Item No 97.5 Requests for extension of LoP beyond 3rd year onwards

|

  • e As per Rule 18(1) of the SEZ Rules, the Approval Committee may approve or reject a proposal for setting up of Unit in a Special Economic Zone.

  • e Cases for consideration of extension of Letter of Permission (LoP)s i.r.o units in SEZs are governed by Rule 19(4) of SEZ Rules.

  • e Rule 19(4) states that an LoP shall be valid for one year. First Proviso grants power to DCs for extending the LoP not exceeding 2 years. Second Proviso grants further power to DCs for extending the LoP for one more year but subject to the condition that two-thirds of activities including construction, relating to the setting up of the Unit is complete and a Chartered Engineer’s certificate to this effect is submitted by the entrepreneur.

  • e Extensions beyond 3™ year (in cases where two-third activities are not complete) and 4" year are granted by BoA.

  • e BoAcan extend the validity for a period of one year at a time. e There is no time limit up to which the Board can extend the validity.

Detailed reasons for delay:-

As part of consolidation of Defense products manufacturing entities across Tata group, Tata Power Company Limited has decided to transfer its Strategic Engineering Division (SED), as a going concern, by way of slump sale under a scheme of arrangement under Sections 230 to 232 of the Companies Act, 2013, to Tata Advanced Systems Ltd. (TASL), a wholly-owned subsidiary of Tata Sons Ltd. They got NCLT approval in this regard on 12.12.2019, and the next step for the merger is to novate all the contracts from SED to TASL, which is pending at the Ministry of Defense. Commencement of operations of the SEZ unit also got delayed due to these reasons. However, unit intends to start the operations by 25th March, 2020, and has applied for extension of LoA for a further period of two months i.e. till 30.04.2020.

- The unit vide their letter dated 04-03-2020 have stated that taking into consideration Sun Set clause, they were more focussed on completion of construction building to obtain occupancy certificate and that they have constructed the building without taking any duty benefit on the materials for authorised operations. 

As informed by DC, the jurisdictional Specified Officer vide his report dated 09.03.2020 has submitted the following:

## Recommendation by DC, SEEPZ SEZ: 

The request of M/s. Steam Equipments Pvt. Ltd. for extension of LOA for a further period from 15.05.2019 to 14.05.2020 is recommended in terms of Rule No.19(4) of SEZ Rules, 2006. 

The request is placed before BOA for its consideration.
