FEFinal Allocation of quota for import under Indo-Sri Lanka Free Trade Agreement Allocation of quota for import under Indo-Sri Lanka Free Trade Agreement The provisional allocation of T RQ items under Indo Sri Lanka Free Trade Agreement was considered in the meeting held on 16.09.2020 in DGFT and comment were sought from the applicants by 30.09.2020 vide draft minutes uploaded on DGFT’s website. DGFT has received comments/representations which have been examined and appropriate decisions taken. 2. No representations have been received w.r.t. allocation of Pepper. Accordingly, the quota provisionally allocated on 16.09.2020 is made final as per details in Annex-I. 3. Vanaspati, Bakery Shortening and Margarine: Total five (05) representations have been received for re-considering the allocation made by the committee. i. Three applicants viz. (i) M/s Nebula Multitrade Private Limited, (ii) M/s Shubham Enterprises and (iii) M/s Arka Ventures Private Limited have requested for reduction in the quantity allocated to them. The request is allowed and reallocation is as per Annex-II. ii. Two applicants namely (i) M/s Sarthak Industries Ltd. and (ii) M/s Vanick Oils & Fats Ltd. have represented for action against the Quota Holders, who have not imported a single consignment in past 2 years, either by reducing the allotted quantity or by rejecting their application, according to Trade Notice No. 13/2018 dated 22.05 2018. They have also requested the pre-purchase agreement of all applicants to be checked to ensure they are with one of the eligible exporter of Vanaspati in Sri Lanka. iii. The objections raised above have been examined and it is observed that none of the applicants, including the complainants, have imported the full quota of Vanaspati, Bakery Shortening and Margarine allocated to them in the past 2 years. The committee decided that these TRQs are under bilateral commitments of ISLFTA and not allocating quota would not be in the spirit of the Agreement, Therefore, the committee decided to allocate to all eligible applicants by relaxing the provision in the Trade Notice No. 13/2018 dated 22.05.2018. iv. The pre-purchase agreements of all the applicants firms were checked with the list of eligible exporters provided by Sri Lankan embassy. Accordingly, six (06) firms i.e. (i) M/s Deepak Vegpro Pvt. Ltd., (ii) M/s ADK Impex Chennai, (iii) M/s Regent Gems & Jewellery, (iv) Motan Enterprise, (v) M/s Din Dayal and Sons & (vi) M/s Simplyjith Investement Corporation Pvt, Ltd. were found not to have a pre-purchase agreement with a firm which was listed as eligible exporter by Sri Lankan embassy. Accordingly, the allotment made to these applicants stands cancelled. v. The revised allocation is as in Annex-II. 4. No representations have been received w.r.t. allocation of Desiceated Coconut. Accordingly, the quota provisionally allocated on 16.09.2020 is made final as per details in Annex-III. 5. As mentioned in Para 10 of the provisional allocation, there will be no relaxation on the MIP condition for import of Black Pepper under ISLFTA. Also CIF value of Rs 150/- is applicable on import of desiccated coconut and that these imports will be subject to er 4

submission of CoO fulfilling the Rules of Origin criteria and such other requirements as stipulated under ISLFTA. 6. With the changes as above, the final allocation is as per Annex-I, Annex-II and Annex- TI to this minutes. Other decisions taken by the Committee in its meeting held on 16.09.2020 remain unchanged. 7. RAs may issue the license to eligible applicants in Annex-I, Annex-II and Annex-lIl. Also, RAs may realize the full value of the application fee/ processing fee, proportionate to the quantity applied for or the maximum amount whichever is applicable, in case less fees have been deposited by the allotted applicants. 28 OK मर मर मे
