Subject:         Import of Air-conditioners covered under EXIM Code 8415.

                        A number of representations have been received from various quarters seeking clarification regarding importability of Air Conditioners filled with HCFC 22 (R-22) Gas.   2.         Attention is invited to EXIM Code 8415 indicated in Schedule-I (Imports) of ITC (HS) Classifications of Export & Import Items, 2004-2009 vide which the item “Air Conditioner” is freely importable.  However, in case of import of Air Conditioners filled with HCFC 22 (R-22) Gas, Customs have been raising objections and asking the exporters to produce import license.   3.         The matter has been examined and it is clarified that import of Air Conditioners is free in terms of ITC (HS) Classification of Export and Import.  The DGFT is in consultation with the Ministry of Environment and Forest in order to evolve a GATT compatible regulation for import of Air Conditioner.  Until such time, the importability of Air Conditioners which have already landed and arrived but not cleared for home consumption. will be treated as free and clearances will accordingly be allowed by Customs.   4.         This issues with the approval of DGFT.   (PRATIMA DIKSHIT) JOINT DIRECTOR GENERAL OF FOREIGN TRADE   (Issued from File No. 01/93/180/1036/AM-99/PCIA).
