Sub:- Compliance of provisions of the E-waste Management Rules, 2016 issued by the Ministry of Environment, Forest and Climate Change-reg.
Attention of all the Importers, Custom Brokers, Shipping Lines/Agents, Logistics Service
Providers, CFS Custodians/Terminal Operators and all other Stakeholders is invited to the
provisions of the notification dated 23.03.2016 issued by the Ministry of Environment, Forest
and Climate Change vide which E-waste Management Rules, 2016 has been implemented.

As per section 3 (1) (CC) of the E-waste Management Rules, 2016, ‘Producers’ has
been defined as - “any person who offers to sell imported electrical and electronic equipment
and their components or consumables or parts or spares”.

Further, Section 5 of Chapter II of the above mentioned Rules casts certain
responsibilities on the producers and mandates certain procedure to be followed including
some requirement of authorization termed as “Extended Producer Responsibility
Authorization” from Central Pollution Control Board (CPCB) when importing the electrical and
electronic equipment including their components, consumables, parts and spares categorized
under schedule I of said rules.

Schedule I of the rules provides categories of electrical and electronic equipment
including their components, consumables, parts and spares covered under the rules. The same
is produced as under-

Television sets (including sets based on (Liquid Crystal Display and Light Emitting Diode technology)
Refrigerator
Washing Machine
Air-conditioners excluding centralized air conditioning plants
Fluorescent and other Mercury containing lamps
In order to comply with the conditions/responsibilities provided under the said rules, Importers have to produce an “Extended Producer Responsibility (EPR) Authorization” from Central Pollution Control Board (CPCB), whenever importing the electrical and electronic equipment including their components, consumables, parts and spares categorized under schedule I above, from the date of issuance of this notice. 6. Difficulties, if any, in implementation of the prescribed procedure may be brought to the notice of the undersigned. 7. Action to be taken in terms of decision taken in this Public Notice should be considered as Standing Order for the purpose of Officers.
