Dated 13.04.2020 STANDING ORDER NO. 10/2020 Sub: - Clearance of goods under India’s Trade Agreements without original Certificate of Origin- regarding. Attention of all the officers of JNCH is invited to the CBIC circular no. 18 of 2020 – Customs dated 11.04.2020 on the above subject. It is directed in the said circular that, in accordance- with the Trade Notice No. 62/2019-2020 issued by DGFT on 06.04.2020, the import consignments, where a preferential treatment of goods under a Free Trade Agreement has been claimed but the original hard copy of COO has not been submitted or only digitally signed copy or unsigned copy of COO is submitted, may be assessed and cleared provisionally in terms of section 18 of the Customs Act, 1962. The final assessment may be done subsequently on submission of the original COO certificate by the importer. The revenue may be secured through undertaking and appropriate security. 2. In this regard JNCH has already issued Public Notice No. 46 of 2020 dated 07.04.2020 which may be referred to. It is further directed that the officers resorting to provisional assessment on account of non-submission of original COO certificate, shall maintain a record of all cases of relaxation allowed by them and will ensure that such provisional assessments are finalized at the earliest and in accordance with the prescribed regulations.

3. In case of any difficulty, the specific issue may be brought to the notice of ADC/ JC, Appraising Main (Import), NS-I or DC/AC in charge of Appraising Main (Import), NS-I.
