वाजणज् य रर उ्योगग मं्ालय (उ्योगग संवधधन रर आंतररक व् यापार जवभाग) अजधसूचना नई ददल् ली, 5 माचध, 2021 सा.का.जन. 154(अ).—राष्ट्रपजत, संजवधान के अनुच्छेद 309 के परंतु द्वारा प्रदत्त िजियों का प्रययोगग करते हुए रर वाजणज्य रर उ्योगग मं्ालय, पेरयोगजलयम तथा जवस्ट्फयोगटक सुरक्षा संगठन, समूह क पद भती जनयम, 2005 कयोग, उन बातों के जसवाय अजधक्ांत करते हुए जजन्हें ऐसे अजधक्मण से पहले दकया गया है या करने का लयोगप दकया गया है जनम्नजलजखत जनयम बनाते हैं, अथाधत्:

1. संजक्षप्त नाम रर प्रारंभ (1) इन जनयमों का संजक्षप्त नाम भारतीय पेरयोगजलयम रर जवस्ट्फयोगटक सुरक्षा सेवा जनयम, 2021 है।
   (2) ये िासकीय राजप् में प्रकािन की तारीख कयोग लागू होंगे।
2. पररभाषा- इन जनयमों में, जब तक दक अन्यथा अपेजक्षत न हयोग,
   (क) "आययोगग" से संघ लयोगक सेवा आययोगग अजभप्रेत है; (ख) "जनयं्क प्राजधकरण" से भारत सरकार, वाजणज्य रर उ्योगग मं्ालय, उ्योगग संवधधन रर आंतररक व्यापार जवभाग अजभप्रेत है। (ग) "जवभागीय प्रयोगन्नजत सजमजत, जवभागीय पुजि सजमजत रर जवभागीय छानबीन सजमजत" से दकसी श्रेणी में अजधकाररयों की प्रयोगन्नजत या पुजि रर कजनष्ठ प्रिासजनक श्रेणी में अकृजययक चयन श्रेणी प्रदान करने पर जवचार करने के जलए इन जनयमों के तीसरी अनुसूची के अनुसार गरठत सजमजत अजभप्रेत है।
   (घ) "ड्यूटीपद" से पहली अनुसूची में उजल्लजखत कयोगई भी अजभप्रेत है।
   (ङ) “सरकार” से भारत सरकार अजभप्रेत है।
   (च) “श्रेणी” से पहली अनुसूची के स्ट्तंभ 2 में जवजनर्ददि श्रेणी अजभप्रेत है।

(ज) दकसी श्रेणी के संबंध में "जनयजमत सेवा" जनयमों के अधीन चयन रर जनयुजि के पश्चात उस श्रेणी में की गई सेवा की अवजध या अवजधयां रर ऐसी कयोगई भी अवजध या अवजधयां जयोग
(i) इन जनयमों के प्रारंभ के समय से पहले उस श्रेणी में रहने की दिा में ज्येष्ठता के प्रययोगजन के जलए गणना में जलया।
(ii) ऐसी अवजध जजसके दौरान अजधकारी उस श्रेणी में ड्यूटी पद धारण दकया हुआ हयोग दकन्तु छुट्टी पर हयोग या ऐसे पद धारण करने के जलए उपलब्ध न हयोग। (झ) “अनुसूची” से इन जनयमों से उपाबद्ध कयोगई अनुसूची अजभप्रेत है। (ञ) “सेवा” से भारतीय पेरयोगजलयम रर जवस्ट्फयोगटक सुरक्षा सेवा अजभप्रेत है। (ट) “अनुसूजचतजाजतयों”, रर "अनुसूजचत जनजाजतयों” पद का वृजद्ध अथध हयोगगा जयोग भारत के संजवधान के अनुच् छेद 366 के खंड (24) रर (25) में उनका है।

योगजलयम रर जवस्ट्फयोगटक सुरक्षा सेवा अजभप्रेत है। (ट) “अनुसूजचतजाजतयों”, रर "अनुसूजचत जनजाजतयों” पद का वृजद्ध अथध हयोगगा जयोग भारत के संजवधान के अनुच् छेद 366 के खंड (24) रर (25) में उनका है।
3. सेवा का गठन– (1) जनयम 5 में जवजनर्ददि सदस्ट्यों से जमलकर बनने वाला, भारतीय पेरयोगजलयम रर जवस्ट्फयोगटक सुरक्षा सेवा नाम से ज्ञान एक सेवा का गठन दकया जाएगा।
(2) इस सेवा में िाजमल सभी पदों कयोग समूह ‘क’ पदों के रूप में वगीकृत दकया जाएगा।
(3) इन जनयमों के प्रारंभ से पूवध, संबंजधत तयथानी श्रेणी में उप जनयम 3 (1)में ददए अनुसार, ज्येष्ठता, पुजि, प्रयोगन्नजत, अकृजययक उन्नयन रर पेंिन के प्रययोगजन के जलए अजधकाररयों द्वारा की गई जनयजमत सेवा की गणना अहधक सेवा के रूप में की जाएगी।
4. श्रेणी, प्राजधकृत संख्या रर इसकी समीक्षा -
(1) इन जनयमों के प्रारंभ हयोगने पर,सेवा के जवजभन्न श्रेजणयों में िाजमल ड्यूटी पद, उनकी संख्या रर वेतन मैररक्स में स्ट्तर वे हयोगगें जयोग पहली अनुसूची में जवजनर्ददि दकया जाए।
(2) इन जनयमों के प्रारंभ हयोगने के बाद, जवजभन्न श्रेजणयों में ड्यूटी पदों की प्राजधकृत संख्या वह हयोगगी जयोग केन्रीय सरकार द्वारा समय- समय पर िाजमल की जाए।
(3) केन्रीय सरकार, आययोगग के परामिध से, सेवा में ऐसे पदों कयोग िाजमल कर सकती है जजन्हें इन जनयमों के प्रथम अनुसूची में िाजमल पदों की जस्ट्थजत, वेतन मैररक्स में स्ट्तर रर ग्रेड के समतुल्य समझती है या उि अनुसूची में िाजमल ड्यूटी पद कयोग सेवा से हटा सकती है।
(4) केन्रीय सरकार, समय-समय पर रर आययोगग के परामिध से, दकसी अजधकारी कयोग, जैसा वह उजचत समझे, अस्ट्थायी हैजसयत या मूल हैजसयत में सेवा के समुजचत श्रेणी में, उप-जनयम (3) के अधीन सेवा में िाजमल पद के ड्यूटी पद पर जनयुि कर सकती है रर सरकार

ोगग के परामिध से, दकसी अजधकारी कयोग, जैसा वह उजचत समझे, अस्ट्थायी हैजसयत या मूल हैजसयत में सेवा के समुजचत श्रेणी में, उप-जनयम (3) के अधीन सेवा में िाजमल पद के ड्यूटी पद पर जनयुि कर सकती है रर सरकार द्वारा समय-समय पर जारी दकए गए सामान्य आदेिों रर जनदेिों के अनुसार उस श्रेणी में उसकी ज्येष्ठता जनधाधररत कर सकती है। 5. सेवा के सदस्ट्य: (1) जनम्नजलजखत व्यजि सेवा के सदस्ट्य होंगे, अथाधत्: - (क) जनयम 6 के अधीन ड्यूटी पदों पर जनयुि व्यजि; रर (ख) जनयम 4 के उप-जनयम (4) के अधीन ड्यूटी पदों पर जनयुि व्यजि। (2) उप जनयम (1) के खंड (क) के अधीन जनयुि व्यजि, सेवा के आरंजभक गठन की तारीख से पहली अनुसूची से जवजनर्ददि अनुसार लागू समुजचत श्रेणी में सेवा का सदस्ट्य समझा जाएगा। (3) उप-जनयम (1) के खंड (ख) के अधीन जनयुि व्यजि, ऐसी जनयुजि की तारीख से पहली अनुसूची में जवजनर्ददि अनुसार लागू श्रेणी में सेवा का सदस्ट्य हयोगगा। 6. सेवा का प्रारंजभक गठन: - पीईएसओ के ऐसे जव्मान सभी अजधकारी जयोग वाजणज्य रर उ्योगग मं्ालय, पेरयोगजलयम रर जवस्ट्फयोगटक सुरक्षा संगठन, समूह 'क' पद भती जनयम, 2005, के अधीन जनयुि जवजभन्न श्रेजणयों में समूह ‘क’ पद धारण दकए हुए हैं, इन जनयमों के प्रारंभ हयोगने की तारीख कयोग ऐसे पदों पर जनयजमत आधार पर या इन जनयमों के प्रारंभ हयोगने की तारीख कयोग धारणाजधकारी पर हैं, यथाजस्ट्थजत अजधष्ठायी या स्ट्थानापन्न हैजसयत में समुजचत ड्यूटी पदों रर सेवा की श्रेजणयों में जनयुि दकए गए। 7.

पदों पर जनयजमत आधार पर या इन जनयमों के प्रारंभ हयोगने की तारीख कयोग धारणाजधकारी पर हैं, यथाजस्ट्थजत अजधष्ठायी या स्ट्थानापन्न हैजसयत में समुजचत ड्यूटी पदों रर सेवा की श्रेजणयों में जनयुि दकए गए। 7. सेवा की भावी अनुरक्षण: - इन जनयमों के प्रारंभ के पश्चात पहली अनुसूची में जनर्ददि दकसी भी श्रेणी में कयोगई भी ररजि जनम्नजलजखत तरीके से भरी जाएगी अथाधत्: - (1) सेवा के जवजभन्न ग्रेडों में जनयुजियां, दूसरी अनुसूची में यथाजवजनर्ददि भती की पद्धजत, प्रयोगन्नजत के क्षे्, अगली जनम्न श्रेणी में न्यूनतम अहधक सेवा रर प्रयोगन्नजत द्वारा जनयुजि के जलए अन्य पा्ता ितों के अनुसार की जाएंगी।

[भागII—खण् ड 3(i)] भारत का राजप् : असाधारण 3 (2) प्रयोगन्नजत के जलए अजधकाररयों का चयन तीसरी अनुसूची के अनुसार गरठत जवभागीय प्रयोगन्नजत सजमजत की जसफाररि पर दकया जाएगा।
(3) सेवा के कजनष्ठ प्रिासजनक श्रेणी (अकृजययक) में अकृजययक चयन श्रेणी (एनएफएसजी), तीसरी अनुसूची में यथाजवजनर्ददि जवभागीय छानबीन सजमजत की जसफाररि पर प्रदान दकया जाएगा। (4) सेवा के कजनष्ठ समय वेतनमान (उप-जनयं्क, जवस्ट्फयोगटक) पर सीधी भती द्वारा जनयुजि के जलए िैजक्षक रर अन्य अहधता, अनुभव रर आयु-सीमा चौथी अनुसूची में जवजनर्ददि अनुसार हयोगगी। 8.

र प्रदान दकया जाएगा। (4) सेवा के कजनष्ठ समय वेतनमान (उप-जनयं्क, जवस्ट्फयोगटक) पर सीधी भती द्वारा जनयुजि के जलए िैजक्षक रर अन्य अहधता, अनुभव रर आयु-सीमा चौथी अनुसूची में जवजनर्ददि अनुसार हयोगगी। 8. पररवीक्षाधीन- (1) सीधी भती द्वारा या कजनष्ठ समय वेतनमान में प्रयोगन्नजत द्वारा सेवा में जनयुि प्रययेक अजधकारी दयोग वषध की अवजध के जलए पररवीक्षाधीन पर हयोगगा: परन्तु जनयं्क प्राजधकारी सरकार द्वारा इस संबंध में समय-समय पर जारी अनुदेिों के अनुसार पररवीक्षा की अवजध बढा सकते हैं: परन्तु यह रर दक पररवीक्षा की अवजध के जवस्ट्तार के जलए कयोगई भी जवजनश्चय, सामान्यत: पररवीक्षा की अवजध की समाजप्त के पश्चात आठ सप्ताह के भीतर जलया जाएगा रर संबंजधत अजधकारी कयोग ऐसा करने के कारणों के आधार पर उि अवजध के भीतर जलजखत रूप में सूजचत दकया जाएगा। (2) पररवीक्षा की अवजध या उसके दकसी भी जवस्ट्ताररत अवजध के पूरा हयोगने पर, अजधकारी कयोग, यदद स्ट्थायी जनयुजि के जलए उपयुि पाया जाता है, तयोग उसे जनयजमत रूप से जनयुि पदपर बनाए रखा जाएगा रर उपलब्ध मूल ररजि के प्रजत जनयत समय में इसकी पुजि की जाएगी। (3) यदद यथाजस्ट्थजत, पररवीक्षा की अवजध या उसके जवस्ट्ताररत अवजध के दौरान, सरकार की यह राय है दक अजधकारी स्ट्थायी जनयुजि के जलए उपयुि नहीं है, तयोग सरकार यथाजस्ट्थजत, उस अजधकारी कयोग पद से मुि कर सकती है या उसे सेवा में उसकी जनयुजि से पहले धाररत पद पर प्रययावर्ततत कर सकती है। (4) पररवीक्षा की अवजध या उसके जवस्ट्ताररत अवजध के दौरान, अजधकारी कयोग ऐसे प्रजिक्षण पाठ्यक्म प्राप्त करना रर अनुदेिों का पालन करना रर परीक्षा व जांच (हहदी में परीक्षा सजहत) उत्तीणध करना अपेजक्षत हयोगगा, जजन्हें सरकार द्वारा, पररवीक्षा संतयोगषजनक ढंग से पूरी करने की ितध के रुप में, उजचत समझा जाएगा।

रना रर अनुदेिों का पालन करना रर परीक्षा व जांच (हहदी में परीक्षा सजहत) उत्तीणध करना अपेजक्षत हयोगगा, जजन्हें सरकार द्वारा, पररवीक्षा संतयोगषजनक ढंग से पूरी करने की ितध के रुप में, उजचत समझा जाएगा। (5) पररवीक्षा से संबंजधत अन्य मामलों के संबंध में, सेवा के सदस्ट्य समय-समय पर इस संबंध में सरकार द्वारा जारी जनदेिों द्वारा िाजसत होंगे। 9. ज्येष्ठता: - (1) जनयम 6 के अधीन सेवा के प्रारंजभक गठन में पहली अनुसूची में उजल्लजखत जवजभन्न श्रेजणयों में जनयुि सेवा के सदस्ट्यों की सापेक्ष ज्येष्ठता, इन जनयमों के प्रारंभ की तारीख से पूवध यथाजनधाधररत संबंजधत श्रेणी में सापेक्ष ज्येष्ठता हयोगगी; परन्तु यदद सेवा के दकसी भी सदस्ट्य की ज्येष्ठता इन जनयमों के प्रारंभ की तारीख से पहले अवधाररत नहीं की गई है, तयोग सरकार द्वारा समय-समय पर जारी ज्येष्ठता के सामान्य जनदेिों के अनुसार सरकार द्वारा इसे अवधाररत दकया जाएगा। (2) प्रारंजभक गठन पर जनयुि अजधकारी, बाद में जनयुि दकए गए अजधकाररयों से ज्येष्ठ होंगे। (3) सेवा के जवजभन्न श्रेजणयों में जनयुि व्यजियों की ज्येष्ठता रर कजनष्ठ समय वेतनमान श्रेणी में सीधी भती रर कजनष्ठ समय वेतनमान में प्रयोगन्नत हयोगने वाले अजधकाररयों के बीच परस्ट्पर-ज्येष्ठता इन जनयमों के प्रारंभ की तारीख कयोग रर उस तारीख से सरकार द्वारा समय- समय पर जारी ज्येष्ठता के सामान्य आदेिों या जनदेिों के अनुसार अवधाररत दकया जाएगा। 10. सेवा में जनयुजि - सेवा के जवजभन्न श्रेजणयों में सभी ड्यूटी पदों हेतु सेवा की सभी जनयुजियां जनयं्क प्राजधकरण द्वारा की जाएंगी। 11.

्ठता के सामान्य आदेिों या जनदेिों के अनुसार अवधाररत दकया जाएगा। 10. सेवा में जनयुजि - सेवा के जवजभन्न श्रेजणयों में सभी ड्यूटी पदों हेतु सेवा की सभी जनयुजियां जनयं्क प्राजधकरण द्वारा की जाएंगी। 11. भारत के दकसी भी भाग में सेवा के जलए दाजययव रर सेवा की अन्य ितें- (1) सेवा में जनयुि अजधकारी भारत या बाहर कहीं भी सेवा करने के जलए उत्तरदायी होंगे। (2) सेवा के सदस्ट्यों की सेवा की ितें, जजनके जलए इन जनयमों में कयोगई उपबंध नहीं है, उन मामलों के संबंध में वे वही होंगे, जयोग दक सामान्य रूप से केंरीय जसजवल सेवा के अजधकाररयों के जलए समय-समय पर लागू हयोगते हैं। 12. जनरहधता: वह व् यजि, (क). जजसने ऐसे व् यजि से जजसका पजत या पय नी जीजवत है, जववाह दकया है या जववाह की संजवदा की है, या; (ख). जजसने अपने पजत या अपनी पय नी के जीजवत रहते हुए दकसी अन् य व् यजि से जववाह दकया है, या जववाह की संजवदा की है, उि सेवा में जनयुजि का पा् नहीं हयोगगा: परन् तु यदद केंरीय सरकार का यह समाधान हयोग जाता है दक ऐसा जववाह ऐसे व् यजि रर जववाह के अन् य पक्षकार कयोग लागू स्ट्वीय जवजध के अधीन अनुज्ञेय है रर ऐसा करने के जलए अन् य आधार है तयोग वह ऐसे व् यजि कयोग इस जनयम के प्रवतधन से छूट दे सकेगी।

योग जाता है दक ऐसा जववाह ऐसे व् यजि रर जववाह के अन् य पक्षकार कयोग लागू स्ट्वीय जवजध के अधीन अनुज्ञेय है रर ऐसा करने के जलए अन् य आधार है तयोग वह ऐसे व् यजि कयोग इस जनयम के प्रवतधन से छूट दे सकेगी।

THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 13. जिजथल करने की िजि - जहां केंरीय सरकार की यह राय है दक ऐसा करना आवश् यक या समीचीन है, वहां वह उसके जलए जयोग कारण हैं, उन्हें लेखबद्ध करके तथा आययोगग से परामिध करके इन जनयमों के दकसी उपबंध कयोग दकसी वगध या प्रवगध के व् यजियों की बाबत आदेि द्वारा जिजथल कर सकेगी। 14. व् यावृजत्त - इन जनयमों की कयोगई बात ऐसे आरक्षणों, आयु-सीमा में छूट रर अन् य ररयायतों पर प्रभाव नहीं डालेगी, जजनका केंरीय सरकार द्वारा इस संबंध में समय-समय पर जारी दकये गए आदेिों के अनुसार अनुसूजचत जाजतयों, अनुसूजचत जनजाजतयों, अन्य जपछडे वगों, भूतपूवध सैजनकों रर अन् य जविेष प्रवगध के व् यजियों के जलए उपाबंध करना अपेजक्षत है। 15. जनवधचन–इन जनयमों केजनवधचन के संबंध में यदद कयोगई प्र्न उठता है तयोग, यह इसका जवजनश्चय सरकार द्वारा दकया जाएगा।

• पदों की संख्या कायधभार के आधार पर पररवतधन दकया जा सकता है।

दकसी भी समय कजनष्ठ प्रिासजनक श्रेणी (अकृजययक) तथा कजनष्ठ प्रिासजनक श्रेणी (कायाधयमक) के कुल अजधकाररयों की संख्या 38 से

अजधक नहीं हयोगगी। दकसी भी समय कजनष्ठ प्रिासजनक श्रेणी (अकृजययक) चयन श्रेणी अथाधतसंयुि मुख्य जनयं्क, जवस्ट्फयोगटक के पदों की संख्या ज्येष्ठ ड्यूटी पदों (याजन दक सेवा संवगध में ज्येष्ठ समय वेतनमान रर उससे ऊपर के सभी ड्यूटी पद) के 15% से अजधक नहीं हयोगगी।

3. कजनष्ठ प्रिासजनक श्रेणी
(कायाधयमक) उप मुख्य जनयं्क, जवस्ट्फयोगटक) वेतन मैररक्स के स्ट्तर 12
(रु. 78,800-2,09,200) चयन के आधार पर प्रयोगन्नजत द्वारा वे अजधकारी जजन्होंने ज्येष्ठकालमान की श्रेणी में पााँच वषध जनयजमत सेवा की है।
4. ज्येष्ठ कालमान जवस्ट्फयोगटक जनयं्क वेतन मैररक्स के स्ट्तर -11 (रु. 67,700-2,08,700) चयन के आधार पर प्रयोगन्नजत द्वारा वे अजधकारी जजन्होंने कजनष्ठ कालमान की श्रेणी में चार वषध जनयजमत सेवा की है। 5. कजनष्ठ कालमान (उप- जनयं्क, जवस्ट्फयोगटक) वेतन मैररक्स के स्ट्तर -10 (रु. 56,100-1,77,500) (i) 95 प्रजतित सीधी भती द्वारा। (ii) पााँच प्रजतित चयन के आधार पर प्रयोगन्नजत द्वारा
(i) आययोगग द्वारा भती के माध्यम से। (ii) प्रयोगन्नजत:- ज्येष्ठ तकनीकी सहायक के रूप में वेतन मैररक्स के स्ट्तर -6 (रु.

रटप्पण 1 : जहां ऐसे कजनष्ठ व्यजियों के संबंध में, जजन्होंने अपनी अहधक/पा्ता सेवा पूरी कर ली हयोग रर उन्हें, कजनष्ठ प्रिासजनक श्रेणी
(अकृजययक) (संयुि मुख्य जनयं्क, जवस्ट्फयोगटक) पद के अजतररि दकसी अन्य पद पर प्रयोगन्नजत के जलए जवचार दकया जा रहा हयोग तयोग उनके ज्येष्ठ व्यजियों के प्रयोगन्नजत के संबंध में थी जवचार दकया जायेगा परन्तु उनकी आवश्यक अहधक/पा्ता सेवा इस प्रकार की आवश्यक अहधक/पा्ता सेवा या दयोग वषध इन दयोगनों में जयोग भी कम हयोग उन्हयोगने सफलतापूवधक पूरी कर ली हयोग रर उन्हयोगने अपने अगले पद पर प्रयोगन्नजत के जलए अपनी पररवीक्षा की अवजध कयोग अपने कजनष्ठों के साथ पूरा कर जलया हयोग।
रटप्पण 2 : जयोग इन जनयमों की अजधसूचना जारी हयोगने के ददन मौजूदा ज्येष्ठ तकनीकी सहायक पदग्राही हैं उनके जलए कजनष्ठ कालमान उप-जनयं्क, जवस्ट्फयोगटक के पद पर प्रयोगन्नजत के जलए उनके पास इस प्रकार की िैक्षजणक ययोगग्यता हयोगने की आवश्यकता नहीं हयोगगी।

G.S.R. 154(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution andin supersession of the Ministry of Commerce and Industry, Petroleum and Explosives Safety Service Organization, Group ‗A‘ Posts Recruitment Rules, 2005, except as respects things done or omitted to be done before such suppression, the President hereby makes the following rules, namely:-

1. Short Title and Commencement.(1) These rules may be called the Indian Petroleum and Explosives Safety Service Rules, 2021. (2) They shall come into force on the date of their publication in the Official Gazette.
2. Definition.– In these rules, unless the context otherwise requires, (a) ―Commission‖ means the Union Public Service Commission; (b) ―Controlling Authority‖ means the Government of India in the Ministry of Commerce and Industry, Department for Promotion of Industry and Internal Trade.

(1) There shall be constituted a Service to be known as the Indian Petroleum and Explosives Safety Service consisting of members specified in rule 5.
(2)
All the posts included in the Service shall be classified as Group ‗A‘ posts. (3) The regular continuous service by the officers, as referred to in sub-rule 3(1) in the respective corresponding Grades, rendered prior to commencement of these rules shall be counted as qualifying service for the purpose of seniority, confirmation, promotion, non-functional up-gradation and pension. 4. Grades, authorized strength and its review.– (1) The duty posts included in the various Grades of the Service, their number and the Level in the Pay Matrix on the commencement of these rules, shall be as specified in the First Schedule; (2) After the commencement of these rules, the authorised strength of the duty posts in various grades shall be such as may, from time to time, be determined by the Central Government; (3) Central Government may, in consultation with the Commission, include in the Service such posts as can be deemed equivalent in status, Level in the Pay Matrix and grade to the posts included in First Schedule to these rules or exclude from the service a duty post included in the said Schedule;

Members of the Service:
(1) The following persons shall be the members of the Service, namely:- (a) persons appointed to duty posts under rule 6; and (b) persons appointed to duty posts under sub-rule (4) of rule 4 and rule
(2) A person appointed under clause (a) of sub-rule (1) shall be deemed to be the member of the Service in the appropriate Grade, applicable to him as specified in the First Schedule, from the date of initial constitution of the Service. (3) A person appointed under clause(b) of sub-rule (1) shall be a member of the Service in the corresponding Grade applicable to him as specified in the First Schedule from the date of such appointment. 6.

Future maintenance of the Service: - Any vacancy in any of the Grades referred to in the First Schedule after the commencement of these rules shall be filled in following manner, namely:- (1) Appointments to various Grades of the Service shall be made in accordance with the method of recruitment, the field of promotion, the minimum qualifying service in the next lower Grade and other eligibility conditions for appointment by promotion, as specified in the Second Schedule. (2) The selection of officers for promotion shall be made on the recommendation of the Departmental Promotion Committee constituted in accordance with the Third Schedule.

[भागII—खण् ड 3(i)] भारत का राजप् : असाधारण 9 Provided that the Controlling Authority may extend the period of probation in accordance with the instructions issued by the Government from time to time in this regard: Provided further that any decision for extension of period of probation shall be taken ordinarily within eight weeks after the expiry of the period of probation and communicated in writing based on reasons to the concerned officer for so doing within the said period. (2) On completion of the period of probation or any extension thereof, the officer shall, if considered fit for permanent appointment, be retained in his appointment on regular basis and be confirmed in due course against the available substantive vacancy.

Seniority:–(1)The relative seniority of members of the Service appointed to the various Grades mentioned in the First Schedule, at the initial constitution of the Service under Rule 6, shall be the relative seniority in their respective grades as determined before the date of commencement of these rules; Provided that if the seniority of any member of the Service has not been determined before the date of commencement of these rules, the same shall be determined by the Government in accordance with the general instructions on seniority issued by the Government from time to time.

Saving.–Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the persons belonging to the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-Servicemen and other special categories of persons in accordance with the orders issued by the Government from time to time in this regard. 15.Interpretation –If any question relating to interpretation of these rules arises, it shall be decided by the Government.
