सा.का.जन. 106 (ऄ).—पेटेंट जनयम, 2003 में और संिोधन करने के जलए, पेटेंट ऄजधजनयम, 1970 की धारा 159 द्वारा प्रदत्त िजियों का प्रयोग करते हुए, केंद्र सरकार जनम्नजलजखत मसौदा जनयम बनाने का प्रस्ट्ताव करती है, जजन्हें आससे प्रभाजवत होने वाले सभी व्यजियों की जानकारी के जलए ईि धारा की ईप-धारा (3) की ऄपेक्षा के ऄनुसार, एतद् द्वारा प्रकाजित दकया जाता है और यह नोरटस ददया जाता है दक ईि मसौदा जनयमों पर, आस ऄजधसूचना को प्रकाजित करने वाले भारत के राजपत्र, जजसमें यह ऄजधसूचना प्रकाजित है, की प्रजतयां, अम लोगों को ईपलब्ध कराए जाने की तारीख से तीस ददनों की ऄवजध समाप्त होने के बाद, जवचार दकया जाएगा; अपजत्तयां या सुझाव, यदद कोइ हों, सजचव, ईद्योग संवधधन और अंतररक व्यापार जवभाग, वाजणज्य और ईद्योग मंत्रालय, भारत सरकार, ईद्योग भवन, नइ ददल्ली- 110011 को या sachin.d@gov.in पर इ-मेल द्वारा भेज ददया जाए; जनर्ददष्ट ऄवजध की समाजप्त से पहले, ईि मसौदा जनयमों के संबंध में दकसी भी व्यजि से प्राप्त होने वाली अपजत्तयों और सुझावों पर केंद्र सरकार द्वारा जवचार दकया जाएगा। मसौदा जनयम 1. (1) आन जनयमों को पेटेंट (संिोधन) जनयम, 2021 कहा जाएगा।

THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. पेटेंट जनयम, 2003 में (जजन्हें आसमें आसके पश्चात मूल जनयम कहा गया है), के जनयम 2 के, ईप-जनयम (ग) के पश् चात जनम् नजलजखत प्रजतस्ट् थाजपत दकया जाएगा नामत: - “(गक) ‘पात्र िैजक्षक संस्ट् थान’ का ऄथध है केंद्र, प्रांत ऄथवा राज् य ऄजधजनयम द्वारा स्ट् थाजपत संस्ट् थान, जजसका स्ट् वाजम‍ व सरकार के पास हो ऄथवा जो सरकार द्वारा जनयंजत्रत हो और पूणध रूप से ऄथवा पयाधप् त रूप से सरकार द्वारा जव‍ त पोजित हो।
व् याख् या:- आस खंड के ईद्देश् य हेतु, ‘पयाधप् त जव‍ त पोिण’ का वही ऄथध होगा जैसा दक जनयंत्रक एवं महालेखा परीक्षक (कतधव् य, िजियां और सेवा ितें) ऄजधजनयम, 1971 (1971 का 56) की धारा 14 की ईप-धारा (1) की व् याख् या में ददया गया है’’

ु, ‘पयाधप् त जव‍ त पोिण’ का वही ऄथध होगा जैसा दक जनयंत्रक एवं महालेखा परीक्षक (कतधव् य, िजियां और सेवा ितें) ऄजधजनयम, 1971 (1971 का 56) की धारा 14 की ईप-धारा (1) की व् याख् या में ददया गया है’’
3. मूल जनयम के जनयम 7 में,
(i) ईप-जनयम (1) में, दूसरे परंतुक हेतु, जनम् नजलजखत परंतुक को प्रजतस्ट् थाजपत दकया जाएगा, नामत: - “बिते दक अगे दकसी छोटी कंपनी ऄथवा स्ट् टाटधऄप ऄथवा पात्र िैक्षजणक संस्ट् थान के मामले में, प्र‍ येक दस्ट् तावेज जजसके जलए िुल् क जनधाधररत दकया गया है, ईसके साथ प्रपत्र-28 को संबद्ध करना होगा” (ii) ईप-जनयम (3) को, जनम्नजलजखत ईप-जनयम से प्रजतस्ट्थाजपत दकया जाएगा, ऄथाधत:-
“(3) ऐसे मामले में जहां दकसी व्यजि, स्ट्टाटधऄप, छोटी कंपनी ऄथवा पात्र िैक्षजणक संस्ट् थान द्वारा दकसी व्यजि, स्ट्टाटधऄप, छोटी कंपनी ऄथवा पात्र िैक्षजणक संस्ट् थान को छोड़कर दकसी ऄन्य व्यजि को पूणधतः या ऄंितः ऄंतररत करने के जलए अवेदन पर कायधवाही की जाती है तो दकसी व्यजि, स्ट्टाटधऄप, छोटी कंपनी ऄथवा पात्र िैक्षजणक संस्ट् थान से ली गइ फीस और व्यजि, स्ट्टाटधऄप, छोटी कंपनी ऄथवा पात्र िैक्षजणक संस्ट् थान को छोड़कर दकसी व् यजि से ली जाने वाली जनजश्चत फीस की मात्रा का ऄंतर, यदद कोइ हो, नए अवेदक द्वारा ऄंतरण के ऄनुरोध के साथ भुगतान दकया जाएगा।”; 4.
मूल जनयम के जनयम 24ग में, ईप-जनयम (1) के खंड (ञ) के पश् चात जनम् नजलजखत खंड को प्रजतस्ट् थाजपत दकया जाएगा नामत: -
“(ट) दक अवेदक एक पात्र िैक्षजणक संस्ट् थान है।”

मूल जनयम के जनयम 24ग में, ईप-जनयम (1) के खंड (ञ) के पश् चात जनम् नजलजखत खंड को प्रजतस्ट् थाजपत दकया जाएगा नामत: -
