नई दली, 15 माच , 2018 सा.का.िन सा.का.िन सा.का.िन सा.का.िन. 231 31 31 31(अ).—केीय सरकार, गैस िसलडर िनयम, 2016 का और संशोधन करने के िलए कितपय िनयम' का (ा)प िव+फोटक अिधिनयम, 1884 (1884 का 4) क2 धारा 18 क2 अपे3ानुसार भारत सरकार के वािण7य और उ9ोग मं:ालय (औ9ोिगक नीित और संवध न िवभाग) क2 अिधसूचना सं<या सा.का.िन. 09(अ), तारीख 04.01.2018 @ारा भारत के राजप: असाधारण, भाग II, खंड 3, उप-खंड (i), तारीख 4 जनवरी, 2018 म (कािशत कया गया था, िजसम ऐसे सभी DिEय' से, िजनक2 इससे (भािवत होने क2 संभावना है, उस तारीख, िजसको अिधसूचना जनता को उपलHध करा दी गई थी, से तीस दन क2 समािI से पहले आ3ेप या सुझाव आमंि:त कए गए थे ; और, उE अिधसूचना जनता को 4 जनवरी, 2018 को उपलHध करा दी गई थी;

और, उE (ा)प के सLबध म जनता से (ाI Nए आ3ेप' और सुझाव' पर केीय सरकार @ारा सLयकत: िवचार कर िलया गया है ; अतः, अब, केीय सरकार िव+फोटक अिधिनयम, 1884 (1884 का 4) क2 धारा 5 और धारा 7 @ारा (दS शिEय' का (योग करते Nए, गैस िसलेTडर िनयम, 2016 का और संशोधन करने के िलए िनUिलिखत िनयम बनाती है, अथा त् :- 1.

ै ; अतः, अब, केीय सरकार िव+फोटक अिधिनयम, 1884 (1884 का 4) क2 धारा 5 और धारा 7 @ारा (दS शिEय' का (योग करते Nए, गैस िसलेTडर िनयम, 2016 का और संशोधन करने के िलए िनUिलिखत िनयम बनाती है, अथा त् :- 1. संि नाम और ारभ संि नाम और ारभ संि नाम और ारभ संि नाम और ारभ - (1) इन िनयम' का संि3I नाम गैस िसलेTडर (दूसरा संशोधन) िनयम, 2018 है । (2) ये राजप: म इनके (काशन क2 तारीख को (वृS ह'गे । 2. गैस िसलेTडर िनयम, 2016 (िजसे इसम इसके पYात् उE िनयम कहा गया है), के िनयम 48 म, उप-िनयम (3) के +थान पर िनUिलिखत रखा जाएगा, अथा त् :- “(3) उप-िनयम (1) के अधीन “अनापिS (माणप:” क2 अपे3ा िनUिलिखत के सLबध म ()प ‘च’ म अनु[िI के िलए लागू नह\ होगी,-

(क) 7वलनशील या िवषैली या सं3ारक गैस' के भंडारण के िलए, जो भरण संयं: का भाग है ; और (ख) िसलेTडर' म िवत पे^ोिलयम गैस के भंडारण के िलए बशत_ ''अनापिS (माणप:'' +थानीय िनकाय जैसे `ाम पंचायत या सLबa शहरी +थानीय िनकाय से अिभ(ाI कया जाएगा ।”
3. उE िनयम के िनयम 57 म, खंड 4 के पYात् िनUिलिखत खंड अतः+थािपत कया जाएगा, अथा त् :-

“(5) इन िनयम' के अधीन अनुदS (bयेक अनु[िI या अनुमोदन रc हो जाएगा, यद अनु[िIधारी, अनु[I साइट या अनुमोदत पdरसर का कोई अिधकार नह\ रखता है ।”

पYात् िनUिलिखत खंड अतः+थािपत कया जाएगा, अथा त् :-

“(5) इन िनयम' के अधीन अनुदS (bयेक अनु[िI या अनुमोदन रc हो जाएगा, यद अनु[िIधारी, अनु[I साइट या अनुमोदत पdरसर का कोई अिधकार नह\ रखता है ।”
4. उE िनयम' के ()प ‘ग’ म, ()प 'ड़', ()प ‘च’ और ()प ‘छ’ म अनु[िI के िलए इस आवेदन के साथ (+तुत कए जाने वाले अपेि3त द+तावेज, शीष के अधीन :- (क) मद (iv) म ''पeा करार'' शH द' का लोप कया जाएगा; (ख) मद (vi) के + थान पर, िनL निलिखत मद रखी जाएगी, अथा त्:--

“(vi) संपीिडत (ाकृितक गैस या संपीिडत बायो गैस ऑटोमोdटव gधन के )प म िवतdरत करने के िलए ()प ‘छ’ म अनु[िh त या िबi2 या Dापार के (योजन के िलए 7 वलनशील गैस' या िवषाE गैस' या सं3ारक गैस' के भंडारण के िलए ()प ‘च’ म अनु[िI के िलए आवेदन क2 दशा म िनयम 48 के अधीन, िजला (ािधकारी से अनापिS (माणप: ;

परंतु 7वलनशील गैस' या िवषाj त गैस' या सं3ारक गैस' के भंडारण के िलए, जो भरण संयं: का भाग है, ()प ‘च’ म अनु[िI या िसलै डर' म िवत पे^ोिलयम गैस के भंडारण के िलए ()प ‘च’ म अनु[िI के िलए िजला (ािधकारी से अनापिS (माणप: क2 अपे3ा, लागू नह\ होगी ।
परंतु यह और क िसलेTडर' म िवत पे^ोिलयम गैस के भंडारण के िलए, ()प ‘च’ म अनु[िI के िलए, +थानीय िनकाय, जैसे `ाम पंचायत या सLबिधत शहरी +थानीय िनकाय से “अनापिS (माणप:” अपेि3त होगा ।”

MINISTRY OF COMMERCE AND INDUSTRY (Department of Industrial Policy and Promotion) NOTIFICATION New Delhi, the 15th March, 2018 G.S.R. 231(E).—WHEREAS the draft of certain rules further to amend the Gas Cylinders Rules, 2016 was published as required by section 18 of the Explosives Act, 1884 (4 of 1884) in the Gazette of India, Extraordinary,
Part II, Section 3, Sub-section (i), dated the 4th January 2018 vide Notification of the Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy & Promotion), number, GSR 09(E), dated 4th January, 2018

inviting objections or suggestions from all persons likely to be affected thereby, before the expiry of thirty days from the date on which the notification was made available to the public; AND WHEREAS, the said notification was made available to the public on the 4th January, 2018. AND WHEREAS, objections and suggestions received from the public on the said draft have been duly considered by the Central Government; NOW WHEREAS, in exercise of the powers conferred by sections 5 and 7 of the Explosives Act, 1884 (4 of 1884), the Central Government hereby makes the following rules further to amend the Gas Cylinders Rules, 2016, namely :-

1. Short title and commencement.— (1) These rules may be called the Gas Cylinders (Second amendment) Rules, 2018.
   (2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Gas Cylinders Rules, 2016 (hereinafter referred to as the said rules), in rule 48, for sub-rule (3), the following shall be substituted, namely:- “(3) The requirement of the “No Objection Certificate” under sub-rule (1) shall not be applicable for a license in form “F”, - (a) for storage of flammable or toxic or corrosive gases forming part of cylinder filling plant ; and (b) for storage of Liquefied Petroleum Gas in cylinders, provided “No Objection Certificate” shall be obtained from the local body such as Gram Panchayat or the urban local body concerned.”

In the said rules, in the rule 57, after clause (4), the following clause shall be inserted, namely :- “(5) Every licence or approval granted under these rules shall stand cancelled, if the licensee ceases to have any right to the site of the licensed or approved premises.” 4.

In the said rules, in form ‘C’, under the heading DOCUMENTS REQUIRED TO BE SUBMITTED WITH THIS APPLICATION FOR A LICENCE IN FORM ‘E’, ‘F’ and ‘G’ :- (a) in item (iv), the words “lease agreement” shall be omitted; (b) for item (vi), the following item shall be substituted, namely :- “(vi) No Objection Certificate from the District Authority under rule 48 in the case of application for a licence in Form “G” to dispense Compressed Natural gas or Compressed Bio Gas as automotive fuel or a Licence in Form “F” to store flammable or Toxic or corrosive gases for the purpose of sale or trading ; Provided that the requirement of No Objection Certificate from the District Authority shall not be applicable for a licence in form “F” for storage of flammable or toxic or corrosive gases forming part of cylinder filling plant or licence in form “F” for storage of Liquefied Petroleum Gas in cylinders: Provided further that for a licence in form ‘F’ for storage of Liquefied Petroleum Gas in cylinders, “No objection Certificate” shall be required from the local body such as Gram Panchayat or the Urban local Body concerned.” 5. In the said rules, in Form “G”, in condition 1, in sub-condition (b), for the words and figure “in condition 6 of the licence”, the words and figures, “Table II of condition 7 of the licence in Form G” shall be substituted.
