वाजणज्य और ईद्योग मंत्रालय (ईद्योग संवधधन और अंतररक व्यापार जवभाग) ऄजधसूचना नइ ददल्ली, 4 नवम् बर, 2020 सा.का.जन. 689(ऄ).—पेटेंट ऄजधजनयम, 1970 (1970 का 39) की धारा 159 की ईपधारा (3) के ऄधीन पेटेंट जनयम, 2003 का और संिोधन करने के जलए कजतपय जनयमों के प्रारूप को ऐसे सभी व्यजियों से, जजनके ईनसे प्रभाजवत होने की संभावना है, ऄजधसूचना वाले राजपत्र की प्रजतयााँ जनसाधारण को ईपलब्ध कराए जाने की तारीख से तीस ददन की ऄवजध की समाजि से पूवध अपजि और सुझाव अमंजत्रत करने के जलए भारत के राजपत्र, ऄसाधारण, भाग-II, खण्ड 3, ईपखण्ड (i) में भारत सरकार के वाजणज्य और ईद्योग मंत्रालय, (ईद्योग संवधधन और अंतररक व्यापार जवभाग) की ऄजधसूचना संख्या सा.का.जन. 799 (ऄ), तारीख 18 ऄिूबर, 2019 द्वारा प्रकाजित दकया गया था;
और ईि राजपत्र की प्रजतयााँ 18 ऄिूबर, 2019 को जनसाधारण को ईपलब्ध करा दी गईं थीं; और ईि प्रारूप जनयमों के संबंध में जनता से प्राि अपजियों और सुझावों पर केन्द्रीय सरकार द्वारा जवचार दकया गया है;
ऄत: ऄब, केन्रीय सरकार, पेटेंट ऄजधजनयम, 1970 (1970 का 39) की धारा 159 द्वारा प्रदि िजियों का प्रयोग करते हुए, पेटेंट जनयम, 2003 का और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती है, ऄथाधत:-

1. संजिि नाम और प्रारम्भ – (1) आन जनयमों का संजिप्त नाम पेटेंट (जद्वतीय संिोधन) जनयम, 2020 है। (2) ये राजपत्र में ईनके प्रकािन की तारीख को प्रवृि होंगे।

(i) ईप-जनयम (3) को जनम्नजलजखत ईप-जनयम से प्रजतस्ट्थाजपत दकया जाएगा, ऄथाधत:-
“(3) ऐसे मामले में जहां दकसी प्रकृत व्यजि ऄथवा स्ट्टाटधऄप ऄथवा छोटी कंपनी द्वारा दकसी व्यजि, स्ट्टाटधऄप ऄथवा छोटी कंपनी को छोड़कर दकसी प्रकृत व्यजि को पूणधतः या ऄंितः ऄंतररत करने के जलए अवेदन पर कायधवाही की जाती है तो दकसी प्रकृत व्यजि, स्ट्टाटधऄप ऄथवा छोटी कंपनी से ली गइ फीस और प्रकृत व्यजि, स्ट्टाटधऄप ऄथवा छोटी कंपनी को छोड़कर दकसी व् यजि से ली जाने वाली जनजश्चत फीस की मात्रा का ऄंतर, यदद कोइ हो, नए अवेदक द्वारा ऄंतरण के ऄनुरोध के साथ भुगतान दकया जाएगा।”; (ii) ईप-जनयम (3क) का लोप दकया जाएगा;
(iii) ईप-जनयम (3ख) का लोप दकया जाएगा; (iv) ईप-जनयम (3) के पश्चात, जनम्नजलजखत स्ट्पष्टीकरण को जोड़ा जाएगा, ऄथाधत:-
“स्ट्पष्टीकरण- जहां स्ट्टाटधऄप ऄथवा छोटी कंपनी ने पेटेंट अवेदन फाआल दकया है लेदकन सिम प्राजधकारी द्वारा स्ट्वीकृत ऄवजध के बीत जाने के कारण स्ट्टाटधऄप ऄथवा छोटी कंपनी नहीं रह जाती है ऄथवा ईसका कारोबार सिम प्राजधकारी द्वारा ऄजधसूजचत जविीय सीमा को पार कर जाता है तो ऐसे मामले में फीस की मात्रा में अए दकसी ऄंतर का भुगतान नहीं करना होगा।”; (v) ईप-जनयम (3ख) के स्ट्पष्टीकरण का लोप दकया जाएगा।

बार सिम प्राजधकारी द्वारा ऄजधसूजचत जविीय सीमा को पार कर जाता है तो ऐसे मामले में फीस की मात्रा में अए दकसी ऄंतर का भुगतान नहीं करना होगा।”; (v) ईप-जनयम (3ख) के स्ट्पष्टीकरण का लोप दकया जाएगा।
3. मूल जनयम में, पहली ऄनुसूची की सारणी 1 को जनम्नजलजखत सारणी से प्रजतस्ट्थाजपत दकया जाएगा, ऄथाधत:-

And whereas, copies of the said Official Gazette were made available to the public on the 18th day of October, 2019; And whereas, the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government;
