वाजणज् य रर उ्योगग मं्ालय (उ्योगग संवधधन रर आंतररक व् यापार जवभाग) आदेि नई ददल् ली, 25 मई, 2021 का.आ. 2028(अ).—भारतीय मानक ब् यूरयोग अजधजनयम, 2016 (2016 का 11) की धारा 17 के साथ परित धारा 16 की उप-धारा (1) रर (2) द्वारा प्रदत् त िजतियय का प्रययोगग करते ुए, रर ददनांक 7 िुलाई, 2020 के भारत के रािप्, असाधारण, भाग-II, खंड-3, उप-खण् ड (ii) में प्रकाजित का.आ. सं 2290 (अ) के द्वारा बाइजसदकल-रेरयोग ररफ्लेजटिव जडवाइसेि (गुणवत् ता जनयं्ण) आदेि, 2020 के अजधक्रमण में, जसवाय उन बात के ियोग ऐसे अजधक्रमण से पूवध की गई या करने का लयोगप दकया गया है, केंद्र सरकार का भारतीय मानक ब् यूरयोग के साथ परामिध करने के बाद यह म त है दक यह िनजहत में आवश् यक अथवा जहतकर है, अत: एतद्द्वारा जनम् नजलजखत आदेि िारी करती है, नामत: -

1. संजिप् त िी्धक रर प्रारंभ - (1) इस आदेि कयोग बाइजसदकल-रेरयोग ररफ्लेजटिव जडवाइसेि (गुणवत् ता जनयं्ण) आदेि, 2021 कहा िाएगा। (2) इस आदेि में अन्यथा दकए गए प्रावधान कयोग सुरजित रखते ुए, यह आदेि आजधकाररक रािप् में प्रकािन की तारीख से प्रभावी हयोगगा।
2. अनुप्रययोगग – 01 िनवरी, 2022 से, यह आदेि ताजलका 1 रर ताजलका 2 के कॉलम (1) में जवजनर्ददष् ि वस्ट् तुओं य या सामान पर लागू हयोगगा, लेदकन इसमें से कुछ भी जनयाधत की िाने वाली वस्ट् तुओं य या सामान पर लागू नहह हयोगगा।

नवरी, 2022 से, यह आदेि ताजलका 1 रर ताजलका 2 के कॉलम (1) में जवजनर्ददष् ि वस्ट् तुओं य या सामान पर लागू हयोगगा, लेदकन इसमें से कुछ भी जनयाधत की िाने वाली वस्ट् तुओं य या सामान पर लागू नहह हयोगगा। 3. मानक की अनुरुपता रर मानक जिह्न का अजनवायध प्रययोगग- ताजलका 1 के कॉलम (1) में जवजनर्ददष् ि वस्ट् तुएं या सामान उट त ताजलका के कॉलम (2) में उजल्लजखत तद्नुरूपी भारतीय मानक के अनुरूप ह गे तथा उनमें भारतीय मानक ब् यूरयोग (अनुपालन मूल् यांकन) जवजनयम, 2018 की अनुसूिी-II की स्ट् कीम-I के अनुसार ब् यूरयोग के लाइसेंस के तहत मानक जिह्न लगा हयोगगा।

अनुरुपता का प्रमाणप् – ताजलका-2 के कॉलम (1) में जवजनर्ददष् ि वस्ट् तुएं या सामान, भारतीय मानक ब् यूरयोग (अनुपालन मूल् यांकन) जवजनयम, 2018 की अनुसूिी-II की स्ट् कीम-IV के अनुसार ब् यूरयोग की अनुरुपता प्रमाणप् के अंतगधत उट त ताजलका के कॉलम (2) में उजल्लजखत तद्नुरूपी अजनवायध आवश्यकता(ओं य) के अनुरूप ह गे। 5. प्रमाणन रर प्रवतधन प्राजधकरण – ताजलका-1 रर ताजलका-2 के कॉलम (1) में जवजनर्ददष् ि वस्ट् तुओं य या सामान के संबंध में ब्यूरयोग प्रमाणन रर प्रवतधन प्राजधकरण हयोगगा। 6.

(1) (2) (3) बाइजसदकल हेतु रेरयोग-ररफ्लेजटिव जडवाइसेि की आवश्यकता आईएस 10613:2014 का खंड 4.14 साइदकल - बाइजसदकल हेतु सुरिा आवश्यकता नयोगि : ताजलका-1 के प्रययोगिन के जलए, उनके संियोगधन सजहत भारतीय मानक के नवीनतम संस्ट् करण, िैसा दक भारतीय मानक ब् यूरयोग द्वारा समय-समय पर अजधसूजित दकए गए हैं, ब्यूरयोग द्वारा अजधसूजित तारीख से लागू ह गे।

MINISTRY OF COMMERCE AND INDUSTRY (Department for Promotion of Industry and Internal Trade) ORDER New Delhi, the 25th May, 2021 S.O. 2028(E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 16 read with section 17 of the Bureau of Indian Standards Act, 2016 (11 of 2016), and in supersession of the Bicycles- Retro Reflective Devices ( Quality Control) Order,2020, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O.2290(E), dated the 7th July, 2020, except as respects things done or omitted to be done before such supersession, the Central Government, after consulting the Bureau of Indian Standards, is of the opinion that it is necessary or expedient so to do in the public interest, hereby makes the following Order, namely:-

1. Short title and commencement. – (1) This Order may be called the Bicycles- Retro Reflective Devices (Quality Control) Order, 2021. (2) Save as otherwise provided in this order, it shall come into force from the date of its publication in the Official Gazette.
2. Application.- With effect from the 1st Jan,2022, this order shall apply to goods or articles specified in column (1) of the Table 1 and Table 2, but nothing herein shall apply to said goods or articles meant for export.

Conformity to Standard and Compulsory use of Standard Mark.- Goods or articles specified in the column (1) of the Table 1 shall conform to the corresponding Indian Standard mentioned in the column (2) of the said Table and shall bear the Standard Mark under a license from the Bureau as per Scheme-I of Schedule-II of Bureau of Indian Standards (Conformity Assessment) Regulations, 2018. 4. Certificate of Conformity. - Goods or articles specified in the column (1) of the Table-2 shall conform to the corresponding essential requirement(s) given in the column (2) of the said table under a certificate of conformity from the Bureau as per Scheme-IV of Schedule-II of Bureau of Indian Standards (Conformity Assessment) Regulations, 2018. 5. Certification and Enforcement Authority.- In respect of the goods or articles specified in the column (1) of the Table-1 and Table-2, the Bureau shall be the certifying and enforcing authority. 6. Penalty for Contravention. - Any person who contravenes the provisions of this Order shall be punishable under the provisions of the Bureau of Indian Standards Act, 2016(11 of 2016).
