Subject: Customs (Administration of Rules of Origin under Trade Agreements) Rules, 2020 [CAROTAR, 2020]-reg.

Attention of Importers, Exporters, Customs Brokers, Shipping Lines/ Agents, Logistics Service Providers, CFSs Custodians, Trade, Customs Staff and all other stakeholders is invited to the Board’s Circular no.-38/2020-Customs dated 21.08.2020 about the introduction of Customs (Administration of Rules of Origin under Trade Agreements) Rules, 2020 (hereafter referred to as the CAROTAR, 2020) issued vide Notification No. 81/2020-Customs (N.T.) dated 21st August, 2020, which have come into force from 21.09.2020. In this regard, ICES Advisory No.: 34/2020 dated 17.09.2020, JNCH Public Notice Nos.- 114/2020 dated 10.09.2020 and 120/2020 dated 17.09.2020 may also be referred to, wherein, it was mentioned that to claim preferential rate of duty under a trade agreement, the importer or his agent shall be required to file certain declarations mandatorily at the time of filing of bill of entry.

It is noticed, that in the context of CAROTAR, 2020, in large number of cases, there are discrepancies in declaration of the issuing authority of certificate of origin (COO). In many cases, the country of origin is different from the COO issuing authority. This discrepancy may have occurred mainly due to careless data feeding by Customs Brokers/Importers at the time of filing of bills of entry. Since these fields are crucial for risk assessment by the assessing officers and the RMCC, extra care needs to be exercised by Customs Brokers/Importers while entering this information.

Therefore, trade and other stake holders are sensitized to follow all the requirements of CAROTAR, 2020 and strictly adhere to correct feeding of the relevant data elements while filing the bills of entry.
