Department vide letter dated 01.09.2025 has informed that the department had lodged its claim with respect to this matter and same has been accepted on 09.03.2021 for appropriation. They have not informed of any further development in this matter. Since in this case, department has filed claim before the NCLT, it shall be dealt with in accordance with law. At this stage, the matter cannot be proceed with.
In view of the same, appeal filed by the appellant is dismissed with liberty to either side to seek restoration in case any claim still survives.
Appeal dismissed in above terms.
