वाजणज्य और ईद्योग मंत्रालय (ईद्योग संवधधन और अंतररक व् यापार जवभाग) ऄजधसूचना नइ ददल् ली, 31 ऄगस्ट्त , 2021 सा.का.जन. 609(ऄ).—जस्ट्थर और गजतिील दाब पात्र (ऄज् वजलत) जनयम, 2016 का प्रारूप, जजसे भारत के राजपत्र, ऄसाधारण, भाग II,खण् ड-3,ईप-खण् ड (i) में भारत सरकार केवाजणज्य और ईद्योग मंत्रालय, (ईद्योग संवधधन और अंतररक व् यापार जवभाग) में ऄजधसूचना संख् या सा.का.जन. 96 (ऄ) तारीख 2 फरवरी, 2021 को, जजसमें ऐसे सभी व् यजियों से जजनके ईससे प्रभाजवत होने की संभावना है अक्षेप या सुझाव मांगने के जलए प्रकाजित की गइ थी, तीस ददन की ऄवजध के समाप् त होने से पूवध ऄजधसूचना की प्रजतयां जनता को ईपल्‍ ध करा दी गइ थी; और जबदक ईक् त ऄजधसूचना,2 फरवरी, 2021 को जनता को ईपल्‍ ध करा दी गइ थी; और जबदक ईक् त प्रारूप जनयमों पर जनता से प्राप् त अक्षेपों और सुझावों पर कें्र सरकार ्ारा जवजधवत जवचार दकया गया; ऄतः ऄब, केन्‍द ्र ीय सरकार एतद् ्ारा जवस्ट् फोटक क ऄजधजनयम 1884 (1884 का 4) की धारा 5 और 7 ्ारा प्रदत् त िजियों का प्रयोग करते हुए,जस्ट्थर और गजतिील दाब पात्र (ऄज् वजलत) जनयम,2016 में संिोधन करने के जलए जनम् नजलजखत जनयम बनाती हं, ऄथाधत्ः-

  1. संजक्षप् त नाम और प्रारम् भ.–(1) आन जनयमों का संजक्षप् त नाम जस्ट्थर और गजतिील दाब पात्र (ऄज् वजलत) (संिोधन) जनयम, 2021 हं।
    (2) ये राजपत्र में ईनकेप्रकािन की तारीख को प्रवृत होंगे । सं. 495] नइ ददल्ली, बुधवार, जसतम् बर 1, 2021/भा्र 10, 1943

गया है) । 3. ईक् त जनयम में, जनयम 2 में, ईप जनयम (viii) के पश् चात जनम् नजलजखत ऄंतःस्ट् थाजपत दकया जाएगा ऄथाधत; "(viii) ‘सक्षम व् यजि’ से मुख् य जनयंत्रक ्ारा मान्‍दयता प्रा्त ऐसा व् यजि ऄजभप्रेत है, जजसे ऐसी गैसों और पात्रों और ईस जवजनर्ददष्ट ऄवजध के जलए ईि जनयमों के ऄधीन जवजनर्ददष् टक परीक्षण, जनरीक्षण, ऄजध्ापनों और पररवहन वाहनों के प्रमाणन के जलए सक्षम घोजित दकया गया हो, यदद यह व् यजि आन जनयमों के पररजिष्ट 2 क में जनधाधररत ऄहधताएं, ऄनुभव और ऄन्‍दय ऄपेक्षाएँ पूणध करते हों और जनयम 12 में ऄजधकजथत प्रदियानुसार मान्‍दयता प्रदान की गइ होः परंतु मुख्य जनयंत्रक दकसी सक्षम व्यजि की ऄहधताओं में जिजथलता प्रदान कर सकेंगे यदद वह व्यजि अपवाददक रूप से ऄनुभवी और जानकार हो ककतु ईसके पास की ऄपेजक्षत सुजवधाओं के सम्बन्‍दध में नहीं;

गइ होः परंतु मुख्य जनयंत्रक दकसी सक्षम व्यजि की ऄहधताओं में जिजथलता प्रदान कर सकेंगे यदद वह व्यजि अपवाददक रूप से ऄनुभवी और जानकार हो ककतु ईसके पास की ऄपेजक्षत सुजवधाओं के सम्बन्‍दध में नहीं;
4. ईक् त जनयम में, जनयम 2 में, ईप जनयम (xxix) के पश् चात जनम् नजलजखत ऄंतःस्ट् थाजपत दकया जाएगा ऄथाधत; “(xxix) (क) ‘अइएसओ टक ंकी अधान’ से ऐसा टक ंकी अधान ऄजभप्रेत है जजसमें दो बुजनयादी तत्व िाजमल हं, पात्र और ढांचा, जो सड़क, रेल और समु्र के ्ारा संपीजडत गैस पररवहन के जलए ईपयुि है, जजसमें पररवहन के आन रूपों के बीच ऄंतबधदल िाजमल है, और जो अइएसओ 1496 की ऄपेक्षाओं का ऄनुपालन करता है”। 5. ईक् त जनयम में, जनयम 2 में,ईप जनयम (xl) के पश् चात, जनम् नजलजखत ऄंतःस्ट् थाजपत दकया जाएगा ऄथाधत;:- “(xlक) तृतीय पक्षकार जनरीक्षण ऄजभकरण से ऐसा वृजिक संगठन ऄजभप्रेत है जो मुख्य जनयंत्रक ्ारा जनरीक्षण, प्रमाणन, परीक्षण और खतरनाक रसायनजनमाधण, भंडारण और अयात जनयम, 1989 के तहत पररभाजित प्रमुख दुघधटक ना खतरों (एमएएच) पररसर की सुरक्षा संपरीक्षा करने के जलए मान्‍दयता प्रा्त हं और जजसमे ऐसे व्यजि िाजमल होगें जजनके पास सक्षम व्यजियों के समानऄहधताएं और ऄनुभव हो”। 6. ईक् त जनयम में, जनयम 2 में,ईप जनयम (xliii) में, ‘दाब पात्र’ ि्‍ द के पश् चात “,अइएसओटक ंकी अधान’”ि्‍ द ऄंतःस्ट् थाजपत दकए जाएंगे। 7. ईक् त जनयम में, जनयम 18 में,ईप जनयम (2)में, खंड (xiii) में, ‘सक्षम व् यजि’ ि्‍ दों के पश् चात जनम् नजलजखत ि्‍ द ऄंतःस्ट् थाजपत दकए जाएंगे: ऄथाधत-
“,तृतीय पक्षकार ऄजभकरण” 8.

थाजपत दकए जाएंगे। 7. ईक् त जनयम में, जनयम 18 में,ईप जनयम (2)में, खंड (xiii) में, ‘सक्षम व् यजि’ ि्‍ दों के पश् चात जनम् नजलजखत ि्‍ द ऄंतःस्ट् थाजपत दकए जाएंगे: ऄथाधत-
“,तृतीय पक्षकार ऄजभकरण” 8. ईक् त जनयम में, जनयम 19 (1) में, (i) ईप जनयम (1) में, खंड (क) में, ‘सक्षम व् यजि’ ि्‍ दोंके पश् चात “तृतीय पक्षकार जनरीक्षण ऄजभकरण (टक ीपीअइए)” ि्‍ द, कोष् ठक और ऄक्षर ऄंतःस्ट् थाजपत दकए जाएंगे। (ii) ईप जनयम (7) में,‘सक्षम व् यजि’ ि्‍ दोंके पश् चात “तृतीय पक्षकार जनरीक्षण ऄजभकरण (टक ीपीअइए)” ि्‍ द, कोष् ठक और ऄक्षर ऄंतःस्ट् थाजपत दकए जाएंगे। 9. ईक् त जनयम में,जनयम 33 में, “सक्षम व् यजि” ि्‍ दोंके पश् चात जनम् नजलजखतऄंतःस्ट् थाजपत दकए जाएंगे: ऄथाधत:-
“तृतीय पक्षकार ऄजभकरण (टक ीपीअइए)”। 10. ईक् त जनयम में, जनयम 43 में, ‘सक्षम व् यजि’ ि्‍ दों के पश् चात जनम् नजलजखत ि्‍ द ऄंतःस्ट् थाजपत दकए जाएंगे: ऄथाधत:- “तृतीय पक्षकार जनरीक्षण ऄजभकरण (टक ीपीअइए)”। 11. ईक् त जनयम में, जनयम 47 में,ईप जनयम (7) के स्ट् थान पर, जनम् नजलजखत रखाजाएगा ऄथाधत्;:- “(7) जजला प्राजधकारी अवेदक को ऄनापजि प्रमाण पत्र जारी करेगा या ऄनापजि प्रमाण पत्र देने से आनकार करने का जलजखत रूप में कारण देते हुए यथासंभव िीघ्रता से अवेदकों को सूजचत करेगा, ककतु अवेदक से अवेदन प्रा्त
होने की तारीख से दो महीने के बाद नहीं होगा और यदद वह जनधाधररत समय में ऐसा करने में जवफल रहता है तो ऄनापजि प्रमाण पत्र जारी समझा जाएगा:

ीघ्रता से अवेदकों को सूजचत करेगा, ककतु अवेदक से अवेदन प्रा्त
होने की तारीख से दो महीने के बाद नहीं होगा और यदद वह जनधाधररत समय में ऐसा करने में जवफल रहता है तो ऄनापजि प्रमाण पत्र जारी समझा जाएगा:

[भागII—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 परंतु यदद जजला प्राजधकारी ऄनापजि प्रमाण पत्र जारी करने सेआनकार या अपजि की सूचना देता है, तो आन जनयमों के ऄधीन जारी की गइ ऄनुज्ञज्त तत्काल प्रभाव से रद्द मानी जाएगी।” 12. ईक् त जनयम में, जनयम 49 ईप जनयम (4) में, ‘ठध-2’ ि्‍ द और अंकडों के पश् चात “ठध -2क और ठध -2ख”ि्‍ द और अंकडेऄंतःस्ट् थाजपत दकए जाएंगे। 13. ईक् तजनयममें, जनयम 50 में,ईप जनयम (ग) के पश् चात जनम् नजलजखत ऄंतःस्ट् थाजपत दकया जाएगा: ऄथाधत्-
“प्ररूप ठध -4 में, यदद अवेदन भारतीय क्षेत्र के भीतर भूजम मागध से अइएसओ टक ंकी अधान’ में संपीजड़त गैस पररवहन की ऄनुमजत के संबंध में है या अइएसओ टक ंक पोत में संपीजड़त गैस के अयात और पररवहन की ऄनुज्ञा हं”। 14. ईक् त जनयम में, जनयम 61 के स्ट् थान पर,जनम् नजलजखत रखा जाएगा ऄथाधत्:- “61 ऄनुज्ञज्त का खोना.- जहां आन जनयमों के ऄधीन मंजूर की गइ ऄनुज्ञज्त खो जाती है या दुघधटक नावि नष् टक हो जाती है,वहॉं जसस्ट्टक म जेनरेटक ेड कॉपी को ऄनुज्ञज्त धारी ्ारा पेरोजलयम तथा जवस्ट् फोटक क सुरक्षा संगठन के ऑनलाआन पोटक धल से डाईनलोड दकया जा सकता है। 15. ईक् त जनयम में, पररजिष् टक IIक में, ि.सं. 2 में, स्ट् तंभ 4 में, कोष् ठक, अकड़े और ि्‍ दों को “(1) न्‍द यूनतम 10 विध का ऄनुभव-” ि्‍ दों को “न्‍द यूनतम 5 विध का ऄनुभव-” ि्‍ दों, अकड़ों और ि्‍दों के स्ट् थान पर रखा जाएगा। 16.

IIक में, ि.सं. 2 में, स्ट् तंभ 4 में, कोष् ठक, अकड़े और ि्‍ दों को “(1) न्‍द यूनतम 10 विध का ऄनुभव-” ि्‍ दों को “न्‍द यूनतम 5 विध का ऄनुभव-” ि्‍ दों, अकड़ों और ि्‍दों के स्ट् थान पर रखा जाएगा। 16. ईक् त जनयम में, पररजिष् टक III में, ि.सं.क और 4 में, स्ट् तंभ 4 में, “सक्षम व् यजि” ि्‍ दों के पश् चात “,तृतीय पक्षकार ऄजभकरण(टक ीपीअइए)”ि्‍ द, को्क और ऄक्षर ऄंतःस्ट् थाजपत दकए जाएंगे। 17. ईक् त जनयम में, ऄनुसूची 1ख में, (i) ि.सं. 13 की प्रजवजष्टयां और आससे संबंजधत प्रजवजष्टयों का लोप दकया जाएगा। (ii) ि.सं. 14 को ि.सं. 13 के रूप में पुन:संख् यांदकत दकया जाएगा और आस प्रकार पुन:संख् यांदकत ि. सं. 13 के पश् चात जनम् नजलजखत ि.सं. ऄंतःस्ट् थाजपत की जाएगी, ऄथाधत:-
“14 भारतीय क्षेत्र के भीतर भूजम मागध से अइएसओ टक ंकी अधान में संपीजड़त गैस के पररवहन की ऄनुज्ञा की मंजूरी रू.5000/-”

  1. ईक् त जनयम में, प्ररूप कध-3 के पश् चात जनम् नजलजखत प्ररूप ऄंतःस्ट् थाजपत दकया जाएगा, ऄथाधत:-
    प्ररूप कध -4 (जनयम 50 देखें) भारतीय क्षेत्र के भीतर अइएसओ टक ंक कंटक ेनरों में संपीजड़त गैस के पररवहन की ऄनुमजत के जलए अवेदन

  2. जजस नाम से ऄनुज्ञा ऄपेजक्षत है i. अवेदक का नाम ii. अवेदक का पूरा डाक पता iii. टक ेलीफोन संख् या(एं) और इ-मेल

  3. जस्ट्थर तथा गजतिील दाबपात्र (ऄज् वजलत) जनयम, 2016 और गैस जसलेंडर जनयम, 2016 के तहत भंडारण ऄनुज्ञज्त

यह ऄनुज्ञा,जारी होने की तारीख से पांच विध तक वैध रहेगी । जारी करने की ताररख मुख् य जवस्ट् फोटक क जनयंत्रक / जवस्ट् फोटक क जनयंत्रक यदद वाहन जस्ट् थर तथा गजतिील दाबपात्र (ऄज् वजलत) जनयम 2016 केऄध्यायों 2 और 4कीऄपेक्षाओं के ऄनुरूप नहीं पाए जानेया जजन जनयमों और िततों के ऄधीन यह ऄनुमजत जारी की गइ है, ईनमें से दकसी का ईल्लंघन होने की दिा में यह ऄनुज्ञा रद्द की जा सकती है और ऄनुमजत धारक ऄजधजनयम के ऄधीन दण् डनीय होगा ।

अइएसओ टक ंकी अधान का ईपयोग ईस संपीजड़त गैस के पररवहन के जलए दकया जाएगा जजसके जलए ऄनुज्ञा मंजूरीजारी की गइ है । 2.
लोड वाहन का वजन अइएसओ टक ंकी अधान पर माईन्न्‍द टक ग के प्रयोजन से प्रयोग दकए जाने वाले प्रस्ट् ताजवत वाहन के अरएलड्‍ल्यू / जीसीड्‍लू / जीवीड्‍ल्यू से ऄजधक नहीं होगा । 3.
अइएसओ टक ंकी अधान का ईपयोग संपीजड़त गैस के जस्ट् थर भंडारण ऄजधष् ठापन के जलए ईपयोग नहीं दकया जाएगा। 4.

ने वाले प्रस्ट् ताजवत वाहन के अरएलड्‍ल्यू / जीसीड्‍लू / जीवीड्‍ल्यू से ऄजधक नहीं होगा । 3.
अइएसओ टक ंकी अधान का ईपयोग संपीजड़त गैस के जस्ट् थर भंडारण ऄजधष् ठापन के जलए ईपयोग नहीं दकया जाएगा। 4.
भारतीय राज् यक्षेत्र के ऄन्‍द दर अइएसओ टक ंकी अधान के बहुजवध पररवहन के मामले में–

क माईन्न्‍द टक ग औरडी-माईन्न्‍द टक ग के स्ट्थानों पर ईठाने और बांधने की पयाधप् त सुजवधाएं सुजनजचितत की जाएंगी।

ख- रेलवे/ पत् तन/पोत पररवहन महाजनदेिक/सीमा-िुल् क अदद, जो भी लागू हो, के कानूनी ऄपेक्षाओं के ऄनुपालन का ईत् तरदाजयत् व ऄनुमज्ञाधारक का होगा । 5-
अइएसओ टक ंकी अधान पर अइएसओ 6348 की ऄपेक्षाओं के जचहनांकन होगा । 6-
ऄंतरराष्ट्रीय समु्र ी खतरनाक माल में यथाजवजनर्ददष् टक अइएसओ टक ंकी अधान का अवजधक जनरीक्षण दकया जाएगा। 7-
अइएसओ टक ंकी अधान की मरम्मत मूल ईपकरण जवजनमाधता या मूल ईपकरण जवजनमाधताओं ्ारा ऄनुिंजसत और पेरोजलयम और जवस्ट्फोटक क सुरक्षा संगठन ्ारा ऄनुमोददत ऄजभकरणों ्ारा की जाएगी। 8-
ऄनुज्ञा पत्र को ऄनुज्ञा प्रा्त वाहन में हर समय रखा जाएगा और जनयम 70 में जवजनर्ददष् टक , दकसी ऄजधकारी ्ारा मांगे जाने पर प्रस्ट् तुत दकया जाएगा । 9-
ऄनुज्ञा प्राप् त वाहन चलाने या तत् सम् बन्‍द धी दकसी भी कायध के जलए केवल ऐसे जजम् मेदार व्यजियों को ऄनुज्ञा दी जाएगी जो ऄनुमजत की िततों के जानकार हों । 10-
ऄनुज्ञा प्राप् त वाहन के साथ हमेिा एक जजम्मेदार व्यजि तथा संपीजड़त गैस के पररवहन के समय कम से कम दो व्यजि मौजूद रहेंगे :

परंतु ऄनुज्ञा प्रा्त वाहन, यदद खाली हो, तो मुख्य जनयंत्रक या जनयंत्रक ्ारा जलजखत रूप में, ईस प्रयोजन के जलए स्ट्वीकृत दकए गए स्ट्थान पर जबना दकसी की मौजूदगी के खड़ा दकया जा सकता है । 11-
ऄनुज्ञा प्राप् त वाहन में हमेिा ईपल्‍ ध रखा जाए –

मुख्य जनयंत्रक या जनयंत्रक ्ारा जलजखत रूप में, ईस प्रयोजन के जलए स्ट्वीकृत दकए गए स्ट्थान पर जबना दकसी की मौजूदगी के खड़ा दकया जा सकता है । 11-
ऄनुज्ञा प्राप् त वाहन में हमेिा ईपल्‍ ध रखा जाए – क- कम से कम दो पोटक ेबल ऄजग् निमन यंत्र, जो 9 लीटक रों से कम न हों और रासायजनक अग बुझाने के जलए ईपयुि हों; ख- ज्वलनिील संपीजड़त गैस के पररवहन के जलए ईपयोग दकए जाने वाले वाहन के मामले में जवद्युत बॉन्न्‍द डग के जलए एक मजबूत लचीला केबल; केबल कम से कम 5 मीटक र लंबा होगा और प्रत्येक छोर पर एक ईपयुि क्लंप या जक्लप होगा। 12-
संपीजड़त गैस के प्रयोजन के जलए, मुख् य जनयंत्रक या जनयंत्रक ्ारा जनयमों के ऄन्‍द तगधत जनर्ददष् टक से ऄनुज्ञप् त पररसर के ऄन्‍द दर ऄनुमोददत स्ट् थान के ऄजतररक् त दकसी ऄन्‍द य स्ट् थान परया जब पात्र मय दफटक मेन्‍द टक ररसाव,दोिपूणध या ऄन्‍दयथा ऄसुरजक्षत हो,अइएसओ टक ंकी अधान में / से लोड या ऄनलोड नहीं दकया जाएगा : परंतु दकसी दुघधटक ना या ब्रेक डाईन की जस्ट् थजत में अइएसओ टक ंकी अधानको सभी सावधाजनयों और पयाध्त
पयधवेक्षणके साथदकसी भी ऄन्‍दय स्ट्थान पर ऄनलोड दकया जा सकता है । 13.
दकसी अइएसओ टक ंकी अधान दकसी भी संपीजड़त गैस को सीधे दकसी भी प्रोसेस पात्र में जडस्ट् चाजध नहीं दकया जाएगा । 14.
यदद कोइ भी दफटक मेंटक मय पात्र लीक,दोिपूणध या ऄन्‍दयथा ऄसुरजक्षत हो,ऄनुज्ञा प्राप् त अइएसओ टक ंक कंटक ेनर लोड नहीं दकया जाएगा ।

सीधे दकसी भी प्रोसेस पात्र में जडस्ट् चाजध नहीं दकया जाएगा । 14.
यदद कोइ भी दफटक मेंटक मय पात्र लीक,दोिपूणध या ऄन्‍दयथा ऄसुरजक्षत हो,ऄनुज्ञा प्राप् त अइएसओ टक ंक कंटक ेनर लोड नहीं दकया जाएगा ।

[भागII—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 7 15.
ऄनुमजत प्राप् त अइएसओ टक ंकी अधान में / से संपीजड़त गैस लोड / ऄनलोड करने से पूवध – क- आसके आंजन को बंद कर ददया जाएगा और बैटक री को एक ईजचत जस्ट्वच या ऄन्‍दयथा ऄलग दकया जाएगा; ख- आसके पजहए ब्रेक ्ारा या स्ट्कैन्चग ्ारा सुरजक्षत दकए जाएंगे; ग- यदद वाहन ज्वलनिील संपीजड़त गैस के पररवहन के जलए ईपयोग दकया जा रहा है, तो आसकी चेजसस को पाआप के साथ एक केबल ्ारा या जजसमें से आसे लोड या ऄनलोड दकया जाना है, जवद्युत रूप से जोड़ा जाएगा; घ- दोनों जसरों पर सही प्रकार से भरण या जडस्ट् चाजध पाआप कनेक्िन दकए जाएंगे; ङ- जब तक लोन्डग या ऄनलोन्डग खत्म न हो जाए और वाहन को मुहरबंद न कर ददया जाए, एक जजम्मेदार व्यजि साथ में ईपजस्ट्थजत में होगा । 16-
रैदफक जसग्नलों पर या ऄनुज्ञापन प्राजधकारी की अवश् यकतानुसार या जनयमों को लागू करने वाले दकसी ऄन्‍द य ऄजधकारी के कहे जाने के ऄजतररक् त ऄनुमजत प्राप् त वाहन दकसी सड़क पर, भीड़भाड़ युक् त स्ट् थान पर या दकसी ऐसे स्ट् थान पर अइएसओ टक ंकी अधान वाहन के लोन्डग एवं ऄनलोन्डग के जलए जो जनयमों के ऄधीन ऄनुज्ञजप् त पररसर के ऄन्‍द दर कोइ स्ट् थान नहीं है, नहीं रोका जाएगा । 17- दकसी ज् वलनिीन गैस के पररवहन के जलए के जलए ईपयोग में लाए जा रहे ऄनुमजत प्राप् त वाहन पर धूम्रपान, दकसी भी प्रकार के ऄजग् न का रोतोत या कृजत्रम रोिनी या कोइ वस्ट् तु जो ज् वलनिील वाष् प ईत् पन्‍द न कर सकता है, की ऄनुज्ञा नहीं होगी । 18-

ईपयोग में लाए जा रहे ऄनुमजत प्राप् त वाहन पर धूम्रपान, दकसी भी प्रकार के ऄजग् न का रोतोत या कृजत्रम रोिनी या कोइ वस्ट् तु जो ज् वलनिील वाष् प ईत् पन्‍द न कर सकता है, की ऄनुज्ञा नहीं होगी । 18-
ऄनुमजत प्राप् त अइएसओ टक ंकी अधान याजत्रयों को ले जाने के जलए प्रयोग नहीं दकया जाएगा । 19-
ऄनुज्ञापन प्राजधकारी के जलजखत पूवाधनुमजत के जबनाअइएसओ टक ंकी अधान या ईसके दफटटक ग् स में दकसी तरह का बदलाव नहीं दकया जाएगा । ऐसे बदलाव ऄनुज्ञजप् त में संिोधन के रूप में पृष् ठांदकत होंगे । 20-

(Unfired) Rules, 2016, were published, vide notification of the Government of India in the Ministry of Commerce and Industry (Department for Promotion of Industry and Internal Trade) number, G.S.R. 96 (E), dated the 2nd February, 2021, in the Gazette of India, Extra-ordinary, Part-II, Section 3, Sub section (i), inviting objections or suggestions from all persons likely to be affected thereby before the expiry of a period of thirty days from the date on which the copies of the Gazette containing the said
notification were made available to the public; And whereas, the copies of the said Gazette notification were made available to the public on the 2nd February, 2021; And whereas, objection and suggestions as received from the public within the said period have been duly considered by the Central Government; NOW THEREFORE, in exercise of the powers conferred by sections 5 and 7 of the Explosives Act, 1884 (4 of 1884), the Central Government thereby makes the following rules further to amend the Static and Mobile Pressure Vessels (Unfired) Rules, 2016, namely: -

  1. Short title and commencement-(1) These rules may be called the Static and Mobile Pressure Vessels (Unfired) (Amendment) Rules, 2021. (2) They shall come into force on the date of their publication in the Official Gazette.
  2. In the Static and Mobile Pressure Vessels (Unfired) Rules, 2016, herein after referred to as the said rules,

In the Static and Mobile Pressure Vessels (Unfired) Rules, 2016, herein after referred to as the said rules, 3. in rule 2, for sub- rule (viii), the following shall be substituted, namely:- ―(viii) ‗competent person‘ means a person recognised by the Chief Controller, for such gases and vessels and for such period as may be specified by him as competent, for carrying out tests, examinations, certification for installations and transport vehicles as stipulated in these rules, if the person possess the qualifications and experience and other requirements as set out in Appendix IIA to these rules and the recognition is granted as per procedure laid down in Rule 12: Provided that the Chief Controller may relax the requirements of qualifications in respect of a competent person if such person is exceptionally experienced and knowledgeable but not the requirements in respect of the facilities at his command‖. 4. In the said rules, in rule 2 after sub- rule (xxix), the following sub-rule shall be inserted, namely:-

In the said rules, in rule 2, after sub-rule (xl), the following shall be inserted, namely:- ―(xla) ‗Third Party Inspection Agency‘ means a professional organisation recognised by Chief Controller to carry out inspection, certifications, testing including safety audit of major accident hazards premises as defined under the Manufacture, Storage and Import of Hazardous Chemicals Rules, 1989, and having persons with qualifications and experience as applicable to the competent persons‖. 6. In the said rules, in rule 2, in sub- rule (xIiii), after the word ―pressure vessel‖ , the letters and words ―, ISO Tank Container‖ shall be inserted. 7. In the said rules, in rule 18 in sub-rule (2) in clause (xiii), after the word ―competent person‖, the following shall be inserted, namely:- ―Third party inspection agency‖. 8. In the said Rules, in rule 19 (1),- i.

In the said rules, in the rule 47, for sub- rule (7) the following sub-rule shall be substituted, namely:- ―(7) The District authority shall grant no objection certificate or convey his refusal for granting no objection certificate with reasons thereof in writing to the applicants as expeditiously as possible but not later than two months from the date of receipt of application from the applicant and if he fails to do so in stipulated time no objection certificate shall be considered deemed to be issued: Provided that in case the District Authority conveys his refusal or objections for granting no objection certificate, the license granted under these rules stands cancelled with immediate effect‖. 12.

In the said rules, for rule 61, the following rule shall be substituted, namely:- ― 61. Loss of licence.- When a licence granted under these rules is lost or accidentally destroyed , system generated copy may be downloaded by the licensee from online portal of Petroleum and Explosive Safety Organisation‖. 15. In the said rules, in Appendix IIA, at Sl. No. 2, in column 4, for the brackets, figures and words ―(1) A minimum experience of 10 years in –‖ the letters, figures and words, ―(1) A minimum experience of 5 years in –‘‘ shall be substituted. 16. In case of multimodal transportation of ISO Tank container within the Indian Territory (a) adequate lifting and tie-down facilities shall be ensured at mounting and demounting locations (b) Permission holder shall be responsible for compliance of statutory requirements of Railways/Ports/ Director General of Shipping/ Customs etc., as applicable. 5. ISO Tank Container shall bear Markings as per the requirements of ISO 6348. 6. The Permitted vehicle shall be constantly attended to by a responsible person and by at least two persons while it is transporting compressed gas: Provided that the permitted vehicle may, if empty, be kept unattended in a place approved for the purpose, in writing, by the Chief Controller or Controller. 11. The permitted vehicle shall at all times carry – (a) at least two portable fire extinguishers of capacity not less than 9 litres and suitable for extinguishing chemical fires; (b) a strong flexible cable for electrical bonding in case of vehicle used for transportation of flammable compressed gas; the cable shall be at least 5 metres long and shall have at each end a suitable clamp or clip. 12. The compressed gas shall not be loaded or unloaded in/from ISO Tank Container except in a place which is approved within the premises licensed for the purpose under the rules by the Chief Controller or Controller or when the fitments including vessel becomes leaky, defective or otherwise insecure. Provided that the permitted ISO Tank Container may be unloaded at any other place with all the precautions and under adequate supervision if such unloading is necessitated by an accident or break down. 13. Before compressed gas is loaded into or unloaded from the permitted ISO Tank Container – (a) its engine shall be stopped and the battery shall be isolated by a proper switch or otherwise; (b) its wheels shall be secured by brakes or by scotching; (c) its chassis shall be electrically bonded by a cable with the pipe into or from which it is to be loaded or unloaded, in case of vehicle used for transportation of flammable compressed gas; (d) the correct filling or discharge pipe connections are made at both ends; (e) a responsible person shall be in attendance and remain so until loading or unloading is over and the vehicle has been sealed. 16. Except when called upon by traffic signals or required by the licensing authority or any other officer entrusted with the job of enforcing the rules, the permitted vehicle shall not stop on any road, congested area or a place which is not a place situated within the premises licensed under the rules for the loading and unloading of ISO Tank Container vehicle. 17. No smoking and no fire or artificial light or any article capable of igniting flammable vapour shall be allowed on the permitted vehicle used for the transportation of any flammable gas.

No alteration in the permitted ISO Tank Container or its safety fittings shall be carried out without previous sanction in writing of the licensing authority. Such alteration so sanctioned shall be endorsed on the licence by an amendment. 20. Any accident, fire, explosion or untoward incident occurred within the permitted ISO Tank Container vehicle shall be immediately reported to the Chief Controller, Controller, nearest police station and District Magistrate by quickest mode of communication.     The above permission is accorded subject to the following conditions, namely:- (a) The permission is valid only for five years for import/export of ISO container. (b) Safety precautions and relevant provisions of the Static and Mobile Pressure Vessels (Unfired) Rules, 2016 should be strictly complied with during transportation of the ISO Tank Container(s). (c) The exhaust of the vehicle shall be fitted with a spark Arrestor of a make approved by the Chief Controller of Explosives if applicable (d) The mounting/demounting of the container shall be carried out under the direct supervision of a responsible officer of your Organisation and a Safety Certificate under rule 43 issued under Static and Mobile Pressure Vessels (Unfired) Rules, 2016 by a competent person or Third Party Inspection Agency duly recognized by the Chief Controller of Explosives.
