1. Introduction: -

Superintendents (Group-B Executive Gazetted) and Inspectors (Preventive officers) (Group-B Non-Gazetted) are the cutting-edge level cadres. Their transfer/rotation is presently governed by S.O. No. 13/2019 dated 02.07.2019, and their Sanction/Working strength is governed by S.O No. 16/2019 dated 03.07.2019 & S.O. No. 15/2020 dated 09.06.2020 as amended by S.O. No. 22/2020 dated 17.07.2020.

2. Need for revision in the existing transfer and posting policy: -

2.1 Post issuance of Annual General Transfer Order 2022 issued by P&E Section, New Customs House, Zone-! in the grade of Superintendents, there has been a considerable change and increase in the working strength vis-a-vis sanctioned strength in the grade of Superintendents posted in Zone — Il.

2.2 In the present scenario, the working strength in the grade of Superintendents posted in Mumbai Customs Zone-ll is almost 85 % vis-a-vis the sanctioned strength, however, the working strength of Preventive officers has been reduced drastically (presently 22.5% of sanctioned strength) owing to large number of promotions from Preventive officers to Superintendents in Dec’2021.

2.3 Further, SCMTR, Turant Suvidha Kendra & LARM have been introduced in JNCH, vide Notification No. 38/2018 dated 11.05.2018 & PN No. 82/2020 dated 14.07.2020 respectively for achieving the key objectives of Turant Customs like prompt and timely assessment of Bills _ of Entry and clearance of imported consignments so as to facilitate the trade and to reduce the handling cost and dwell time.

2.4 Therefore, to accommodate the above mentioned changes in the working and administration of JNCH, a need has been felt to review the existing transfer and posting policy of the officers and allocation of sanctioned and working strength in the grade of Superintendents posted in Zone II.

3.1 As per Standing Order No. 13/2019 dated 02.07.2019, all charges/assignments at F JNCH have been divided into three Clusters: Cluster A, Cluster B and Cluster C. | 3.2 For Superintendents, Cluster A comprises of SEZ, Intelligence sections, Export Assessment, container scanning division and Audit. The erstwhile sections like Drawback and CRC Refund have been shifted to Cluster B. Further, it is submitted that all sections in cluster B are office postings except DPD /RMS which falls in the category of import clearance. Similarly, all sections covered under cluster C pertains to clearance of import / export cargo or Boarding of vessels arriving at JNPT, The tenure of postings categorized in cluster A and B are of one year each. The tenure of Custer C has further been subdivided into two sub-clusters of 6 months each i.e in cluster C1 & Cluster C2.

3.3 Therefore, to attempt the equalization of the cadre strength viz. in clusters A, B, & C, minor shifting of existing sections/ newly created sections are required which are elaborated in annexure B.

3.4 Further, as per Standing Order No. 16/2019 dated 30.07.2019, amended vide Standing Order No. 15/2020 dated 09.06.2020, which pertains to the sanctioned strength and working strength of officers in Zone II, no sanctioned strength in the grade of Superintendents had been assigned for LARM & SCMTR sections.

3.5 Accordingly, in order to examine the above mentioned issues, a committee of Commissioners of Customs (JNCH) was constituted by the order of competent authority. Subsequently, on the basis of the recommendation envisioned by the said committee which deliberated upon providing an all-round exposure to the different aspects of department’s working, the allocation of different charges of Zone II and sanctioned strength in the three clusters are revised for the purpose of transfer/posting in different sections {Annexure ‘A’ for Superintendents sanction/working strength reallocation} and cluster wise section posting as per annexure ‘ B’.

3.6 Further, if an officer who is posted in any non-sensitive posting and remains absent or proceeds on any type of leave for a period of more than one month, without any appropriate reason, then the concerned officer shall be liable for continuation to be posted in the same cluster till the expiry of prescribed tenure in that cluster.

This policy takes effect from the date of its issuance and all matters connected with transfer and postings in the jurisdiction of JNCH shall be governed by it. This covers those officers also who are presently working in JNCH and who are hitherto been governed by earlier SOs. All other provisions & guidelines provided in previous Standing Order No. 13/2019 dated 02.07.2019, Standing Order No. 16/2019 dated 30.07.2019, S.O No. 15/2020 dated 09.06.2020 & S.O No. 22/2020 dated 17.07.2020 which has not been covered/modified in the present order will continue to remain unchanged.
