Agenda for the 110" meeting of the Board of Approval to be held on 26" May, 2022 through Video Conferencing

110.1 Ratification of the minutes of the 109" meeting of the Board of Approval held on 31.03.2022.

110.2 Request for extension of LoA of the Developer (one proposal) 110.2(i) Proposal of M/s. Venkatesh Coke and Power Limited for extension of the validity period of formal approval granted for setting up of FTWZ at Athipattu, Nandianbakkam & Puzhuthivakkam Villages, Ponneri Taluk, Thiruvallur District, Tamil Nadu beyond 02.07.2022. Date of LoA : 03.07.2017 LoA valid upto : 02.07.2022 Extensions granted earlier: The developer has been granted two extensions. Extension sought : The developer has requested for further extension upto 02.07.2025. over M/s Venkatesh Coke & Power Ltd. had been granted formal approval for setting up FTWZ the an area of 46.71 Ha. The SEZ has not been notified so far. The formal approval was granted with condition that the encumbrance of Rs.6.5 cr to be settled before notification of the FTWZ and to fulfil the contiguity issues as per Instruction no.27 dated 18.08.2009. On expiry of initial validity period i.e. beyond 02.07.2020, they have been granted two extensions upto 02.07.2021 and 02.07.2022 respectively.

DC, MEPZ has informed that the developer has made a request for extending their formal approval for 3 more years i.e. from 02.07.2022 to 02.07.2025. During the current extension period, despite the pandemic when operations were affected nationwide, they have entered into a Memorandum of Understanding with a potential on the property. In addition, they also have signed a binding MoU with one Multinational Company to start their multinational trading in India from their FTWZ. The commitments of investment are subject to the notification of their FTWZ. the As regards status of settlement of encumbrance by the developer, DC has informed that though developer has taken steps for legal remedy in the matter, the status of encumbrance remains the same. As per the developer, they have approached the court to issue the direction to the Sub-Registrar Office (SRO) to remove the encumbrance charges against their properties, for which they have duly secured a court order. They have further applied to the relevant courts for directions to the SRO to remove the encumbrance markings and provide them the clear encumbrance certificates. U pon receiving the clear encumbrance certificates, they shall deposit the same to satisfy the conditions of the formal approval and further implement the project.

DC has further informed that in order to minimize the impairment of opportunity and to avoid any further delay, the developer proposes to reduce the FTWZ land to an extent of 5 acres and set aside the same specifically for any exigency arising due to the encumbrance charges. Accordingly, the propose to exclude the same from their total FTWZ lands, for the satisfaction of the encumbrances as set out in the formal approval, and if deemed appropriate the balance land admeasuring approx. 110 acres can be notified as a FTWZ. Since current scenario is business favourable, the infrastructure work could be undertaken immediately after the notification. In view of the above, they have requested to consider their proposal for notification.

Detailed reasons for delay: -

The Unit has completed construction work during the month of May 2017 and invested approximately Rs.483.00 lakh. During construction, they have faced protests from local farmers, which were resolved amicably through negotiation. They have not availed any kind of bank facility/loan and spent out from their internal accruals. Due to the implementation of GST and the Covid-19 pandemic, their business slowed down, which led to financial crisis.

Recommendation by DC, CSEZ:

The unit has submitted that there is lot of Opportunity in soft will line as the import of goods from China is disturbed. The Unit has given an undertaking that they Nos. initially generate employment of 650 Nos. and will increase the employment to 2000 Hence, the request of the unit for extension of the validity of Letter of Approval upto 13.10.2022 is recommended for consideration.

Detailed reasons for delay: - The The unit submitted that the matter is sub-judice, pending before the High Court of Karnataka. City Civil Court dismissed the petition filed by the Contractor vide Judgement dated 09.06.2021. Against this, the Contractor filed appeal before the Hon’ble High Court of Karnataka (Case No. Commercial appeal No.137/2021 & 138/202). M/s BEML has filed their objections. Further, the Unit informed that the tender for Electrical works was finalized, but the work order was not issued to the Contractor due to non-execution of Civil and PEB work. The project is at a standstill due to pending litigation.

Recommendation by DC, CSEZ:

Recommended for extension of the validity of Letter of Approval for a further period of one year up to 04.01.2023. However, the company has to take proactive measures to settle the litigation and implement the project with the involvement of the higher authorities from their controlling Ministry.

Earlier, M/s. Cybage Software Private Limited was approved as SEZ unit vide LoA dated 29.01.2019 for IT/ITES services. The said entity commenced operations with effect ftom 10.05.2019 and their cumulative exports as on 31.03.2021 is Rs.86.90 crores with positive NFE and employment generation for over 300 persons. The said approved unit is currently operating from the space allotted in another co-developer building i.e. Brigade International Financial Centre, GIFT SEZ, Gandhinagar. The said entity shall continue as SEZ unit in GIFT SEZ, Gandhinagar. As such, this is a separate application for co-developer status for which approval of the BoA has been sought.

Recommendation by DC, GIFT SEZ:-

In view of the satisfactory performance in SEZ and increase in economic activity and other developments at GIFT-SEZ, Gandhinagar, DC has recommended the proposal of M/s. The Developer M/s. GIFT SEZ Limited had sought approval for creation of dual use area in the non-processing area of the notified SEZ over an area of 25.8353 hectares. The Government of Gujarat vide their letter dated 07.10.2021 had granted No Objection Certificate to the developer for the dual use area in the Non-processing area of 63.84 acres (25.8353 hectares). The said proposal was approved by the Board of Approval in its 108" meeting held on 27.01.2022 and approval was issued by the DoC on 08.02.2022 under Rule 11A of the SEZ Rules, 2006.

The draft lease agreement is for 99 years and provisional letter of allotment for development of Residential sub project over land area admeasuring 4790 square meters (0.479 hectares) with Development Rights of 3,23,000 square feet for residential project.

It was observed that as per the physical inspection report, the ITI (Industrial Training Institute) is within the earmarked Industrial land and the Rajiv Gandhi University Off Campus approved by State Govt. is also situated in the Balinong area. Director, Trade & Commerce, Govt. of Arunachal Pradesh vide letter dated 24.03.2022 informed that the Industrial Training Institute (ITI) and the Rajiv Gandhi University off campus approved by the State Govt. do not fall within the 30.20 Ha land earmarked for setting up of SEZ at Balinong. The proposed land is a vacant land where no functional ports, structures in which any commercial or economic activity is in progress, and hence fulfils the criteria of Rule 2(zf) of the SEZ Rules, 2006. DC, FSEZ has endorsed the same.

## Recommendations of DC: - 

DC, FSEZ has recommended the proposal for consideration of the BoA in terms of Rule 3 of the SEZ Rules, 2006. 

110.5(ii) Proposal of M/s. DLF Limited for setting up an IT/ITES SEZ over an area of 12.612 Ha at Village Kherki Daula, Tehsil- Manesar, Distt- Gurugram (Haryana). The proposal of M/s. DLF Limited for setting up an IT/ITES SEZ over an area of 20.02 Ha at above mentioned location was earlier placed before the BoA in its 106'" meeting held on 07.10.2021 for its consideration. The Board was informed that there is a 66 Feet wide Bitumen Road at Khasra No. 67/15, 68/20 & 68/21 of Village Kherki Daula and a 33 Feet wide Bitumen Road at No. 2394. 2395 & 2398 of Village Shikohpur existing at proposed SEZ land. The Board noted that there are some contiguity issues in the proposal. Accordingly, DC, NSEZ desired to withdraw the proposal, which was allowed by the Board with direction to submit the revised proposal. 

The physical inspection of the proposed SEZ land was earlier conducted by DC, JDC, ADC NSEZ along with Patwari, Villages — Kherki Daula and Shikohpur and representatives of M/s. DLF Ltd. As per the Inspection report, there was a bitumen road that cuts across the SEZ.

Now, the Developer has excluded the non-contiguous land pertaining to Village Shikohpur and land of 66 ft. wide road. Besides, a piece of land having Khasra No. 63/14 of Village Kherki Daula, surrounded by the proposed SEZ land has been excluded. The developer has informed that they are in process of getting the lease deed executed for the said land, which will be later applied for addition in the SEZ. However, for the time being, they propose 3.35 Mtrs. wide access to the said land from their adjoining leased land. A High Tension (HT) electricity line crossing over the proposed SEZ land was also found. They will construct boundary wall all around the said land and the proposed access will be constructed so that contiguity of proposed SEZ is maintained. 

Now, M/s. DLF Ltd. has submitted a revised proposal for setting up of IT/ITES SEZ on revised area of 12.612 Ha (earlier 20.02 Ha) at Village Kherki Daula, Tehsil-Manesar, DisttGurugram (Haryana), by excluding the non-contiguous land of Village Shikohpur and land of 66ft. wide road.

As per 3 & 4" proviso to Rule 27(1) of the SEZ Rules, 2006, the item prohibited for import can be procured by SEZ from a place outside India with the prior approval of BoA and supply of restricted items by a DTA unit to SEZ is also permissible with the approval of the BoA. There is no explicit rule for import of restricted items to be allowed by the BoA. DoC Earlier w.r.t. the proposal of the said unit for allowing inclusion of ‘Restricted items’ in LoA, had obtained comments from DGFT/ MHA/ DGEP before seeking approval of the BoA, DC, NSEZ has stated that since the proposed items relate to fire arms, comments of nodal departments like DGFT/ MHA/ DGEP are desirable for consideration by the Board of Approval.

DGFT: Vide OM dated 19.02.2021(pg.19/C) DGFT had referred to their OM dated 22.04.2019 further referring to their inputs vide OM dated 29.08.2018 in the earlier proposal of the unit wherein DGFT had stated that these are military weapons//arms/armaments. All these have security implications as far as DTA is concerned. That is why these are subject to very elaborate licensing system for the DTA. Though SEZ units are allowed restricted items, these items are not normal tradeable goods. BoA has to take a decision after security clearance from MHA and MOD. DGFT has stated that they have sent the comments under FT (D&R) Act, 1992 / FTP, 201520.

Also same products are stocked also for Sports Authorities, e.g., Sports Authority of Gujarat, Madhya Pradesh, Karnataka, etc. for timely supply to ensure good quality equipment to be used by athletes in international championships. One more reason is also to stock parts for deferred payment of custom duty as and when its required by DTA unit for manufacturing.

M/s Ambika Scrap Recycling Pvt. Ltd. was issued another LoA on 10.03.1998 for setting up a manufacturing unit for Plastic Granules/Flakes/Agglomerates Pellets/Bars and Articles thereof from imported plastic waste material with total capacity of 8000 MT for a five-year period but the unit could not commence its authorized activity in respect of plastic recycling falling under this LoA.

After passing of several years, the unit has requested for revival of their unit condoning inactive years which was due to the reason of natural calamity and problems to the then existing directors. The Unit has also undertaken that they will pay all the government dues before issuance of their (renewed) LoA. As per Rule 18(4) of the SEZ Rules, No proposal shall be considered for—

DC, KASEZ had referred following two precedence which were revived after a long year of

M/s R.R Vibrant Polymers Limited: The unit was issued LoA on 27.11.1996 for manufacturing of recycled polymer pellets of LDPE/HDPE/PP/PVC/ABB and further broad-banded on 07.08.1997 for manufacturing of Agglomerates and was operating successfully till fire broke out on 27.05.2000. Soon thereafter an earthquake occurred on 26.01.2001 and the unit could not continue/revive its operation. The said unit was granted approval for revival and renewal of the LoA after 15 years in the 68 “BoA meeting held on 30.12.2015.

M/s Anita Exports: The unit was issued LoA for manufacturing of Plastic-Bags- Garbage Collection/ Carry/ Shopping Bags etc. and continued their operation till 2005-06 but could not carry out any activity under the plastic recycling business after 2005-06. The LoA of the unit was renewed in the light of directions dated 18.04.2019 of the Hon’*ble High Court of Gujarat for further period up to 31.05.2020 (at par with other plastic recycling units) and the same was ratified by the BoA in its 95 " BoA Meeting held on 14.02.2020. The LoA of the said units has been further extended by the BoA in its 104 " meeting held on 28.05.2021 in light of the policy dated 27.05.2021 issued by the DoC in respect of the worn and used clothing units and the plastic recycling units.

It has been further informed that the unit had filed an appeal before the Gujarat Value Added Tax Tribunal at Ahmedabad and Gujarat Value Added Tax Tribunal, vide its judgement dated 05.01.2016, allowed the appeals of the unit and ruled in favour of the unit. The unit has stated this to be the reason for being non-operational as the VAT authorities had visited their business premises and has seized the accounting materials/records and had also frozen their bank account. DC, KASEZ has recommended the request of M/s. Ambika Scrap Recycling Pvt. However, nothing is on record which would substantiate the fact that the said LoA has been cancelled/revoked. Further, that in case of M/s R.R. Vibrant Polymers Ltd., KASEZ which is a precedent the unit was issued LoA on 27.11.1996 for manufacturing of recycled polymer pellets and further broad-banded on 17.08.1997 for manufacturing of agglomerates was operating successfully till fire broke out their factory on 27.05.2000 and soon thereafter earthquake occurred on 26.01.2001. The unit could not continue/revive its operation and was evicted on 31.03.2005. The said unit was granted approval for revival and renewal of LoA in the 6 “ meeting held on 30.12.2015.

The proposal was placed before the Board of Approval in its 107" meeting held on 25.11.2021 wherein the DoR had observed that the agenda involved complex issues and requested for details/documents w.r.t. the case of M/s Ambika Scrap Recycling Pvt. Ltd. and those referred to by the unit. The Board, after deliberations, decided to treat the proposal as withdrawn and directed DC, KASEZ to re-examine the case and re-submit a consolidated proposal so that the same may be taken up with the DoR along with all necessary documents specified by DoR. The matter has been taken up with DGEP after receipt of proposal from DC, KASEZ. Subsequently, as requested by DoR vide their OM dated 19.04.2022, this department had vide OM dated 28.04.2022 furnished its comments on the clarification sought by DGEP. As regards import quantum for plastic waste and metal scrap recycling units, DGFT has been requested to send their comments to DGEP.

110.6(iii) Request of M/s. Persipina Developers Pvt. Ltd. for increase in area of 1.56 Ha (beyond 10%) to their ITITES SEZ at Village Bhokarpada, Taluka-Panvel, District-Raigad, Maharashtra over an area of 5.04 Ha.

M/s. Sunny Vista Realtors Pvt. Ltd. was granted formal approval on 15.10.2007 for setting up of a multi-services SEZ at Village- Bhokarpada, Taluka-Panvel, District-Raigad, Maharashtra. The SEZ was later notified vide Gazette Notification dated 19.02.2009 over an area of 139.83 Ha. Subsequently, the request of the Developer for change of ownership from M/s. Sunny Vista Realtors Pvt. Ltd. to M/s. Persipina Developers Pvt. Ltd. was approved on 01.07.2015. The request of the Developer for change of sector from multi-services to IT/ITES was approved in the 84" meeting of the BoA held on 12.09.2018. An area of 134.79 Ha of the SEZ was de-notified vide Gazette Notification dated 17.01.2019. The SEZ stands over an area of 5.04 (139.83-134.79) Ha at present.

In compliance of DoC’s Instruction No.102 dated 18.11.2019 regarding physical inspection and contiguity condition, the Inspection Report has been provided. Against the proposed 1.56 Ha of land, 1.1977 Ha will be used for exclusive road approaching SEZ and in the balance area of 0.3665 Ha, power station has been installed for un-interrupted power supply. However, it was observed that since the contiguity could not be maintained at the power station, the Developer has proposed over bridge construction to comply with the contiguity requirement. The over bridge shall be connecting the existing SEZ area with the power stations and shall not be accessible from DTA area.
