वाजणज्य और उद्योग मंत्रालय (उद्योग संवधधन और आंतररक व् यापार जवभाग) अजधसूचना नई दिल् ली, 20 िनवरी, 2022 सा.का.जन. 44(अ)—गैस जसलैंडर जनयम, 2016 का और संिोधन करने के जलए कजतपय जनयमों का प्रारूप, जिसे भारत के रािपत्र, असाधारण, भाग-2, खंड-3, उप-खंड(i) में, संख यांक सा.का.जन. 462(अ), तारीख 25 िून, 2021 द्वारा, ऐसे सभी व् यज‍ तयों से जिनके उससे प्रभाजवत होने की संभावना है, उ‍ त अजधसूचना अंतर्वधष् ट करने वाले रािपत्र की प्रजतयां िनता को उपलब् ध कराने की तारीख से तीस दिन की अवजध समाप् त होने के पूवध, आक्षेप और सुझाव आमंजत्रत करने के जलए प्रकाजित दकया गया था; और, उ‍ त रािपत्र की प्रजतयां, 25 िून, 2021 को िनता को उपलब् ध करा िी गई थीं; और उ‍ त प्रारूप जनयमों पर िनता से प्राप् त आक्षेपों और सुझावों पर जवचार दकया गया; अतः अब, केन्द्रीय सरकार, जवस्ट् फोटक अजधजनयम 1884 (1884 का 4) की धारा 5 और धारा 7 द्वारा प्रित् त िजियों का प्रयोग करते हुए, गैस जसलेंडर जनयम, 2016 का और संिोधन करने के जलए जनम् नजलजखत जनयम बनाती है, अथाधत्:—

THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 1. संजक्षप् त नाम और प्रारम् भ.–(1) इन जनयमों का संजक्षप् त नाम गैस जसलेंडर (संिोधन) जनयम, 2022 है।
(2) ये रािपत्र में प्रकािन की तारीख को प्रवृत होंगे। 2.
गैस जसलेंडर जनयम, 2016 में, जनयम 6 में उप-जनयम 2 में खंड (ख) के पश्चात् जनम्नजलजखत खंड अंतःस्ट् थाजपत दकया िाएगा अथाधत:— “(ग) गैर-जवषाि, गैर-ज्वलनिील गैस और तरल पिाथों को भरने के जलए उपयोग दकए िाने वाले सभी उच्च िाब के जसलेंडरों और क्रायोिेजनक आधानों में जसलेंडरों और आधानों के सहििृश् य स्ट्थान पर बार कोड या आरएफआईडी या ‍यूआर कोड या दकसी भी माध्यम के इले‍रॉजनक पहचान संखया के रुप में स्ट्थाई और पररवर्तधत न की िा सकने वाली मार्किंग की िाएगी।
परंतु इन जनयमों के प्रकािन से पहले जवजनर्मधत जसलेंडरों के जलए उपरोि स्ट्थायी और पररवर्तधत न की िा सकने वाली मार्किंग, ऑ‍सीिन जसलेंडर के मामले में, इन जनयमों के प्रकािन की तारीख से छह महीने की समाजि से पहले और अन्द्य गैर-जवषैले और गैर-ज्वलनिील गैस जसलेंडरों के मामले में एक वषध की समाजि से पहले की होगी।" [फा.सं. पी-13033/32/2021-जवस्ट्फोटक-भाग(1)] सुजमता िावरा, अपर सजचव नोट-

MINISTRY OF COMMERCE AND INDUSTRY (Department of Industrial Policy and Promotion) NOTIFICATION New Delhi, the 20th January, 2022 G.S.R. 44(E).—WHEREAS the draft of certain rules further to amend the Gas Cylinder Rules, 2016 was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-Section (i), dated the 25th June, 2021, vide number G.S.R. 462 (E), dated the 25th June, 2021, inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of a period of thirty days from the date on which the copies of the Official Gazette containing the said notification were made Available to the public; AND WHEREAS, the copies of the said Gazette were made available to the public on
25th June, 2021;
AND WHEREAS, objections and suggestions received from the public on the said draft rules were considered;
NOW, THEREFORE, in exercise of the powers conferred by sections 5 and 7 of the Explosives Act, 1884 (4 of 1884), the Central Government hereby makes the following rules further to amend the Gas Cylinder Rules, 2016, namely:—

1. Short title and commencement.—(1) These rules may be called the Gas Cylinders (Amendment) Rules, 2022. (2) They shall come into force on the date of their publication in the Official Gazette.

2. Short title and commencement.—(1) These rules may be called the Gas Cylinders (Amendment) Rules, 2022. (2) They shall come into force on the date of their publication in the Official Gazette.

[भागII—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 2. In the Gas Cylinders Rules, 2016 in rule 6, in Sub-rule (2) after clause (b), the following clause shall be inserted, namely:— “(c) All the high pressure cylinders and Cryogenic containers used for filling of Non-Toxic, Non-Flammable Gases and Liquids shall have permanent and tamper proof marking in form of Bar Code or RFID or QR code or any means of electronic identification number at conspicuous place on cylinders and containers.
Provided that for the cylinders manufactured before the publication of these rules
shall have above said permanent and tamper proof marking, before expiry of six months in case of oxygen cylinders and one year in case of other non-toxic and non-flammable gas cylinders from the date of publication of these rules."
