PART II—Section 3—Sub-section (i) प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY वाजणज्य और ईद्योग मंत्रालय (ईद्योग संवधधन और अंतररक व्यापार जवभाग) ऄजधसूचना नइ ददल्ली, 17 िनवरी, 2023 सा.का.जन. 31(ऄ).— जवस्ट्फोटक जनयम, 2008 का और संिोधन करने के जलए जनम्नजलजखत जनयमों का प्रारूप जिसे केन्द्रीय सरकार, जवस्फोटक ऄजधजनयम, 1884 (1884 का 4) की धारा 5 तथा 7 द्वारा प्रदत्त िजियों का प्रयोग करते हुए, बनाने का प्रस्ताव करती है, ईि ऄजधजनयम, की धारा 18 की ईपधारा (1) की ऄपेक्षानुसार ईन व्यजियों की सूचना के जलए प्रकाजित दकया िाता है, जिनके ईससे प्रभाजवत होने की संभावना है और एतद्द्वारा सूचना दी िाती है दक ईक्त प्रारूप पर ईस तारीख से पैंतालीस ददन की ऄवजध के पि्चात जवचार दकया िाएगा, जिसको ईक्त प्रारूप जनयमों को ऄंतर्ववष्ट करने वाले रािपत्र की प्रजतयां िनता को ईपलब्ध करा दी िाती है;
आन प्रारूप जनयमों पर अक्षेप या सुझाव, यदद कोइ हो, को जनदेिक, ईदयोग संवधधन और अंतररक व्यापार जवभाग, वाजणज्य और ईद्योग मंत्रालय, कमरा नं. 254 क, ईद्योग भवन, नइ ददल्ली–110 011, इमेलः avi.gupta@gov.in को ईपयुधि जवजनर्ददष्ट ऄवजध के पूवध भेिे िा सकेंगे।
दकसी व्यजि से प्राप्त अक्षेप और सुझाव, ईक्त प्रारूप जनयमों के बारे में ईपयुधि जवजनर्ददष्ट ऄवजध के पूवध, केंद्रीय सरकार द्वारा जवचार दकया िाएगा।

1. (1) आन जनयमों का संजक्षप्त नाम जवस्फोटक (संिोधन) जनयम, 2022 है । (2) ये रािपत्र में ईनके ऄंजतम प्रकािन की तारीख को प्रवृत्त होंगे। 2. जवस्ट्फोटक जनयम, 2008 में (आसके अगे से मूल जनयम कहा गया है) जनयम 2, में- (क) ईप जनयम 56 के पश्चात जनम्नजलजखत खंड िोडा िाएगा, ऄथाधत्: - "(56क) तृतीय पक्षकार जनरीक्षण ऄजभकरण से ऐसा वृजत्तक संगठन ऄजभप्रेत है िो मुख्य जनयंत्रक द्वारा पररसंकटमय, रसायनो का जवजनमाधण, भंडारण और अयात जनयम, 1989 के तहत पररभाजषत प्रमुख दुघधटना खतरों वाले (एमएएच) पररसर की सुरक्षा संपरीक्षा करने के जलए मान्यता प्राप्त हैं, और जिसमे ऐसे न्यूनतम तीन व्यजि िाजमल हो जिनके पास दकसी मान्यता प्राप्त जवश्वजवद्यालय से रसायन जवज्ञान में स्नातकोत्तर ईपाजध या रसायन ऄजभयांजत्रकी में स्नातक ईपाजध की न्यूनतम योग्यता हो और जवस्ट्फोटकों के जवजनमाधण और संचालन में दस साल का न्यूनतम ऄनुभव प्राप्त हो।
2. मूल जनयम में, जनयम 112 में, ईप जनयम (2) को जनम्नजलजखत द्वारा प्रजतस्ट्थाजपत दकया िाएगा, ऄथाधत् "- "ऄनुज्ञजप्त का नवीनीकरण" - (2) ऄनुज्ञजप्त के नवीनीकरण के जलए ईप-जनयम (1) के तहत प्रत्येक अवेदन के साथ जनम्नजलजखत दस्ट्तावेि संलग्न दकए िाएंगे, ऄथाधत्: - क. प्रारूप अरइ-1 में अवेदन;
   ख. मूल ऄनुज्ञजप्त: ग. जनधाधररत नवीनीकरण िुल्क। घ.

्त के नवीनीकरण के जलए ईप-जनयम (1) के तहत प्रत्येक अवेदन के साथ जनम्नजलजखत दस्ट्तावेि संलग्न दकए िाएंगे, ऄथाधत्: - क. प्रारूप अरइ-1 में अवेदन;
ख. मूल ऄनुज्ञजप्त: ग. जनधाधररत नवीनीकरण िुल्क। घ. जवस्ट्फोटक जवजनमाधण आकाआयों के मामले में, आन जनयमों के तहत ऄनुमोददत तृतीय पक्षकार जनरीक्षण ऄजभकरण द्वारा िारी खतरनाक रसायनों के जवजनमाधण, भंडारण और अयात जनयम, 1989 के ऄनुसार ऄंजतम ऄनुमोदन के
बाद से सभी जनरीक्षण या सुरक्षा संपरीक्षा ररपोटध।"

MINISTRY OF COMMERCE AND INDUSTRY (Department for Promotion of Industry and Internal Trade) NOTIFICATION New Delhi, the 17th January, 2023 G.S.R. 31(E).—The draft of the following rules to amend the Explosives Rules, 2008, which Central Government proposes to make in exercise of the powers conferred by sections 5 and 7 of the Explosives Act, 1884 (4 of 1884) is hereby published as required by sub-section (1) of section 18 of the said Act for information of all persons likely to be affected thereby, and notice is hereby given that the said draft shall be taken into consideration after expiry of a period of forty-five days from the date on which the copies of the Gazette of India containing this notification are made available to the public.

Objections or suggestions if any, to these draft rules may be sent to the Director (Explosives), Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry, Room No. 254A Udyog Bhavan, New Delhi – 110 011 or email avi.gupta@gov.in within the period specified above;

The objections or suggestions which may be received from any person with respect to the said draft within the period above so specified will be taken into consideration by the Central Government.

Draft Rules

1. (1) These rules may be called the Explosives(Amendment) Rules, 2022 (2) They shall come into force on the date of their final publication in the Official Gazette.

2. In the Explosives Rules, 2008 (hereinafter referred to as the principal rules).

In rule 2,- (a) after sub rule 56 following clause shall be inserted namely:- ―(56A) Third Party Inspection Agency means a professional organization recognized by Chief Controller of Explosives to carry out inspection and safety audit of major accident hazards premises as defined under the Manufacture, Storage and Import of hazardous Chemicals Rules, 1989, and having minimum three persons with minimum qualification of masters degree in chemistry or bachelors degree in chemical engineering from a recognized university and minimum experience of ten years in manufacturing and handling of Explosives.‖

3. In the principal rule, in the Rule 112, for sub rule (2) following shall be substituted, namely‖- “Renewal of license‖-(2) Every application under sub-rule (1) for renewal of the license shall be
   accompanied by the following documents, namely:- a. application in Form RE-1; b. The original license: c. Prescribed renewal fee. d. In case of Explosives Manufacturing Units, all the inspection or safety audit reports since last approval as per the Manufacture, Storage and Import of Hazardous Chemicals Rules, 1989 issued by Third Party Inspection Agency approved under these Rules.‖
