STANDING ORDER NO. 09/2021 Reference is made to the CBIC Instruction No. 08/2021- Customs dated 27.04.2021, F. No. 450/117/2021 Cus-IV (Pt) (Copy enclosed) which is self-explanatory.

All permissions / licenses / authorizations required from other Government Departments / Agencies prior to the clearance of goods, if any, are deemed to have been given in respect of such imports in terms of this Instruction. In other words, these cases would not need to be referred to those agencies or the requirement may be suitably waived. This point must be implemented without exception.

Further, as such Indian Red Cross Society imports facilitated by our Ministry of External Affairs are related to the extraordinary situation of COVID-19 pandemic in our country and hence required to be seamlessly cleared, if any such consignment of relief materials needs a waiver of any other type, it should be obtained instantaneously from the Commissioner.

Accordingly, in terms of the above, there would remain no reason to raise any issues in the course of Customs processes that may delay the clearance in any manner.

If a container is selected for scanning, the same should be brought to the notice of Additional Commissioner, CSD, Nhava Sheva for immediate action.

The highest priority in dealing with and facilitating such consignments for clearance and delivery in the absolute shortest possible time shall be extended by the Customs officers for which all co-ordination with other stakeholders would be maintained at the initiative of Customs from in- advance onwards. Towards this end, such consignments shall be cleared and delivered directly from the Port/ Terminal/ Place of arrival.

This issues with the concurrent approval of the Pr. Commissioners/Commissioners of Customs NS – Gen, I, III and V, Nhava Sheva.

Reference is invited to Board Instruction No.07/2021 dated 24th April 2021 requesting the field formations to give high priority for Customs clearance of import of goods relating to COVID 19 pandemic, including medical grade oxygen, specified equipment for production, transportation and distribution of oxygen, equipment for oxygen therapy to COVID patients and COVID-19 vaccines etc. Donations of COVID-related material and medicines from foreign Governments have also started arriving at our ports. 2. In wake of the extraordinary situation owing to the COVID pandemic, the issue of providing seamless clearance to such relief material received from foreign Governments and imported by Indian Red Cross Society was discussed in a meeting chaired by Cabinet Secretary on 27.4.2021.
It was decided that in all cases of covid related imports facilitated by Ministry of External Affairs and/ or imported by Indian Red Cross society, permissions/ licences/ authorizations required from other Government Department/Agencies prior to the clearance of goods, if any, would be deemed to have been given. In other words, such cases need not be referred to those agencies or the requirement may be suitably waived. 3.
