Subject: - Permission for drawal of samples from import consignments
facilitated under RMS for testing by PGAs- regarding.
Representations have been received from the members of Trade that they are facing difficulty in obtaining permission for drawal of samples from RMS facilitated import consignments, which are required for testing by Participating Government Agencies (PGAs). At present, such permission for drawal of samples is accorded by the concerned Additional/ Joint Commissioner of Customs (Docks) as per Standing Order no. 06/2006 dated 22.02.2006.
It has been stipulated under Para 8 of the said Standing Order no. 06/2006 dated 22.02.2006 that, “………..It is also clarified that officers in the shed may examine a consignment even if it is directly selected for out-of-charge by the RMS, if they have a valid reason for doing so. However, such examination should be done only after bringing the case to the notice of the Additional/Joint Commissioner of Customs (Shed). In case of Accredited Clients, it would require written approval of the Commissioner.”
The issue has been examined and it has been decided that in case, where the bill of entry is facilitated by RMS and there is requirement of testing by PGAs, the permission for drawal of samples for such testing may be given by the concerned Deputy/ Asstt. Commissioner of Customs (Docks).
The Standing Order no. 06/2006 dated 22.02.2006 stands modified to the above extent.
