L.-33004/99 xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण्ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY वाजणज्य और उद्योग मं त्रालय (उद्योग सं वधध न और आं तररकव्यापार जवभाग) अजधसू चना नई दिल्ली, 3 िून, 2024 सा.का.जन. 312(अ).— कै जल्ियम कार्ाधइड जनयम, 1987 में संिोधन करने के जलए प्रारूप जनयम पेरोजलयम अजधजनयम 1934 (1934 का 30) की धारा 29 की उप धारा (2) की अपेक्षानुसार, भारत के रािपत्र, असाधारण, भाग 2, खण्ड- 3, उप-खण्ड (i) में अजधसूचना संख्या सा.का.जन. 835 (अ) तारीख 14 नवंर्र, 2023 द्वारा प्रकाजित की गई थी, जिसमें उन सभी व्यजियों से, जिनके इससे प्रभाजवत होने की संभावना है, उि अजधसूचना को िनता को उपलब्ध कराए िाने की तारीख से पैंतालीस दिन की अवजध समाप्त होने से पूवध आपजियां और सुझाव आमंजत्रत दकए गए थे; और उि अजधसूचना, 14 नवंर्र, 2023 को िनता को उपलब्ध करा िी गई थी; और केंद्रीय सरकार को उि प्रारूप जनयमों पर िनता से कोई आपजि और सुझाव प्राप्त नहीं हुए; अतः, अर्, के न्द्द्रीय सरकार पेरोजलयम अजधजनयम 1934 की धारा 4 द्वारा प्रिि िजियों का प्रयोग करते हुए, कै जल्ियम कार्ाधइड जनयम, 1987 का संिोधन करने के जलए जनम्नजलजखत जनयम र्नाती है, अथाधतः-

1. 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. कै जल्ियम कार्ाधइड जनयम, 1987 (जिसे इसमें इसके पश्चात उि जनयम कहा गया है) में, जनयम 4 के परंतुक में "ऐसी मात्राओं में" िब्िों का लोप दकया िाएगा। 3. उि जनयम में, जनयम 26 के परंतुक के स्ट्थान पर, जनम्नजलजखत परंतुक रखा िाएगा, अथाधत्:- "परंतु कै जल्ियम कार्ाधइड के भं डाकरणके जलए दकसी अनु ज्ञजप्तकी जनम्नजलजखत ििाओं में अपेक्षा नहीं की िाएगी- (क) िर् वह अस्ट्थायी रूप से ऐसी ितों के अधीन पिन की सीमा के भीतर िैसा दक पिन के संरक्षक द्वारा जवजनर्िधष्ट दकए गए हों, (ख) िर् वह रेल प्रिासन या सड़क पररवहन अजभकरण की अजभरक्षा के अधीन अजभवहन में हो; (ग) िर् वह संघ के रक्षा र्लों के अजधकार में हो; 4. उि जनयमों में, जनयम 27 के उप जनयम (1) में जनम्नजलजखत परंतुक अंतःस्ट्थाजपत दकया िाएगा, अथाधत्:- "परंतु कै जल्ियम कार्ाधइड - (क) पांच दकलोग्राम से अनजधक मात्रा में जवजहत पात्रों में भं डाररतदकया िाएगा, जिनमें से प्रत्येक में एक दकलोग्राम से अजधक नहीं होगी; और (ख) पांच दकलोग्राम से अजधक दकसी भी मात्रा में, दकन्द्तु िो सौ दकलोग्राम से अनजधक भंडारण नहीं दकया िाएगा यदि: - (i) ऐसे पात्रों का दकसी िुष्क और अच्छी तरह से संवाजतत िेड में भंडाकरण दकया िाएगा िो भवन का भाग हो सके गा या उससे संलग्न हो सके गा परन्द्तु यह तर् िर् दक वह दकसी पयाधप्त िीवार द्वारा उससे अलग दकया गया है और उस तक पहुं चने में साधन के वल र्ाह्य वायु से है । (ii) अप्राजधकृ त व्यजियों को पात्रों तक पहुं चनेसे रोकने के जलए सम्यक सावधाजनयां र्रती िाएंगी;

Whereas, the draft rules to amend the Calcium Carbide Rules, 1987, were published as required by Sub-Section (2) of Section 29 of the Petroleum Act 1934 (30 of 1934), vide notification number G.S.R. 835(E), dated the 14th November, 2023, in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of forty-five days from the date on which the notification was made available to the public; And whereas the said notification was made available to the public on the 14th November, 2023; And whereas no objection and suggestions were received from the public on the said draft rules by the Central Government;

[भाग II—खण्ड 3(i)] भारत का रािपत्र : असाधारण 3 Now, therefore, in exercise of the powers conferred by Section 4 of the Petroleum Act, 1934, the Central Government hereby makes the following rules further to amend the Calcium Carbide Rules, 1987, namely: -

1. (1) These rules may be called the Calcium Carbide (Amendment) Rules, 2024 (2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Calcium Carbide Rules, 1987 (hereinafter referred to as the said rules), in Rule 4, in the proviso, the words “in quantities” shall be omitted.

In rule 27 of the said rules, in sub-rule (1), the following proviso shall be inserted namely:- “Provided that calcium carbide- (a in any quantity not exceeding five kilograms shall be stored in prescribed receptacles each containing not more than one kilogram; and (b) in any quantity exceeding five kilograms but not exceeding two hundred kilograms shall be stored,- (i) in receptacles stored in a dry and well ventilated storage shed, which may form a part of or attached to a building that it is separated there from by a substantial partition and the only means of access to it is from outside air; (ii) due precautions shall be taken to prevent unauthorised persons from having access to the receptacles; (iii) the receptacles shall be kept securely closed except while taking out carbide there from.” [F.
