The Developer i.e. Department of Information Technology, Government of Sikkim vide letter dated 16.07.2020 has directly requested MHA for providing National Security Clearance. Further, the mutation documents of land and irrevocable rights certificate of the developer are yet to submitted.

Recommendations of DC:

DC, Falta SEZ has recommended the proposal for consideration of the Board of Approval.

In view of the facts and position, the proposal is submitted for consideration of the Board of Approval for “in-principle” approval in terms of Rule 6(1) (b) of the SEZ Rules, 2006.

99.9 Change of name/shareholding pattern of the co-developer (Two proposals)

99.9(i) Proposal for change of name of the co-developer of APSEZ , Mundra from M/s MPSEZ Utilities Pvt. Ltd. to MPEZ Utilities Ltd.

        MPSEZ Utilities Private Limited, a co-developer of APSEZ, Mundra has informed

that the name of the company has been changed to “MPSEZ Utilites Ltd.” from “MPSEZ Utilities Pvt. Ltd.” as per the fresh certificate of incorporation issued by the Registrar of Companies, Ahmedabad on 16.06.2020.

99.10 Request of co-developer for additional area (Three cases)

99.10 (i) Application of Co-Developer, M/s. ATS Savvy Developers LLP in GIFT Multi Services SEZ for approval of Authorized Operations. M/s. ATS Savvy Developers LLP, co-developer in GIFT-Multi-services-SEZ, Gandhinagar has sought approval for Authorized Operations i.e. ‘Multi-level car parking’ to be undertaken in the Processing Area in the SEZ. The said Co-Developer M/s. ATS Savvy Developers LLP has already been issued following two Approvals by the Department of Commerce for authorized operation viz. construction, development, maintenance and operation of SEZ building for units to undertake export of services in the processing area of SEZ, over an area of 4,16,370 sq. ft. ATS Savvy Developers LLP of Ahmedabad (Co-Developer) has sought approval of additional built up area admeasuring 1671 sq. ft.. This request for approval of additional built-up area is due to increase in final built-up area based on approved drawings/plans by the Developer – M/s. GIFT SEZ Limited and it agencies. The details of the approved and additional Built up Area are as under:  Approved built up area - 4,00,000 sq. ft. by BoA  Approved additional Built up area admeasuring 16,370 sq. ft.  Current increase/revision of built-up area sought for 1671 sq. ft.  Total Built up area will be admeasuring 4,18,041sq. ft. The co-developer has furnished the Provisional Letter of Allotment issued by GIFT to the co-developer and undertakes to submit the executed copy of agreement for additional area post BoA approval.

The request is placed before BoA for its consideration, subject to execution of agreement for additional area. 99.10(iii) Request of Nxtra Data Limited (Co-developer) in MIDC IT/ITES-SEZ located at Rajiv Gandhi Infotech Park, MIDC, Hinjewadi, Phase-III, Pune for increase in area from approved 1.90 Ha to 2.40 Ha i.e. increase by 0.50 Ha.

M/s. Nxtra Data Ltd. has been granted the co-developer status in MIDC-Pune IT/ITES SEZ vide LoA dated 14.12.2017 for construction of buildings and related infrastructure of IT/ITES units, development of space for IT/ITES units and all default authorized operations over an area of 1.90 Ha. in Plot No. 28 and Plot No. 13/10/A, Hinjewadi, Phase-III, Pune.

The co-developer has applied for an addition of area admeasuring 5000 sq.mtrs. located at Plot No. 13/10/B to the existing area. M/s. Nxtra Data Ltd. is a 100% subsidiary of Bharti Airtel Limited, which is a leading global telecommunications company with operations in 16 countries across Asia and Africa. The company is amongst the top 3 mobile services providers globally in terms of subscribers.

As informed by DC, the co-developer intends to expand their existing area for housing substation and office along with space for supporting MEP services, Reception, loading / unloading area, dry type transformers, HT Switchgear panels, Control Room etc. over the adjacent plot admeasuring 5000 sq.mtrs. at Plot No. 13/10B. the said premises will support and power 1800 Racks Data Centre for in house application support, DR facility and third party hosting of servers and Network Operations Centre. The co-developer has submitted the offer letter dated 10.06.2020 issued to them by MIDC for Plot no. 13/10B admeasuring 5000 sq. meters. Further, it has also been informed that MIDC has requested them to get the LoA amended inorder to further process the agreement.

As per the Inspection Report furnished by JDC, the inspection was carried out on 13.07.2020 and the area of 0.50 Ha located at Plot no. 13/10/B, Rajiv Gandhi Infotech Park, Hinjewadi, Phase-III, Pune is adjacent to the existing Plot no. 13/10/A where the co- developer-SEZ is located and upon addition of the additional area of 5000 sq. mtr. to the existing area of 19000 sq. mtr., it is verified that the SEZ will remain contiguous and that the said land parcel is vacant.

The Co-Developer intends to invest an amount of Rs.150 crores in the project which will be financed by way of loan from Bank. The Co-developer has projected that upon development and full occupation of SEZ activities, they estimate export turnover of Rs. 10 to 15 Crores over a period of 5 years. Further, they have projected employment generation of approx. 50 Direct and 200 indirect personnel over a period of 5 years.

99.11(i) Request for extension of LoA of used and worn clothing units and plastic recycling units located at Kandla, Falta and Noida SEZ in terms of Rule 18(4) of the SEZ Rules, 2006.

As per Rule 18(4) (a) and (c) of the SEZ Rules, 2006, the extension of LoA of the existing units involved in plastic scrap and waste recycling and reprocessing of garments or used clothing etc. shall be decided by the BoA.

The Apex Court in its order dated 09.08.2019 has directed that “Status quo, as on date, qua the petitioners shall be maintained by the parties”. DC has recommended that- i.
