[TO BE PUBLISHED IN THE GAZETTE OF INDIA PART-II, SECTION 3 SUB-SECTION (i)] Government of India Ministry of Commerce and Industry (Department for Promotion of Industry and Internal Trade) NOTIFICATION New Delhi, the November, 2023 G.S.R. . - In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion) Technical Officers Posts Recruitment Rules, 2017, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules to regulate the recruitment to the posts of the technical officers in the Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry and Ministry of Heavy Industries, namely:- 1. Short title and commencement.  (1)These rules may be called the Ministry of Commerce and Industry (Department for Promotion of Industry and Internal Trade) Technical Officers Posts Recruitment Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Application.  These rules shall apply to recruitment to the posts specified in column (1) of the schedule annexed hereto. 3. Number of posts, classification and pay in pay matrix . The number of post, its classification and the pay in pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules. 4. Method of recruitment, age-limit and other qualification, etc. The method of recruitment, age-limit, qualification and other matters relating to the said posts shall be as specified in columns (5) to (13) of the aforesaid Schedule. 5. Disqualifications.  No person,- (a) who had entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the post: provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule. 6. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order and for reasons to be recorded in writing, and in consultation with Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons. 7. Saving.- Nothing in these rules shall affect reservations and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

(11) (12) (13) Promotion: (i) Additional Industrial Adviser (Engineering) in level-13 in the pay matrix with two years regular service in the grade, failing which, Additional Industrial Adviser (Engineering) with combined six years’ regular service in the grades of Additional Industrial Adviser (Engineering) and Senior Development Officer (Engineering) in level 12 in the pay matrix and failing both Senior Development Officer (Engineering) with six years’ regular service in the grade. Note 1 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their senior would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying /eligibility service or two years, whichever is less and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying/eligibility service. Group ‘A’ Departmental Promotion Committee (for considering promotion):- (I) Chairman/Member, Union Public Service Commission – Chairman.
(II) Secretary, Department for Promotion of Industry and Internal Trade – Member (III) Secretary, Ministry of Heavy Industries – Member. Consultation with Union Public Service Commission necessary while filling up the post on promotion basis.

Deputation (including short-term contract): (I) Officers under the Central/State Government/ Union territories/Public Sector Undertakings/ Universities/Recognised Research Institutions/ Semi- Government or Autonomous or Statutory Organisations:- (A) (I) holding analogous post on regular basis in the parent cadre/Department; or (II) with two years’ service in the grade rendered after appointment thereto on regular basis in level 13 in the pay matrix or equivalent in the parent cadre/Department, and (B) possessing the following educational qualifications and experience: Essential: (I) Degree in Mechanical/Electrical/ Electronics/Industrial Engineering from a recognised University/Institute. (II) Fifteen years’ practical experience in the field of Mechanical/Electrical/Electronics/Industrial Engineering
in any Industrial Undertaking dealing with Planning/Development /Production/Research Techniques of Engineering Industry or in any Central/State Government/Union territories

/Public Sector Undertakings/ Universities/ Recognised Research Institutions/ Semi-Government or Autonomous or Statutory Organisations. Desirable: Five years’ experience in industrial undertaking exploring

Note 1: The Departmental Officers in the feeder category who are in direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion. any industrial undertaking dealing with planning/development/ production/ research in engineering industry or in any Central/State Government Department or in any Public Sector Undertaking. Desirable: Four years’ experience in industrial undertaking exploring latest trends/ techniques in engineering/ manufacturing technology with special reference to Indian conditions and techno- economic assessment of industrial projects. Group ‘A’ Departmental Promotion Committee (for considering promotion): (i) Chairman/Member Union Public Service Commission - Chairman (ii) Secretary, Department for Promotion of Industry and Internal Trade – Member (iii) Secretary, Ministry of Heavy Industries – Member Consultation with Union Public Service Commission necessary while filling up the post on promotion basis.

Note:- Vacancies caused by the incumbent being away on deputation or long illness or study leave or under other circumstances for duration of one year or more may be filled on deputation basis from officers of Central Government/State Government/ Union territories- (A) (I) holding analogous post on regular basis in the parent cadre/Department; or (II) with two years’ service in the grade rendered after appointment thereto on a regular basis in posts in level 8 in the pay matrix or equivalent in the parent cadre or department; and (B) possessing the following

educational qualifications and experience: (I) Bachelor’s degree in Mechanical/Electrical/Electronics/Metallurgical Engineering of a recognised University/ Institute. (II) Three years experience in production/research in the field of Mechanical/Electrical/Electronics/Metallurgical Engineering. (Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization/department of the Central Government shall ordinarily not to exceed three years. The maximum age limit for appointment by deputation shall be not exceeding fifty six years as on the closing date of receipt of applications) Not applicable.
