Subject: Proposal for Repeal of the Explosives Act, 1884(4 of 1884) and
introduction of the Explosives Bill, 2024 for enactment of the Act-reg. The Explosives Act, 1884 was enacted to regulate the manufacture, possession, use, sale, transport, import and export of explosives for commercial purposes and to prevent accidents (explosion) due to explosives in the territory of India. 2. The subject "explosives" is enumerated in the Union list of the Seventh Schedule to the Constitution and administration of the Explosives Act, 1884 is within the control of Union of India through its various statutory bodies. 3. The Explosives Act, 1884 is a pre-constitutional Act and it was comprehensively modified in the year, 1978. Many large and small companies began to manufacture high explosives after independence. It is observed that the Explosives Act, 1884, which is based on the old British pattern. With a view to removing the shortcomings in the Explosives Act, 1884 and to obviate the difficulties experienced by the industry, the Explosives Act, 1884 was comprehensively amended in the year, 1978 by the Explosives (Amendment) Act, 1978 (32 of 1978). 4. During examining all the pre-constitutional Acts from the purview of their suitability and relevance in the present circumstances and suggested to take remedial actions for their repeal or re-enactment or consolidation of two or more central acts into single enactment regulating identical matters for re enactment or repeal, as the case may be.

It is proposed to repeal the Explosives Act, 1884 and re-enact a new law with necessary modifications including in the penal provisions thereof, to bring it in conformity with the current scenario or circumstances. 5. Salient features of the amendments made in the Explosives Act, 1884 by the Explosives Bill, 2024 are as under: Page 1 of 3
• Object and purpose of the Act modified • Section 1 - Short Title and Commencement modified. • Section 4 - Two Definitions viz. licencing authority and notification added. • Section 5 shifted to Section 25 and Section SA (Transitional provisions deleted after comprehensive amendment in 1978.)- Deleted • Two sub-sections (1) and (3) (which is Section 6 in the existing Act) shifted to Section 3 of the proposed bill and one sub-section (2) is also newly inserted in Section 3 of the proposed Bill. Sub-section (2) authority competent to grant, suspend or revoke a licence and to perform certain other functions under this Act and Sub-section (3) The Customs Act, 1962 shall have effect in relation to any explosive with regard to importation. • Sections 6A to Section 9A of the existing Act are renumbered as Section 4 to Section 13 respectively in the proposed bill.

In view of the above, comments/ suggestions from the General public, Industry associations and other persons and entities concerned has been invited on the above mentioned proposed enactment.
