(अ).— िवफोटक अिधिनयम, 1884 (1884 का 4) क धारा 18 क अपेानुसार गैस िसल$डर िनयम, 2016 के संशोधन का +ा,प भारत के राजप0, असाधारण, भाग II, खंड 3, उप-खंड (i), तारीख 17 जुलाई, 2017 म$, भारत सरकार के वािण4य और उ7ोग मं0ालय (औ7ोिगक नीित और संवध8न िवभाग) क अिधसूचना सं;यांक सा.का.िन. 886(अ), तारीख 17 जुलाई, 2017 =ारा +कािशत उन सभी >ि?य@ से, िजनके उससे +भािवत होने क संभावना थी, उस तारीख से, िजसको उ? अिधसूचना जनता को उपलCध करा दी गई थD, पEतालीस दन क अविध क समािF से पूव8 आेप और सुझाव आमंि0त करते Iए +कािशत कया गया था ।

और उ? अिधसूचना जनता को तारीख 17 जुलाई, 2017 को उपलCध करा दी गई थी ;

और कोई आेप या सुझाव +ाF नहD Iए हE ;

अतः, अब, केNOीय सरकार, िवफोटक अिधिनयम, 1884 (1884 का 4) क धारा 5 और धारा 7 =ारा +दQ शि?य@ का +योग करते Iए, गैस िसल$डर िनयम, 2016 का और संशोधन करने के िलए िनRिलिखत िनयम बनाती है, अथा8त् :- 1.

अतः, अब, केNOीय सरकार, िवफोटक अिधिनयम, 1884 (1884 का 4) क धारा 5 और धारा 7 =ारा +दQ शि?य@ का +योग करते Iए, गैस िसल$डर िनयम, 2016 का और संशोधन करने के िलए िनRिलिखत िनयम बनाती है, अथा8त् :- 1. संि नाम और ा संि नाम और ा संि नाम और ा संि नाम और ारभ रभ रभ रभ : (1) इन िनयम@ का संिF नाम िसल$डर (संशोधन) िनयम, 2018 है ।

(2) ये राजप0 म$ इनके +काशन क तारीख को +वृQ ह@गे । 2. गैस िसल$डर िनयम, 2016 के िनयम 2 म$,
(क) खंड (i) के पVात्, िनRिलिखत खंड अNतःथािपत कया जाएगा, अथा8त् :- (iक) “ऑटो एलएनजी” से ऑटोमोXटव Yधन के िलए बनी Oिवत +ाकृितक गैस अिभ+ेत है;’; (ख) (xxiii) “गैस िसल$डर” या “िसल$डर” से आरZभ होने वाले को[क@, अंक@ और शCद@ तथा “>ास 60 स$टीमीटर से अिधक न हो” से समाF होने वाले शCद@ और अंक@ के थान पर िनRिलिखत रखा जाएगा, अथा8त् :-

‘(xxviii) “गैस िसल$डर” या “िसल$डर” से संपीिडत गैस के भ\डारण और पXरवहन के िलए आशियत कोई बंद धातु आधान अिभ+ेत है, िजसका आयतन 500 िमली से अिधक कNतु 1000 लीटर से अनिधक है, जो कसी मोटरयान म$ इसके Yधन टEक के ,प म$ लगाया गया कोई Oिवत पे]ोिलयम गैस (एल.पी.जी.) आधान या Oिवत +ाकृितक गैस (एल.एन.जी.) आधान अथवा संपीिडत +ाकृितक गैस (सी.एन.जी.) िसल$डर हेतु आशियत है, कNतु इसके अNतग8त कसी िवशेष पXरवहन या अवच_ म$ लगाया गया ऐसा कोई अNय आधान नहD है और िजसम$ कZपोिजट िसल$डर और _ायोजिनक आधान भी सिZमिलत है, तथािप, सी.एन.जी.

कृितक गैस (सी.एन.जी.) िसल$डर हेतु आशियत है, कNतु इसके अNतग8त कसी िवशेष पXरवहन या अवच_ म$ लगाया गया ऐसा कोई अNय आधान नहD है और िजसम$ कZपोिजट िसल$डर और _ायोजिनक आधान भी सिZमिलत है, तथािप, सी.एन.जी. नाइ]ोजन या संपीिडत वायु के भंडारण के िलए +यु? िसल$डर क जलीय मता 1000 लीटर से 3000 लीटर तक अिधक हो सकती है, परंतु तब जबक ऐसे िसल$डर का >ास 60 स$टीमीटर से अिधक न हो ;’; (ग) खंड (xxxviii) के पVात्, िनRिलिखत खंड अNतःथािपत कया जाएगा, अथा8त् :-

‘(xxxviiiक) “Oिवत +ाकृितक गैस” से _ायोजिनक अवथा म$ एक Oव अिभ+ेत है जो मु;य ,प से िमथेन से बना है ;’।

MINISTRY OF COMMERCE AND INDUSTRY (Department of Industrial Policy and Promotion) NOTIFICATION New Delhi, the 27th February, 2018

G.S.R. 189(E). — WHEREAS the draft of the amendment of the Gas Cylinders Rules, 2016 was published as required by section 18 of the Explosives Act, 1884 (4 of 1884) in the Gazette of India, Extraordinary, Part II, section 3, Sub-section (i), dated the 17th July, 2017, vide notification of the Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion), number, G.S.R.

3, Sub-section (i), dated the 17th July, 2017, vide notification of the Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion), number, G.S.R. 886(E), dated the 17th July, 2017 inviting ob- jections or suggestions from all persons likely to be affected thereby, before the expiry of forty five days from the date on which the said notification was made available to the public;

AND WHEREAS, the said notification was made available to the public on the 17th July, 2017; AND WHEREAS, no objection or suggestion has been received; NOW, THEREFORE, in exercise of the powers conferred by sections 5 and 7 of the Explosives Act, 1884
(4 of 1884), the Central Government thereby makes the following rules further to amend the Gas Cylinders Rules, 2016, namely :- 1.
Short title and commencement (1) These rules may be called the Gas Cylinders (Amendment) Rules, 2018. (2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Gas Cylinders Rules, 2016, in rule 2,- (a) after clause (i), the following clause shall be inserted, namely:-

‘(ia) “Auto LNG” means a liquefied natural gas meant for automotive fuel;’;

¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 (b) for the portion beginning with the brackets, figures and words ‘ (xxiii) “gas cylinder” or “ cylinder” ’ and ending with the words and figures “ such cylinder does not exceed 60 cm”, the following shall be substi- tuted, namely :- ‘(xxviii) “gas cylinder” or “cylinder” means any closed metal container having a volume exceeding 500 ml but not exceeding 1000 liters intended for the storage and transport of compressed gas, including any lique- fied petroleum gas (LPG) container or liquefied natural gas (LNG) container or compressed natural gas (CNG) cylinder fitted to a motor vehicle as its fuel tank but not including any other such container fitted to a special transport or undercarriage and includes a composite cylinder and cryogenic container, however, the water capacity of cylinder used for storage of CNG, nitrogen or compressed air may exceed 1000 liters up to 3000 liters provided the diameter of such cylinder does not exceed 60 cm;’; (c) after clause (xxxviii), the following clause shall be inserted, namely :-

‘(xxxviii-a) “liquefied natural gas” means a fluid in the cryogenic liquid state composed predominantly of
methane;’.
