With the notification of the Customs (Electronic Cash Ledger) Regulations, 2022 (ECLR) notified vide Notification No. 20/2022-Customs (N.T) dated 30.03.2022, the statutory provisions of section 51A came into force on 01.06.2022. However, all the deposits classes were exempted till 31.03.2023, vide Notification No. 47/2022-Customs (NT) dt. 31.05.2022, as amended. Further, vide Circular No. 09/2023-Cus dated 30.03.2023, the Board has enabled ECL in phases from 01.04.2023. However, on enabling the said provisions, in some instances, grievances from trade have been received that after payment of the duty the same is not being reflected in ICES and Out Of Charge is not getting effected by the ICES.

In view of the above, in order to facilitate the trade and to keep a check on dwell time, it has been decided that in case of import of perishable cargo, where the payment of the duty has been done but the same is not being reflected in ICES, the docks officer shall grant manual Out Of Charge if the importer produces a bank certificate indicating the payment of duty amount along with an undertaking that in case duty is found to be not credited, the importer shall deposit the same immediately.

3. D.C. / A.C. Docks, in-charge of each cluster of docks, are directed to maintain a register of such cases of import of perishable cargo kept in each cluster of Docks. At the end of each day, D.C. / A.C. Docks in-charge of each cluster shall forward the report to Appraising Main (Import) of such cases.

4. The Appraising Main (Import) on receipt of such reports, will verify the payments with the concerned banks on the following working day. After verification of the payment such entries shall be struck off from the Docks register as well as Appraising Main (Import) database and the manual Out Of Charge shall be regularized in the ICES system. D. Difficulty, if any, faced in the implementation of this standing order may be brought to the notice of the Addl. / Joint Commissioner of Customs [Appraising Main (Import)] through email at appraisingmain.jnch@gov.in . 6. This issues with the approval of Chief Commissioner of Customs, Zone-ll, JNCH.
