The area admeasuring 139359.00 SQM of the Container Freight Station of M/s. Gateway Distriparks Ltd. located at Sector 6, Dronagiri Node, Taluka Uran, Dist. Raigad, Maharashtra- 400707 was declared as a Customs Area vide notification No. 02/98 dated 01.12.1998 and M/s. Gateway Distriparks Ltd. was appointed as a ‘Custodian’ of the Container Freight Station, under section 45 of the Customs Act, 1962 as amended from time to time and vide last Notification No. 27/2015 dated 18.06.2015 and Corrigendum dated 30.06.2015 for a period of 5 years from 15.03.2015.

Now, in exercise of the powers conferred on me under Section 45(1) and 141 (2) of the Customs Act, 1962, I, Sanjay Mahendru, Commissioner of Customs (General), JNCH hereby renew the appointment of M/s. Gateway Distriparks Ltd. as ‘Custodian’ of the imported goods received at the said Container Freight Station until these are cleared for home consumption or are warehoused or are transshipped in accordance with the provision of Chapter VIII of the Customs Act, 1962. Similarly, M/s. Gateway Distriparks Ltd. will also be the ‘Custodian’ of the Export Cargo brought into said Container Freight Station, for examination and stuffing till their exportation through Jawaharlal Nehru Port.

Further, in exercise of the powers conferred on me under Regulation 10 of the ‘Handling of Cargo in Customs Areas Regulations 2009’ I, Sanjay Mahendru, Commissioner of Customs (General), JNCH, hereby renew the approval of M/s. Gateway Distriparks Ltd. as the ‘Customs Cargo Services Provider’ for CFS M/s. Gateway Distriparks Ltd. subject to the following conditions: (i) The Custodian M/s. Gateway Distriparks Ltd. approved as ‘Customs Cargo Services Provider’ shall abide by all the provisions of the Customs Act, 1962, the rules of the ‘Handling of Cargo in Customs Areas Regulations, 2009’ and other regulations, notifications, orders issued there under.

(ii) The duration of appointment of M/s. Gateway Distriparks Ltd. as ‘Custodian’ and as ‘Customs Cargo Services Provider’ shall remain valid for five (5) years from 15.03.2020.

(iii) The waiver from execution of Bank Guarantee has been given in terms of regulation 5(3) of HCCAR, 2009, as the CFS has been accredited with AEO-LO status with validity till 24.04.2022. If the validity of AEO status granted to the CFS is withdrawn prior to the scheduled date i.e. 24.04.2022 or is not extended beyond 24.04.2020, the CFS shall execute bank guarantee for the amount as determined w.e.f. date of expiry of validity of AEO status.

(iv) The Commissioner of Customs (General), JNCH, shall have right to review the approval as ‘Customs Cargo Services Provider’ before the completion of five years for failure to comply with any of Regulations of the ‘Handling of Cargo in Customs Areas Regulations, 2009’ or as per the directions of the Government of India.
