In continuation to this Department’s O.M. of even numbers dated 10" February, 2021 and 18t March, 2021 on the above mentioned subject, the undersigned is directed to enclose herewith the Supplementary Agenda for the 103 meeting of the BoA for SEZs scheduled to be held on 18 March, 2021 at 11:30 A.M. for information and necessary action. The unit has submitted that earlier they have been planned to develop Solar Cell and Module using Multi Crystalline Technology, including in-house manufacturing of Ingot and Wafer, Poly silicon as raw materials for Solar Cell and Module. Though, based on their technical team validation, now they plan to use Mono crystalline technology instead of Multi Crystalline Technology.
Partner Further, as stated by the Unit, their technical team is working with technical JV in advanced direct wafering technology as compared to traditional ingot wafer technology. The advanced direct wafering technology, on which they are working, will help them improve the operational cost of wafer manufacturing, thereby making project more viable in terms of finance and reliability.

by DC, APSEZ: the In view of the above and also that it is an environment friendly project, the request of 1.€. unit is recommended for consideration for extension of the LoA for a period of two year up to 18.04.2022 as considerable period has already lapsed. The request is placed before BoA for consideration.

The Composite Arrangement would result in an efficient corporate structure with focused management and streamlined shareholding. The Company is expecting that the composite arrangement shall result in unlocking the following benefits.

Simplified management structure, leading to better administration and reduction in cost from more focused operational efforts, rationalization, standardization and simplification of business process, the elimination of duplication, reduction in multiplicity of legal and regulatory compliances and rationalization of administrative expenses.

103.9 Request for co-developer status (three proposals)
103.9(i) Request of M/s. DesignTech Systems Pvt. Ltd., (presently an IT/ITES Unit) for Co-developer status in MIDC-IT/ITES SEZ, Rajiv Gandhi Infotech Park, Hinjewadi, Phase-III, Pune for the purpose of construction of IT/ITES building and related infrastructure of Units, development of space for IT/ITES units and all default authorised operations.
The above mentioned SEZ stands notified on 07.06.2007 over an area of 223.560 Ha.
M/s. DesignTech Systems Pvt. Ltd. has been granted LOA as a unit vide LOA dated 19-01-2017 over an area of 6000 sq. mtrs. Their LOA was valid upto 18-01-2021.They have Started construction activity and the same is under construction stage and have completed 45% of work with regard to Civil work and 70% w.rt. Boundary walls/Gates etc. as certified by the Chartered Engineer.

The unit has stated that a big contract with a German Company could not be concluded for which they had proposed to set up the unit. Now, owing to Covid-19 impact, their business is badly affected and hence they don’t foresee utilization of entire land for their own use. Hence they intend to take approval as a Co-developer, so that other units may utilize the excess space. d. Other details: i. The unit has not started their operations and they have now requested to change their status from Unit to Co-developer and have submitted an undertaking to pay back the duty benefit availed by them under SEZ Act and Rules in the capacity of unit holder once the co-developer status is approved.

li. The unit has availed duty benefit of Rs. 38.41 lakhs on the goods worth Rs. 212.69 lakhs.
Recommendations of DC:
DC SEEPZ SEZ has recommended the proposal for grant of approval for Codeveloper status subject to surrender of benefits taken by the applicant as an unit, as applicable.
The proposal is placed before BoA for consideration.
103.9(ii) Request of M/s. Click2Cloud Technology Services India Pvt. Ltd. for codeveloper status in the multi-product SEZ in M/s. MIHAN SEZ at Nagpur, Maharashtra
The above mentioned SEZ stands notified on 29.05.2007 over an area of 1511.51
M/s. Click2Cloud Technology Services India Pvt. Ltd. (earlier known as Rgen Software Solutions (I) Pvt. Ltd.) had applied for setting up of SEZ unit at MIHAN SEZ and they were issued LoA on 8.06.2012 for Software development & consulting services at Plot No. IR, Dahegoan, Survey No. 27 (Part), MIHAN SEZ, Nagpur
The unit could not commence operation with the initial validity of LoA, the unit submitted application for extension of validity period on 31.05.2013. Accordingly, one year extension upto 07.06.2014 was granted to the unit in terms of Rule 19(4) of SEZ Rules, 2006. The unit thereafter did not submit application for extension of validity of LoA. The validity of LOA has been expired on 07.06.2014. Lease M/s. Click2Cloud Technology Services India Pvt. Ltd. has entered into Agreement to dated 30.06.2013 with MADC for setting up SEZ unit for providing IT/ITES services.

M/s. Click2Cloud Technology Services India Pvt. Ltd. approached the MADC (Developer) of the MIHAN SEZ for change of allotted plot i.e. plot No. IR, Sector 18, in the processing area. The developer vide letter dated 10.12.2019 accepted the request and allotted the plot no. SA admeasuring 6714 sq. mtrs., sector 18.
M/s. Click2Cloud Technology Services India Pvt. Ltd. approached the MADC (Developer) of the MIHAN SEZ for changing their status from SEZ unit to SEZ — codeveloper for the said project and the developer has given their consent to set up the said project as SEZ co-developer instead of SEZ unit, vide letter dated 06.07.2020. getting Now, M/s. Click2Cloud Technology Services India Pvt. Ltd. has made application for approval as SEZ co-developer to the BoA for providing infrastructure facility such as constructed warm shell with plug and play facilities, internet facilities & Wi-Fi, common server rooms, common meeting & conference rooms, common cafeteria, common garden, power back up facilities.
Co-developer agreement dated 10.02.2021 entered into with the developer has been provided. The proposed amount of investment by the co-developer in the SEZ is Rs. 33.42

An Undertaking dated 10.03.2020 has also been provided by M/s. Click2Cloud Technology Services India Pvt. Ltd. undertaking that they have not procured anything under the said LoA and neither they have claimed any duty benefit nor claimed any Exemptions. They also declare that they have already applied for the cancellation of the Lease Deed to MADC for the said Plot No. 1R in Sector 1B, Mihan SEZ, Khapri, Nagpur.
Recommendation by DC, MIHAN SEZ:
The proposal of M/s. Click2Cloud Technology Services India Pvt. Ltd. as codeveloper for creation of Infrastructure facilities for Electronic Hardware & Software including Information Technology Enabled Services (IT & ITES) industries viz. constructed warm shell with plug & Play facilities, internet facilities & WiFi, Common Server Rooms, Common Meeting & Conference Rooms, Common cafeteria, common garden power back facilities etc. is submitted before the BoA for consideration.

M/s Squarespace SEZ was issued formal approval on 21.10.2020 for co-developer Status to develop, upgrade, operate and maintain an area admeasuring 24,306 sq. ft. in 11" Floor in Tower-B of M/s Phoenix Tech Zone Pvt. Ltd. SEZ for IT/ITES at Sy. No.115/35 at Nanakramguda Village, Serilingampally Mandal, Telangana on a continuous stretch of land admeasuring 2.02 hectares.
BoA in its meeting held on 27.11.2020 accorded approval for increase in space from 24,306 sq. ft. in 11" Floor, Tower-B to 92,375 sq. ft. in 14" and 15" Floors, Tower B in accordance with the amended co-developer agreement dated 06.11.2020 entered with the developer.

Ltd. was granted LOA on 11.08.2017 for warehousing (excluding liquor under Chapter heading 2203, 2204, 2205, 2206, 2207 & 2208, precious/semi-precious metals under Chapter 71 and articles of precious/semi-precious metals under other ITC (HS) Headings) against free foreign exchange. The unit commenced its production w.e.f. 10.01.2018 and the LoA of the unit is valid upto 09.01.2023. setting As informed by DC, NSEZ the proposal of M/s Onnsynex Ventures Pvt. Ltd. for held up a unit in NSEZ was initially rejected by the Approval Committee in its meeting its on 03.05.2017. The unit then filed an appeal before the Board of Approval. The BoA in meeting held on 03.07.2017 after hearing the appellant allowed the appeal excluding warehousing of liquor and precious/semi-precious metals. Now, the unit has submitted their request for inclusion of liquors and precious/semiprecious metals in their LoA. The proposal of the unit for inclusion of additional authorized Operations in LoA and monitoring of performance was considered by the Approval Committee in its meeting held on 04.02.2021 wherein the representatives of the unit informed that they have found interest of their clients for warehousing of liquor and precious/semiprecious metals. These clients want to import foreign liquors in bulk and then from their warehousing unit they will fulfill the FSSAI norms, respective State requirements of affixing bar codes/labels etc. and thereafter these foreign liquors will be removed to Custom bonded area/duty free shops.
That similarly they have found interest of some international traders of bullion who
want to setup a base in India for stocking their product (Bullion) and do Quality and purity check before further supplies/exhibiting to their international and Indian buyers as per prescribed import/export policy, this shall also offer them better control over their product and comfort for both buyers and suppliers. They are currently losing such business opportunities and subsequent forex to other countries, since they have not been accorded with the permission to warehouse "liquor" and "precious/semi precious metals".

The Approval Committee observed that the Board of Approval had not accorded permission for warehousing of liquor and precious/semi-precious metals while allowing the appeal of the unit. The Approval Committee was of the view that while precious/semiprecious metals may be sensitive, liquor could be considered provided it was for exports or sales to duty free shops.
The Approval Committee, after deliberations, unanimously decided to forward the request of the unit for consideration of inclusion of liquor in its LoA to BoA. Meanwhile, the unit requested to add supply of liquor to the bonded warehouse as well while forwarding the proposal to BoA for consideration.

DC, NSEZ has recommended the proposal of the unit for inclusion of "warehousing of liquor" only for exports or sales to duty free shops and supply of liquor to bonded warehouse as per decision of Approval Committee in its meeting dated 25.02.2021.
