वाजणज्य और उद्योग मंत्रालय (उद्योग संवधधन और आंतररक व्यापार जवभाग) अजधसूचना नई दिल्ली, 25 िनवरी, 2021 सा.का.जन. 45(अ).—िबदक, जडिाइन अजधजनयम, 2000 (2000 का 16) की धारा 47 की उप-धारा (3) के अधीन यथापेजित जडिाइन जनयम, 2001 को और संिोजधत करने के जलए कजतपय जनयमों अथाधत्, जडिाइन (संिोधन) जनयम, 2019 के प्रारुप को, भारत के रािपत्र, असाधारण, भाग-II, खण्ड 3, उप-खण्ड (i) में भारत सरकार, वाजणज्य और उद्योग मंत्रालय (उद्योग संवधधन और आंतररक व्यापार जवभाग) की अजधसूचना संख्या सा.का.जन. 798(अ), तारीख 18 अक्टूबर, 2019 द्वारा प्रकाजित दकया गया था; जिसमें ऐसे सभी व्यजियों से, जिनके उससे प्रभाजवत होने की संभावना थी, उि, अजधसूचना वाले रािपत्र की प्रजतयााँ िनसाधारण को उपलब्ध कराए िाने की तारीख से तीस दिन की अवजध की समाजि से पूवध आपजियां और सुझाव आमंजत्रत दकये गये थे;
और िबदक, उि रािपत्र की प्रजतयााँ 19 अक्टूबर, 2019 को िनसाधारण को उपलब्ध करा िी गईं थीं; और िबदक, उि प्रारूप जनयमों के संबंध में िनता से प्राि आपजियां और सुझावों पर केन्द्र सरकार द्वारा जवचार कर जलया गया है;

THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अत: अब, केन्द्र सरकार, जडिाइन अजधजनयम, 2000 की धारा 47 द्वारा प्रिि िजियों का प्रयोग करते हुए, जडिाइन जनयम, 2001 का और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती है, नामत: -

    संजिि नाम और प्रारम्भ :– (1) इन जनयमों को जडिाइन (संिोधन) जनयम, 2021 कहा िाएगा।

(2) ये िासकीय रािपत्र में उनके अंजतम प्रकािन की तारीख से प्रवृि होंगे। 2. जडिाइन जनयम, 2001 (जिसे इसमें इसके पश्चात मूल जनयम कहा गया है) के जनयम 2 में, खंड (ङक) के पश्चात, जनम्नजलजखत खंड अंतःस्ट्थाजपत दकया िाएगा, नामत: -
(ङख) “स्ट्टाटधअप” से अजभप्रेत है- (क) स्ट्टाटध-अप इंजडया पहल के अधीन सिम प्राजधकारी द्वारा स्ट्टाटधअप के रूप में मान्द्यता प्राि भारत की एक इकाई; और (ख) जविेिी इकाई के मामले में, स्ट्टाटध-अप इंजडया पहल के अनुसार व्यापारावतध और अपने जनगमन या पंिीकरण की अवजध संबंधी मानिंड पूरा करने और इस जवषय में उद्घोषणा प्रस्ट्तुत करने वाली एक इकाई। स्ट्पष्टीकरण: व्यापारावतध की गणना करते समय भारतीय ररिवध बैंक की जविेिी मुरा की संिभध िर लागू होंगी।” 3. मूल जनयमों के जनयम 4 में, परंतुक के स्ट्थान पर जनम्नजलजखत परंतुक रखा िाएगा, नामत: - “बिते दक सेवा के जलए ऐसे पते में, एिेंट/आवेिक का ई-मेल पता और भारत में पंिीकृत मोबाइल नंबर िाजमल होगा।”
4. मूल जनयमों के, जनयम 5 के उप-जनयम (2) में,
i.

नजलजखत परंतुक रखा िाएगा, नामत: - “बिते दक सेवा के जलए ऐसे पते में, एिेंट/आवेिक का ई-मेल पता और भारत में पंिीकृत मोबाइल नंबर िाजमल होगा।”
4. मूल जनयमों के, जनयम 5 के उप-जनयम (2) में,
i. खंड (ङ) के स्ट्थान पर जनम्नजलजखत खंड रखा िाएगा, नामत: -
“(ङ) ऐसे मामले में िहां दकसी प्रकृत व्यजि और/या स्ट्टाटधअप और/ या लघु इकाई द्वारा दकए गए दकसी आवेिन की कायधवाही दकसी प्रकृत व्यजि, स्ट्टाटधअप या लघु इकाई से जभन्न दकसी व्यजि को पूणधतः या भागतः अंतररत की िाती है वहााँ उसी जवषय में दकसी प्रकृत व्यजि, स्ट्टाटधअप या लघु इकाई से प्रभाररत िुल्क और प्रकृत व्यजि, स्ट्टाटधअप या लघु इकाई से जभन्न व्यजि से प्रभाररत िुल्क के बीच िुल्कों के मापमान का अंतर, यदि कोई हो, नए आवेिक द्वारा अंतरण के अनुरोध के साथ भुगतान दकया िाएगा।”; ii. खंड (च) का लोप दकया िाएगा। iii. उपजनयम (ङ) के पश्चात, जनम्नजलजखत स्ट्पष्टीकरण अंतःस्ट्थाजपत दकया िाएगा, नामत: - “स्ट्पष्टीकरण- िहां स्ट्टाटधअप अथवा लघु इकाई ने दकसी जडिाइन के जलए कोई आवेिन िायर दकया है, वह अवजध जिसके जलए सिम प्राजधकारी द्वारा मान्द्यता प्राि है, उस के बीत िाने के उपरांत या बाि में उसका व्यापारावतध के सिम प्राजधकारी द्वारा अजधसूजचत जविीय सीमा पार कर लेने पर, िुल्क के मापमान में दकसी अंतर का भुगतान नहीं करना होगा।” 5. मूल जनयमों के जनयम 10 में, उप-जनयम (1) के स्ट्थान पर जनम्नजलजखत उपजनयम को रखा िाएगा, नामत: -
“जडिाइन के पंिीकरण और इन जनयमों, के प्रयोिनों के जलए, वस्ट्तुओं को जवश्व बौजिक सम्पिा संगठन (वायपो) द्वारा प्रकाजित “औद्योजगक जडिाइन का अंतराधष्ट्रीय वगीकरण (इंटरनेिनल क्लाजसदिकेिन िॉर इंडजस्ट्रयल जडिाइन) (लोकानो वगीकरण)” के वतधमान संस्ट्करण के अनुसार अनु्छेेिों को वगीकृत दकया िाएगा।”

ठन (वायपो) द्वारा प्रकाजित “औद्योजगक जडिाइन का अंतराधष्ट्रीय वगीकरण (इंटरनेिनल क्लाजसदिकेिन िॉर इंडजस्ट्रयल जडिाइन) (लोकानो वगीकरण)” के वतधमान संस्ट्करण के अनुसार अनु्छेेिों को वगीकृत दकया िाएगा।”

[भागII—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 बिते दक दकसी जडिाइन का पंिीकरण अजधजनयम के उपबंधों, जविेषकर धारा 2 (क) और 2 (घ) को पूरा दकए िाने के अध्यधीन होगा।”
6. मूल जनयमों में, पहली अनुसूची के स्ट्थान पर जनम्नजलजखत अनुसूची रखी िाएगी, नामत:- पहली अनुसूची (जनयम 5 िेखें) िुल्क प्रजवजष्ट की सं. जनम्नजलजखत पर संिेय सुसंगत प्ररूप की सं. िुल्क(रुपए में) प्रकृत व्यजि(यों) और/ या स्ट्टाटधअप(प्स) और/ या लघु इकाई(यों) के जलए

लघु इकाई अथवा स्ट्टाटधअप के रूप में जस्ट्थजत की बाबत तथ्यों की गलत सूचना/ गलत व्याख्या के आधार पर िुल्क में कमी का िायिा लेने का यह अजभप्राय होगा दकजनयम 5(2)(ख) द्वारा यथा आिेिाधीन िस्ट्तावेज़ के साथ संपूणध िुल्क नहीं है। ऐसे मामले में धारा 24(2) के अनुसार िस्ट्तावेि का िायर दकया िाना तब तक प्रभावी नहीं होगा िब तक िुल्क का पूणधतया भुगतान नहीं कर दिया गया हो।
लघु इकाई अथवा स्ट्टाटधअप के रूप में जस्ट्थजत के बारे में कोई जमथ्या सुझाव याजमथ्या प्रस्ट्तुजत करके जडिाइन रजिस्ट्टर में प्रजवष्ट पंिीकृत जडिाइन पर जडिाइन अजधजनयम, 2000 की धारा 31 के उपबंध लागू हो सकेंगे।”

    मूल जनयमों में, तीसरी अनुसूची का लोप दकया िाएगा।

    मूल जनयमों में, चौथी अनुसूची के  स्ट्थान पर जनम्नजलजखत अनुसूची को रखा िाएगा, नामत::-

“चौथी अनुसूची (जनयम 43 िेखें) जनयंत्रक के समि कायधवाजहयों में अनुज्ञेय खचों का मापमान प्रजवजष्ट की सं.

मूल जनयमों में, चौथी अनुसूची के स्ट्थान पर जनम्नजलजखत अनुसूची को रखा िाएगा, नामत::- “चौथी अनुसूची (जनयम 43 िेखें) जनयंत्रक के समि कायधवाजहयों में अनुज्ञेय खचों का मापमान प्रजवजष्ट की सं. वे जवषय जिनकी बाबत खचध अजधजनणीत दकया िाएगा राजि (रुपए में) प्रकृत व्यजि(यों)

(Department for Promotion of Industry and Internal Trade) NOTIFICATION New Delhi, the 25th January, 2021 G.S.R. 45(E).—Whereas, the draft of certain rules, namely, the Designs (Amendment) Rules. 2019 further to amend the Design Rules, 2001 were published, as required under sub-section (3) of section 47 of the Designs Act, 2000 (16 of 2000), vide notification of the Government of India in the Ministry of Commerce and Industry (Department for Promotion of Industry and Internal Trade) number G.S.R.

of the Designs Act, 2000 (16 of 2000), vide notification of the Government of India in the Ministry of Commerce and Industry (Department for Promotion of Industry and Internal Trade) number G.S.R. 798(E), dated 18th October, 2019, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of a period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public; And whereas, the copies of the said Gazette were made available to the public on the 19th day of October, 2019; And whereas, the objections and the suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 47 of the Designs Act, 2000, the Central Government hereby makes the following rules further to amend the Designs Rules, 2001, namely:-

Short title and commencement:- (1) These rules may be called the Designs (Amendment) Rules, 2021. (2) They shall come into force from date of their final publication in the Official Gazette.

In rule 2 of the Designs Rules 2001, (hereinafter referred to as the principal rules), after clause (ea), the following clause shall be inserted, namely:- ‘(eb) “startup” means- ‘(a) an entity in India recognised as a startup by the competent authority under Startup India initiative; and (b) in case of a foreign entity, an entity fulfilling the criteria for turnover and period of incorporation or registration as per Startup India Initiative and submitting declaration to that effect. Explanation: In calculating the turnover, reference rates of foreign currency of the Reserve Bank of India shall prevail.’

In rule 4 of the principal rules, for the proviso, the following proviso shall be substituted, namely:-

In rule 5 of the principal rules, in sub-rule (2), (i) for the clause (e), the following clause shall be substituted, namely:- “(e) In case an application processed by a natural person and/ or startup and/ or small entity is fully or partly transferred to a person other than a natural person, startup or small entity, the difference, if any, in the scale of fees between the fees charged from the natural person, startup or small entity and the fees chargeable from the person other than a natural person, startup or small entity in the same matter, shall be paid by the new applicant with the request for transfer.”:

(ii) clause (f) shall be omitted.

(iii) after sub-rule (e), the following explanation shall be inserted namely:-
“Explanation--Where a startup or small entity, having filed an application for a design, ceases to be a startup or small entity due to the lapse of the period during which it is recognised by the competent authority, or its turnover subsequently crosses the financial threshold limit as notified by the competent authority, no such difference in the scale of fees shall be payable”. 5.

Availing of benefit of reduction in fee on the basis of incorrect information/misrepresentation of facts with regard to status as a small entity or startup would mean that the entire fee did not accompany the document, as mandated by rule 5(2)(b). In such a case, in accordance with section 24(2), the filing of the document shall be of no effect unless the fee has been fully paid.
