DIRECTORATE GENERAL OF FOREIGN TRADE SCOMET DIVISION wee Minutes of IMWG Meeting No. 03/2021-22 on SCOMET held on 28.06.2021 at New Delhi Meeting No. 03(2021-22) of Inter-ministerial Working Group (IMWG) was held under the Chairmanship of Shri Vijay Kumar, Addl. DGFT on 28.06.2020 to consider the applications for export of dual use ‘SCOMET’ items. 2. Altogether 186 applications (including 117 Deferred cases) were considered by the IMWG, out of which total 81 cases were “Approved” (38 post-facto approval, 28 clear approvals and 15 cases subject to clear and un-conditional NOC of one member). 02 cases were “Dropped” from the Agenda on the request of the firm and 02 cases were denied for end use and end user concern in terms of factor/criteria under Para 2.74(I)(a) of HBP. Remaining 101 cases were “Deferred” due to want of comments/NOC from concerned IMWG member agencies or in await of information/ clarification from the applicant firms. By After approval of cases by the IMWG and fulfilling other conditions, the export authorisations are issued within three working days. The original copy of Export Authorization is sent through Speed Post, at the given address. The updated status of all SCOMET applications and export authorizations is available on the DGFT website and can be verified by any agency including Customs from weblink : https://tinyurl.com/4x3krax6. (iii) Approved post-facto : Cases which are shown as Approved post-facto implies that approval against those cases have already been issued by DGFT (Hqrs), with the approval of Chairman, IMWG in terms of

Para 2.74(IX) of HBP (Handbook of Procedure 2015-20).

(iv) Approved subject to NOC/ clearance from one agency : Cases which are shown as Approved subject to NOC/ clearance from one agency implies that the NOC is pending from any one IMWG member and export authorisation shall be issued only after receipt of clear and un-conditional NOC of that Deptt. / Org. if an al | nt eee 2 Dy. In case there is variance in the views of IMWG members, the case shall be kept on hold and placed before next IMWG for discussions. (v) Returned without action: Cases which are shown as Returned without action implies that application is incomplete in its basis parameters and cannot be processed even after submission of additional documents provided by the firm. In such cases, an email will be sent by SDCOMET Cell notifying the deficiency and advise to the firm to file fresh application. (vi) Denied: Cases which are shown as Denied implies that application has been considered by the IMWG and after due consideration, the case has not been Approved due to end use / user concern or break in supply chain. (vii) Dropped: Cases which are shown as Dropped implies that application has been considered by the IMWG and after due consideration, it has been decided that the case cannot be processed in the present form and a fresh application need to be filed by the applicant firm with complete and correct documents. Applications withdrawn by the exporters are also included in this category. (viii) Issue of export license by DGFT (Hqrs):W.e.f. 06.07.2018, the export licenses / authorizations for Approved SCOMET applications are issued centrally by DGFT (Hqrs) generally within three working days from issue of Minutes of IMWG meeting subject to all mandatory compliance. An SMS/E-mail alert with reference number of application is sent twice to the applicant, first when the case is electronically Approved on the IMWG portal and secondly when export license is generated. Note : SCOMETExport Authorisations are generally not handed over physically to the applicant firms and sent through Speed Post only.
