Final Allocation of quota for import of items under Indo-Sri Lanka Free Trade Agreement The provisional allocation of TRQ items under Indo Sri Lanka Free Trade Agreement was considered in the meeting held on 15.5.2019 in DGFT and comment were sought from the applicants by 24/05/2019 vide draft minutes uploaded on DGFT’s website. DGFT has received comments/representations which have been are examined and appropriate decisions taken. (2) Pepper: 02 (two) representations: M/s Motan Exports and M/s Rose Marry International have represented that their applications were not considered by the Committee. The matter has been examined and it is seen that in the applicant’s mail in dated 28.2.2019, the name has been mentioned as La spirit Liquor Trading. This created some confusion and the case was not considered. Now that it has been corrected and the application is considered for allocation of quota. In case of M/s Rose Mary International, this office missed this application and now it is being considered. It is observed that both the applicants fulfill the criteria for allocation and therefore allocation is being made as per the criteria laid down in the minutes of the meeting dated 15.5.2019 which may be assessed at https://dgft.gov.in/sites/default/files/Sri%20Lanka_0.pdf. 3. Accordingly, with two more applications eligible for allocation of Pepper, the total number of applicants is now 86 and the total quantity of applied for comes to 16,010MT. As per the norms laid down earlier vide minutes of the meeting dated 15.5.2019 the available quantity (2,500 MT) is divided amongst 86 applicants equally and consequently, each applicant is eligible for 29.06 MT of Pepper. The details of the quota allotted is detailed in Annex —I to this minutes. 4. Vanaspati, Bakery Shortening and Margarine : Total eight (08) representations have been received for re-considering the allocation made by the Committee. (i) Five applicants viz. (i) M/s Vijay Solvex, (ii) M/s Deepak Vegpro (P) Ltd., (iii) M/s Sarthak Global Ltd., (iv) M/s Patan Agroproducts and (v) M/s Nebula Multitrade (P) Ltd. have requested for reduction in the quantity allocated to them. The request is allowed and reallocation is as per Annex-II. (ii) Three applicants namely M/s Anik Industries Ltd., (ii) M/s Sarthak Industries Ltd. and M/s Vanick Oils & Fats (P) Ltd. have represented that for the quota of Vanaspati, Bakery Shortening and Margarine distributed for the financial year 2018-19 under ISLFTA has not been utilized by some and they should be blacklisted as per the Trade Notice No. 13/2018 dated 22.5.2018. It has also been pointed out that the Committee has made allocation to two applicants viz. M/s Deepak Vegpro (P) Ltd. and M/s Shubham Enterprises more than the requested quantity. (iii)The objections raised above have been examined and it is observed that none of the applicants, including the complainants, have imported the full quota of Vanaspati, Bakery Shortening and Margarine allocated to them for the financial year 2018-19. In that sense all are defaulters on this account. The Committee decided that these TRQs are under bilateral commitments of ISLFTA and not allocation quota would not be in the spirit of the Agreement. Therefore, the committee decided to allocate to all applicants by relaxing the provision in the Trade Notice No 13/2018 dated 22.5.2018. Also the quantity allocated to M/s Deepak Vegpro (P) Ltd. and M/s Shubham Enterprises are corrected as per their applied quantity as per Annex-II, 5. No representations have been received w.r.t. allocation of Desiccated Coconut. Accordingly, the quota provisionally allocated on 15.5.2019 is made final as per details in Annex-III. 6. With the changes as above, the final allocation is as per Annex-I, Annex-II and Annex- TIT to this minutes. Other decisions taken by the Committee in its meeting held on 15.5.2019 remains unchanged. if RAs may issue the license to eligible applicants in Annex-I, Annex-II and Annex-III. RIL
