वाजणज्य और ईद्योग मंत्रालय (ईद्योग संवधधन और अंतररक व् यापार जवभाग) ऄजधसूचना नइ ददल् ली, 31 ऄगस्ट्त 2021 सा.का.जन. 608(ऄ).—जवस्ट् फोटक ऄजधजनयम, 1884 (1884 का 4) की धारा 18 की ऄपेक्षानुसार, ऄमोजनयम नाआरेट जनयम, 2012 के कजतपय प्रारूप जनयमों का और संिोधन करने के जलए भारत सरकार के वाजणज् य और ईद्योग मंत्रालय (ईद्योग संवधधन और अंतररक व् यापार जवभाग) की ऄजधसूचना सं‍ या सा.का.जन. 111(ऄ), तारीख 10 फरवरी, 2021 द्वारा भारत के राजपत्र, ऄसाधारण, भाग-II, खण् ड 3, ईप-खण् ड (i) में प्रकाजित की गइ थी जजसमें ईन सभी व् यजतयों से जजनके आससे प्रभाजवत ोोने की संभावना ो , ईक् त ऄजधसूचना में ऄंत्व्‍ ट राजपत्र की प्रजतय जनता को ईपलब् ध कराए जाने की तारीख से तीस ददन की ऄवजध की समाजि के पश् चात् अक्षेप और सुझाव अमंजत्रत दकए गए थे;

और ईक् त ऄजधसूचना, 10 फरवरी, 2021 ऄथाधत् वो तारीख जजस ददन ईक् त गजट सरकारी गजट में प्रकाजित की गइ, जनता को ईपलब् ध करा दी गइ थी; और ईक् त प्रारूप जनयमों पर जनता से ईक् त ऄवजध में प्रा्‍ त अक्षेपों और सुझावों पर केंद्र सरकार द्वारा सम् यक रूप से जवचार दकया गया; ऄतः ऄब, केन्‍द द्रीय सरकार एतवारा ारा जवस्ट् फोटक ऄजधजनयम 1884 (1884 का 4) की धारा 5 और 7 द्वारा प्रदत् त िजियों का प्रयोग करते हुए, ऄमोजनयम नाआरेट जनयम, 2012 में और संिोधन करने के जलए जनम् नजलजखत जनयम बनाती ोैं, ऄथाधत्ः-

1. संजक्ष्‍ त नाम और प्रारंभ—(1) आन जनयमों का संजक्ष्‍ त नाम ऄमोजनयम नाआरेट (संिोधन) जनयम, 2021 ो । (2) ये राजपत्र में ईनके प्रकािन की तारीख को प्रवृत् त ोोंगे।

ऄमोजनयम नाआरेट जनयम, 2012 में (जजसे आससें पश् चात मूल जनयम कोा गया ो ), जनयम 2 में, (i) खण् ड (ण) में, ईप खण् ड (iv) के पश् चात्, जनम् नजलजखत ऄंतःस्ट् थाजपत दकया जाएगा, ऄथाधत्; ‘(v) सरकारी संगठन या केंद्रीय या राज्य सावधजजनक क्षेत्र का ईपक्रम, ईस संगठन या ईपक्रम द्वारा जलजखत रूप में नाजमत कोइ ऄजधकारी।' (ii) खण् ड (ध) का लोप दकया जाएगा, (iii) खण् ड (न) में,कोष्ठक और ऄक्षर (न) के स्ट् थान पर कोष्ठक और ऄक्षर (ध) रखा जाएगा। 3. मूल जनयम में, जनयम 3 में, ईप-जनयम (1) में “नौभरण” िब् द का लोप दकया जाएगा। 4. मूल जनयम में, जनयम 4 में, “नौभरण” िब् द का लोप दकया जाएगा। 5. मूल जनयम में, जनयम 6 में, ईप-जनयम (3) में, “नौभरण” िब् द का लोप दकया जाएगा। 6. मूल जनयम में, जनयम 11 में, ईप-जनयम (4) के पश् चात जनम् नजलजखत ईप जनयम ऄंतःस्ट् थाजपत दकया जाएगा, ऄथाधत्;
“(5) ऄमोजनयम नाआरेट भंडारण और ोैंडललग पररसर में एनएफपीए 490 के ऄनुसार पयाधि ऄजििमन सुजवधा प्रदान की जाएगी।” 7.

1 में, ईप-जनयम (4) के पश् चात जनम् नजलजखत ईप जनयम ऄंतःस्ट् थाजपत दकया जाएगा, ऄथाधत्;
“(5) ऄमोजनयम नाआरेट भंडारण और ोैंडललग पररसर में एनएफपीए 490 के ऄनुसार पयाधि ऄजििमन सुजवधा प्रदान की जाएगी।” 7. मूल जनयम में, जनयम 12 में,- (क) ईप-जनयम (1) के पश् चात जनम् नजलजखत ईप जनयम ऄंतःस्ट् थाजपत दकया जाएगा, ऄथाधत्;
“(1क) एक भण् डार गृो के जलए ऄनुञप्जिधारी, जनमाधण संयंत्रों से जुडे भण् डार गृो को छोडकर, भण् डार गृो से कम से कम तीस मीटर की दूरी पर भण् डार गृो के पास यूटूटी पर मौजूद सुरक्षा गाडध के जलए एक अरय य प्रदान करेगा”; (ख) ईप जनयम (6) के जलए जनम् नजलजखत ईप-जनयम ऄंतःस्ट् थाजपत दकया जाएगा, ऄथाधत्;
“(6) ऄमोजनयम नाआरेट को जवक्रय के जलए कब् जे में रखने के जलए प्रयुक् त भण् डार गृो का फिध क्षेत्रफल 2.5 मीररक टन ऄमोजनयम नाआरेट के जलए एक 2.5 मीररक टन प्रजतवगध मीटर से कम नोीं ोोगा और भण् डार गृो की कुल धारण क्षमता 5000 मीररक टन से ऄजधक नोीं ोोगी: परंतु पेटीबंद ऄमोजनयम नाआरेट का एक ढेर 500 मीररक टन से ऄजधक कानोीं ोोगा और समीपवतीढेरों के बीच न्‍दयूनतम 2 मीटर का फासला रखा जाएगा और ढेरों तथा भण् डार गृो कीदीवारों के बीच कम से कम 0.6 मीटर चौडा मागधबनाए रखा जाएगा: परंतु और यो दक ढेर की ऄजधकतम उंचाइ ज़मीनी स्ट्तर से 4.0 मीटर से ऄजधक नोीं ोोगी और ईसे भण् डार गृो की दीवारों पर मोटे ऄक्षरों में जचहनांदकत दकया जाएगा"; 8.

म से कम 0.6 मीटर चौडा मागधबनाए रखा जाएगा: परंतु और यो दक ढेर की ऄजधकतम उंचाइ ज़मीनी स्ट्तर से 4.0 मीटर से ऄजधक नोीं ोोगी और ईसे भण् डार गृो की दीवारों पर मोटे ऄक्षरों में जचहनांदकत दकया जाएगा"; 8. मूल जनयम में, जनयम 18 में,- ‘(क) ईप-जनयम (1) के जलए जनम् नजलजखत ईप जनयम रखा जाएगा, ऄथाधत्;
“(1) अयातक द्वारा ऄमोजनयम नाआरेट का अयात केवल पेटीबंद रूप में और केवल बंद रूप में खपत के जलए दकया जाएगा और यदद अवश्यक ोो तो अयातक ईपयुि प ककग के जलए प्ररूप पी2 में व ध ऄनुञप्जि रखने वाले ऄनुञप्जिधारी को ऄजधकृत करेगा।"; (ख) ईप जनयम (2) के जलए, जनम् नजलजखत ईप-जनयम रखा जाएगा, ऄथाधत्;
“(2) पी2 ऄनुञप्जिधारक प्रा्‍ त दकए गए और प्रत् येक प्रेज त दकए गए ऄमोजनयम नआरेट का ऄजभलेख रखेगा तादक जवाबदेोी, पोचान और खोज-खबर और जववरणी प्रस्ट् तुत दकया जाना सुजनज त करने के जलए प्रत्येक अयातक को प्राि और भेजे गए ऄमोजनयम नाआरेट के ररकॉडध बनाए रखा जा सकें।”;

[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण
3 (ग) ईप-जनयम (3) के जलए, जनम् नजलजखत ईप-जनयम रखा जाएगा, ऄथाधत्;
“(3) अयात दकए गए ऄमोजनयम नाआरेट को तत् काल पतन न से जनकालकर पतन न ऄजधसूजचत क्षेत्र से 500 मीटर से ऄजधक दूरी पर जस्ट्थत प्ररूप पी 2 में ऄनुञप््‍ त भंडार गृो में ले जाया जाएगा और ऄनुञप््‍ त भंडार गृो से ऄमोजनयम नाआरेट का प्रे ण केवल पेटीबंद रूप में दकया जाएगा और ऄमोजनयम नाआरेट की प्रत्येक पेटी को जनयम 9 के ऄनुसार जचहनांदकत दकया जाएगा।" 9.

‍ त भंडार गृो में ले जाया जाएगा और ऄनुञप््‍ त भंडार गृो से ऄमोजनयम नाआरेट का प्रे ण केवल पेटीबंद रूप में दकया जाएगा और ऄमोजनयम नाआरेट की प्रत्येक पेटी को जनयम 9 के ऄनुसार जचहनांदकत दकया जाएगा।" 9. मूल जनयम के, जनयम 22 में,- (क) ईप-जनयम (1) के जलए जनम् नजलजखत ईप-जनयम ऄंतःस्ट् थाजपत दकया जाएगा, ऄथाधत्;
“(1) ऄमोजनयम नाआरेट के पररवोन में जवजनयोजजत यान में ऐसे चालकों या क्लीनरों को रखा जाएगा जजनके पूवधवृतन
का सत् यापन पुजलस द्वारा दकया गया ोो और ऐसे चालकों और क्लीनरों के पूणध व यजिक ब् यौरे सजोत एक सूची पुजलस स्ट्टेिन को सत् यापन करने के जलए पोले से ईपलब् ध कराइ जाएगी और ऐसे चालकों और क् लीनरों का पुनसधत् यापन जनयजमत ऄंतराल में, प च व ध में एक बार, दकया जाएगा।"; (ख) ईप-जनयम (2) के जलए जनम् नजलजखत ईप-जनयम ऄंतःस्ट् थाजपत दकया जाएगा, ऄथाधत्; “(2) ऄमोजनयम नाआरेट का वोन करने वाले यान के साथ कम से कम एक सक्षम ऄंगरक्षक ोोना चाजोए। 10. मूल जनयम के, जनयम 27 के, ईप-जनयम (2) में, खण् ड (घ) के पश् चात, जनम् नजलजखत खण् ड ऄंतःस्ट् थाजपत दकया जाएगा, ऄथाधत्; “(ङ) ऄमोजनयम नाआरेट के ईसी ऄजधभोगी के एक पररसर से दूसरे पररसर में स्ट्थानान्‍दतरण के जलए, प्ररूप पी 3 (कब्जे और ईपयोग के जलए) के ऄधीन ऄनुञप्जि प्राजधकारी की पूवध ऄनुमजत से ऐसा कर सकता ो ।" 11. मूल जनयम में, जनयम 29 के, ईप जनयम (1) में,- (i) खण् ड (छ) में, “नौभरण” िब् द का लोप दकया जाएगा। (ii) खण् ड (ञ) का लोप दकया जाएगा। 12.

न ऄनुञप्जि प्राजधकारी की पूवध ऄनुमजत से ऐसा कर सकता ो ।" 11. मूल जनयम में, जनयम 29 के, ईप जनयम (1) में,- (i) खण् ड (छ) में, “नौभरण” िब् द का लोप दकया जाएगा। (ii) खण् ड (ञ) का लोप दकया जाएगा। 12. मूल जनयम के, जनयम 34 में,- (क) ईप-जनयम (4) के जलए, जनम् नजलजखत ईप-जनयम रखा जाएगा, ऄथाधत्; “(4) यथाजस्ट्थजत,जजला प्राजधकारी या खान सुरक्षा मोाजनदेिक, तीन मास की ऄवजध के भीतर यथािक् य िी्र ज च पूरी करेगा और ऐसा प्राजधकारी ऄपना समाधान कर लेने के बाद ऄनुसूची-2 के भाग-4 के प्ररूप ग-2 में ऄनापजतन
प्रमाण-पत्र प्रदान करेगा और आसके साथ ऐसे प्राजधकारी द्वारा सम् यक रूप से ोस्ट् ताक्षररत और मुोर लगा साआट ्‍ लान ोोगा।” (ख) ईप-जनयम (6) के जलए, जनम् नजलजखत खण् ड रखा जाएगा, ऄथाधत्; “(6) यथाजस्ट्थजत, जजला प्राजधकारी या खान सुरक्षा मोाजनदेिक, ऄनापजतन प्रमाण-पत्र या ऄनुञप्जि, यथाजस्ट्थजत, प्रदान करने से ऄपने आंकार की सूचना जलजखत में ईसके कारणों के साथ यथािक् य, िी्र देगा, ककतु अवेदक से अवेदन प्रा्‍ त करने की तारीख से तीन मास की ऄवजध के भीतर अवेदक को देगा।” 13. मूल जनयम में, जनयम 47 के जलए जनम् नजलजखत जनयम रखा जाएगा, ऄथाधत्; “47. जो आन जनयमों के ऄधीन प्रदान की गइ ऄनुञप्जि या ईसकी प्रमाजणत प्रजत खो जाती ो या दुघधटना के कारण न्‍ ट ोो जाती ो , वो जसस्ट्टम जेनरेटेड कॉपी को ऄनुञप्जिधारी द्वारा पेरोजलयम तथा जवस्ट् फोटक सुरक्षा संगठन के ऑनलाआन पोटधल से डाईनलोड दकया जा सकता ो ।” 14.

माजणत प्रजत खो जाती ो या दुघधटना के कारण न्‍ ट ोो जाती ो , वो जसस्ट्टम जेनरेटेड कॉपी को ऄनुञप्जिधारी द्वारा पेरोजलयम तथा जवस्ट् फोटक सुरक्षा संगठन के ऑनलाआन पोटधल से डाईनलोड दकया जा सकता ो ।” 14. मूल जनयम के, जनयम 50 में, ईप-जनयम (1) में, खण् ड (ग) के पश् चात जनम् नजलजखत खण् ड ऄंतःस्ट् थाजपत दकया जाएगा, ऄथाधत्; “(घ)‘(i) ’आस ईप-जनयम में दकसी भी बात के ोोते हुए, सारणी में ऄजधकृत कायधकारी मजजस्ट्रेट या पुजलस ऄजधकारी छो मोीने में एक बार ऄपने ऄजधकार क्षेत्र में जस्ट्थत ऄनुञप््‍ तपररसर का जनरीक्षण करेंगे तादक यो पता लगाया जा सके दक क्या ऄजधजनयम या जनयम का कोइ ईल्लंघन हुअ ो ।

THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] '(ii)' आस तरो के जनरीक्षण के दौरान जनयम 12(1) के ईपजनयम (1) के ऄनुसार ऄनुञप्जिधारी द्वारा भंडार गृो में ईपलब्ध कराए गए सुरक्षा गाडों की पयाधिता के संबंध में अकलन भी दकया जाएगा और आस तरो के जनरीक्षण की एक ररपोटध संबंजधत जजला मजजस्ट्रेट या पुजलस ऄधीक्षक या पुजलस अयुि को प्रस्ट्तुत की जाएगी और एक प्रजत ऄनुञप्ापनप्राजधकारी को भेजी जाएगी ।" 15. मूल जनयम के, जनयम 51 में, ईप-जनयम (2) में, “न्‍ ट कर सकता ो ” िब् दों के स्ट् थान पर “नीलामी करने या न्‍ ट करने की ऄनुमजत दे सकता ो ” िब् दों को रखा जाएगा। 16. मूल जनयम में, ऄनुसूची 1 में, ताजलका में, ऄनुक्रमांक 2 में, स्ट्तंभ 2 में, “नौभरण” िब् द का लोप दकया जाएगा। 17.

्ट् थान पर “नीलामी करने या न्‍ ट करने की ऄनुमजत दे सकता ो ” िब् दों को रखा जाएगा। 16. मूल जनयम में, ऄनुसूची 1 में, ताजलका में, ऄनुक्रमांक 2 में, स्ट्तंभ 2 में, “नौभरण” िब् द का लोप दकया जाएगा। 17. मूल जनयम में, ऄनुसूची 2 में,- (क) भाग 1 में, सारणी में, प्ररूप क-2 में,स्ट्तंभ 2 में, “के नौभरण” िब् द का लोप दकया जाएगा। (ख) भाग 2 में, सारणी में, प्ररूप त-2 में, स्ट्तंभ 2 में, “के नौभरण” िब् द का लोप दकया जाएगा। (ग) भाग 3 में, सारणी में, प्ररूप द-5 में, स्ट्तंभ 2 में, प्रजवजियों के जलए जनम् नजलजखत प्रजतस्ट् थाजपत दकया जाएगा, ऄथाधतः-
“त-2 ऄनुञप्जिधारक द्वाराऄनुरजक्षत दकए जाने वाले खाते के जलए प्ररूप - प्राि और भेजे गए ऄमोजनयम नाआरेट का खाता ।” (घ) भाग 4 में, (i) प्ररूप क-2 के जलए, जनम् नजलजखत प्ररूप क-2 रखा जाएगा, ऄथाधत्:- फामध क -2 (ऄमोजनयम नाआरेट जनयम, 2012 की ऄनुसूची 2 के भाग 1, जनयम 33, 35 और 37 देजख ए) ऄमोजनयम नाआरेट के पेटी बंद और भण् डारण के ऄनुञप्जि ोेतु ऄनुमोदन

(1) These rules may be called the Ammonium Nitrate (Amendment) Rules, 2021.

7 (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Ammonium Nitrate Rules, 2012 (hereinafter referred to as the principal rules), in rule 2,- (i) in clause (o), after the sub- clause (iv) and before the long line, the following shall be inserted, namely:- ‗(v) Government organisation or Central or State Public Sector Undertaking, any officer nominated in writing by that organisation or undertaking.‘; (ii) clause (s) shall be omitted; (iii) in clause (t), for the brackets and letter ―(t)‖, the brackets and letter ―(s)‖ shall be substituted. 3. In the principal rules, in rule 3, in sub-rule (1), the word "stevedoring" shall be omitted. 4.

In the principal rules, in rule 12,- (A) after sub-rule (1), the following sub-rule shall be inserted, namely:- ―(1a) The licensee for a store house shall provide a shelter for the security guard(s) on duty near the store house at a suitable location not less than thirty metres away from the store house except for store house attached to manufacturing plants‖;

shelter for the security guard(s) on duty near the store house at a suitable location not less than thirty metres away from the store house except for store house attached to manufacturing plants‖; (B) for sub-rule (6), the following sub-rule shall be substituted, namely:- ―(6) Any store house used for possession for sale or possession for use of Ammonium Nitrate shall have a floor area not less than one square meter per 2.5 MT of Ammonium Nitrate and the store house holding capacity shall not exceed 5000 MT storage: Provided that one stack of bagged Ammonium Nitrate shall not exceed 500 MT and a minimum clearance of 2 meters shall be maintained between the adjacent stacks and at least 0.6 meters wide gangway shall be maintained between the stacks and the walls of the store house: Provided further that the maximum stack height shall not exceed 4.0 meters from the floor level and the same shall be prominently marked on the walls of the store house.‖; (C) after sub-rule (6), the following sub-rule shall be inserted, namely:- ―(6 A) on and from the commencement of the Ammonium Nitrate (Amendment) Rules, 2021, all flooring in ammonium nitrate storage and handling area shall be without open drains, traps, pits or pocket into which any molten ammonium nitrate is able to flow and be confined in the event of fire and the Ammonium Nitrate storage sheds licensed prior to publication of Ammonium Nitrate (Amendment) Rules, 2021shall adopt the same within one year from the date of publication of that Rules.‖ 8.

In the principal rules, in rule 18, - ‗(A)‘ for sub-rule (1), the following sub-rule shall be substituted, namely:- ―(1) Ammonium Nitrate shall be imported by the importer only in bagged form and for captive consumption only and the importer shall authorize licencee having valid licence in Form P2 for suitable packing if required.‖; (B) for sub-rule (2), the following sub-rule shall be substituted, namely:- ―(2) The P2 Licencee shall maintain records of Ammonium Nitrate received and dispatched to each importer to ensure accountability, identification and traceability and file returns.‖; (C) for sub-rule (3), the following sub-rule shall be substituted, namely:-

In the principal rules, in rule 22,- (A) for sub-rule (1), the following sub-rule shall be inserted, namely:- ―(1) The vehicle engaged in the transport of Ammonium Nitrate, shall be attended by such drivers or cleaners whose antecedents are verified by the police and a list of such drivers and cleaners along with all personal particulars shall be made available to the police station in advance to carry out the verification and the reverification of such drivers or cleaners shall be carried out at regular intervals, once in every five years.‖; (B) for sub-rule (2), the following sub-rule shall be inserted, namely:- ―(2) The vehicle carrying Ammonium Nitrate shall be accompanied by at least one able bodied guard‖. 10. In the principal rules, in rule 27, in sub-rule (2), after clause (d), the following clause shall be inserted, namely:- ―(e) for transfer of the Ammonium Nitrate from one premise to another premise of the same occupier, a licensee under form P3 (for possession and Use) may do so with the prior permission of the Licensing Authority.‖ 11. In the principal rules, in rule 34,- (A) for sub-rule (4), the following sub-rule shall be substituted namely: - ―(4) The District Authority or the Director General of Mines Safety, as the case may be, shall complete the enquiry as expeditiously as possible within a period of three months and such authority shall, after being satisfied, grant no objection certificate in Form C-2 of Part-4 of Schedule-II, along with site plan, duly signed and sealed by such authority.‖; (B) for sub-rule (6), the following sub-rule shall be substituted namely: - ―(6) The District Authority or the Director-General of Mines Safety, as the case may be, shall convey his refusal for granting no objection certificate or licence, as the case may be, with reasons thereof in writing to the applicant as expeditiously as possible but not later than a period of three months from the date of receipt of application from the applicant‖. 13. In the principal rules, for rule 47, the following rule shall be substitute, namely:- ―47. Where a licence granted under these rules or an authenticated copy granted thereof, is lost or accidentally destroyed, system generated copy may be downloaded by the licencee from online portal of Petroleum and Explosives Safety Organisation.‖

In the principal rules, in rule 50, in sub-rule (1), after clause (c), the following clause shall be inserted, namely: - ―(d) ‗(i)‘ Notwithstanding anything contained in this sub-rule, the Executive Magistrates or Police Officers authorised in the table shall carry out inspection of the licensed premises located within their jurisdiction once in six months in order to ascertain if there has been any violation of the Act or the rules thereof. ‗(ii)‘ An assessment regarding adequacy of security guards provided by the licensee at the store house as per sub-rule (1) of rule 12shall also be made during such inspection and a report of such inspection shall be submitted to the concerned District Magistrate or Superintendent of Police or Commissioner of Police with a copy to the licensing authority.‖.
