Subject:         Applicability of Public Notice No. 36 in respect of pending

claims for TED refunds as per amended Para 8.3.1(iii) of HBP Volume 1.   References have been received from various Regional Authorities regarding the applicability of Public Notice No. 36 dated 23.8.2007 in respect of pending claims for Deemed Export Drawback/TED refunds.   2.         The matter has been examined and it is clarified that:   (i)                All time barred, pending or rejected applications which were filed after six months from end of the option period as exercised by the applicant, but are now within a period of 12 months from end of the originally exercised option period, should be processed as per amended para 8.3.1(ii) of HBP,   (ii)                        Those cases where benefit has already been granted with applicable late cut etc. on or before 23.8.2007, shall not be reopened and no request for enhancement etc. will be entertained.   This issues with the approval of Director General of Foreign Trade                                                        Sd/- (SANJAY RASTOGI) Export Commissioner   (Issued from file No. 01/92/180/00004/AM08/PC.II)
