ईपधारा (2) के खंड (ङ) और खंड (च) के साथ परठत ईपधारा (1) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, और बायलर प्रचालन जनयम, 2021 का ऄजधक्रमण करते हुए, ईन बातों के जसवाय जजन्द्हें ऐसे ऄजधक्रमण से पूवध दकया गया है या करने का लोप दकया गया है, जनम्नजलजखत जनयम बनाती है, ऄथाधत्:-
ऄध्याय 1 प्रारंजभक

संजिप्त नाम और प्रारंभ.— (1) आन जनयमों का संजिप्त नाम बायलर प्रचालन आंजीजनयर जनयम, 2025 है। (2) ये राजपत्र में ईनके प्रकािन की तारीख को प्रवृत्त होंगे।
पररभाषाएं.— आन जनयमों में, जब तक दक संदभध से ऄन्द्यथा ऄपेजित न हो,- (क) “ऄजधजनयम” से बायलर ऄजधजनयम, 2025 (2025 का 12) ऄजभप्रेत है;
(ख)

“ऄध्यि” से सजमजत का ऄध्यि ऄजभप्रेत है;
(घ)
“मुख्य जनरीिक” दक वही ऄथध होगा जो बायलर ऄजधजनयम, 2025 (2025 का 12) की धारा 2 के खंड (ङ) के ऄधीन है;
(ङ)
“सजमजत” से आन जनयमों के ऄधीन गरठत परीिक सजमजत ऄजभप्रेत है;
(च)
“प्ररूप” से आन जनयमों से ईपाबद्ध प्ररूप ऄजभप्रेत है;
(छ) “सरकार” से राज्य सरकार या संघ राज् यिेत्र का प्रिासन ऄजभप्रेत है;
(ज)
“सजचव” से सजमजत का सजचव ऄजभप्रेत है;
(झ)
“धारा” से ऄजधजनयम की धारा ऄजभप्रेत है;
(ञ)
आन जनयमों में दकसी बायलर या बायलरों के प्रजत प्रत् येक संदभध के बारे में यह समझा जाएगा दक आसके ऄंतगधत आकॉनामाइजर या आकॉनामाइजरों के संदभध िाजमल हैं।
(2) आस ऄजधजनयम में प्रयुक् त ि्‍ द और या पद, ककतु जो पररभाजषत नहीं हैं, का वही ऄथध होगा जो ईनका ऄजधजनयम में है। ऄध्याय 2 साधारण 3.

क आसके ऄंतगधत आकॉनामाइजर या आकॉनामाइजरों के संदभध िाजमल हैं।
(2) आस ऄजधजनयम में प्रयुक् त ि्‍ द और या पद, ककतु जो पररभाजषत नहीं हैं, का वही ऄथध होगा जो ईनका ऄजधजनयम में है। ऄध्याय 2 साधारण 3. बायलर के प्रचालन का पयधवेिण—दकसी एकल बायलर या बैटरी में जुडे हुए दो या ऄजधक बायलरों या दकसी ऄन्द् य दिा में एक हजार वगधमीटर से ऄजधक कुल तापन सतह वाले 50 मीटर की पररजध के भीतर जस्ट्थत पृथक् व्यजिक बायलरों का स्ट्वामी तब तक ईसका ईपयोग नहीं करेगा या ईसके ईपयोग की ऄनुज्ञा नहीं देगा जब तक बायलर या बायलरों को, आन जनयमों में यथाजवजनर्ददि ऐसी संख्या में बायलर पररचालकों के ऄजतररि जनयम 4 में जवजनर्ददि सिम व्यजि के प्रत्यि प्रभार में न रखा जाए : परंतु मुख्य जनरीिक, आन जनयमों में ऄंतर्ववि दकसी प्रजतकूल बात के होते हुए भी दकसी बायलर पररचालक को तीन मास की ऄजधकतम ऄवजध के जलए बायलर का प्रभारी बने रहने की ऄनुज्ञा दे सकेगा :
परंतु यह और दक आन जनयमों की कोइ बात, बायलर पररचर जनयम, 2025 के ऄधीन प्रदत्त प्रथम श्रेणी सिमता प्रमाण पत्र धारण करने वाले दकसी व्यजि को हाजजर होने और दकसी अकार के बायलर या बायलरों के भारसाधक होने से जववर्वजत नहीं करेगी और आन जनयमों के प्रयोजन के जलए ऐसा कोइ प्रमाण पत्र आन जनयमों के ऄधीन प्रदत्त दकया गया समझा जाएगा ।
4. सिम व्यजि प्रमाण पत्र रखेगा और ऄहधता को बढाना.— दकसी ऐसे व्यजि को, जजसके पास आन जनयमों के ऄधीन बायलर प्रचालन आंजीजनयर के रूप में प्रवीणता प्रमाण पत्र नहीं है, जनयम 3 में ऄजधकजथत सीमाओं वाले बायलर या बायलरों का प्रभार धारण करने के जलए ईजचत और ईपयुि व्यजि नहीं समझा जाएगा ।

जनयमों के ऄधीन बायलर प्रचालन आंजीजनयर के रूप में प्रवीणता प्रमाण पत्र नहीं है, जनयम 3 में ऄजधकजथत सीमाओं वाले बायलर या बायलरों का प्रभार धारण करने के जलए ईजचत और ईपयुि व्यजि नहीं समझा जाएगा ।
5. प्रमाण पत्र का प्रस्ट्तुत करना— आन जनयमों के ऄधीन प्रवीणता प्रमाण पत्र धारण करने वाला बायलर प्रचालन आंजीजनयर, जब ईससे, ऄजधजनयम के ऄधीन प्रदत्त दकसी प्रमाण पत्र या ऄनंजतम अदेि प्रस्ट्तुत करने हेतु मांग करने के जलए धारा 20 के ऄधीन सिि व्यजियों में से दकसी के द्वारा ऐसा करने के जलए कहा जाता है तो ईसके प्रभार या हाजजरी में दकसी बायलर की ऄवजध के दौरान सभी युजियुि समयों पर ऐसा प्रमाण पत्र प्रस्ट्तुत करने के जलए अबद्ध होगा।
6. स्ट्वामी द्वारा मुख्य बायलर जनरीिक या जनदेिक को प्रमाण पत्र का जववरण प्रस्ट्तुत करना.— (1) दकसी बायलर का स्ट्वामी, जो दकसी व्यजि को ईसका भारसाधक जनयुि करता है, ऐसी जनयुजि के सात ददन के भीतर यथाजस्ट् थजत बायलरों के

मुख्य जनरीिक या जनदेिक को, ऐसे व्यजि का पूणध जववरण, जजसके ऄंतगधत ईसके प्रमाण पत्र की क्रम संख्या, तारीख और जारी करने का स्ट्थान भी है, प्रस्ट्तुत करेगा ।
(2) दकसी बायलर का ऐसा स्ट्वामी, जो दकसी ऐसे ऄन्द् य व्यजि के स्ट्थान पर, जो ईपजनयम (1) के ऄधीन ईक् त बायलर का भारसाधक था, ऐसे व्यजि द्वारा ऄपना जनयोजन छोडे जाने की दिा में या ऐसे व्यजि की मृत्यु की दिा में, जैसा भी मामला हो, बायलरों के मुख्य जनरीिक या जनदेिक को सात ददन के भीतर ईस तथ्य की ररपोटध करेगा।

भारसाधक था, ऐसे व्यजि द्वारा ऄपना जनयोजन छोडे जाने की दिा में या ऐसे व्यजि की मृत्यु की दिा में, जैसा भी मामला हो, बायलरों के मुख्य जनरीिक या जनदेिक को सात ददन के भीतर ईस तथ्य की ररपोटध करेगा।
7. दैजनक ईपजस्ट्थजत ऄवजध, राहत और कायधिेत्र की सीमाएं— (1) दकसी व्यजि को, जो दकसी बायलर भारसाधक है, जब वह ऐसे बायलर के 100 मीटर के भीतर िारीररक रूप से ईपजस्ट् थत हो, तो ईसका प्रत्यि और तात्काजलक प्रभारी समझा जाएगा । (2) दकसी व्यजि को, जो दकसी बायलर का भारसाधक है, जजसके जलए आन जनयमों के ऄधीन प्रवीणता प्रमाण पत्र ऄपेजित है, दो से ऄनजधक ऄवजधयों के जलए दकसी एक ददन में भार से भारमुि दकया जा सकेगा जो, बायलर पररचारक के रूप में प्रथम श्रेणी सिमता प्रमाण पत्र धारण करने वाले दकसी व्यजि द्वारा संयोजजत करने पर दो घंटे से ऄजधक नहीं होगी ।
(3) बायलर पररचारक के रूप में प्रथम श्रेणी सिमता प्रमाण पत्र का धारक, यथाजस्ट् थजत, बायलरों के मुख्य जनरीिक या जनदेिक, की जलजखत सहमजत से बायलर प्रचालन आंजीजनयर के रूप में प्रवीणता प्रमाण पत्र धारण करने वाले व्यजि को ऐसी ऄवजध के जलए कायधभारमुि कर सकेगा जो जनरंतर दस ददन के जलए जवस्ट्ताररत की जा सकेगी, जजसे जविेष पररजस्ट्थजतयों में बायलर का मुख् य जनरीिक या जनदेिक दकसी एक समय पर ऄजधकतम तीस ददन के जलए जवस्ट्ताररत कर सकेगा । 8.

ए कायधभारमुि कर सकेगा जो जनरंतर दस ददन के जलए जवस्ट्ताररत की जा सकेगी, जजसे जविेष पररजस्ट्थजतयों में बायलर का मुख् य जनरीिक या जनदेिक दकसी एक समय पर ऄजधकतम तीस ददन के जलए जवस्ट्ताररत कर सकेगा । 8. बायलर को कब ईपयोग में समझा जाएगा— (1) आन जनयमों के प्रयोजन के जलए बायलर को तब ईपयोग में समझा जाएगा जब बायलर में या ऄजि पुंज दिा के ऄधीन, पानी गरम करने के प्रयोजन के जलए भट्टी ऄजिबाक्स या ऄजि स्ट्थान में ऄजि होती है:
परंतु दकसी बायलर को ईपयोग में नहीं समझा जाएगा जब ऄजि को हटा ददया गया हो और संपूणध वाष्प और जल संयोजन बंद कर ददए गए हों । (2) आन जनयमों के प्रयोजन के जलए दकसी आकॉनामाइजर या ऄपजिि उष्मा बायलर को तब ईपयोग मे समझा जाएगा जब ईसमें आकॉनामाइजर या ऄपजिि उष्मा बायलर से होकर फ्लू गैसें या ऄन्द्य तापन मीजडया प्रवाजहत होते हैं और पानी और तापन गैस या मीजडया के बीच पयाधप्त उष्मा ऄंतरण होता है।
ऄध्याय 3 परीिक सजमजत 9. परीिक सजमजत का गठन—(1) सरकार द्वारा राज्य या संघ राज्यिेत्र के जलए परीिक सजमजत का, बायलरों के मुख्य जनरीिक या जनदेिक, ईप मुख्य जनरीिक या जनरीिक ऄथवा बायलरों के मुख्य जनरीिक या जनदेिक द्वारा यथा नाम जनर्ददि समतुल्य व्यजि और सरकार द्वारा समय-समय पर जनयुि दकए जाने वाले तीन ऄन्द्य ऐसे सदस्ट्यों से जमलकर गठन दकया जाएगा जजन्द्हें प्राआम मूवर और अधुजनक बायलर पद्धजतयों का िैजिक और व्यवहाररक ज्ञान हो। (2) ईपजनयम (1) में ऄतंर्ववष् ट दकसी बात के होते हुए भी, भारत सरकार द्वारा केंरीय स्ट् तर पर भी परीिक सजमजत का गठन दकया जा सकेगा, जजसमें भारत सरकार के वाजणज् य और ईद्योग मंत्रालय के ईद्योग संवधधन और अंतररक व् यापार जवभाग के बायलर खंड में कायध करने वाले तकनीकी सलाहकार, तकनीकी ऄजधकारी और केंरीय सरकार द्वारा समय-समय

या जा सकेगा, जजसमें भारत सरकार के वाजणज् य और ईद्योग मंत्रालय के ईद्योग संवधधन और अंतररक व् यापार जवभाग के बायलर खंड में कायध करने वाले तकनीकी सलाहकार, तकनीकी ऄजधकारी और केंरीय सरकार द्वारा समय-समय पर नाजमत दकए जाने वाले तीन ऄन्द्य ऐसे सदस्ट्य जजन्द्हें प्राआम मूवर और अधुजनक बायलर पद्धजतयों का िैजिक और व्यवहाररक ज्ञान हो, सजम् मजलत होंगें ।

(3) बायलरों का मुख्य जनरीिक या जनदेिक, राज् य या संघ राज्य िेत्र में गरठत सजमजत का पदेन ऄध्यि और ईप मुख्य जनरीिक या जनरीिक ऄथवा बॉयलर के मुख्य जनरीिक या जनदेिक, यथाजस्ट्थजत द्वारा नाजमत समतुल्य व् यजि आस सजमजत का पदेन सजचव होगा तथा केंरीय सरकार के स्ट् तर पर गरठत सजमजत में, तकनीकी सलाहकार पदेन ऄध् यि तथा ईद्योग संवधधन और अंतररक व् यापार जवभाग, वाजणज् य और ईद्योग मंत्रालय, भारत सरकार के बॉयलर ऄनुभाग में कायधरत तकनीकी ऄजधकारी आसका पदेन सजचव होगा।

सदस्ट्यों की पदावजध— (क) सजमत के पदेन सदस्ट्यों से जभन्न प्रत्येक सदस्ट्य की पदावजध तीन वषध की होगी। (ख) राज्य या संघ राज्यिेत्र के जलए गरठत सजमजत में, यदद कोइ सदस्ट्य स्ट्थायी रूप से राज्य या संघ राज्यिेत्र को छोड देता है/देती है या सजमजत की ऄनुज्ञा के जबना लगातार तीन बैठकों से स्ट्वयं को ऄनुपजस्ट्थत रखता है/रखती है तो यह समझा जाएगा दक ईसने सजमजत से ऄपना स्ट्थान खाली कर ददया है और ईसकी ऄवजध के िेष भाग के जलए ईसके स्ट्थान पर दकसी ऄन्द्य व्यजि की जनयुजि की जा सकेगी।
(ग) केंरीय सरकार स्ट् तर पर गरठत सजमजत में, यदद सजमजत की ऄनुज्ञा के जबना लगातार तीन बैठकों से स्ट्वयं को ऄनुपजस्ट्थत रखता है/रखती है तो यह समझा जाएगा दक ईसने सजमजत से ऄपना स्ट्थान खाली कर ददया है और

ग) केंरीय सरकार स्ट् तर पर गरठत सजमजत में, यदद सजमजत की ऄनुज्ञा के जबना लगातार तीन बैठकों से स्ट्वयं को ऄनुपजस्ट्थत रखता है/रखती है तो यह समझा जाएगा दक ईसने सजमजत से ऄपना स्ट्थान खाली कर ददया है और ईसकी ऄवजध के िेष भाग के जलए ईसके स्ट्थान पर दकसी ऄन्द्य व्यजि की जनयुजि की जा सकेगी ।
11. सजमजत के कृत्य— परीिक सजमजत- (i) बायलर प्रचालन आंजीजनयर के रूप में प्रवीणता प्रमाण पत्र प्रदान करने के जलए स्ट् वयं या आस संबंध में ईसके द्वारा प्राजधकृत दकसी ऄजभकरण के माध् यम से ऄभ्यर्वथयों की परीिा और व्यवहाररक परीिा का संचालन करेगी;
(ii) दकसी व्यजि को दकसी परीिा के प्रश्नपत्र तैयार करने वाले या परीिक के रूप में जनयुि करने का ऄजधकार होगा;
(iii) सफल ऄभ्यर्वथयों को बायलर प्रचालक आंजीजनयर के रूप में प्रवीणता प्रमाण पत्र प्रदान करेगी; और (iv) धारा 45 के ऄधीन प्राप्त जांच ररपोटों पर जवचार करेगी। 12. सजमजत की बैठक— जनयम (9) के ऄधीन गरठत सजमजत की, ईसके कायध के संव्यवहार के जलए, जजतनी बार ऄध्यि की राय हो ऐसे स्ट्थान और समय पर जो ऄध्यि जवजनज‍ चत करे, बैठक की जाएगी । 13. बैठक की सूचना और कारबार की सूची— (1) सजमजत के प्रत्येक सदस्ट्य को ईक् त सजमजत की प्रत्येक बैठक के जलए जनजित समय और स्ट्थान के बारे में कम से कम पन्द्रह ददन की सूचना, ऐसी सूचना के साथ बैठक में जवचार-जवमिध दकए जाने वाले कारबार की सूची ईपाबद्ध करते हुए, दी जाएगी:
परंतु यदद ऄध्यि दकसी ऐसे जवषय पर, जो ईसकी राय में ऄत्याव‍यक है, जवचार करने हेतु कोइ बैठक बुलाता है तो सूचना देने के जलए ऐसे युजियुि समय को, जो वह अव‍यक समझे, पयाधप्त समझा जाएगा;
(2) दकसी ऐसे कारबार पर, जो सूची में सजम् मजलत नहीं है, ऄध्यि की ऄनुमजत के जबना बैठक में जवचार नहीं दकया
जाएगा ।
14.

सूचना देने के जलए ऐसे युजियुि समय को, जो वह अव‍यक समझे, पयाधप्त समझा जाएगा;
(2) दकसी ऐसे कारबार पर, जो सूची में सजम् मजलत नहीं है, ऄध्यि की ऄनुमजत के जबना बैठक में जवचार नहीं दकया
जाएगा ।
14. गणपूर्वत— परीिक सजमजत के ऄध्यि या सजचव और दो सदस्ट्यों से, बैठक की गणपूर्वत होगी।
15. ऄध्यि द्वारा सजमजत की बैठकों की ऄध्यिता करना— ऄध्यि, सजमजत की सभी बैठकों की ऄध्यिता करेगा और ईसकी ऄनुपजस्ट्थजत में, बैठक में ईपजस्ट्थत सदस्ट्यों द्वारा चुना गया सदस्ट्य बैठक की ऄध्यिता करेगा । 16. सजमजत के सजचव के कृत् य— सजचव, प्रवीणता प्रमाण पत्र धारण करने वाले बायलर प्रचालन आंजीजनयरों का रजजस्ट्टर रखेगा और ऐसे ऄन्द्य कृत्यों का पालन करेगा जो जनयमों में जवजनर्ददि दकए गए हों या जो ऄध्यि द्वारा समय-समय पर जनदेजित दकए गए हों ।

अवेदन पर सजमजत का पृष्ांकन— सजमजत, प्रत्येक ऄभ्यथी के अवेदन पत्र पर बायलर प्रचालन आंजीजनयर के रूप में प्रवीणता प्रमाण पत्र के जलए ईसके परीिा का पररणाम पृष्ांदकत करेगी और पृष्ांदकत अवेदन, सजचव को वापस लौटा ददया जाएगा।

न— सजमजत, प्रत्येक ऄभ्यथी के अवेदन पत्र पर बायलर प्रचालन आंजीजनयर के रूप में प्रवीणता प्रमाण पत्र के जलए ईसके परीिा का पररणाम पृष्ांदकत करेगी और पृष्ांदकत अवेदन, सजचव को वापस लौटा ददया जाएगा।
18. सजमजत की प्रमाण पत्र जारी करने से आंकार करने की िजि— सजमजत, दकसी ऐसे ऄभ्यथी को, जो ईपजस्ट्थत सदस्ट्यों के बहुमत की राय में, ऄत्यजधक वृद्ध है या ऄंग जवकार, स्ट्वास्ट्थ्यकर कमजोरी, त्रुरटपूणध दृजििजि, बहरेपन, या दकसी ऄंग की हाजन के कारण बायलर प्रचालन आंजीजनयर के कतधव्यों का पालन करने में िारीररक रूप से ऄस्ट्वस्ट्थ है, सरकार ऄथवा भारत सरकार के जचदकत्सा पररषद के पास रजजस्ट्री जचदकत्सक ऄथवा रजजस्ट्री जचदकत्सा व्यवसायी से अरोग्य प्रमाण पत्र प्रस्ट्तुत करने का जनदेि दे सकेगा और जहां ऄभ्यथी अरोग्य प्रमाण पत्र प्रस्ट्तुत करने में ऄसफल रहता है तो, सजमजत को बायलर प्रचालन आंजीजनयर के रूप में ईसको ऄथवा ईसके प्रवीणता प्रमाण पत्र को आंकार करने की िजि होगी। 19. परीिक फीस— ऄध्यि और सजचव और परीिक तथा जनरीिक के जसवाय जनयम 9 के ऄधीन जनयुि परीिक सजमजत के प्रत् येक सदस्ट् य, ऄभ्यर्वथयों की परीिा की जांच करने के जलए सजमजत द्वारा आन जनयमों के ऄधीन यथाजनधाधररत फीस प्राप्त करने के हकदार होंगे और फीस की न्द्यूनतम दर जनम्नजलजखत होगी: -
(क) सजमजत की बैठक संबंधी फीस (गैर िासकीय सजमजत सदस्ट्यों के जलए) 1000/- रु. (ख) प्रश्नपत्र तैयार करने के जलए
3500/- रु. (ग) ईत्तर पुजस्ट्तका के मूल्यांकन के जलए 100/- रु. (प्रजत ईत् तर पुजस्ट् तका) (घ) ऄभ्यथी की परीिा के जलए 150/- रु. (प्रजत ऄभ् यथी) (ङ) ऄन्द्वीिण फीस (प्रजत जनरीिक)
(i) 600/- रु. (यदद परीिा 3 घंटे से ऄजधक की है) (ii) 300/- रु. (यदद परीिा 3 घंटे तक की है) 20.

(यदद परीिा 3 घंटे तक की है) 20. सजमजत की कारधवाइ—सजमजत की कोइ कारधवाइ, सजमजत के गठन में दकसी त्रुरट के कारण या ऐसी कारधवाइ सजमजत में दकसी ररजि की ऄवजध के दौरान दकए जाने के कारण ऄजवजधमान्द्य नहीं समझी जाएगी । ऄध्याय 4 परीिा 21. परीिा—सजमजत द्वारा या आस संबंध में ईसके द्वारा प्राजधकृत दकसी ऄजभकरण द्वारा, बायलर प्रचालन आंजीजनयर के रूप में प्रवीणता प्रमाण पत्र प्रदान करने के जलए परीिा, ऐसे स्ट्थान पर और ऐसी तारीखों पर जो सजमजत द्वारा, समय- समय पर जवजनज‍ चत की जाएं, अयोजजत की जाएगी ।
22. परीिा का स्ट्थगन— जब परीिा के जलए जनयत तारीख को राजपजत्रत छुट्टी के रूप में घोजषत कर ददया जाता है या जब दकसी ऄकजल्पत कारण से जनयत तारीख को परीिा अयोजजत नहीं की जा सकती है तो ऄध्यि, परीिा करवाने के जलए कोइ ऄन्द्य तारीख जनयत कर सकेगा और ईसे ऄभ्यर्वथयों को और परीिक सजमजत के सदस्ट् यों को सम्यक् रूप से सूजचत दकया जाएगा।
ऄध्याय 5 प्रमाण पत्र 23. प्रमाण पत्र धारकों की सामथ्यधता— (1) बायलर प्रचालन आंजीजनयर के रूप में प्रवीणता प्रमाण पत्र ईसके धारक को दकसी भी प्रकार और दकसी भी अकार के बायलर या बायलरों का भार साधक होने के जलए ऄर्वहत करेगा परंतु यह तब जबदक बायलरों की जस्ट्थजत आस प्रकार हैं दक ईनमें से दकसी की भी दूरी अपस में पचास मीटर के घेरे से ऄजधक नहीं है ।

र और दकसी भी अकार के बायलर या बायलरों का भार साधक होने के जलए ऄर्वहत करेगा परंतु यह तब जबदक बायलरों की जस्ट्थजत आस प्रकार हैं दक ईनमें से दकसी की भी दूरी अपस में पचास मीटर के घेरे से ऄजधक नहीं है ।

(2) बायलर प्रचालन आंजीजनयर के रूप में प्रवीणता प्रमाण पत्र धारक सभी अियों और प्रयोजनों के जलए बायलर पररचर जनयम, 2025 की ऄपेिाओं को पूरा करने वाला समझा जाएगा:
परंतु ईक् त जनयमों की ऄजधसूचना की तारीख से पूवध यथाजस्ट्थजत सरकार या भारत सरकार, द्वारा जारी बायलर प्रचालन आंजीजनयर के रूप में राजपत्र में बायलर प्रचालक जनयम, 2025 के प्रकािन से पूवध प्रवीणता प्रमाणपत्र धारण करने वाला कोइ बायलर प्रचालन आंजीजनयर, प्रवीणता प्रमाणपत्र में यथावर्वणत बायलर (बायलरों) का भारसाधक होने का पात्र होगा । 24. प्रमाणपत्र की जवजधमान्द् यता—(1) दकसी सजमजत द्वारा ऄभ् यथी को बायलर प्रचालन आंजीजनयर के रूप में प्रदत् त प्रवीणता प्रमाण-पत्र सम् पूणध भारत में जवजधमान्द् य होगा, परंतु प्रचालन आंजीजनयर के रूप में प्रवीणता प्रमाण पत्र धारण करने वाला कोइ व्यजि ऄपने प्रवीणता प्रमाणपत्र की प्रजत के साथ, संबद्ध सरकार के बायलरों के मुख् य जनरीिक या जनदेिक को, जजसमें वह सेवाओं के जलए अवेदन करता है/करती है या एक राज् य से दूसरे राज् य में सेवाओं के पररवतधन की जस्ट्थजत में सूजचत करेगा/करेगी, जो दकसी ऑन-लाइन माध् यम या इ-मेल द्वारा भी दकया जा सकता है। (2) प्रमाणपत्र धारक के पैंसठ वषध की अयु प्राप्त करने तक प्रवीणता प्रमाणपत्र मान्द्य होगा।
ऄध्याय 6 परीिा के जलए अवेदन 25.

करेगा/करेगी, जो दकसी ऑन-लाइन माध् यम या इ-मेल द्वारा भी दकया जा सकता है। (2) प्रमाणपत्र धारक के पैंसठ वषध की अयु प्राप्त करने तक प्रवीणता प्रमाणपत्र मान्द्य होगा।
ऄध्याय 6 परीिा के जलए अवेदन 25. अवेदन का प्ररूप— (1) परीिा के जलए प्रत्येक अवेदन प्ररूप ‘क’ में होगा।
(2) अवेदक, प्ररूप के भाग को ईसी प्रकार भरेगा जैसे दकसी ऄभ्यथी द्वारा भरा जाता है और ईस पर हस्ट्तािर करेगा।
(3) भरा गया अवेदन सजचव या परीिा संबंधी सूचना या जवज्ञापन ऄथवा जववरण पजत्रका में यथा जवजनर्ददष् ट व् यजक् त को ऄग्रेजषत दकया जाएगा और ईसके साथ जनम्न दस्ट्तावेज संलग् न होंगे— (क) ऄभ्यथी की िैिजणक ऄहधताओं, ईसके व्यवहाररक ऄनुभव की बाबत प्रत्येक िंसापत्र की स्ट् वयं ऄनुप्रमाजणत प्रजत (सभी मूल िंसापत्र सािात्कार के समय प्रस्ट्तुत दकए जाएंगे);
(ख) ईसके जनयोजक से ईत्तम चररत्र का प्रमाण-पत्र ।
(ग) परीिा के जलए आन जनयमों में जवजनर्ददि फीस के संदाय के समथधन में, ईस परीिा के जलए सूचना या जवज्ञापन ऄथवा जववरण पजत्रका में यथा जवजनर्ददष् ट खजाना चालान की या संदाय के दकसी ऄन्द्य प्रकार की, जजसके ऄंतगधत ऑन-लाइन संदाय की रीजत भी है, की एक प्रजत; और
(घ) पासपोटध अकार के नवीनतम फोटोग्राफ (50 जम.जम. X 65 जम.जम.) की दो प्रजतयां, जजसमें से एक के पीछे, ऄभ्यथी के हस्ट्तािर होंगे:
परंतु यदद परीिा के जलए अवेदन ऑनलाआन अमंजत्रत दकए जाते हैं, तो आस जनयम में ईजल्लजखत प्रिंसापत्र, िुल्क, फोटोग्राफ अवेदन के साथ ऄपलोड दकए जाएंगे, जैसा दक परीिा संबंधी नोरटस या जवज्ञापन या जववरजणका में जनर्ददि दकया गया है।
26.

ऑनलाआन अमंजत्रत दकए जाते हैं, तो आस जनयम में ईजल्लजखत प्रिंसापत्र, िुल्क, फोटोग्राफ अवेदन के साथ ऄपलोड दकए जाएंगे, जैसा दक परीिा संबंधी नोरटस या जवज्ञापन या जववरजणका में जनर्ददि दकया गया है।
26. ऄभ्यथी द्वारा संतोषप्रद प्रिंसापत्र प्रस्ट्तुत करना— (1) दकसी ऐसे ऄभ्यथी को परीिा में प्रवेि नहीं ददया जाएगा जो ऄपने ऄनुभव, योग्यता और ऄपनी ऄहधता सेवा की संपूणध ऄवजध के ईत्तम अचरण या ऄहधता सेवा की ऄवजध में कोइ ऄस्ट्पि व्यवधान को प्रभाजवत करने वाला संतोषप्रद प्रिंसापत्र प्रस्ट्तुत नहीं कर सकता है और ऐसे िंसापत्र स्ट्पि रूप से ईस सामथ्यधता का जजसमें ऄभ्यथी, जििु आंजीजनयर, पयधवेिक या सहायक आंजीजनयर अदद के रूप में जनयोजजत था और ईन तारीखों का, जजसके बीच में ऄभ्यथी आस प्रकार जनयोजजत था, का स्ट्पि जववरण देंगे।

[भाग II—खण् ड 3(i)] 7

(2) प्रिंसापत्र, ऐसे जवभाग के आंचाजध द्वारा हस्ट्तािररत होगा जजसके ऄधीन ऄभ्यथी जनयोजजत था और वह जमल, कारखाने या कायधिाला के स्ट्वामी या ऄजभकताध द्वारा या ऐसे दकसी ऄन्द्य व्यजि द्वारा जजसे सजमजत आस जनजमत्त ऄजधकजथत करे, प्रजत हस्ट्तािररत होगा।
(3) ऐसा ऄभ्यथी, जजसने दकसी मान्द्यताप्राप्त आंजीजनयररग कॉलेज या तकनीकी संस्ट्थान में प्रजििण पाठय़क्रम प्राप्त दकया है, या तो यथाजस्ट्थजत पाठय़क्रम की जडग्री या जडप्लोमा या कॉलेज ऄथवा संस्ट्थान, का प्रमाण-पत्र प्रस्ट्तुत करेगा, जजसमें पाठय़क्रम पूरा करने में लगे समय का ईल् लेख होगा।
(4) दकसी वाष्प पोत में सेवा की बाबत प्रिंसापत्र मुख्य आंजीजनयर द्वारा हस्ट्तािररत दकया जा सकेगा और जलयान के मास्ट्टर द्वारा प्रजतहस्ट्तािररत या पोत पररवहन मास्ट्टर द्वारा जारी नाजवक जनवधहन प्रमाण पत्र के प्ररूप में हो सकेगा ।

की बाबत प्रिंसापत्र मुख्य आंजीजनयर द्वारा हस्ट्तािररत दकया जा सकेगा और जलयान के मास्ट्टर द्वारा प्रजतहस्ट्तािररत या पोत पररवहन मास्ट्टर द्वारा जारी नाजवक जनवधहन प्रमाण पत्र के प्ररूप में हो सकेगा । (5) रेल बायलरों या दकसी सरकारी जवभाग या स्ट्थानीय जनकायों के बायलरों पर दी गइ दकसी सेवा से संबंजधत प्रिंसापत्र, ऐसे जवभाग के सिम ऄजधकारी द्वारा हस्ट्तािररत होगा जहां ऄभ्यथी ने सेवा की है और संबंजधत जवभागाध्यि द्वारा प्रजतहस्ट्तािररत दकया जाएगा। 27. िंकास्ट्पद प्रिंसापत्र— यदद सजचव के पास, दकसी अवेदन या प्रिंसापत्रों में ददए गए दकसी कथन की सत्यता पर िंका करने का कारण है तो वह ऐसी जांच कर सकेगा जो वह ईसे सत्याजपत करने हेतु ठीक समझे ।
28. जमथ्या प्रिंसापत्र— (1) यदद जांच करने पर, सजचव का यह समाधान हो जाता है दक प्रऄभ्यथी द्वारा प्रस्ट्तुत दकसी प्रिंसापत्र की कोइ ताजत्वक जवजिजियां जमथ्या हैं तो वह ऄपने जनष्कषध ऄध्यि को प्रस्ट्तुत करेगा जो ऐसे ऄभ्यथी को आन जनयमों के ऄधीन अयोजजत दकसी परीिा में प्रवेि करने से जववर्वजत करने का जलजखत अदेि कर सकेगा। यदद ऐसे दकन्द्हीं प्रिंसापत्रों के बल पर, दकसी ऄभ्यथी ने पहले ही परीिा में प्रवेि प्राप्त कर जलया है तो ईसे ऐसी परीिा में ऄसफल समझा जाएगा और ऐसी परीिा में ऄसफल घोजषत होने के पररणामस्ट्वरूप ईसे प्रदत्त प्रमाण पत्र तत्काल वापस ले जलया जाएगा और ईसे रद्द कर ददया जाएगा :
परंतु अवेदक को मामले में सुनवाइ का ऄवसर ददए जबना आस जनयम के ऄधीन कोइ कारधवाइ नहीं की जाएगी । (2) ईप-जनयम (1) के ऄधीन ऄध्यि के अदेि से व्यजथत कोइ भी व्यजि अदेि प्राजप्त की तारीख से तीस ददन की ऄवजध के भीतर यथाजस्ट् थजत सरकार या भारत सरकार को ऄपील कर सकेगा जजसका ईस पर जवजनिय ऄंजतम होगा। 29.

(2) ईप-जनयम (1) के ऄधीन ऄध्यि के अदेि से व्यजथत कोइ भी व्यजि अदेि प्राजप्त की तारीख से तीस ददन की ऄवजध के भीतर यथाजस्ट् थजत सरकार या भारत सरकार को ऄपील कर सकेगा जजसका ईस पर जवजनिय ऄंजतम होगा। 29. अवेदनों और प्रिंसापत्रों की प्रजतयों का रखा जाना— ऄभ्यथी द्वारा प्रस्ट्तुत अवेदन और प्रिंसापत्र की प्रजतयां ऄध्यि के कायाधलय में या परीिा संचाजलत करने के जलए प्राजधकृत दकसी ऄजभकरण में, जैसा सजमजत द्वारा जवजनज‍ चत दकया जाए, ऄजभलेख के रूप में रखे जाएंगे। ऄध्याय 7 पात्रता मापदंड 30. अयु, ऄहधता और ऄनुभव--बायलर प्रचालन आंजीजनयर के रूप में प्रवीणता प्रमाण पत्र के जलए दकसी ऄभ्यथी को परीिा में तभी प्रवेि ददया जाएगा, जब -
(क) ईसने तेइस वषध की अयु पूरी कर ली हो; (ख) ईसके पास दकसी मान्द्यताप्राप्त जवश्वजवद्यालय या संस्ट्था से यांजत्रकी या जवद्युत या रासायजनक या िजि संयत्र या ईत्पादन ऄथवा धातुकमध या आंस्ट्ूमेंटेिन आंजीजनयरी में स्नातक जडग्री या जडप्लोमा हो;

रटप्पण: आंजीजनयररग की उपर-ईजल्लजखत िाखाओं, ईदाहरण के जलए, आलेजक्रकल और आलेक्रॉजनक्स, आलेजक्रकल और आंस्ट्ूमेंटेिन, मेक्रोजनक्स अदद के साथ दकसी भी एकीकरण या संयोजन की भी ऄनुमजत होगी।

(ग) जजसने कम से कम एक हजार वगधमीटर तापक सतह के बायलर के या कम से कम कुल जमलाकर एक हजार वगधमीटर तापक सतह के बायलरों की बैटरी के, जजनमें से कम से कम एक बायलर कम से कम पांच सौ वगधमीटर तापक सतह का हो, प्रचालन या रखरखाव में जडग्री धारकों की दिा में कम से कम दो वषध की और जडप्लोमा धारक की दिा में पांच वषध कायध दकया हो:
परंतु, राष्ट्रीय जवद्युत प्रजििण संस्ट्थान से पॉवर प्लांट आंजीजनयररग में स्नातकोत्तर जडप्लोमा धारक की दिा में, न्द्यूनतम कायध ऄनुभव की ऄपेिा एक वषध होगी; और राष्ट्रीय जवद्युत प्रजििण संस्ट्थान से पॉवर प्लांट आंजीजनयररग में पोस्ट्ट जडप्लोमा पाठ्यक्रम धारक के मामले में, न्द्यूनतम कायध ऄनुभव की ऄपेिा चार वषध होगी।
ऄध्याय 8 परीिा के जलए पाठ्यक्रम 31. परीिा के जलए पाठ्यक्रम- दकसी ऄभ्यथी को, आन जनयमों के ऄधीन प्रवीणता प्रमाण पत्र ऄर्वहत होने के ऄनुक्रम में परीिक को जनम् नजलजखत के जलए अ‍ वस्ट् त करना होगा दक वह:-
(क) भार, िेत्रफल, अयतन, पररमाण और वजन की संगणना कर सकता है; (ख) भूजम पर प्रयुि वाष्प बायलरों के मुख्य प्रकारों के ्‍यौरे दे सकता है और ईन प्रयोजनों और कारणों को बता सकता है जजसके जलए जभन्न-जभन्न प्रकार के बायलर लगाए जाते हैं, और अंकडों और प्रदत्त सूत्र से भारतीय बायलर जवजनयम के ऄनुसार बायलर के दकसी भाग के जलए सुरजित चालन दबाव की संगणना कर सकता है;

ारणों को बता सकता है जजसके जलए जभन्न-जभन्न प्रकार के बायलर लगाए जाते हैं, और अंकडों और प्रदत्त सूत्र से भारतीय बायलर जवजनयम के ऄनुसार बायलर के दकसी भाग के जलए सुरजित चालन दबाव की संगणना कर सकता है; (ग) गोलाकार िलाका और िैफ्ट के भीतर का प्रत्यि प्रजतबल, मरोडी प्रजतबल और बंकन प्रजतबल और ददए गए भार के साथ अयताकार िलाकाओं और लीवरों के भीतर के बंकन प्रजतबल की संगणना कर सकता है;
(घ)
वाष्प बायलरों, सुपर-हीटसध और आकॉनोमीजसध तथा ऄन्द्य सहायक सामजग्रयों के कायध और प्रबंधन को समझ सकता है;
(ङ)
जवजभन्न वाल्वों, कोक, माईंरटग, दफरटग और यंत्र सुरिा युजियों का प्रयोग और प्रयोजन समझ सकता है;
(च) भरण पंपों, भरण ऄंतःिेपक, भरण जवजनयामक, भरण जल जनस्ट्पंदक और मृदुकर, भरण तापक, वायु तापक, ईष्मांक, वाष्प संचायक, कृजत्रम कषधण, ऄजभप्रेररत कषधण, स्ट्वचाजलत कषधण जनयंत्रण युजियों का जववरण दे सकता है और ईसके कायध को स्ट्पि कर सकता है; (छ) दहन, ईष्मा और वाष्प से संबंजधत तथ्यों का ईत्तर दे सकता है और ईंधन और जल के ईपभोग को और वाष्प की ईस मात्रा को संगजणत कर सकता है जो दकसी भूजम बायलर में कषधण की जभन्न-जभन्न पद्धजतयों के ऄधीन तापक सतह से सृजजत हो सकती है और बायलर संयंत्र की संपूणध दिता को भी संगजणत कर सकता है; (ज) धारा और सतह संिेपण, वाष्प जवस्ट्तारण के पुनः तापन और कायधकरण को स्ट्पि कर सकता है;
(झ) बायलर और जचमजनयों की नींव रखने और दहनिील पदाथध को सफलतापूवधक जनकालने हेतु जचमजनयों की उंचाइ में प्रयुि साधारण पद्धजतयों को स्ट्पि कर सकता है;

पुनः तापन और कायधकरण को स्ट्पि कर सकता है;
(झ) बायलर और जचमजनयों की नींव रखने और दहनिील पदाथध को सफलतापूवधक जनकालने हेतु जचमजनयों की उंचाइ में प्रयुि साधारण पद्धजतयों को स्ट्पि कर सकता है;
(ञ)
धुंए के जनवारण के जलए प्रयुि मुख्य साजधत्र का और ईस जसद्धांत का, जजस पर वे कायध करते हैं, महत्व स्ट्पि कर सकता है और ईपयोग में अने वाली मुख्य यांजत्रक अग वाले, संपेषक, गैस, तेल और प्रपूर्वणत ईंधन प्रणाली का जववरण दे सकता है;

(ट) काजलक सफाइ, तापक सतह की पपडी या ऄन्द्य जनिेपों के जनवारण के जलए प्रयुि पद्धजतयां और भरे हुए जल में क्वाजलटी मानदंड को बनाए रखने की अव‍यकता को समझा सकता है;
(ठ) बायलरों की त्रुरटयों का पता लगा सकता है और ईन्द्हें सुधारने के साधनों और पद्धजतयों को बता सकता है;
(ड) ठंडी या एकजत्रत ऄजि की जस्ट्थजत से बायलरों और आकोनोमाआजर को चलाने में बरती जाने वाली सावधाजनयों को समझ सकता है;
(ढ) दकसी आकोनोमाआजर को ईस समय बंद करने के जलए जब बायलर वाष्प चाजलत हो, ऄपनाइ जाने वाली प्रदक्रया को समझ सकता है;
(ण) ईंधन की बचत करने के जलए और बायलर गृह में प्रयुि जवजभन्न ईपकरणों के जलए ऄंगीकृत पद्धजतयों को स्ट्पि कर सकता है;
(त) सुपरदक्ररटकल बायलरों सजहत बायलरों, बायलर घटकों और पाआपपग के जलए प्रयुि सामग्री, जनमाधण और जडजाआन मानदंडों को स्ट्पि कर सकता है;
(थ) बायलर, बायलर घटकों और बायलर माईंरटग या ईसके भागों का कायधिील स्ट्केच और ड्राआंग पढ सकता है, स्ट्पि कर सकता है और तैयार कर सकता है; (द) बायलर के जलए ईपयोग दकए जाने वाले जवजभन्न प्रकार के दफरटग, आसके संयोजनों, सहायक ईपकरणों के कायधिील स्ट्केच और ड्राआंग को पढ सकता है, समझा सकता है और तैयार कर सकता है;

ता है और तैयार कर सकता है; (द) बायलर के जलए ईपयोग दकए जाने वाले जवजभन्न प्रकार के दफरटग, आसके संयोजनों, सहायक ईपकरणों के कायधिील स्ट्केच और ड्राआंग को पढ सकता है, समझा सकता है और तैयार कर सकता है; और (ध) कायधिील स्ट्केच और पाआपपग और आंस्ट्ूमेंटेिन अरेख, आंस्ट्ूमेंटेिन ऄजभन्द्यास, बायलर और बायलर जसस्ट्टम की सामान्द्य व्यवस्ट्था ऄजभन्द्यास को पढ सकता है, स्ट्पि कर सकता है और तैयार कर सकता है।
ऄध्याय 9 परीिा की पद्धजत
32. परीिा की प्रकृजत--बायलर प्रचालन आंजीजनयर के रूप में प्रवीणता प्रमाण पत्र हेतु परीिा ऐसी प्रकृजत की होगी जजसे भूजम पर प्रयुि सभी प्रकार और दबावों के वाष्प जजनत संयंत्रों के प्रभारी के रूप में जनयुजि करने के जलए दकसी ऄभ्यथी की ईपयुिता को ऄजभजनजित करने के जलए ऄभ्यर्वथयों की व्यवहाररक योग्यता और तकनीकी ज्ञान की परीिा की जा सके। 33. परीिा के जलए जवषय--परीिा जनम्नजलजखत रीजत में संचाजलत की जाएगी: - (1) जलजखत परीिा जजसमें एक प्रश्न पत्र जनयम 31 के ईपजनयम (क) से ईपजनयम (ज) के ऄधीन जनयत पाठ्य जववरण को पूरा करने वाला बायलरों से संबंजधत और दूसरा प्रश्न पत्र जनयम 31 के ईपजनयम (झ) से ईप जनयम (त) के ऄधीन जनयत पाठ्य जववरण को पूरा करने वाला बायलरों से संबंजधत होगा।
(2) जनयम 31 के ईपजनयम (थ), (द) और (ध) को पूरा करने वाली जलजखत ड्राआंग परीिा। (3) बायलर के प्रयोग से संबजधत प्रश्नों का ईत्तर देने के जलए मौजखक परीिा और यदद परीिक द्वारा ऄपेजित है तो दकसी बायलर गृह में ईसके कतधव्यों के व्यवहाररक पहलुओं को पूरा करने के जलए ईसकी योग्यता को परीिा भवन या दकसी कायधिाला में प्रदर्वित करना।
34.

ेने के जलए मौजखक परीिा और यदद परीिक द्वारा ऄपेजित है तो दकसी बायलर गृह में ईसके कतधव्यों के व्यवहाररक पहलुओं को पूरा करने के जलए ईसकी योग्यता को परीिा भवन या दकसी कायधिाला में प्रदर्वित करना।
34. कायध का मूल्यांकन—(क) ऄभ्यथी को प्रत्येक जलजखत प्रश्न पत्र में और मौजखक तथा ड्राआंग परीिा में कम से कम पैंतालीस प्रजतित ऄंक ऄर्वजत करने होंगे; ककतु आन जनयमों के ऄधीन प्रवीणता प्रमाण पत्र प्रदान करने के क्रम में संपूणध योग कुल ऄंकों का पचास प्रजतित से कम नहीं होना चाजहए ।

(ख) दकसी भी जलजखत प्रश्न पत्र में पैंतालीस प्रजतित से कम ऄंक प्राप्त करने वाले ऄभ्यथी को मौजखक परीिा के जलए नहीं बुलाया जाएगा। 35. परीिा की फीस-- ऄभ्यथी, बायलर प्रचालन आंजीजनयर के रूप में प्रवीणता प्रमाण पत्र के जलए परीिा हेतु 2200/- रु. (दो हजार दो सौ रुपए) की फीस के साथ यथालागू माल और सेवा कर सजहत खजाना चालान द्वारा या ऐसी ऄन्द्य रीजत से जजसके ऄंतगधत संदाय की ऑनलाआन पद्धजत भी है, जो परीिा के जलए सूचना या जवज्ञापन या जववरण पजत्रका में ऄजधकजथत की जाए, भुगतान करेगा। 36. फीस का प्रजतदाय-- ऐसा ऄभ्यथी, जो आन जनयमों के ऄधीन एक बार परीिा में प्रवेि प्राप्त कर लेता है, दकसी फीस के प्रजतदाय का हकदार नहीं होगा और जब कोइ ऄभ्यथी जनजित तारीख को ऄपररहायध कारणों से परीिा में ऄनुपजस्ट्थत रहता है तो, ऄध्यि ईसे ऄगली परीिा में दूसरी बार फीस का संदाय दकए जबना सजम्मजलत होने के जलए ऄनुज्ञा दे सकेगा। 37. ऄपात्र पाए जाने पर ऄभ्यथी के जलए फीस--कोइ ऐसा ऄभ्यथी जजसने परीिा फीस संदत्त की है ककतु परीिा के जलए ऄपात्र पाया जाता है तो ईि फीस समपहृत कर ली जाएगी।
ऄध्याय 10 प्रमाण पत्र प्रदान करना 38.

ऄपात्र पाए जाने पर ऄभ्यथी के जलए फीस--कोइ ऐसा ऄभ्यथी जजसने परीिा फीस संदत्त की है ककतु परीिा के जलए ऄपात्र पाया जाता है तो ईि फीस समपहृत कर ली जाएगी।
ऄध्याय 10 प्रमाण पत्र प्रदान करना
प्रवीणता प्रमाणपत्र प्रदान करना—ऐसे ऄभ्यर्वथयों के ्‍यौरे जो परीिा में ईत्तीणध होते हैं, सजमजत द्वारा ऄजधसूजचत दकए जाएंगे और ऄभ्यर्वथयों को पररणाम की घोषणा के पिात् प्रवीणता प्रमाणपत्र प्रदान दकया जाएगा।
प्रमाणपत्र का प्ररूप--बायलर प्रचालन आंजीजनयर के रूप में प्रवीणता प्रमाण पत्र प्ररूप ‘ख’ में होगा और आसे या तो भौजतक रूप में या जडजजटल रूप में जारी दकया जा सकेगा।
पहचान करने की ऄपेिा-- आन जनयमों के ऄधीन प्रदत्त प्रत्येक प्रमाण पत्र पर, जनयम 25 के ऄधीन ईसके अवेदन के साथ यथाजस्ट्थजत पहले प्रस्ट्तुत या ऄपलोड दकए गए, ईसके धारक का अवि फोटो और ईसके हस्ट्तािर तथा ऐसी जवजिजियां होगी जो पहचान के प्रयोजन के जलए ऄपेजित हों।
प्रमाण पत्र की दूसरी प्रजत प्रदान करना-- (1) जब कभी प्रमाण पत्र धारक ऄध्यि को समाधानप्रद रूप में यह साजबत करता है दक आन जनयमों के ऄधीन ईसे प्रदत्त प्रमाण पत्र खो गया है, चोरी हो गया है या नि हो गया है या जवकृत हो गया है तो ईसे 200/-रु.

-- (1) जब कभी प्रमाण पत्र धारक ऄध्यि को समाधानप्रद रूप में यह साजबत करता है दक आन जनयमों के ऄधीन ईसे प्रदत्त प्रमाण पत्र खो गया है, चोरी हो गया है या नि हो गया है या जवकृत हो गया है तो ईसे 200/-रु. (दो सौ रुपए) फीस का संदाय करने पर प्रमाण पत्र की दूसरी प्रजत प्रदान की जाएगी, जो यथा पूवोि ईस ऄजभलेख के ऄनुसार होगी, जजसका वह हकदार प्रतीत होता है, जजसकी ईन सभी प्रयोजनों के जलए वैसी ही जवजधमान्द्यता होगी जो मूल प्रमाण पत्र की होती और ऐसे प्रमाण पत्र पर ''प्रमाणपत्र की दूसरी प्रजत'' ि्‍द जलखा होगा और फीस खजाना चालान या ऐसी ऄन्द्य पद्धजत जजसके ऄंतगधत संदाय की ऑनलाआन पद्धजत भी है, संदत्त की जाएगी जो सजमजत आस जनजमत्त ऄजधकजथत करे। (2) यदद जांच करने पर सजचव की यह राय है दक प्रमाण पत्र की दूसरी प्रजत जारी करने के जलए अवेदक द्वारा ददया गया कोइ कथन जमथ्या है तो वह ईि सजमजत को ईसकी ऄगली बैठक में मामले की ररपोटध करेगा और सजमजत ऄपने जववेकाजधकार से, प्रमाण पत्र को रद्द कर सकेगा या यथा पूवोि प्रमाण पत्र की दूसरी प्रजत या तो तुरंत या ऐसी ऄवजध के पिात् जो बारह मास से ऄनजधक की ऐसी ऄवजध के पिात्, जो सजमजत प्रत्येक मामले की पररजस्ट्थजतयों को ध्यान में रखते हुए ईजचत समझे, प्रदान करने की ऄनुज्ञा दे सकेगी।
42. प्रमाण पत्र की दूसरी प्रजत के जलए अवेदन--प्रमाण पत्र की दूसरी प्रजत के जलए अवेदन, आस संबंध में पुजलस के पास दजध प्रथम सूचना ररपोटध की प्रजत के साथ और कथन की आस घोषणा के साथ दक आन जनयमों के ऄधीन प्रदत्त प्रमाण पत्र खो गया है, ऄध्यि के समि प्रस्ट्तुत दकया जाएगा।

मूल प्रमाण पत्र की ऄजवजधमान्द्यता--प्रमाण पत्र की दूसरी प्रजत के जारी दकए जाने पर, मूल प्रमाण पत्र जवजधमान्द्य नहीं रह जाएगा और यदद वह ईसके धारक के क्‍जे में है तो ईसे ऄध्यि के कायाधलय में वापस दकया जाएगा।
प्रमाणपत्र की दूसरी प्रजत का ऄजभलेख--आन जनयमों के ऄधीन प्रदत्त सभी प्रमाण पत्रों की दूसरी प्रजत के ्‍यौरे ऄध्यि के कायाधलय में ऄजभजलजखत दकए जाएंगे ।
ऄध्याय 11 जांच
प्रमाण पत्र धारकों के संबंध में जांच--यदद जजला मजजस्ट्रेट या बायलरों के मुख्य जनरीिक या जनदेिक के पास दकसी भी कारण से यह जवश्वास करने का कारण है दक आन जनयमों के ऄधीन प्रवीणता प्रमाण पत्र धारण करने वाले दकसी बायलर प्रचालन आंजीजनयर की ओर से कतधव्य की ऄिमता, मत्तता, ऄवचार या ईपेिा के ऄजभकथनों की जांच की जानी चाजहए तो वे या तो स्ट्वयं ऐसी जांच करेंगे या ऄपने ऄधीनस्ट्थ ऄजधकाररयों द्वारा आसकी जांच करवाएंगे, और-
(क) ईस व्यजि की ईपजस्ट्थजत में कायधवाजहयां की जाएंगी जजसका अचरण जांच की जवषयवस्ट्तु है और ईसको ऐसा कोइ कथन करने का और ऄपनी प्रजतरिा में कोइ साक्ष्य प्रस्ट्तुत करने का ऄवसर प्राप्त होगा।
(ख) जांच करने वाले ऄजधकारी द्वारा ईस पर ददए गए जनष्कषों के साथ ऐसी जांच की कायधवाही, ईस ऄजधकारी द्वारा सजमजत के जवजनिय के जलए ऄग्रेजषत की जाएगी।

46. प्रमाण पत्र का ऄभ्यपधण--जब जनयम 45 के ऄधीन कोइ जांच की जा रही है तो, ऐसे प्रमाण पत्र का धारक जांच ऄजधकारी की मांग पर, तुरंत ऐसी जांच के पररणाम के लंजबत रहने के दौरान ईि ऄजधकारी को ऄपना प्रमाण पत्र ऄभ्यर्वपत कर देगा। 47. सजमजत का जवजनिय--(1) सजमजत, जनयम 45 के ऄधीन की गइ जांच की कायधवाही, ईस पर ददए गए जनष्कषध के साथ प्राप्त होने पर, अदेि द्वारा प्रमाण पत्र की मान्द्यता को जलजखत में ऄनुज्ञात कर सकेगा या ईसे ऐसी ऄवजध के जलए जनलंजबत कर सकेगा, जो वह ठीक समझे या स्ट्थायी रूप से प्रमाण पत्र को रद्द कर सकेगा। (2) ईपजनयम (1) के ऄधीन कोइ कारधवाइ करने के पूवध ऄभ्यथी को मामले में सुनवाइ का ऄवसर प्रदान दकया जाएगा। (3) ईपजनयम (1) के ऄधीन सजमजत के अदेि से व्यजथत कोइ व्यजि, अदेि की प्राजप्त के तीस ददन के भीतर, यथाजस्ट्थजत सरकार या भारत सरकार को ऄपील कर सकेगा, जजसका ईस पर जवजनिय ऄंजतम होगा। (4) ईपजनयम (1) या ईपजनयम (3) के ऄधीन यथाजस्ट्थजत, अदेि या जवजनि की प्रजत, सजमजत द्वारा जनम्नजलजखत को भी भेजी जाएगी:

(क) सभी ऄन्द्य सरकारों के बायलरों के मुख्य जनरीिक या जनदेिक, और

(ख) तकनीकी सलाहकार।

म (1) या ईपजनयम (3) के ऄधीन यथाजस्ट्थजत, अदेि या जवजनि की प्रजत, सजमजत द्वारा जनम्नजलजखत को भी भेजी जाएगी:

Supervision of operation of boiler.– The owner of a single boiler or two or more boilers connected in a battery or of many separate individual boilers situated within a radius of fifty meters having a total heating surface exceeding one thousand square meters in any of the cases shall not use the same or permit the same to be used unless the boiler or boilers are placed in direct charge of a proficient person specified in rule 4 in addition to such number of boiler attendants as specified in these rules:

Provided that the Chief Inspector may permit any boiler attendant to remain in-charge of a boiler for a maximum period of three months notwithstanding any thing contrary contained in these rules:

Provided further that nothing in these rules shall debar a person holding a first class certificate of competency granted under the Boiler Attendants‘ Rules, 2025 from remaining in attendance and in charge of a boiler or boilers of any size and any such certificate shall for the purpose of these rules be deemed to have been granted under these rules. 4. Production of Certificate. – A Boiler Operation Engineer holding a certificate of proficiency under these rules shall, at all reasonable times during the period any boiler is in his charge or attendance, be bound to produce such certificate when called upon to do so by any of the persons empowered under section 20 to call for the production of a certificate or provisional order granted under the Act. 6. Owner to furnish Chief Inspector or Director of Boilers with particulars of Certificates. – (1) The owner of a boiler who engages any person to be incharge thereof, shall within seven days of such engagement furnish to the Chief Inspector or Director of Boilers, as the case may be, the full particulars of such person including the serial number, date and place of issue of his certificate.

(2) A person who is in-charge of a boiler for which a certificate of proficiency is required under these rules may be relieved of charge in any one day for not more than two periods, which when combined do not exceed two hours in duration by a person holding a first class certificate of competency as a Boiler attendant.

Examiner’s Fees. – Each member of the Committee of Examiners appointed under rule 9 except Chairperson and Secretary and examiners and invigilators shall be entitled to receive fees for examining candidates under these rules as decided by the committee and the minimum rate of fees shall be as follows:─

CHAPTER V CERTIFICATE 23. Capabilities of holders of Certificate. – (1) The certificate of proficiency as a Boiler Operation Engineer shall qualify the holder thereof to be incharge of a boiler or boilers of any type and size provided that the boilers are so situated that none of them is at a distance of more than fifty meters radius from any one of them. (2) The holder of a certificate of proficiency as a Boiler Operation Engineer shall for all intents and purposes be deemed to have fulfilled the requirements of the Boilers Attendants‘ Rules, 2025:

(2) The testimonial shall be signed by the incharge of the department in which the candidate was employed and be countersigned by the owner or agent of the mill, factory or workshop or by such other persons as the committee may lay down in this behalf. (3) A candidate who has undergone a course of training at a recognised Engineering College or Technical Institution shall produce either the degree or diploma of the course or a certificate from the college or institution as the case may be, giving the period devoted in completing the course. (4) A testimonial in respect of service in a steamship may be signed by the Chief Engineer and counter signed by the master of the vessel or may be in the form of a seaman‘s discharge certificate issued by a Shipping Master.

Doubtful testimonials. – If the Secretary has reason to doubt the truth of any statement made in any application or testimonials, he may make such enquiries as he thinks fit to verify the same. 28. False testimonials.– (1) If on enquiry, the Secretary is satisfied that any testimonial submitted by a candidate is false in any material particulars, he shall submit his findings to the Chairperson who may by a written order debar such candidate from being admitted to any examination held under these rules and in case if, on the strength of any such testimonials, a candidate has already been admitted to an examination, he or she shall be deemed to have been failed in such examination and any certificate granted to him or her as a result of his or her having been declared to have passed such examination, shall be forthwith recalled and be cancelled:

Nature of examination.– The examination for certificate of proficiency as a Boiler Operation Engineer shall be of such nature as to test the practical ability and technical knowledge of the candidates in order to ascertain the suitability of a candidate for appointing as in charge of steam generating plants of all types and pressures in land use. 33. Subjects for Examination. – The examination shall be conducted in the following manner, namely: - (1) written examination consisting of one paper on boilers to cover the syllabus stipulated under sub- rules (a) to (h) of rule 31 and another paper on boilers to cover the syllabus stipulated under sub-rules (i) to (p) of rule 31. (2) A written drawing examination covering sub-rules (q), (r) and (s) of rule 31. (3) An oral examination to answer questions pertaining to boiler practices and if required by the examiner to demonstrate in the examination room or in a workshop, his ability to carry out the practical aspects of his duties in a Boiler House. 34. Assessment of work. – (a)A candidate shall secure at least forty-five Percent of the marks in each written paper as well as in the oral and drawing examinations; but the aggregate should not be less than fifty Percent of the total marks in order that he can be awarded a certificate of proficiency under these rules.

Fees for Examination. – A candidate for examination for certificate of proficiency as a Boiler Operation Engineer shall pay a fee of Rs.2200/- (two thousand two hundred rupees) plus Goods and Services Tax (GST) as applicable, by Treasury Challan or in the manner including on-line mode of payment, as laid down in the notice or advertisement or prospectus for examination. 36.Refund of Fee. –A candidate once admitted to an examination under these rules shall not be entitled to any refund of fees and where a candidate is unavoidably absent from the examination on the date fixed, the Chairperson may allow him to appear without payment of a second fee at the next examination. 37.Fee for candidate found ineligible. – A candidate who has paid the examination fee but is found ineligible for an examination shall forfeit the said fee.
CHAPTER X GRANT OF CERTIFICATES. 38. Grant of certificate of proficiency. – Details of candidates who pass the examination shall be notified

Grant of duplicate certificate.– (1) Whenever the holder of a certificate proves to the satisfaction of the Chairperson that the certificate granted to him under these rules has been lost, stolen or destroyed or mutilated, he shall be granted on payment of a fee of Rs.200/- ( two hundred rupees), a duplicate certificate to which, by the record so kept as aforesaid, he appears to be entitled, which shall have for all purposes the same validity as the original certificate and the words ―Duplicate Certificate‖ shall be written on such certificate and the fee shall be paid by Treasury Challan or such other mode including on-line mode of payment, as lay down by the Committee in this behalf.

(2) If on enquiry the Secretary is of the opinion that any statement made by the applicant for the issue of duplicate certificate is false, he shall report the case to the said Committee at its next meeting and the Committee may at its discretion either cancel the certificate or permit the grant of a duplicate certificate either immediately or after such period not exceeding twelve months as the Committee may think fit having regard to the circumstances of each case. 42. Application for duplicate certificate. – Application for issuance of a duplicate certificate shall be made to the Chairperson along-with a copy of the First Information Report lodged with the police in this regard and a self-declaration stating that the certificate granted under these rules, has been lost. 43. Invalidity of original certificate. – On the issue of a duplicate certificate, the original certificate shall cease to be valid, and shall if in the possession of the holder thereof be returned to the office of the Chairperson. 44. Record of duplicate certificate. – The details of all the duplicate certificates granted under these rules shall be recorded in the office of the Chairperson. CHAPTER XI ENQUIRY 45. Surrender of certificate. –When an enquiry is being conducted under rule 45, the holder of such certificate shall, on demand by the officer in charge of the enquiry, forthwith surrender his certificate to the said officer pending the result of such enquiry. 47.
