This refers to the note for public & Stakeholder consultation dated 15.04.2024 placed in public domain on the above cited subject. 2 . In this regard, this department received requests from concerned Stakeholder seeking text of the proposed provisions which are highlighted in para no. 5 of the above mentioned note dated 15.04.2024. 3. Therefore, for better understanding for the general public and concerned stakeholder of the provisions which are proposed to be amendment/ inserted and to achieve the objective of Public & Stakeholder Consultations in more true & letter spirit. The detailed comparative Statement of the relevant existing provisions of the Explosives Act, 1884 and the proposed provisions in the draft Explosive Bill, 2024 are annexed herewith for ready reference. 4. This note shall be treated as in addition to the note dated 15.04.2024. Further, time for seeking comments/suggestions from the General public, Industry associations and other persons and entities concerned has also been extended till 25.05.2024. 5. (1) The Central Government may, for any part of India, make rules consistent with this Act to regulate or prohibit, except under and in accordance with the conditions of a licence granted as provided by those rules, the manufacture, possession, use, sale. transport, import and export of explosives, or any specified class of explosives. (2) Rules under this section may provide for all or any of the following, among other matters, that is to say a . The authority by which licences may be granted; b. Grant of licence­ (1) Any person who intends to manufacture, possess, use, sell, transport, import or export any explosive or specified class of explosive shall make an application for obtaining a licence to the licensing authority in such form, along with such documents, with such fee and other expenses in such manner as may be prescribed. (2) In particular, and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely: ­ (a) Such other authority under clause (g) of section 2 ; (b) the authority competent to grant, suspend or revoke a licence under sub-section (2) of section 3; (c) the form and manner of making application, documents , fees and expenses to be paid, under sub-section ( 1), the period and conditions on which a licence may be granted under sub-section (4) , the quantity and the period of explosives that a licencee can manufacture , possess, sell, transport, import or export under sub -section (5) of section 5 ;

(d) the authority and the period for making an appeal under sub-section ( 1), the fee for such appeal under sub­ section (4), and the procedure to be followed by the appellate authority under sub-section (5) of section 9; (e) the powers of inspection, search and seizure , detention and removal under sub­ section (1) of section 10; (f) the time and manner of giving notice under section 11; (g) the procedure to regulate inquiries under clause (a), to enable the Chief Controller of Explosives to be present or represented at an inquiry under clause (b), to permit the Chief Controller of Explosives to examine any witnesses at an inquiry under clause (c), the procedure to be followed where the Chief Controller of Explosives is not present or represented at an inquiry under clause (d) and the manner in which and the time within which notices shall be given under clause (e) of sub-section (4) section 12; (h) the manner of inquiry under sub-section (6) of section 13 ; and

Power to remove difficulties. ­ (1) If any difficulty anses in giving effect to the provisions of this Act, the Central Government may, by order, published m the Official Gazette, make such provisions, not inconsistent with the provisions of this Act, as may appear to it to be necessary or expedient for removing the difficulty: Provided that no order shall be made under this section after the expiry of two years from the date of commencement of this Act. (2) Every order made under this section shall, as soon as may be after it is made, be laid before each House of Parliament. 28. Repeal and Savings.­ (1) The Explosives Act, 1884 (4 of 1884) shall stand repealed: Provided that such repeal shall not effect,­ (i) the previous operations of the licences granted, orders and notifications made or issued or anything duly done or suffered under the enactment under repeal till the date of their expiry, if any; or (ii) any right, privilege, obligation or liability acquired, accrued or incurred under the enactment or orders under repeal; or (iii) any penalty, forfeiture or punishment incurred in respect of any offences committed against

ion or liability acquired, accrued or incurred under the enactment or orders under repeal; or (iii) any penalty, forfeiture or punishment incurred in respect of any offences committed against

the enactment under repeal; or (iv) any investigation or remedy in respect of any penalty, forfeiture or punishment, and any investigation, legal proceedings or remedy instituted, continued or enforced before the appointed date shall be continued and remain in force as if the same has instituted, continued or enforced under this Act. (2) Notwithstanding anything contained in any other law for the time being in force , no court shall take cognizance of an offence under the repealed Act after the expiry of a period of three years from the date of the commencement of this Act. (3) Notwithstanding the repeal of the aforesaid enactment, the rules made under such enactment, which are in force on the date of commencement of this Act, shall continue to be in force till new rules are made under this Act.
