one square metre per", the figure "1.5" shall be inserted; (ii) in the proviso, for the figure, "200", the figure "300" shall be substituted;
(C) in sub-rule (8), in clause (iii), after the words "protected works", the words “and the distance of minimum one metre shall be maintained between two such Ammonium Nitrate melt tanks” shall be inserted. 8.

"(1) Every person holding a licence granted under these rules for manufacture, conversion, stevedore, possession for sale or use, transport, import or export of the Ammonium Nitrate shall maintain records in the forms specified in Part 3 of Schedule II to ensure accountability, identification and traceability of Ammonium Nitrate and shall produce such records on demand to an authority specified in rule 50. (1A) The licence holder shall enter the particulars on manufacture, conversion, stevedore, bagging,
possession for sale or use, transport, import or export of Ammonium Nitrate in the online system made available in the official website of Petroleum and Explosives Safety Organisation on day to day basis.". 9. In the principal rules, in “CHAPTER III", for the heading, the following heading shall be substituted, namely:- “PROVISIONS FOR SAFETY AND SECURITY MANAGEMENT PLAN”. 10. In the principal rules, in rule 15, for sub-rule (1), the following sub-rule shall be substituted, namely:- "(1) A person intending to manufacture, convert or stevedore Ammonium Nitrate shall submit Safety and Security Management Plan to the licensing authority and to the District Authority.".

(C) after sub-rule (8), the following sub-rules shall be inserted, namely:- "(9) No licence shall be renewed if the application for renewal is received by the licensing or renewing authority after six months of the date of its expiry.
